BY ACKNOWLEDGING THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. To: The property known as "Life's A Beach" (Owner of Property, Releasees) AND High Tide Realty and Rentals (Management Company, Releasees)

I wish to swim at the pool during the length of stay at your vacation home. By swimming in the vacation home pool, I recognize and fully understand certain things, including: •At no time is there a lifeguard on duty, you (the guest) are responsible for the safe operation of the pool and are responsible for all persons using the pool during your stay. •My use of the pool facilities during my stay involves certain risks, including but not limited to: 1. The risk of injury resulting from possible malfunction of the pool equipment 2. The risk of injuries resulting from tripping or falling over obstacles in the pool area 3. The risk of injuries resulting from unsupervised divers and swimmers colliding 4. The risk of other injuries resulting from participating in any action in the pool. •I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming. In exchange for the Owner allowing me to utilize the pool and area during my stay, I hereby agree to the conditions below. I fully intend and choose to give up the legal rights, as stated below:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against the Owner, its directors, officers, employees, agents, or representatives (hereinafter referred to as the “Releasees”) relating to my use of the pool and pool area.
2. TO RELEASE THE RELEASEES from any and all liability for any loss, damage, injury, expense, or other cost that I may suffer or that my next of kin may suffer in connection with my use of the Releasees pool or pool area to any cause whatsoever, INCLUDING NEGLIGENCE ON THE PART OF THE RELEASEES.
3. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability to property, or personal injury to, any third party, resulting from the use of the pool or pool area.
4. That I am over the age of 18 and that I am responsible and will adhere to all the rules of the property.
5. That this Waiver, Release, and Agreement is fully effective and shall be effective and binding upon me, and my heirs, next of kin, executors, administrators, and assigns, or anyone else authorized to act on my behalf or on behalf of my estate. I have read and understood this document. I am waiving certain legal rights that I may have against the Releasees, and I fully agree to do so.

Further:

We take great pride in maintaining our home for all of our guests to enjoy, and with that in mind, through trial and error, we've put together a list of quirks this home may have, liability waivers and what we expect from guests to preserve our home for years to come. By booking this home, you agree to the following terms and conditions:

🌴This home is THOROUGHLY cleaned, inspected and inventoried prior to every guest arrival. Anything missing, broken or damaged will be charged accordingly. In addition, as stated above, our cleaners thoroughly clean and check cabinets, drawers and other inconspicuous places, we are not responsible for items that prior guests may have accidentally left behind in the unit and are not responsible for tracking anything you may leave behind. It is your responsibility to inspect where you are staying upon arrival and departure. In the event a previous guest left something behind, you may call us to come retrieve it.

🌴By renting this home you acknowledge that you understand you enter and occupy the premises at 17010 Hernando Panama City Beach, FL 32413 at your own risk and that the homeowner and High Tide Realty and Rentals are not and will not be responsible for injuries or deaths that may occur on this property. You, and all of your guests attending, agree that everything you use is at your own risk, including any beach equipment left on the property. By renting this home, you agree that you are also financially responsible for any third-party damages that are caused by your group. Neither the homeowner or High Tide Realty and Rentals are liable, financially or otherwise, for any accidental or intentional third party damages your party causes.

🌴You must be 21 years of age or older to rent this home and you must be attending the stay. Third party bookings are NOT allowed.

🌴Please note: No refunds will be issued for unavailable or out-of-service amenities, including but not limited to Wi-Fi, pools, hot tubs, fitness centers, tennis courts, pickleball courts, or other shared facilities. While we understand these amenities enhance your stay, their availability is managed by the property, resort or third-party company, and may occasionally be impacted by maintenance, weather, or other factors beyond our control.

We appreciate your understanding and flexibility!

🌴Standard check-in is at 4:00 PM, and we do our best to have your rental cleaned and ready by that time. However, please note that check-in availability can occasionally be delayed—especially if the unit requires extra cleaning due to how it was left by previous guests.

While we make every effort to ensure your rental is prepared on time, we appreciate your understanding in rare cases where housekeeping may need a bit more time. Refunds are not issued for delays related to cleaning, as guest readiness depends on the condition in which the property is returned.

We recommend planning your arrival accordingly and thank you for your patience—our team is working hard to ensure everything is spotless and comfortable for your stay!

🌴Occasionally, you may find clean dishes left in the dishwasher or fresh linens in the dryer when you arrive. This simply means our cleaner finished preparing the unit and, rather than delay your check-in, left these items to finish drying or cooling.

Feel free to use them as needed—they're clean and ready for your stay. We just wanted to keep things efficient so you could start relaxing sooner!

Other things you need to know:

🌴This home is on a septic, as are most homes in Florida. It is imperative that nothing other than the septic safe toilet paper we provide is flushed down the toilet or the septic will clog and overflow and we will have to have a company come out to pump it at your cost.

🌴Guests are responsible for filling propane tanks for the outdoor grill and cleaning the grill after each use. If the grill needs to be cleaned upon your departure, our cleaning company charges $175 for grill cleaning and that will be billed to the booking party.

🌴There is a maximum occupancy of 8 people for this home, and no additional guests are permitted to stay other than those that are documented in your rental.

🌴We provide make-up removal wipes. Please do not use our towels to remove your make-up or wipe up any spills or messes other than water. We provide paper towels for that.

🌴Sand is harsh! There is an outdoor shower in the back of this home and many beach access points with showers to rinse off sand. Please get as much sand off as possible before entering the home after leaving the beach.

🌴For those bringing children: you agree that your children will be supervised in this home at all times and any damages caused by children brought to stay here will be charged to the individual that booked your reservation.

🌴Please do not use anything labeled "housekeeping". These items are for our cleaners to turn the unit, and you will be charged $100 if used.

🌴Please return items to the area in which you got them. Our cleaners clean MANY properties, and it is not their job to reorganize homes and try to remember where everything is supposed to go.

🌴Please do not move any furniture.

🌴Do not burn candles, not in/at this home or anywhere on the premises.

🌴Please do not take remotes out of the rooms they belong in.

🌴Please reserve eating for the dining areas provided, especially with children. Children should not bring food into bedroom/ living areas and should have their hands washed after eating.

🌴Please do not allow children {or anyone else} to jump on the beds.

🌴By entering our rental home, you understand that disconnecting the Wi-Fi is grounds for immediate eviction.

🌴Allergens: This is a smoke free, drug free and pet free home. No smoking is allowed on the property. If our home has been found to have been smoked in or we find evidence of a pet occupying the premises during your reservation, a $1,000 fee will be imposed for professional ozone air purification and loss of use of the home during this process so we may continue to accommodate our guests that are allergic.

🌴No parties or events. Quiet time is 11 pm - 7 am. We have neighbors that live here.

🌴Undocumented guests that are not noted in your reservation and are found to be staying in this home will be charged $100/ day, per guest, and are subject to immediate ejection without notice or refund at our discretion.

🌴Sub- leasing is not allowed. Those found to be sub- leasing our property will be fined $1,000 and the unapproved guests will be ejected immediately without notice or refund.

Departure:

🌴Checkout time is 10 a.m. firm. This allows our cleaner to get in and turn the unit in time for the next guests to arrive. Guests found to stay after 10 a.m. will be charged a $100 fine and $50/ hr. each hour thereafter that we pay our cleaners for their wait time unless a late checkout has been pre-arranged.

🌴Please start a load of towels with the laundry detergent provided prior to departure. Towels take the longest to dry and this really helps our cleaners to transfer those upon arrival and get started on bedding so this home can be ready in time for the following guests.

🌴Please load and start the dishwasher with the dishwasher liquid located under the sink or dishwashing pods left on the counter upon departure. Similar to the towel situation, dishwashers take a very long time to run and it's imperative that the cycle is through before our cleaners have to leave.

🌴Please remove all opened food from refrigerators, freezers and pantries. You may leave unopened items that are not expired.

🌴Please place trash bags in the garbage can outside.

🌴It is not our cleaner's job to clean a trashed unit, it is their job to launder linens, sanitize all surfaces and make everything look pretty. Otherwise, it is your responsibility to leave the home similar to the condition in which you received it. Additional fees will be charged for units that require excessive cleaning beyond general cleaning and sanitizing.

🌴Violating any of these rules will result in immediate ejection without notice or refund.

While aforementioned items may seem like common knowledge, trial and error has forced us to have to document and charge accordingly to enforce them. We thank you for caring for this home so that you and many others may enjoy it for years to come.
