For All Booking Channels- By accepting the rental agreement on any Booking Channel, you agree to the terms of this Rental Agreement. Sending a signed copy of this document to the property manager is not necessary. Deposit-

A deposit will be held virtually by and only utilized if damage or violations occurred during your stay. The reservation will be confirmed upon payment through Airbnb and your electronic agreement to the rental agreement. Housekeeping Fee – A non-refundable fee of $300 per stay is required and due 30 days in advance. Daily maid service is not provided.
Pet Fee – Pets are not permitted at this property. Payment– Rent, Deposit and Housekeeping Fees must be prepaid in the form of Credit/Debit Card 30 days before arrival date. Failure to prepay Rent and/or Housekeeping Fees will result in forfeiture of Deposit and cancellation of reservation.   RENTAL AGREEMENT Property: 209 Lake Dr, Tool, Tx 75143

Cancellations – A thirty (30) day notice is required for cancellation by either party. Cancellations made within 30 days of the arrival date, forfeit the Rent, Deposit and Housekeeping fees.

Maximum Capacity- The maximum number of overnight guests is limited to 8 people.
Special Occasions – This property is NOT available for rental to individuals or groups celebrating Spring Break, Prom or large parties. If it is discovered that a reservation was made using false or misleading information, the reservation will be subject to immediate termination, eviction of all occupants and complete forfeiture of security deposit and rental fee. Should any damage occur to the property, Tenant will be responsible for all repairs or replacement necessary to bring the properly hack to its original condition.

Age Requirement- The guest renting must be at least 25 years of age and be present during the entire rental.

Security Cameras/Audio detecting devices – This home is equipped with outside video surveillance and/or loud noise monitoring devices.

Children- The renter always agrees to use extreme caution when occupying property and ensure appropriate supervision of children of all ages. Children and all guests are the sole responsibility of the renter and property owners assume no responsibility. Children should NEVER be allowed to roam alone or enter lake alone without adult supervision.

Smart Lock Key Pad –The key code for the smart lock key pad will be sent to you within 72 hours of check-in.

Inclusive Fees – Rates include a one-time linen-towel setup. Towels and linens are NOT to be removed from the unit. Maintenance - The Owners strive to maintain the property in optimum working condition, but appliance and mechanical problems can arise. Should an appliance or mechanical malfunction occur during your stay, you agree to notify property manager immediately. Owners are not obligated to provide refunds due to short term appliance or mechanical malfunction that occurs during your stay. Prompt notification allows for property manager to remedy the situation with minimal disruption to your stay.

Amenities- Unit is equipped with the following:  Kitchen necessities- trash can, microwave, coffee maker, dinnerware, glassware, flatware, cooking utensils & vessels.  Minimal paper/disposable products are available- toilet tissue, paper towels, and cleaning supplies.  Pool Table- Broken pool sticks will result in deduction of deposit.  *Fire pit—Outdoor fire pits are permitted for responsible use only. There is no guarantee that firewood will be available; please bring your own firewood. Do not throw any paper, trash, or other combustible materials, aside from firewood, in the fire pit. Locally issued burn bans may prohibit the use of the fire pit. Renters are responsible for asking the property manager if a burn ban is in effect. Owners are not responsible for any fines incurred by renters while burn bans are in effect.  *Parking—Vehicles are to be parked on the driveway only. Parking on the road across the street is not permitted. Illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.  *Dock/Pier- Use of the dock/pier for renter owned/leased watercraft is limited to boat tie-up only. Do not jump off the dock into the water there are rocks. The water around the boat dock and sea wall may contain tree stumps and other potential debris and is inappropriate for diving/jumping into. Steps or ladders into the lake may become slippery; use extreme caution. Property owners assume no responsibility for injury incurred while on the premises.  *Hot Tub- Use of the hot tub is at your own risk. Children prohibited without adults.

Contents and condition of the unit are inventoried and inspected before and after the Rental Period. Missing items or damage will result in a forfeiture of Deposit. If the total cost of repairs exceeds Deposit, additional monies will be requested from Renter or legal action will ensue. Violations of the following rules can result in forfeiture of deposit and eviction: Alcohol Consumption- Adults 21 and over should consume alcohol responsibly. Alcohol use by people under 21 is strictly prohibited. Contents and condition of the unit are inventoried and inspected before and after the Rental Period. Missing items or damage will result in a forfeiture of deposit. No Smoking- this is a no smoking home. Smoking is only permitted outside away from the house. No Fireworks- Fireworks are not allowed at this property. No Contraband- Authorities will be notified. Pets- Not allowed. Follow all established rules and regulations of the community the property is in. Owners are not responsible for any fines incurred by renters during their stay. Falsified Reservations- Any reservation obtained under false pretense will be subject to forfeiture of all monies and check-in will not be permitted or automatic eviction without refund if already checked in

Violations of the following rules can result in a reduction of deposit: Damage done to unit, contents, property, or boat dock, beyond normal wear and tear. Renter is expected to leave the unit and outside area in a reasonably clean and orderly condition:  No colored liquids should be consumed on carpets or furniture.  All trash placed in garbage cans at the street. Trash pick-up is Monday.  Soiled dishes. Dirty dishes are to be placed in the dishwasher and cleaned.  Soiled towels & wash cloths are to be placed on bathroom floors.  Strip beds of soiled linens, leave linens on floor of bedroom.  Please secure chairs from dock Outside noise must cease at 10 PM, be respectful of neighbors and neighborhood.

If the total cost of repairs or violations exceeds deposit, additional monies will be requested from Renter or legal action will ensue.

RENTAL AGREEMENT Property: 209 Lake Dr, Tool, Tx 75143 General Release of Liability The undersigned, and his or her renters, guests, and or visitors, hereby jointly and severally releases, acquits, forgives, discharges, and holds harmless, Peter Silva, Morgan Hinckley Page, and Cedar Creek Lake Getaways from any actions, claims, demands, suits, agreements, judgments, liabilities, and proceedings, whether arising in equity or law and arising from:

During Rental and Use of Property: 209 Lake DR, Tool, TX 75143 For purposes of clarity, this provision shall constitute a full and complete waiver of liability, INCLUDING ANY CLAIMS OF NEGLIGENCE. The undersigned agrees: • To be responsible during the rental period for all renters and guests, informing every one of the rules and personal liabilities and agree to use prudent judgment on the premises knowing that there is direct access to the lake. • Life jackets should be worn at all times while guests are in the lake. Life jackets MUST be provided by the tenant or tenant’s guests. • No diving from the platform or off the seawall into the water • All guests and enforcement of rules is the full responsibility of the undersigned. This release shall remain binding upon all successors in interest and personal representatives of the contracting parties, to the extent permitted by law.
