LANDLORD COVENANTS AND AGREES AS FOLLOWS:

1. To have the Premises and contents clean and in order for occupancy at the beginning of the term herein stated. And to allow said Tenant, upon paying the rent and performing the covenants and agreements contained herein, to quietly enjoy the demised Premises, furnishings, etc., for the term hereby granted.

2. To pay all charges of electricity, fuel, basic telephone and general operating expenses. General operating expenses shall include but shall be limited to appliance repairs, basic home supplies, water usage, pest control, snow removal, plumbing and electrical service calls.

3. To see the Premises, (including the plumbing, heating, lighting, electrical and roof) are in working condition. To bear the responsibility of maintaining all appliances and providing basic telephone and cable television service where applicable as well as an operating telephone and television on the Premises.

4. To provide clear access to the Premises, including driveway and pathway snow removal.

5. To ensure the Property is fully and properly insured under the NY State and Essex County regulations for Short Term Vacation Rental Properties.

6. To remit all bed/occupancy taxes on behalf of the Tenant.

7. To be available and reachable throughout Tenant’s stay to address any questions or concerns.

TENANT COVENANTS AND AGREES AS FOLLOWS:

1. Not to assign this agreement or sublet the demised Premises and contents, without written consent of the Landlord.

2. To pay all charges of telephone that shall accrue or be charged upon or against the demised Premises during said term.

3. To permit the Landlord or his agents to enter the Premises at reasonable hours in the daytime to examine or show or to make reasonable repairs therein.

4. To make no alterations in or on without written consent of the landlord and to bear the responsibility and expense of all damages or repairs resulting from the neglect or carelessness of the Tenant, his family or guests during said term of occupancy and to quit and surrender the Premises and furniture, etc., in as good a state and condition as they were at the time of taking occupancy.

5. That the maximum occupancy is limited to the number of persons listed on the VRBO/AirBNB reservation page. Any visits by non-residing day time and overnight guests must be pre-approved by the Landlord in advance. Any violation of this agreement without consent will result in additional per-guest fees, as per VRBO/AirBNB pricing structure, and/or loss of security deposit and/or eviction.

ADDITIONAL COVENANTS:

1. If the Tenant has not yet made prior personal inspection of the leased Premises, Tenant acknowledges and agrees to lease the Premises "as is" subject to any state of facts that a personal inspection would have disclosed. Neither Landlord nor Leasing Agent (optional) shall be responsible for providing any item or service which is not present and would have been disclosed by a personal inspection.

2. Tenant agrees to provide the Landlord a $500 refundable security deposit, or as agreed to in writing otherwise. Landlord agreed to refund the security deposit in full within 7 days of departure, if there are no charges against the Tenant. In addition, Landlord may require the Tenant to purchase a one-time Property Damage Protection (PDP) Policy which will protect the Premises against accidental damages during the Tenant’s stay. If the home was booked through VRBO/HomeAway, such policy is already included. For all other bookings, it can be purchased at http://vacationprotection.com/

3. The Tenant must immediately notify the Landlord of any damage after the incident and take detailed pictures of the damage and submit those to the Landlord. The Tenant agrees to reimburse the Landlord for any damages exceeding or not covered by the PDP and/or the refundable security deposit.

4. Landlord agrees to notify the Tenant of all damages or charges against Tenant within 7 days of said vacancy. Exceptions are telephone and “pay-per-view” TV charges, as per billing statement availability.

5. It is further agreed and understood that pets are not allowed in or on the leased Premises unless agreed to and pet fee has been paid in full prior to the stay. Any violation of the covenant will be considered a breach of this agreement and will result in loss of security deposit.

6. Tenant agrees not to smoke or vape inside the Premises. Any violation of the covenant will be considered a breach of this agreement and will result in loss of security deposit and/or immediate eviction. Additionally, Tenant agrees to properly dispose of any cigarette remains and not litter the Property. Failure to do so will result in $200 fee deducted from the security deposit.

7. Tenant is responsible for all digital content downloaded/uploaded by all guests during the stay at the Property. Any fees or fines associated with illegally downloaded or streamed content (i.e. “pirating” movies) will be assessed to the Tenant.

8. Tenant agrees to adhere to Essex County, Town of Jay, and Adirondack State Park rules, regulations and ordinances, such as noise, fire, etc.

a. Quiet hours are 10pm – 7am. Initial complaint (neighbors, authorities, etc.) will result in a warning. Repeat complaint(s) will result in immediate eviction.

b. Fireworks discharge (except sparkles) is illegal and can lead to significant fines and possible imprisonment. Fireworks are not allowed on the Property. Violation will result in immediate eviction and loss of security deposit to cover any fines imposed on the Property.

c. Trespassing onto or through any adjoining properties, vacated or not, is illegal. Initial complaint (neighbors, authorities, etc.) will result in a warning. Repeat complaint(s) will result in immediate eviction.

9. No motorized vehicles (ATV's, Snowmobiles etc.) shall be used on the Property w/o Landlord’s explicit permission. Breach of this covenant will result in loss of security deposit and/or immediate eviction.

10. Tenant understands that the use of Hot Tub and Sauna is solely at individual own risk and therefore releases Landlord from any liability associated with potential sickness or injury.

11. Tenant agrees to review and follow the home information document attached at the end of this contract. The Tenant also agrees to distribute a copy of this document to all guests in their party.

12. Tenant understands that they are responsible and will be held accountable for all guests, and their actions, residing and/or visiting the Property during Tenant’s stay.

13. Other Provisions:

A. Please be aware that the home has 2 non-intrusive/passive NEST wireless security cameras, as required by our insurance carrier. One is located on the porch pointing at the entryway/driveway and the other one inside locked utility room to monitor the appliances. As per NEST privacy policy, all cameras will display a faint green indicator light to ensure everyone is aware of their presence. The outside camera is not actively monitored and is only activated in emergency scenarios such as smoke/CO alarm, unauthorized home entry, etc.
