You’ll be staying in someone’s home, so please treat it with care and respect.
Please take the time to read and completely understand all the following rules/conditions and make sure to explain them to your guests as you and all your guests will be responsible for them. Please feel free to contact me if you have any questions.
The guest(s) will be responsible for any fees and will be charged for any damages/citations resulting from not following the below rules which may also result into getting removed with no refunds.
ALL HOMES ARE EQUIPPED WITH OUTSIDE VIDEO AND AUDIO RECORDING DEVICES (please read “health and safety” for camera locations) and will be recording during reservations for your protection and mine.
Guests of gated communities must verify and identify all guests first and last names. You must give drivers first and last name along with first and last names of each passenger. This ensures guests access to the community and also verifies the amount of guests originally booked. This also insures the maximum occupancy will not be breached.
General Rules:
Smoking is NOT allowed inside or outside our homes. If smoking damage occurs you agree to pay $2000 damage fee for smoking. NO SMOKING INSIDE OR OUTSIDE!
Please lock all windows, sliders, and doors each time you leave the property.
Please use the furniture for what they are intended for. Do not move furniture from indoors to the outdoors.
Do not attempt to enter locked closets or areas.
Please do not throw any paper or other combustible materials in the fireplace or the outdoor firepit.
Do not flush anything other than toilet paper.
Please do not set the thermostats below 72 degrees. Setting the thermostats below 72 will make the units run excessively and freeze up, causing damage.
Please do not plug in any electronic equipment/speakers/appliances that require high wattage either inside or outside that may cause circuit breakers to trip. This may result into loss of WiFi and or loss of control on the outdoor features during your stay.
All pets must be approved by host first and require a $300 occupancy fee per pet.
Pool and Outdoor Features:
No glass/bottles by the pool. Any broken glass inside the pool will cause for a complete drainage to remove the broken glass pieces.
Pool and outdoor features may be controlled by the spa controller inside the spa or the iPad/iPhone/pool remote inside the house Please use instructions provided in the instructions booklet.
On windy days do not use the fire pit or open any of the umbrellas/awnings as this may cause irreversible damage.
Pool floats must be removed from inside the pool every night allowing to water to circulate properly through the filtration system.
If the firepit or the BBQ grill is under an umbrellas/awnings, make sure the umbrellas/awnings are closed during the use of fire pit or the BBQ grill as this may cause a fire hazard.
Please close all awnings/umbrellas and turn off the fire pit for overnight.
In order to request pool or spa heat please contact property manager.
Noise and Nuisance Rules:
All daytime noise should be at an acceptable level so our neighbors won’t be disturbed.
Respect our neighbors and do not trespass on their property unless you have their permission.
Additional Guests:
Only total number of guests in the original booking will be allowed to check in unless authorized by property manager or the property owner, 16 Max on Airbnb. Guests first and last names (gated communities) must be provided for entry through the security guard gate. If you exceed the number of guests booked (16 Guests), you agree to pay $100 per night per guest. If you exceed the maximum occupancy, the reservation will be canceled without refund. At which time you will be trespassing and agree to vacate the premises. If you do not leave the property, the police can and will be called to assist with removal for trespassing.
Earliest check in time is 4 pm and latest check out time is 10 am for all guest(s) and visitor(s) unless otherwise authorized.
We reserve the right to allow or decline any day visitors.
If you do not check out by 10 AM, you will be penalized and you agree to pay $200/hr. If you check out more than two hours past the regular checkout time of 10 AM, you agree to pay the base rate for the day. In the event that the upcoming reservation has to be cancelled due to your late checkout, you will be responsible for reimbursement of the future booking entirely.
Parking:
No street parking allowed.
All violations just described will result in a $750 per car per day fee that you will need to pay before your departure. Please check the individual home description for more details.
Release of Liability:
All the homes are privately owned. the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the property.
Property Cleanliness:
If the premises are left in a deplorable state an additional $250 or more extra cleaning fee will be charged or deducted from the security deposit. While linens, bath towels and pool towels are provided, daily laundry service is not included in the rate. We do not permit bath towels or linens to be taken from the home. Trash:
Trash collection day is every Friday morning early by 7:30am. Please place any trash in the trash bins located on the side of the house no later than Friday by 7:30AM. We have roll off service so the trash company will roll out the cans and bring them back in. Please just make sure all the trash is inside of the bins before they arrive.
Pool Cleaning and Gardening Services:
Pool service is Tuesdays and Fridays and Gardening service is on Wednesday or Thursdays.
PERSONAL BELONGINGS: We are not responsible for any personal belongings left behind. If you leave something behind, we will not ship it to you unless you provide a label and mailing instructions along with providing insurance on any item that you want to be shipped back. We are not responsible for any item we ship to you that does not make it to its destination. The fee for shipping an item to you even if you provide a label is $50.
THEFT OR DAMAGE - In the event of theft from or damage to the property caused during my stay, I authorize the owners upon inspection, to notify me and charge my credit card for up to $5,000 to cover repair or replacement of property.
Please understand that our homes are located in the desert, where wind, dust, extreme temperatures, bugs, animals, wildlife, mother nature, and other similar conditions may occur and are outside of Luxury Desert Escapes’ reasonable control. While we do our best to maintain the property and all amenities at the highest standard, certain amenities or outdoor features may become unavailable, non-operational, broken, shut off, or restricted due to weather, safety concerns, maintenance issues, utility issues, high winds, acts of nature, wildlife, insects, or other conditions outside of our control.
Guest safety is our number one priority. Management, property ownership, weather conditions, maintenance professionals, or safety concerns may require an amenity to be turned off, restricted, repaired, or removed from use at any time during a stay. Because these issues can happen unexpectedly, Luxury Desert Escapes may not always be able to provide advance notice if an amenity or feature will not be operational or available during your reservation.
Cancellation By Luxury Desert Escapes. If for any reason the Accommodation you booked is unavailable, including, but not limited to, issues related to safety, utilities, maintenance, guest overstays, weather or inaccessibility, accidental double booking on multiple platforms, Property ownership changes, permitting, licensing, or regulatory changes, or other reasons, Luxury Desert Escapes may substitute a comparable unit or allow Guest to cancel and receive a full refund, or, if no comparable unit is available, Luxury Desert Escapes may cancel the reservation and provide a full refund of all payments made by you.
Check-out Instructions:
DIRTY LINENS: Please gather all your towels and place them in the laundry and start a load if you can before leaving. We would appreciate it.
BEDS: Do not make the beds, leave all beds as is.
KITCHEN: Please do not leave dirty dishes in the sink or on the counter. Please rinse off the dishes, place them in the dishwasher, and start it. Any rinsed leftover dishes are to be left on the counter.
DOORS/WINDOWS: Please make sure all doors are locked before leaving.
USE OF POOLS, HOT TUBS AND DOCKS: The use of swimming pools, hot tubs, and spas, docks, ponds, lakes, beaches and any accessory or related equipment, while providing exercise, recreation, and relaxation can be inherently dangerous. You and your guests are strongly cautioned to adhere to the following safe practices: 1. No diving into the pool or hot tub or spa; 2. No intoxicated persons may use the pool or hot tub or spa; 3. No use of glass containers by the pool; 4. No one should use the pool or hot tub or spa alone; 5. Children may never be left unattended when they may gain access to the pool, pond, hot tub or spa, not even for a few seconds. 6. No Swimming in Pond 7. Waterslides are feet first sitting straight up 8. No one shall ever jump off a waterslide, climb on a waterslide, or dive off a waterslide. If these rules are not followed then death or injury may occur
RELEASE & WAIVER OF LIABILITY AND INDEMNIFICATION AGREEMENT. Renter shall indemnify, defend and hold harmless the property owner, its respective affiliates and partners from and against all demands, suits, judgments, settlements, claims, damages to persons and/or property, fines, liens, losses, and other liabilities, including attorneys' fees arising out of or in any way related to your stay in our property and its surrounding land including claims for loss or damage to any property or for death or injury to any individual. All the homes are privately owned; the owners are not responsible for any accidents, injuries, or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. If you leave any items behind, we will not be responsible for the item(s) and we will not responsible to ship them to you. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to the property.
Waiver and Release
By purchasing or utilizing any Concierge Services, you hereby release, waive, discharge and covenant not to sue Luxury Desert Escapes, Inc. or its trustees, directors, officers, employees and agents or representatives from any and all liability, claims, demand, actions and causes of action whatsoever arising out of or related to any accidents, loss, damage, illnesses or injury, including death, that may be sustained by you or your guests, or any of the property belonging to you or your guests. You agree that Luxury Desert Escapes will not, under any circumstances, be responsible or liable, directly or indirectly, for any claim, damages or loss related to your use of the Concierge Services.
You acknowledge and understand that some of the Concierge Services offered by Luxury Desert Escapes may be dangerous or inherently dangerous, and your participation in such dangerous or inherently dangerous activities is at your own risk.
You acknowledge and understand that you are responsible and liable for your own acts and the acts of anyone you invite to join or provide access to the Concierge Services. If you are booking for an additional guest who is a minor, you must be legally authorized to act on behalf of the minor and agree to be solely responsible for the supervision of that minor.
In compliance with the City of Indio ORDINANCE NO. 1665 section 37.011 OPERATIONAL REQUIREMENTS AND PERFORMANCE STANDARDS ESTABLISHED; It is required that the primary overnight and daytime occupant of the short -term vacation rental to be an adult 21 years of age or older.
If You have purchased a Waivo® Damage Waiver (“Waiver”) then the following terms and conditions are now part of Your vacation rental agreement.
Damage Waiver:
I. AGREEMENT
On behalf of XXXX Vacation Rentals, the party authorized to rent the vacation rental property and the owner of the vacation rental property, Waivo has assumed the responsibility for damages as outlined below up to $X,XXX, the Waiver limit purchased by or for You, the renter, for your stay at the vacation rental property. Waivo is hereby responsible for direct damage to real or personal property of the vacation rental property as a result of Your acts or omissions. Waivo will reimburse the lesser of the cost of repairs or the cost to replace the property up to $X,XXX. This Waiver does not negate your responsibilities as a renter for items outside of Waivo’s responsibilities. This is not an agreement to provide insurance.
II. EXCLUSIONS
This Waiver will not reimburse for theft, or damages resulting from: Acts of God Prior damage, cosmetic damage, marring or normal wear and tear Loss of use of the vacation rental property Rodent, termite, infestation, or wild animal Damage to a motorized vehicle Fine art, collectibles, or sets of items Consequential loss This Waiver will not reimburse for damage or theft of property owned by You. This Waiver will not reimburse for costs associated with odor, debris removal, backups of sewers and drains, clogged plumbing, excess trash, laundering linens, spa/pool maintenance, landscaping, maintenance or mechanical breakdown.
III. CONDITIONS
Waivo has the sole authority to determine the nature and extent of damages, necessary repairs, and eligibility for the Waiver. Waivo reserves the right to determine if damage is eligible for reimbursement at actual cash value. This Waiver will reimburse for assembly of replacement furniture up to a maximum amount of $50.00 US Dollars. This Waiver is only effective for a one-time single continuous stay, for which You purchased the Waiver. It takes effect when You occupy the vacation rental property and terminates when You depart the same vacation rental property. This Waiver is only effective if damage is reported to Waivo by You, the property manager, the online travel agent or the owner of the vacation rental property within 14 days of Your departure from the vacation rental property. Waivo will not respond to damage under $50 US Dollars. If there is a dispute related to these terms, mediation is required before any party may file litigation. In the event of litigation, all parties waive the right to a jury trial.
IV. DEFINITIONS
You, or Your, is the renter of the vacation rental property and includes the renter’s spouse, children and any other person You invited on to the vacation rental property during your stay.
