Minimum Age Restriction: You must be 25 years of age to rent this rental property. You herby confirm that you are at least 25 years of age. You acknowledge that failure of this confirmation to be true constitutes a material breach of this agreement.

Cancellation Policy: Rental payments are refundable for cancellation requests received 61 or more days before the first night of your reservation. No full, or partial refund will be granted for no-shows or if you cancel within 60 days of of the first night of your reservation, arrive after the first night of your reservation, or depart early. No refunds or compensation will be given if the property is unavailable for any reason outside reasonable, including but not limited to adverse weather conditions, natural disasters, epidemics, or other Acts of God, mechanical failures, or utility outages. You are encouraged to obtain appropriate travel insurance. In addition, for any unforeseen circumstance Merrill L. Thomas Real Estate reserves the right to, among other actions, relocate guests to another similar property, cancel the stay, or issue a credit for a future stay. In the event the reservation is moved, changed, or a future stay credit is given and deemed acceptable to the guest, the reservation will not be eligible for cancellation or refund. If you do not book direct and use a third party instead, please review their policies in advance of booking.

Check-In/Check-Out:
Tenant agrees that the check-in time is no earlier than 4:00 p.m. and the check-out time is no later than 10:00 a.m. (unless prior arrangements have been made and confirmed by Owner or Agent in writing). Agent will use every reasonable effort to have the premises ready for your occupancy at check-in time, but Agent cannot guarantee the exact time of occupancy. Early check-in times are allowed only when the property is cleaned and ready for occupancy. If you desire an early check-in there is an additional fee of $95.00. No keys will be distributed to Tenants in advance and only at the appropriate check-in time. All requests for a late check-out must be approved at least 24 hours in advance of the scheduled departure and may be subject to a late check-out fee of $95.00. All keys must be returned to the rental Agent's office upon departure.

The maximum daily use or nightly occupancy is pursuant to the subject’s short term rental permit and limited to the number specified on this unit. No parties or gatherings shall be permitted on premises, over the number of allowable guests, without prior consent.

Good Neighbor Policy: Our community enforces a good neighbor policy. You are required to treat the Property with the same care you would use with your own residence, and in any case with no less than reasonable care, and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you are required to close and lock doors and windows when you are not present at the Property and upon check-out. You also acknowledge that you are required to comply with all check-out procedures and other rules and requirements of the Property, as presented to you in writing in the Property Description or otherwise. You and your Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, homeowner associations, and the community and obey designated parking. Noise audible outside the Property (including music or loud conversation) is prohibited between 9 p.m. and 7 a.m.

No smoking is permitted at the property (including on porches, decks, or outdoor areas of the premises). No marijuana, medicinal or otherwise may be consumed on the premises.

Animals: . Unless otherwise agreed to in writing, no animals shall be permitted at the Premises. Any
violation of this provision will be considered a material breach of contract, and Tenant’s occupancy will be immediately terminated and the security deposit forfeited.
If you are reservation a dog friendly property, you must disclose the dog's age, breed, and weight. A pet fee will be added to your reservation.

Events and Activities: Events, parties, and commercial photography or filming at the Property is prohibited without prior written permission (if approved, additional fees and conditions may apply). Events include without limitation, weddings, meetings, concerts or ceremonial get togethers. No tents, canopies, or other temporary structures may be erected on the Property.

Hot Tubs if applicable to your property: Hot tubs can be particularly finicky and pose certain health issues. Tenants agree to use at their own risk. Agent cannot guarantee the cleanliness or maintenance of hot tubs after Tenants’ use.

Fireplace if applicable to your property: The house may contain a wood-burning fireplace. If you have any questions about the proper use of such, please call Merrill L. Thomas prior to attempting use. Large
roaring fires are not permitted and will cause damage to the flue and possibly the building. All fires must be small in nature and the fireplace must be operated responsibly with a screen in place at all times. The availability of firewood cannot be guaranteed. If none is available at the residence it can usually be obtained from local markets or convenience stores.

In the property there may be locked closets which are owner’s closets and may hold cleaning/household supplies or owner’s personal property. Tenant will not attempt to open locked closets. No items should be removed from locked closets. If an owner’s closet or
any closet locked prior to the rental is found open or the lock damaged or tampered with, it will be considered a breach of this Agreement.

The Property is provided AS-IS, and we are not responsible nor you will be provided with any discount for the inoperability of any amenities (including, without limitation, any phone or internet service, air conditioning, TVs, DVDs, cable, and Equipment). You agree to contact us as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous or unsafe condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. We will take reasonable and appropriate steps to remedy any reported urgent, hazardous or unsafe problem as soon as practicable. We may enter the Property to remedy any problem you report or of which we become aware, or otherwise to protect the Property or any persons. We will seek to limit our access to reasonable times and upon reasonable notice, but we reserve the right to inspect, maintain, or repair the Property, and to address any situation that we reasonably deem an urgent situation or emergency that threatens persons or property, at any time and without notice if we determine such access to be appropriate. We provide an initial supply of tissue, toilet paper, paper towels, laundry detergent, dish detergent, clean bed linens, and towels. We do not replenish products during your stay.

You will be required to pay a cleaning fee associated with the cost of cleaning the Property on your departure. The cleaning fee varies depending on your property size and past history. You will be required to return furniture to its original location, load and run the dishwasher, strip used bedding and towels, and remove all food brought to the Property as well as place trash in receptacles. Failure to comply may result in added cleaning fees.

Assignment: Tenant shall not sub-let or assign his or her rights under this Agreement without written consent of Owner or Merrill L. Thomas, Inc. (Agent).

Boating if applicable to your property . In the event that boats (motorized or non-motorized) are used on or from the property, tenant agrees to hold Landlord harmless from any liability associated with such usage.

Security and Damage: After Check-out the Property will be inspected for damage, missing items, or abnormally dirty appearance and guests will be notified of the determination within 14 days of vacancy should there be an issue. In the event of damages to the Property the guest authorizes us to charge them on their file credit card to repair or replace items. In the event of a dispute the security deposit will continue to be held until the guests and the owner settle the disagreement.

The Tenant shall Hold Harmless and Indemnify Landlord and Merrill L. Thomas, Inc. for any personal injuries incurred by the Tenant, the family of the Tenant, guests of the Tenant and/or other parties on or about the premises unless such personal injuries are caused by gross negligence, misrepresentation, or fraud by the Owner or Merrill L. Thomas, Inc.
