Your reservation requires a completed and signed rental agreement. It will be provided when you book your stay and must be returned within 48 hours.
Primary renter must be at least 25 years old.
Government-issued ID verification is required prior to check-in.
Only registered guests are permitted on the property.
No parties, events, receptions, or large gatherings are allowed.
Quiet hours are from 9:00 PM to 9:00 AM.
Smoking and vaping are prohibited inside the home.
Pets are only allowed at designated pet-friendly properties and must be approved in advance with a paid pet fee.
Check-out is by 10:00 AM.
The maximum occupancy listed for the property may not be exceeded at any time.
No outdoor fires are permitted between Memorial Day and Labor Day due to local fire restrictions.
Illegal activity of any kind is strictly prohibited.
Failure to comply with these rules may result in additional fees, cancellation of the reservation, or removal from the property without refund.
Vacation Rental Authority Guest Agreement
You are renting a PRIVATE HOME. Please treat the property with the respect you would like shown to your own home.
This Guest Agreement is made and entered into between the vacation rental Property Owner and the undersigned "Guest" with respect to that certain residential vacation property listed in the Reservation Confirmation. Please refer to the Reservation Confirmation for payment, dates, occupancy and other details. Vacation Rental Authority has authority to administer this contract (aka "Agreement") as the Agent of the Property Owner.
Occupancy
Guest agrees not to exceed the maximum number of individuals stated in the Reservation Confirmation. The undersigned Guest is aware of, and responsible for adhering to, all local ordinances occupancy restrictions, as applicable.
Smoking or Fireworks
Smoking is not allowed on and within any and all portions of the Property. Fireworks are not allowed at the Property. Aerial fireworks are prohibited by local ordinance. Should VRA find that the guest did not adhere to these rules, Guests may incur additional fees.
Garbage
Properly bag garbage, place in cans and keep covered to avoid wild animals. Garbage collection is on a regular weekly schedule. Please take note of your rental garbage schedule and leave cans by the street. Guests may leave up to 2 full cans with closing lids upon departure. Please haul excess garbage to the nearest disposal and recycling site, as posted. Fees apply for excessive garbage left at the home, or if wild animals get into the garbage.
Directions
Address information is provided once full payment has been received. Guests are solely responsible for finding the rental home, and planning ahead is recommended. No refunds will be given for failure to locate the property.
Items Provided
The Premises is furnished for typical use. Owner will provide an initial supply of towels, linens, blankets, pillows, cups, knives, forks, spoons, dishes, and other like and similar items. A limited quantity of other kitchen and bath items may be provided for the Guest's convenience. The purchase of any missing or additional kitchen, bath, and laundry items are the sole responsibility of the Guest.
Additional Items
The nightly rate paid for a vacation rental is for holding the home for your exclusive use during the agreed upon, reserved dates. If you do not enter or stay at the home for any reason, the cancellation policy applies. Furnishings and amenities found within the home are complimentary. The premises is equipped for typical use, but may not be equipped with all the items the Guest is accustomed to having at home as each Owner has provided their own combination of items. Guest should expect to bring or provide any item which is important to them, at their own cost. For more information about whether specific items are on site, contact Guest Services prior to arrival.
Using Items
The property owner and VRA will make every effort to assure the home and all equipment is operational prior to your arrival, and use of such is complimentary. As such, in the event that an item or system is not working (including but not limited to wifi, a/c or cable), no refunds will be given. Guest is responsible for operating the items and systems found in the home. Neither the owner, nor Vacation Rental Authority, can guarantee that every item requested is available and in working order.
Use of Premises
Guest shall use the premises only in a careful and lawful manner. The Premises shall be used for a private residential vacation rental by the persons comprising the Guest's approved Rental Party. Guest shall not permit other individuals to reside in the Premises or to treat the Premises as a residence, nor misuse, damage, waste or neglect the Premises. The Premises shall not be used for any business, commercial, immoral or unlawful use.
Check-in
Address and entry information is provided once the following have all been received: final payment, photo ID, and signed rental agreement. Check-in time begins at 4pm. VRA will make every effort to assure the home is ready prior to 4pm, but cannot guarantee any specific time on the day of Arrival. VRA reserves the right to charge the early check-in fee of 50% of the average nightly rate booked or $250, whichever is more, for any member of the party who is found inside the home prior to 4pm on their arrival day.
Check-out
Check-out is prior to 10am. As such, the premises must be vacated of people and belongings by 10am. VRA reserves the right to charge the late check-out fee of 50% of the average nightly rate booked or $250, whichever is more, for any member of the party found inside the home after 10am on their departure day.
Cleaning on Departure
Guest agrees to leave the home in a clean, orderly condition inside and outside. Failure to leave the home in this condition will result in excessive cleaning charges.
Trailers, Tents and RV's
Using trailers, tents or RV's for living space or sleeping is not allowed at any rental property. Parking only (not living or sleeping) for trailers or RV's may be available at some properties with written permission. Trailer and RV Parking cannot be guaranteed and the lack of will not result in any concessions to the guest.
Parking
Guest agrees to comply with parking rules and regulations related to the rented premises. Each property has different parking limitations and rules, and may not accommodate parking for the equivalent occupancy allowed. Guest is solely responsible for inquiring about those rules and planning ahead accordingly. Any vehicle over the maximum allowed for parking at the home will not be permitted. Lack of parking will not result in any concessions or exceptions to the cancellation policy.
Quiet Enjoyment
Quiet hours are 9pm to 9am. The Guest and their Rental Party shall govern themselves at all times in a civilized, respectful manner and shall be good neighbors respecting the rights of the surrounding property owners.
The Guest and Rental Party shall not create noises or disturbances likely to disturb or annoy the surrounding property owners. Hot tub, beach, deck and other outdoor noise should be kept to a minimum. Dogs who bark excessively are considered neighborhood nuisances and are not permitted at any time.
Pets
Pets are welcome at many of our properties with prior approval and non-refundable pet fee. Please add your pet to your reservation at the time of booking to avoid extra costs. They must be appropriately contained (or on leash), reasonably quiet, and picked up after, to avoid potential pet eviction.
Hot Tubs
No children under the age of sixteen (16) are permitted in the pool or hot tub without direct adult supervision. When using the pool or hot tub, Guest acknowledges that there is a certain health risk associated with the use of such facilities and Guest fully accepts such risks. Guest agrees that all members of their Rental Party shall use the same at their own risk.
Boating / Docks
Guest is responsible for each member of their rental group swimming and boating safely off the adjoining dock where applicable. Guest agrees to be considerate of neighbors, and abide by all relevant local rules and laws.
*Dock delivery and water levels may vary and are not guaranteed.
Inspection
Owner or Agent shall be entitled to access all areas of the Premises for the purpose of inspecting, maintaining and repairing the Premises or having a contractor perform the work deemed necessary.
Events
The Premises is located in a residential area, and may not be used for weddings, wedding parties, receptions, bachelor parties, or other group functions. Using a property managed by Vacation Rental Authority Inc for any event or a function with a number of guests exceeding the agreed upon occupancy of the property without written approval may result in immediate removal of all guests and fees determined solely by Vacation Rental Authority.
Guest acknowledges that any occupancy exceeding the maximum allowed guests as stated in the rental agreement is trespassing according to Chapter 70 section 18-7011 of the Idaho Statutes and subject to criminal and civil legal action.
Additional Charges
Guest agrees to accept charges to the credit card on file and to keep an up to date credit card on file for any additional fees incurred during the guest's stay. Should credit card be declined guest is aware that they may be pursued legally for any charges applicable to their stay.
Action and Behavior
Guests are expected to behave respectfully in regards to people and property, such as the house, land, amenities, furnishings, neighbors, neighborhood and representatives of Vacation Rental Authority. Specifically, Guest and all other occupants will be required to vacate the premises, forfeit their payment, and incur additional fees for any of the following (including but not limited to):
Occupancy exceeding the maximum as agreed upon in the Reservation Confirmation. A $100 charge to your payment credit card may be assessed per day and per person over the agreed upon occupancy.
Using the premises for any illegal activity including, but not
limited to, the possession, serving or consumption of alcoholic beverages by or to persons less than 21 years of age.
Causing damage to the premises rented, or to any of the neighboring properties.
Any other acts which interfere with neighbors' right to quiet enjoyment of their property such as barking dogs or other on-going noise. NOTE: If law enforcement is notified due to disturbances emanating from the premises or grounds, there will be a minimum $250 charge to your credit card per incident.
Vacation Rental Damage Protection
Guest agrees that all damages to the property that occur during the Guest's stay as a result of the Guest, the Guest's Rental Party, visitors or pets are the responsibility of the Guest, and will accept charges to the credit card on file to make repairs. At the time your reservation is made, you may have purchased a Damage Waiver as described below.
Damage Waiver
It is the Guest's responsibility to report damage that is caused to the Property during their stay. The vacation rental Damage Waiver is not insurance, but instead an agreement by Vacation Rental Authority to replace or repair unintentional damages up to $3000 in total to the rental unit's interior. Damages that qualify for this agreement must occur during a Guest's reservation, be disclosed to management prior to check-out, and the Damage Waiver must have been paid in full prior to arrival. Any damages that either exceed $3000, are not disclosed prior to check-out, or are deemed intentional, will be charged to the credit card on file. The waiver does not cover intentional damage.
Indemnification and Liability
Owner and Agent shall not be liable for any damage or injury to Guest, or to any other person or to any property, occurring on or within any portion of the Premises. Guest acknowledges that the Premises is subject to certain inherent dangers, such as its proximity to a golf course or body of water, the existence of a water fountain, rocks, stairs, fire pits and fireplaces. Further, Owner and Agent shall not be liable for any damage or injury to Guest, or to any other person or to any property, stemming from any use of equipment including but not limited to kayaks, stand-up paddle boards, bicycles, etc. Guest agrees to defend and hold Owner and Agent harmless, and to indemnify Owner and Agent from any claims for damages or injuries caused by Guest, the Rental Party and/or other occupants, visitors or other individuals.
Disputes
Guest agrees to give us an opportunity to resolve any disputes or claims by contacting our complaints department Monday – Friday by submitting a formal complaint. If we are not able to resolve your Claims within 60 days, you may seek relief through arbitration, as set forth below.
Any and all Claims will be resolved by binding arbitration, rather than in court. This includes any Claims you assert against Vacation Rental Authority, its members or employees, relevant property owners or others (which are beneficiaries of this arbitration agreement). This also includes any Claims that arose before you accepted this agreement, regardless of whether prior versions of the agreement required arbitration.
If a dispute arises from or relates to this contract or the breach thereof, and if the dispute cannot be settled through direct discussions, the parties agree that any unresolved controversy or claim shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
By agreeing to arbitration under the AAA Rules, the parties agree, among other things, that the arbitrator, and not any federal, state, or local court or agency, shall have the exclusive power to rule on any objections with respect to the existence, scope, or validity of the arbitration agreement or to the arbitrability of any claim or counterclaim.
Arbitration and Attorney Fees
Owner and Agent shall be entitled to recover any costs and/or attorney fees incurred in enforcing the terms of this agreement.
Entire Agreement
This agreement constitutes the entire agreement between the parties and may not be modified except in writing signed by both parties. Any prior understanding or representation of any kind preceding the date of this agreement shall not be binding on either party except to the extent incorporated within this agreement.
Governing Law
This agreement shall be construed and enforced in accordance with the laws of the State of Idaho and Kootenai County.
