House Rules and Rental & Damage Policy Agreement
These rules/policies are in place to ensure that all guests have a safe, enjoyable and relaxing stay with us and can fully enjoy the accommodations and amenities provided. It is important that you take the time to read and understand these rules and policies, not only for the protection of our business and property but even more importantly for everyone’s safety & enjoyment which we take very seriously. By booking this property, you agree to the following Rental and Damage Policies. When you complete your Booking, you accept these Terms and any other ones that you're provided with during the booking process.
AGE REQUIREMENTS. To rent from Stay Twin Lakes LLC you must be 18 years of age or older. Parents or others may not “absentee” book for others to avoid these age restrictions.
PAYMENT AND DEPOSIT. At the time the reservation is made, the full stay will be charged to the credit card provided. Credit card information will be held for damage liability until the room has been cleaned and inspected. If credit card on file is not sufficient to pay for damages, liabilities or other incurred charges, Guest agrees to provide additional funds in the form of cash, check or additional credit card. Returned/bounced checks will be charged an additional fee of $20.
CANCELLATIONS. Full refund for cancellations up to 30 days before check-in. If booked fewer than 30 days before check-in, full refund for cancellations made within 48 hours of booking and at least 14 days before check-in. After that, 50% refund up to 7 days before check-in. No refund after that. A no-show is an automatic forfeiture of charges.
CHECK-IN / CHECK-OUT POLICIES. Check-in time is 4:00 PM or after. Check-out time is10:00 AM. Late check outs and early arrivals are subject to availability and must be approved by management. Late checkout without approval from management is subject to fines of $30 per hour and housekeeping staff is permitted to enter the premises and begin cleaning if needed.
QUIET ENJOYMENT. Quiet hours are 10:00 PM - 8:00 AM. We ask that all groups be respectful of other guests in neighboring cabins as well as local residents by maintaining a reasonable level of noise which includes music and outside conversation. The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner. The Guest is expected to behave in a civilized manner and shall be good neighbors with any residents or guests of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of rental agreement. Any small gathering must comply with other rules set regarding noise. Guests and any visitors are to comply with parking regulations.
PETS. We are dog friendly, please no cats. There is a $10 pet fee per night. Dogs must be listed in the rental agreement. You must clean-up after your dog both inside & out. Additional clean-up by our crew will incur cleaning fees. We ask that you don’t allow dogs on the furniture, however, you may bring your own sheet or blanket to cover the furniture. Please make certain your dog remains on this covering. Guests are responsible for any damage as a result of keeping a pet on the premises. Damage is not covered by pet fees and must be paid for by the guest at time of departure. Any damage caused by a pet is subject to charges per our damage policy. Dogs who wander away easily should be leashed at all times when outdoors. Free roaming dogs must remain attended to and close to the owner while outside the cabin. This is for the consideration and safety of all guests and pets, including your own as we sometimes have coyotes, bears and mountain lions in nearby areas. We allow service animals, with proper documentation provided to us prior to check in. Registered service animals will not acquire a pet fee with the proper paperwork.
TRASH. The Guests shall dispose of all waste material generated during the Lease Term in the dumpster near the back alley behind cabin 4. Code will be provided. Due to bear activity, Dumpster is required to remain locked at all times. DO NOT leave food (human or pet) or trash in any outside area. We are in a rural area and have wildlife including bears that can be dangerous to guests and pets.
PARKING. Please park in front of Stay Twin Lakes perpendicular to Highway 82. Guests are not permitted to park in front of the Twin Lakes General Store or Perkolated Peaks (our neighbors to either side). Overflow parking is located across the street on Hwy 82 or in the Visitor’s Center parking lot. Parking in, or otherwise blocking the rear alley is not permitted. Each cabin rental comes with one parking space, additional vehicles must be parked in overflow parking when not loading/unloading. Parking is subject to local and CDOT restrictions and may be modified without prior notice. *Please note local road closures as a result of the Leadville Race Series and prepare accordingly
SMOKING POLICY. Smoking is not permitted inside any cabin. Evidence of smoking, including odor, will result in a $150.00 cleaning fee. Smoking is permitted outside only and you must maintain proper cigarette disposal. It is the guests’ responsibility to be aware of any fire restrictions that ban smoking and abide by these regulations. Be respectful of guests in neighboring cabins.
INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.
WEATHER. We do not provide refunds or discounts as a result of weather issues (snow, rain, high winds, inclement hot or cold weather, etc.). In the winter months, four-wheel drive is recommended for driving in this area per Colorado traction law. Note that Highway 82 past Stay Twin Lakes is plowed by CDOT.
KITCHEN. If dishes and kitchen items were used, they must be cleaned and returned to the proper location. Coffee maker must be cleaned out & coffee grounds disposed of in trash can.
LAUNDRY. Guests are not permitted to do laundry or otherwise wash garments, bedding, footwear, camping gear or upholstery items in sinks or showers. Laundry is permitted in cabins that have a washer/dryer included. Other laundry services may be available, please reach out to management.
SPACE HEATERS. Please turn off space heaters when you leave the cabin. This does not apply to electric baseboard heaters which can be left on at a reasonable level if needed.
FIRE PIT. Outdoor fires must be contained to the designated fire pit. Do not leave fire unattended. Use caution especially around children. Children under 16 must be supervised by adults. Guest assumes any and all liability involved in starting, maintaining and extinguishing a fire. Use of an accelerant is not permitted. Do not remove hot ashes or coals from your fire pit. Do not throw any trash in fire pits. Do not leave fire to burn out on its own. Guests are responsible for properly extinguishing fires. Firewood is not provided; you must supply/purchase your own. Gathering wood, branches, downed trees, etc. from neighboring areas is not permitted. It is the guests’ responsibility to be aware of any fire bans or restrictions and act accordingly.
OUTDOOR GRILL. It is Guests’ responsibility to safely operate and clean outdoor grills. Guests assume any and all liability involved with use and cleaning of grills. Grills must be properly cleaned after use, as leftover food and grease can attract bears.
LAKE & FISHING. There is no lifeguard. Swimming and recreation (winter and summer) are at the guest’s own discretion and all guests assume liability for risks and injuries. Colorado fishing license required for all types of fishing (purchase online from Colorado parks and wildlife)
HUNTING/FIREARMS/FIREWORKS. Firearms may not be discharged on property. The use of fireworks on the property is prohibited.
TENTS / TEMPORARY STRUCTURES. We do not allow the erection of tents or temporary structures including mobile homes or pop-up campers without prior approval. The cabin occupancy limits are as posted for each cabin and cannot be increased by tents, campers, etc.
MOTORIZED RECREATIONAL VEHICLES. If you are traveling with the intention of bringing recreational vehicles, please be aware you may need to use overflow parking in the Visitor’s Center lot across the street. We do not allow motorized recreational vehicles to be used on the grounds. This includes quads, dirt bikes, go karts, snowmobiles, etc.
HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired. Guest agrees to assume all responsibility for any accident, injury or damage that may result in or about the premises, to persons or property including those of renter’s guests. The renter agrees that the owner and its agents shall not be held liable, or responsible for such injury, accident, or damage. Renter assumes all risk involved and agrees to hold harmless and indemnify the Owner and its agents from any and all claims and liability of any nature which may arise by reason of the use of the renter or others during renters occupancy. Renter assumes responsibility of all guests during the reservation time.
USE OF PREMISES. The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.
SUBLETTING. The guest does not have the right to sublet the Premises.
ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund.
POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. Guests are recommended to secure their vehicles and lock their doors when away from their cabins. After a period of 30 days, left items will be properly discarded in any manner deemed appropriate, with the exception of food & beverage items, which will be disposed of upon cleaning of the cabin. You can make arrangements to pick up your item. If you would like the item/items shipped to you there is a $10.00 handling charge plus the cost to ship the item.
WEATHER AND OUTAGES. We do not offer refunds for issues relating to inclement weather, utility outages, or amenity malfunctions. Please notify management as soon as possible if you experience an issue. If you experience an outage or service interruption of any kind, please let us know and we will work with the appropriate providers to remedy the issue as soon as possible.
PESTS. We perform regular pest control maintenance on all of our cabins. Our area experiences seasonal increases in certain insect/animal activity which can include flies, wasps, bees, mice, bears, ground squirrels etc. We do not have control over this and cannot issue refunds due to this. If you encounter a pest issue during your stay, please notify us and we will make every effort to make you more comfortable. Do not leave doors to your cabin open for long periods of time, as this can encourage pest entry. Please remember that nature is an integral part of the beauty here and that we will do our absolute best to maintain the balance of human need/comfort within the natural environs.
MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings. Damages and repairs are subject to Booking Income Loss. The Guest is responsible for covering the loss of booking income if the property is unrentable as a result of damages caused by the booking party or anyone that they allow on or in the property. The Booking Income Loss will be measured starting from the time of occurrence of the covered loss and ending when the covered accommodation can be made ready for habitation under the same or equivalent physical and operating conditions that existed prior to the damage.
ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.
DAMAGES. All guests are required to leave the premises in a clean, undamaged condition. The booking party assumes all liability in regards to any damages to the cabin during their stay and are responsible for the guests staying with them. Any cleaning fees, damages, missing item charges, or booking income loss caused by any guest will be assumed by the booking party. Inventory is taken before your arrival and upon your departure and any items found missing, moved to another cabin or damaged will result in additional charges. Excessive cleaning, both inside and outside your cabin will result in a $45 per hour cleaning fee.
Excessive cleaning can include but is not limited to: *Trash that is not bagged and put in proper receptacles. *Kitchen items that have not been washed and returned to their proper location, or items that have not been thoroughly cleaned and need to be rewashed *Clean up of bodily fluids or matter of any kind. If someone in your cabin has become ill and you require the use of cleaning supplies or disposable towels not in your cabin, you may call us and we will provide them for your use. If you use the towels or linens that are left for general use for this, the cost of those items will be billed to you as they will need to be replaced. *Carpet, curtain, or surface cleaning beyond normal means. *Laundering or air purification due to smoking, or evidence of smoking in the cabin.
Damages can include, but are not limited to: *Damage to the septic system due improper disposal of restricted items. Do not flush anything other than toilet paper and natural waste. Do not flush wipes or feminine products even if they are labeled flushable. Do not put food waste down the kitchen drain, including but not limited to small solid waste (like coffee grounds) and grease/lard. *Any damages to the property, furniture, or any amenity that provides a use or is decorative, will result in charges. If a cabin is rendered unrentable due to damages, cleaning, or missing items that are necessary to make it rent-ready, charges for days out of commission may be applied. Any fees for such damages will be taken from the refundable deposit if one was required, and any remainder returned. If damages exceed the amount of the deposit, the difference will be billed to the credit card on file. For units not requiring an additional deposit, damages, excessive cleaning fees or missing items will be billed to the credit card on file or require additional payment by guest until all costs have been covered. The booking guest agrees to this, and will be provided a list of fees, damages and/or missing items with amounts to repair/replace the items upon request.
