We know you want to get on to the fun part of planning your vacation, but first please preview the details of our rental contract below. After your booking has been confirmed through Airbnb, you must sign a custom e-agreement, provide ID and a credit card for a security deposit within 48 hours from the booking.

As the Primary Guest and contact for this booking, you must check-in to the property and you are responsible for all other individuals, occupants and invitees at the property during the reservation period. It is your responsibility to ensure each Guest is familiar with the terms and conditions of this agreement. Payment or occupancy demonstrates acceptance of the terms and conditions of this agreement.

MAXIMUM OCCUPANCY/REGISTERED GUESTS - The maximum number of occupants is 10 people including all infants and children.

AIRBNB PAYMENT DETAILS - An initial deposit or full rental payment is required at time of booking. Payment will be processed through Airbnb and will appear as Airbnb on your credit card statement. We do not offer price adjustments or provide lower rate guarantees once a booking has been confirmed. We require reservations to be booked and paid by the Primary Guest who's going to stay in the home.

SECURITY DEPOSIT - A security deposit for the amount of $500 is required and will be automatically reserved for the booking 2 day(s) prior to the arrival date. Access details will be provided to the vacation property once a valid credit card has been provided to the Owner for the security deposit. The Primary Guest authorizes that the security deposit and credit card on file may be used to pay for various damages, fines or penalties resulting from violations of this rental agreement, as well as any misuse of the Property or Common Areas which includes, without limitation, damage to the vacation home, any appliances, hot tub, furnishings and personal property located on the Vacation Property, theft, lost items, unauthorized pets, smoking, noise violations resulting in a security visit, exceeding occupancy limits, early check-in or late check-out without Owner’s prior approval, extensive cleaning required following check-out, damage to Common Areas and any fines imposed due to violation of any law, ordinance, rule or regulation by the Guest(s). The Guest(s) will be responsible for any damage or fines in excess of the security deposit and will be invoiced separately.

RENTAL FEE REDUCTIONS / REFUND POLICY - No compensation, refunds, credits or reduction of Rental Fees will be given for (i) delayed arrivals (ii) early departures for any reason (iii) reducing the number of nights reserved when less than 60 days prior to the scheduled date of arrival (iv) inclement weather, including hurricanes (v) road closures when alternate routes are available (vi) smoke from wildfires (vii) Pandemics, Natural Disasters, Acts of God or other unforeseen circumstances that are beyond the Owner’s control.

CHECK IN TIMES - Check-In is after 4 PM. Directions to the vacation home and access codes will be sent once the booking is paid in full and a valid credit card has been provided for the security deposit.

CHECK OUT TIMES - Check-Out is at 10:30 AM. The following check-out list is required upon departure from the vacation home: (i) Start one load of towels (ii) Load and start dishwasher & leave the sink empty (iii) Ensure gas to BBQ grill is set to OFF position (iv) Take all garbage to the garbage cans and take any garbage that does not fit with you (v) Close and lock all the windows, patio doors, main entrance doors & hot tub. Failure to follow the departure instructions may result in charges to the Security Deposit Credit Card. Unauthorized late check-outs will be charged $100/hour (or partial hour) past the check-out time. Additional cleaning costs will be charged at a rate of $50 per hour and garbage disposal will be charged a $100 fee.

FLEXIBLE CHECK-IN/CHECK-OUT - We try to accommodate reasonable requests for early check-in or late check-out, but we can’t confirm until 48 hours prior to your stay. We also offer flexible check-in or check-out options (subject to availability) that can be purchased 48 hours prior to check-in or check-out dates, so you can extend your stay: Flexible Check-In: Offers check-in any time after 9 AM on the day of your arrival (when available). Flexible Check-Out: Offers check-out any time before 6 PM on the day of your departure (when available). Flexible rates vary. Ask us for more details.

NO SMOKING / VAPING ALLOWED – No smoking or vaping is allowed inside the home. Smoking is permitted outside 15 feet away from the home. Please properly dispose of all cigarette butts. Evidence of smoking inside the home will result in a $500 FINE to cover additional cleaning charges to return the property to a smoke-free environment including steam cleaning of all carpeting, area rugs, bedding, linens, and other furnishings.

PET POLICY - No unauthorized pets are allowed in the home or on the premises. Evidence of a pet (of any size) on the premises will result in a $500 fine to cover additional cleaning charges to return the property to pet-free environment including steam cleaning of all carpeting, area rugs, bedding, linens, and other furnishings.

NOISE POLICY- Guest(s) need to be respectful of the surrounding property owners. We have a zero tolerance policy for noise disturbances caused by guests at any time. Quiet times are from 10:00 pm to 8:00 am. Noise levels while outside including music should be kept at reasonable levels. Any noise complaints from neighbors that involve a security visit will result in a $250 Fine. If the first warning is not adhered to there will be an immediate eviction without refund.

SECURITY CAMERAS – The home has a security system with external cameras for the security of our guests and for remote monitoring when vacant. The front door exterior entrance and the garage entrance may be monitored/recorded with cameras. Guest(s) agree to audio & video recording.Tampering with or disconnecting cameras could result in eviction from the home.

TROPICAL ENVIRONMENT - Florida is a tropical environment and it is common to see various insects and animals around and inside the property. We try to control the natural occurrence of insects by regularly spraying for insects. The most common pests that may find their way into the Rental Property include ants, small beetles, gnats, mosquitoes, geckos, grasshoppers, and even cockroaches. There are also wild animals in the area including alligators, birds of prey, and various ocean animals and creatures of all sizes. There will be no refunds or cancellations from insect or animal sightings, bites, or stings. Do not leave uncovered food out of the refrigerator as it will attract pests and do not feed the birds or animals.

HOT TUB – The Guest(s) assume full responsibility for all risks associated with using the hot tub. If the hot tub is unavailable during the stay, there is no reduction of rent or refund.

CANAL/GULF - Guests assume full responsibility for the risks associated with recreating and swimming in the local canal/Gulf. Life jackets and water toys, including kayaks, stand up paddle boards, and other flotation devices are provided by Owner. Guests assume full responsibility for the risk associated with using these toys and equipment and/or using any of their own equipment and toys, including but not limited to boats. Furthermore Guests are responsible for any damage to the property of Owner resulting from any activities of Guests.

RIGHT TO ENTER - If necessary, The Owner, Owner’s Agent or designated vendors may enter the property in order to inspect the property or make required repairs. Except in the case of an emergency, Owner or Agent will provide the Guest at least 24 hours notice before entering the Property and will only enter during reasonable hours. Regular vendors to the property including, yard and cleaning services shall be allowed to enter at scheduled times.

INTERNET SPEED– No refund will be given for Internet speed, access problems or lack of service. Please do not download unauthorized/copyrighted/pirated materials. If the internet provider/authorities notify us (The Owner) about any downloads that occurred during your stay, we may be required to submit your (The Guest) contact information to the requesting parties.

HOT TUB – Guest(s) assume full responsibility for all risks associated with using the hot tub. Children under the age of 3 must wear a swim diaper. An adult MUST supervise young children in the hot tub at all times. Use of the Hot Tub should be limited after 10:00 PM. Any noise complaints from neighbors that result in a security visit will result in a $250 fee. If the hot tub is required to be drained between guests, it is possible that the hot tub may not reach a comfortable temperature for use immediately after your arrival. DO NOT SIT, STAND ON, OR MISTREAT the hot tub cover. A $500 charge will result in any damages to the hot tub cover. The hot tub is provided as part of the rental and is considered a non-essential facility. If a breakdown should occur to the hot tub, every effort will be made to repair it for the rental period. No reduction of rent or refund will be issued for failure of non-essential facilities including the hot tub.

NO EVENTS - No parties, stags/stagettes, wedding gatherings/rehearsal dinners, commercial activities are allowed inside the home or outside on the property. Any such activities will be grounds for immediate removal from the home.

PARKING – Parking is not allowed on the street or on any landscape surface (the lawns). The Property has parking in the driveway for up to four vehicles. There may also be space for one vehicle in the garage.

NO SUBLETTING OF THE PROPERTY- Subletting is strictly prohibited.

FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or any rental money, and the group will not be permitted to check in.

FAILURE OF APPLIANCES & UTILITY SERVICES – The home is well maintained but The Owner cannot guarantee against the failure or unavailability of appliances and services. The Guest(s) must immediately report to the Owner any inoperative appliances or services. The Owner will make every reasonable effort to have repairs completed as quickly as possible but cannot guarantee repair will be completed during the Guests stay. No reduction of rent or no refund will be issued for the malfunctioning of minor appliances, failure of non-essential appliances or equipment, or temporary utility outages or services including but not limited to, the dishwasher, washer, dryer, entertainment systems, Internet, satellite TV or hot tub. The Owner cannot guarantee against outages of utility services such as electricity, gas, water, plumbing, satellite TV service, Internet, or telephone service. In the event of any persistent failure of certain critical major appliances, equipment or utilities that cause the Rental Property to become unsafe or unusable (i.e. heating, major appliances, electricity, gas or water), the Owner will provide a reasonable reduction of the Rental Fee or credit as determined by the Owner.

NO DAILY CLEANING SERVICE– Daily cleaning service is not included. Linens & bath towels are included in the rental of the home. Please do not remove towels from the home. A starter pack of paper goods, dish soap and bath products are provided as part of the rental. Supplies are not replenished during the duration of the stay.

BABY & TODDLER ITEMS - As a convenience to guests, the property is equipped with a variety of baby items. Baby items are frequently recalled by the manufacturers, and Owner shall not be liable for accidents due to Primary Guest's, or Additional Guests’ use of the baby equipment provided in the property. All guests are responsible for supervising the use of all baby & toddler equipment and toys. Please return all items in clean condition.

BUNK BEDS - Bunk beds (if present) may be a hazard. No child under the age of 5 is permitted to sleep on the top of a bunk bed. Do not let children play on them. The maximum weight limit is 400 pounds.

LEGAL USE OF PROPERTY – The Guest(s) agree not to use the Rental Property, or any Common Areas or Common Facilities, for any activity or purpose that violates any laws, rules or regulations. Any illegal use will cause termination of this agreement, immediate eviction with no refund of rents or deposits.

MAINTENANCE OF PROPERTY- Any damage or maintenance problems must be reported to the Owner within 24 hours from the Guest’s occupancy of the Rental Property or 24 hours of occurrence. Failure to report deficiencies may result in the Guest(s) being held responsible for damages or repairs. The Guest(s) accept responsibility to properly care for the Rental Property during their occupancy and agree to: (i) keep the property in a state of cleanliness, in good condition and in a ready to rent condition (ii) replace or repair and pay for any breakage, damage, or loss caused by the Guest(s), (iii) be financially responsible for unwarranted or unneeded service calls, or any service calls caused by misuse of the Rental Property (iv) follow the Check-out list to ensure the home is left in the appropriate state upon departure from the home. Additional cleaning hours (over and above allocated hours) required to return the home to the same condition as found upon check-in will be charged at a rate of $50 per hour.

AIRBNB DAMAGE CLAIMS & FINES – For Airbnb bookings, a claim can also be made through the Airbnb resolution center if there are damages, fines or penalties resulting from violations of this rental agreement, as well as any misuse of the Property or Common Areas which includes, without limitation, damage to the vacation home, appliances, hot tub, furnishings and personal property located on the Vacation Property (including carpet stains), theft, lost items, unauthorized guests or pets, smoking, exceeding occupancy limits, early check-in or late check-out without Owner’s prior approval, extensive cleaning required following check-out, damage to Common Areas and any fines imposed due to violation of any law, ordinance, rule or regulation by the Guest(s). TERMINATION: The Owner reserves the right to immediately and without warning terminate any occupancy of the Rental Property without any refund of rent, any deposit, or fees if a disturbance is reported.

ENTIRE AGREEMENT: This Agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.

MODIFICATIONS TO AGREEMENT: This Agreement can only be modified in a writing that is signed by both Guest and The Owner

SEVERABILITY: If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

WAIVER: The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.

APPLICABLE LAW; DISPUTE RESOLUTION: This Agreement shall be governed by the laws of the State of Florida. Guest irrevocably agrees that all legal proceedings relating to any dispute or claim arising out of this Agreement or Guest’s use of any the Owner’s property shall take place only in the federal and state courts located in Hernando County, Florida. If any action or proceeding is necessary to enforce the terms of this Agreement, the substantially prevailing party will be entitled to its reasonable attorneys’ fees, costs and expenses in addition to any other relief to which such prevailing party may be awarded by the court.

CONDUCT AND INDEMNIFICATION AND HOLD HARMLESS: Guest agrees to conduct itself during the rental period in an orderly manner and in full compliance with the terms of this Agreement and all applicable laws and regulations. Guest assumes full and sole responsibility for the acts and omissions of itself and all other parties who are present on Owner’s property during the rental period and for any damages, losses, or other liability incurred. Owner reserves the right to refuse the patronage of and provision of services (including rental of any of Owner’s property) to any Guest if they do not comply accordingly.

Guest, on behalf of itself and its guests and other invitees (the “Guest Parties”), acknowledges and agrees that the Guest Parties will enter and use the Owner property as-is and with all faults, dangers, and risks, voluntarily and at the Guest Parties’ sole risk. The Guest Parties agree that they are each responsible for their own health and actions in being at the Owner property, and that the Guest Parties are aware of the risks involved which include, among other things, the hazards of walking on uneven terrain, slips and falls, and the forces of nature including precipitation and rapid weather change,and other dangerous conditions. Each Guest Party expressly agrees and promises to accept and assume all of the risks existing in these activities including injury, illness, property damage, or death. In addition, Guest voluntarily accepts and incurs all risks of any such injuries, damages or harm that arise during or resulting from any acts or omissions of Owner, its Owners, affiliates, members, managers, officers, agents, employees, contractors, attorneys, agents, and representatives (hereafter referred to collectively as the "Owner Released Parties,") or of services provided by the Owner Released Parties or any of them.

GUEST HEREBY WAIVES, RELEASES AND FOREVER DISCHARGES ALL CLAIMS AGAINST THE OWNER RELEASED PARTIES OR ANY OF THEM, FOR ANY INJURIES, DAMAGES, LOSSES OR CLAIMS (INCLUDING ATTORNEYS FEES), WHETHER KNOWN OR UNKNOWN, WHICH ARISE DURING OR RESULTING FROM ANY ACTIVITY, SERVICE OR USE OF FACILITIES PROVIDED BY THE OWNER RELEASED PARTIES. BY ACCEPTING THIS RESERVATION, GUEST ACKNOWLEDGES AND AGREES IT IS EXPRESSLY ASSUMING THE RISK OF ANY HARM ARISING FROM GUEST’S OR ANY AND ALL OTHER GUEST PARTIES’ USE OF THE PROPERTY. TO THE MAXIMUM EXTENT PERMITTED UNDER OREGON STATE LAW, THIS RELEASE ALSO APPLIES TO ANY NEGLIGENT ACTS OF THE OWNER RELEASED PARTIES. ALL LIABILITY FOR ANY CLAIMS FOR DAMAGES, INJURIES, LIABILITY, COSTS, OR LOSSES WHATSOEVER SHALL BE THE SOLE AND ABSOLUTE RESPONSIBILITY OF EACH GUEST. GUEST ACKNOWLEDGES THAT IT HAS CAREFULLY READ THIS AGREEMENT, INCLUDING THIS SECTION 35, AND FULLY UNDERSTANDS THAT IT CONTAINS A RELEASE OF LIABILITY.

Guest shall indemnify, hold harmless and defend the Owner Released Parties against any and all claims, damages, injuries, liability, costs, or losses suffered or incurred by Guest or any Guest Party arising out of or related to this Agreement.
