HOUSE REGULATIONS
All homes and condos are privately owned and equipped for turnkey vacations. Bed linens are provided as well as bath linens. Kitchens are equipped with general appliances such as coffeemakers, toasters, and kitchen merchandise such as dishes, silverware, glassware, pots, and pans. A start up kit is placed in the units providing you with enough materials to get you through a few nights stay. This includes toilet paper, paper towels, liquid hand soap, laundry soap, dishwasher and dish soap, a few white kitchen size trash bags.
Your unit will not have a landline telephone service. Please make your own necessary arrangements prior to your arrival.
Maintenance problems in the home or condo will be handled in a timely and professional manner. The rental rate will not be adjusted due to any malfunction of equipment, which includes, but is not limited to TV’s, VCR’s, DVD’s, air conditioning units, hot water heaters, stoves, refrigerators, door locks, etc. Our promise to you is that we will work diligently to resolve it.
MAXIMUM OCCUPANCY:
Each property has a specific maximum occupancy. Take note of the maximum number of guests allowed in the homes and condos before making your reservation. Under no circumstances may more than the number of persons detailed on the guest registration form occupy the property except by the prior written agreement of Realty by Dale Thomas. We reserve the right to refuse admittance to the property if this condition is not observed and treat the failure to meet this condition as a cancellation by the Renter and charge the associated cancellation charges outlined in the Cancellation and Refunds Policies section.
GATHERINGS:
Our properties are located in residential areas and are rented for personal vacation uses only. Parties and other large gatherings are not allowed. Prior arrangements for weddings, family reunions, etc. may be made with the permission of the owner of the property. Those that break this rule risk forfeiture of their security deposit, rental fees, and eviction. There is also a local noise ordinance that needs to be complied with from 10pm to 7am.
NO SMOKING:
All homes and condos are NON-SMOKING! No exceptions or automatic forfeiture of your Security Deposit.
Pet Policy: NO PETS
Some of our properties are pet friendly. If the home is pet friendly there is a size and weight category for different properties and communities. This size and weight are listed in the overview/amenities.
. ONLY PET(S) SPECIFICALLY ON THIS AGREEMENT ARE ALLOWED AND SUCH PET MUST BE PRE-APPROVED PRIOR TO BRINGING PET ON THE PREMISES.
. Pet(s) must be kept on a leash at all times while it is outside of the premises. PETS ARE NOT ALLOWED TO RUN LOOSE AT ANY TIME. Tenant(s) agree to fully indemnify the Landlord, owner or agent for any damages arising out of injury to another person or to another pet by the pet(s). Pet(s) must not be tied or kept outside the door, in the hallways or on the balcony or lanais, if applicable.
. Tenant(s) may be assigned a designated area to walk pets and Tenant(s) must walk pets in that area only. Tenant(s) are responsible for immediately cleaning up after the pet(s) and must do so.
. Tenant(s) will be responsible for FULL replacement and/or repair cost of carpet, walls, blinds, flooring, or any other items damaged in any way by pet(s). Tenant(s) also will be responsible for the full cost of any exterminating that may be required because of pet(s).
PROPERTIES WITH WATERFRONT
Tenant acknowledges and agrees that owner and agent shall be in no way liable for damage or injury to persons or property as a result of the use of docks, natural seawalls, concrete seawalls, and boat lifts (if owner allows usage). Boats must be within the designated footage and weight for the dock area and boatlift capacity. Tenant agrees that no one else may use the waterfront amenities and it shall not be sublet or rented by the tenant. Tenant agrees to notify owner or agent in writing of any hazardous conditions that may develop along the dock, lift or seawall if applicable. Tenant agrees that the Landlord or its agent may withdraw any consent to use the dock at any time if previously given. Tenant agrees that the owner shall not be required to maintain any of the waterfront amenities if present including but not limited to any dock, lift and/or seawall if present. Tenant agrees to remove any boat or watercraft if requested by the owner or agent at any time. Tenants may not make any modifications, alterations, or additions to the waterfront amenities. Any use of the waterfront is at Tenant's own risk and Tenant agrees to indemnify the owner and/or agent for any injuries or damages suffered to Tenant's guests arising out of the use of the waterfront amenities. Tenant agrees to be liable for any damages caused to the waterfront amenities due to Tenant's use.

POOL REGULATIONS
This Swimming Pool is attached to and becomes a part of the Rental and Lease Agreement on the property referenced above.
The subject property has a (swimming pool) located thereon. The tenant(s) will use the swimming pool at the tenant's own risk. The landlord will not be held responsible for the injuries sustained by the tenant and/or the tenant's occupants or guests when using the swimming pool, and the tenant will indemnify the landlord for any actions resulting from injuries to tenant and/or tenant's occupants or guests.
The tenant is responsible for keeping the swimming pool clean of debris including pool toys.
The tenant is responsible for keeping the doors locked and the swimming pool secured at all times. With stipulation that pool service will need to gain entry to do the weekly service on pool.
The tenant understands and agrees to allow the landlord access at regular times to maintain the pool equipment. The tenant agrees to refrain from attempting to make any repairs or adjustments to the pool equipment or to any electrical wiring for the pool equipment.
The tenant must immediately notify the landlord of any repair that the swimming pool may require. The tenant is responsible for the full cost that may be due for repair and /or replacement of the swimming pool/hot tub that is required as a result of negligence by the tenant or the tenant's occupants or guests. The tenant must operate the swimming pool/hot tub in accordance with the manufacturer's instructions and in a safe, responsible manner.
Diving in the pool is prohibited.
No pets of any kind are permitted in the swimming pool at any time.
Children under 14 must be accompanied by an adult in the pool.
Persons under the influence of alcohol or narcotics are not permitted in the pool.
Persons with colds, nasal or eye discharges, skin eruptions, open wounds, open sores, or bandages not allowed in the pool.
Showers must be taken prior to entering the pool.
No shampoos or soaps in pools.
Glass objects or containers, sports or electronic equipment, roller blades, bicycles, skateboards, skate shoes etc., not allowed in the pool or pool area.
Smoking and /or use of tobacco products is prohibited.
Eating and drinking in designated areas only.
For the safety of residents, no running on pool deck, no climbing or jumping from structures.
Horseplay on the pool deck or in the pool area is prohibited.
The tenant understands that the swimming pool and /or hot tub is strictly an amenity and that the use of this amenity is not guaranteed under the terms of the lease. Any interruption or non-availability of the use of the
the swimming pool will not violate any terms of the lease.
If the tenant violates any part of this Addendum, the tenant will then be in default of the lease. In the event of a default, the landlord may initiate legal proceedings in accordance with local and state regulations to evict or have the tenant removed from the leased premises, as well as seek judgement against the tenant for any monies owed to the landlord as a result of the tenant's default.
Renters should not, and are not permitted to, altar or adjust the pool equipment settings. If you feel there is an issue with the pool, please contact Realty By Dale Thomas. Any damages will be charged accordingly.

HOA (HOMEOWNERS ASSOCIATION ) RULES
Section 12. PETS -ANIMALS:
Pets must be carried, leashed, or otherwise always restrained when not on a Lot or outside of a Residence. No pets shall be permitted to roam freely. Each homeowner shall immediately remove their pets’ feces from Lots and Common Areas.
Section 15. CLOTHES DRYING:
Outdoor clothes drying shall be in a sight-screened area to not be readily visible. No clothes drying shall be allowed in the front of a house or the sides of a house that face the street. This amendment is deemed a clarification of the existing restriction and is retroactive to the original date of recording the amendment to the Deed Restrictions.
Section 18. BOATS:
No boat is permitted to be placed or stored in Rotonda West unless the same is fully enclosed in a garage, placed on the bank of the waterways.
2.(b) All boats or other watercraft using the waterways shall observe the "NO WAKE" restriction Section 21 VEHICLES & PARKING:
1.(a) vehicles are defined as, but not limited to, automobiles, pick-up trucks, vans, sport utility vehicle (SUV), trucks, tractor-trailer rigs, motor homes, trailer homes, campers, trailers, boats, motorcycles, a I terrain vehicles (AN), golf carts, recreational vehicles or other types of transportation devices that may be defined as vehicles at the sole discretion of the Association and without regard to any other definition established by any government authority or the manufacturer.
2.(b) All vehicles, other than automobiles, pick-up trucks, SUV's, vans, motorcycles, privately owned commercial vehicles less than 3/4 ton or other vehicles as may be approved from time to time at the sole discretion of the Grantor/Developer or Association must be parked in a fully enclosed garage.
1.(c) No vehicle may be parked on any lawn, road right of way, easement, or vacant lot, except:
2.(i) On a temporary basis, not to exceed 12 hours, and only for the necessary construction, repair, or maintenance of an improved or vacant lot.
3.(d) Any vehicle not required to park in a garage must park on a driveway. A driveway is defined as
concrete surface that provides continuous access to a garage except for expanded driveways as provided at this property.
4.(i) Existing single lane driveways leading to an existing one car garage in a single-family residence may be expanded with a stone, shell, or concrete driveway with the written approval of the RMC. All other driveways must be constructed of concrete.
5.(ii) At those home sites where a single car garage and a non-expanded single lane driveway co-exist, additional vehicles may only be parked in tandem, in a single lane wide strip on the front lawn immediately adjacent and parallel to the existing driveway.
(iii) At home sites with a two (2) car garage and/or two (2) car wide driveways, parking off the driveway is prohibited.
- (iv) Un-licensed and inoperable vehicles must be stored in a garage.
2.(v) Any Vehicle repair and maintenance exceeding 3 hours in length must take place in a garage. 3. (iv) No vehicle may be used as a domicile or residence even on a temporary basis.
Section 22. THREE (3) DAY VEHICLE PASS:
In order to alleviate any hardship upon any property owner, or occupant of the property, a pass may be issued by the Association allowing a vehicle to be parked in a driveway overnight for the convenience of loading or unloading a boat, motor home, camper, or camper trailer. The pass may not exceed three days. This pass must be obtained in advance before any of the above is parked or placed on the property. A pass will be issued only to the occupant living in the property. Repeated violations or abuses may result in the suspension of the right to obtain any pass for a person, address, or vehicle. No more than two passes in a thirty-day period will be issued.
Section 31. DEED RESTRICTION ENFORCEMENT:
All owners shall be responsible for any and all violations of these Restrictions by their tenants, guests and by guests of the tenants. Failure of a Member, or a member's guest, or a tenant's guest to comply with any Covenants and/or Deed Restrictions shall be grounds for immediate action. Such action will include without limitation an action to recover sums due for fines, damages, injunctive relief, or any combination thereof and for recovery of reasonable attorney's fees, including lien filing and other appellate fees and costs as provided by Florida Statute 720.305
