Gertrude Rentals Terms and Conditions:

PAYMENTS, CANCELLATIONS & REFUNDS. Cancellations made 60 or more days before arrival receive a 50% refund of amounts paid; cancellations made less than 60 days before arrival are nonrefundable, and no credit will be issued. Additionally, we cannot provide refunds or rate reductions for weather, government orders, travel disruptions, construction/noise, utility or internet outages, amenity failures, pests/wildlife, or any other events outside our control. Guests wishing to insure their stay should consider purchasing trip insurance.

LISTING, USE & CONDITION. Guest is responsible for confirming listing photos, description, location, and amenities indicated in the listing fit their needs before reserving. Amenities are provided as a courtesy and may occasionally be unavailable. Agent and Owner make no warranty (express or implied) regarding the Property, amenities, or fitness for any particular purpose other than lodging.

ASSUMPTION OF RISK, HOLD HARMLESS & INDEMNITY. Your safety matters, but some Property features and locations involve inherent risk—including, without limitation, stairs, balconies/rails, bunk beds, gas appliances and grills; bicycles, paddleboards, kayaks; pools and hot tubs; and natural conditions such as extreme weather, wildlife, and terrain. To the fullest extent permitted by law, Guest assumes these risks and agrees to defend, indemnify, release, and hold harmless the Owner and Agent (and their owners, officers, employees, agents, and subcontractors) from any and all claims, losses, damages, liabilities, and expenses (including attorneys’ fees) arising out of or related to the use or occupancy of the Property or its amenities by Guest or anyone in Guest’s party, including claims alleged to be caused in whole or in part by the negligence of any released party, except to the extent caused by that party’s gross negligence or willful misconduct. Guest’s duty to defend begins upon tender of a claim and continues until final resolution.

SAFETY & SECURITY. Guest understands their belongings aren’t insured and Agent and Owner aren’t responsible for lost, stolen, missing, or forgotten items. During the stay, Guest will be solely responsible for locking doors, garages, windows, gates, and garages as they deem appropriate. Guest further agrees to ensure a responsible adult supervises minors at all times while on the property. If gate locks to pools or other water features are present, keep locked when children are present. When applicable, rooftop decks, kayaks, paddleboards, fishing or snorkel gear, and bikes are for adults only.

SECURITY DEPOSIT & DAMAGE AUTHORIZATION. You allow Agent to pre-authorize or charge the card on file for damage, missing items, excessive cleaning, extra laundry, stains and odors, rule violations, fines, and related costs. Charges may exceed the deposit if necessary to cover actual loss and collection costs.

PENALTIES & REMEDIES. · Tampering with safety or security devices including noise sensors, locks, and exterior cameras: $300 per incident, plus related damages. · Smoking or vaping on the premises: $300 to $500 remediation charge. · Occupancy violations: up to $1,000 per person found in excess of maximum stated occupancy limit and potential termination of the stay without refund. · Unauthorized pet at a “No-Pets” rental: $500 deep cleaning plus related damages. · Unauthorized event or gathering at a “No-Events” rental: up to $5,000 penalty and potential termination of the stay without refund.

OFF-LIMITS AREAS & OWNER PROPERTY. Owner and Agent reserve the right to store personal items on the Property. Guests are prohibited from accessing or attempting to access locked doors serving closets, garages and storage areas. Guests attempting to break into lock to areas can be subject to criminal charges, termination of the stay without refund, and legal fees and damages.

ENTRY & INSPECTION. Owner, Agent, and hired vendors may enter and inspect the Property with or without prior notice when it is deemed inspection may be necessary to enforce this Agreement, protect people or property, or make critical repairs.

OTHER POLICIES. Additional policies such as rates and fees, check-in and check-out time, cancellations, minimum stay, smoking, pet policies, maximum occupancy, children and age limits, security deposit requirements etc. will be according to information given in the property listing. This agreement expresses and reflects all that was agreed between the parties and cancels any agreements and/or other understandings between them.

LEGAL TERMS. This Agreement is governed by the law where the Property is located; exclusive venue is in that jurisdiction’s courts. The prevailing party in any enforcement action is entitled to attorneys’ fees and costs. Unenforceable terms will be replaced with valid ones closest to the original intent (severability). Jury trial is waived to the extent allowed by law. This is the entire agreement and supersedes prior understandings.
