Rules to Follow:
--NOISE: We are a loud, Italian, fun-loving family and if we can keep the noise down I know you can too. Emerald Island Resort has a very strict noise ordinance and there can be no excessive noise between the hours of 8pm and 8am. Also, during the day please keep the noise at an appropriate level so our neighbors are not calling me about it--you know the saying, "do unto others"! If the police are called or complaints are made there will be an immediate eviction and forfeitures of any remaining days (laying down the law here, folks).
--PARTIES: NO PARTIES! Just good old, relaxing fun allowed! If damage was done to the home a fee up to $150,000 could apply.

Evidence found of smoking within the property, or improperly disposing of smoking or drug related paraphernalia, will result in a $1,500.00 fine per incident. Multiple fines may apply. We have a cigarette detector so please don't test this rule! Our children are allergic to cigarette smoke and it really comes down to the health of everyone staying at our property. Thank you!
- -POOL & SPA: This house has a pool and hot tub (so awesome, I know!), therefore children must be continuously monitored to prevent drowning (Like a hawk y’all!) - No Diving in the pool or hot tub. By signing this agreement you agree to swim at your own risk. - No running on the pool deck - The pool cover must be left over the pool when it is not in use if it is out (we put it away during some months of the year depending on weather). This keeps the temperature of the pool warm for your use. Leaving it off when not in use will drop the temperature of the pool 10 degrees or more even when thermostat is set. It will take 24 hours or more to warm back up so for your own best experience, please keep the pool cover on at all times when it is not being used.- No glass items on the pool deck (glasses or plates, ect) please use plastic cups and plates provided. (If glass is found on the deck or in the pool after a reservation a $100 fee will apply.) -Pool controls on the side of the house is monitored by 24-hour surveillance and if you tamper with the pool controls a $200 fee will apply and up to $5,000 depending in the pool breaks as a result of tampering with the controls. If there is an issue with the pool please contact Rebecca. Thank you! -We offer a safety gate you are able to use or take down at your convenience on the pool deck. But it must be put back up the way you found it at check out. -We generously offer FREE pool and spa heat but it does have a limit. The pool is set at 88 degrees October-March and 85 degrees April-September. If you want it set higher for your stay please contact Rebecca and a fee of $30/day up to 88 degrees can be set in the warmer months. Our spa heats up to 102 degrees but remember you need to set the timer and it does take 15-30min to heat up depending on how cold it is outside.

- OCCUPANCY/USAGE OF HOMES AND PROPERTIES: Each rental property has an established “maximum occupancy”. Maximum occupancy is an effort to protect and promote the interest of the property owners, guests, and visitors. Any guest exceeding maximum occupancy inside or outside, day or night, will be subject to immediate eviction without refund. Children under the age of twelve should not be left in the property without an adult. Mobile units, such as campers and tents, cannot be used on the property. Wear the tear y’all! No rentals to groups less than 25 yrs old. Need to have that frontal lobe developed (for all my fellow nurses out there, you know what I mean!).
- -TRASH: Trash days are Mondays AND Thursdays. Recycle days are on Wednesday. The community will take the trash to the curb and pull it back up to the side of the house for you. (So you don’t even have to remember this one!) If the trash is already full take your trash to the trash compactor which prevents animals and bugs attacking you and your children in the driveway—not joke if you leave it out, they will come! Our trash bins are monitored by 24 hour video surveillance and if you leave overflowing trash outside (if trash bins don't close completely or you leave extra trash bags outside of bins) OR you don’t have trash in trash bags(loose trash) a fee of $100 fee will apply. Trash Compactor is the first right after you go through the gate to leave the community. If you reached Funie Steed Rd you have gone to far. After you turn right go through the gate and strait toward the tennis courts and it is to the right of the tennis courts.
--A/C & HEAT: We have an upstairs and downstairs AC/Heat unit to keep you comfortable all year round on both floors. In order to prevent the units from over working and breaking we have a limit set on the thermostats for you to use to control the temp. The lowest it will go is 72 degrees in the summer months and the highest it will go is 72 in the winter months. We do offer fans for your comfort. Ensuring blinds are shut and doors to outside are closed will also help you keep the temperature comfortable for your stay. We cannot adjust the temperature as we are already pushing what the energy company and AC Company recommends for these months and it is important not to overwork the unit to ensure they don't break for your stay.

Thanks for reading folks!
-Oh and one more rule: HAVE SO MUCH FUN! Go Army!
*The fees added are a result of unfortunate events from previous guests. Most of our guests do not need any rules to follow but in order to respect our cleaners, pay them for their time and extra work if needed, and/or to pay additional cleaners to help out if the house is not left properly in order to get the house clean and sanitized for upcoming guests we do need to have these rules and extra fee’s in place. Thank you for your understanding.
*Choice of Law; Jurisdiction and Venue; Dispute Resolution. A.1. Dispute Resolution and Arbitration Agreement: United States. If (a) your claim against Rebecca relates in any way to a reservation for or stay at a Property located in the United States, or (b) you bring any other claim against Rebecca in the United States (to the extent permitted by these Rebecca Terms or the Airbnb Terms) (any such dispute, claim, or controversy under either (a) or (b) a “US Claim”), then you agree to resolve the US Claim as follows: a. Agreement to Arbitrate. You and Rebecca mutually agree that any US Claim will be settled by binding arbitration rather than in court, such arbitration to be conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, or such other AAA arbitration rules that the AAA decides to be applicable to a specific dispute, that are in effect as of the time of service of an arbitration demand. Payment of filing, administration and arbitrator fees will be governed by the AAA's rules. To begin an arbitration, a party must send a letter to the other party requesting arbitration and describing the claim. If Rebecca requests arbitration, it will send the letter to your most recent email or physical address in Rebecca’s records. If you request arbitration, you must send the letter to Rebecca, or if the dispute does not involve a reservation for or stay at a specific property. b. Place of Arbitration. The arbitration shall take place in the county in which the Property is located, or in such other location as you and Rebecca may mutually agree. c. Exceptions to Arbitration Requirement. As the only exceptions to the agreement to submit all US Claims to binding arbitration as provided herein, Rebecca and Renter both retain the right to pursue: (1) in small claims court in the county in which the Property is located, any claim that is within that court’s jurisdiction, and the parties consent to the personal jurisdiction and venue of such court; and (2) a suit in any court with jurisdiction to enjoin (whether by temporary, preliminary, or permanent injunctive relief) infringement or other misuse of intellectual property rights. A.2. Class Action and Jury Trial Waiver. You and Rebecca agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Rebecca waive any right to a jury trial. M. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL THE OWNER OF THE PROPERTY OR Rebecca, NOR THEIR AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR OWNERS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE PROPERTY. THIS LIMITATION APPLIES TO ALL CLAIMS FOR DAMAGES WHETHER BASED ON A THEORY OF WARRANTY, CONTRACT, TORT (INCLUDING ORDINARY NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF Rebecca HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE AND EVEN IF THE LIMITED REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. N. Indemnity. You agree to hold harmless and indemnify Rebecca and Owner, and their respective affiliates, for and from all claims for property damage, personal injury, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during or relating to your stay. O. Substitution of Property. On rare occasions, due to ownership changes, properties being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation and Rebecca may have to cancel your booking. In this unlikely event, rebooking shall be subject to the Airbnb Terms for booking modifications. P. Assignment. Rebecca may assign these Terms or any of its rights, or delegate any of its duties under these Terms, at any time without your consent.
