Possession: Guest acknowledges that check-in time is no earlier than 4:00PM on the “Arrival Date”. However, it is mutually agreed that Broker, Owner, and/or their agents, designees, contractors, or employees may remain on the premises until 8:00 p.m. on the Arrival Date for cleaning and repairs, when necessary. Guest understands that Guest does not have exclusive possession and control of the Property during the rental period. Broker and/or Owner may access the Property at any reasonable time with reasonable notice to Guest in order to perform inspections or conduct repairs. Guest agrees to surrender possession of the Property hereby rented at check-out time on the “Departure Date”, without delay and in the same condition as it was at the commencement of this Agreement, reasonable wear and tear and Acts of God excepted.
Damage Waiver: All Confirmation Agreements are subject to a non-refundable Accidental Damage Waiver. The cost of such Waiver is set forth in this Agreement. The Accidental Damage Waiver covers up to $1,000 in accidental damage to the Property or its contents (including furniture, fixtures, and appliances), provided that the incident is reported to Broker before check-out. The Accidental Damage Waiver does not cover intentional acts, gross negligence, willful misconduct, damage caused by or evidence of pets or other animals brought onto the Property (where authorized), loss of use, damage caused by unauthorized groups, loss or damage of Guests' personal property, rental equipment brought onto the premises, criminal activity, or charges for extra cleaning. Broker will determine all necessary repairs. Please report accidental damage as soon as it occurs so Broker can assess and minimize the extent of the damage.
The Accidental Damage Waiver only covers damage that occurs during the authorized rental period and is reported by Guest or another authorized occupant of the Property before check-out. The Waiver does not cover damage to any structure other than the Property associated with the confirmed reservation. Damage exceeding $1,000, as well as any uncovered damages, are the responsibility of the Guest and will be charged to Guest’s credit card on file. The Accidental Damage Waiver program is provided and administered by Broker and is not an insurance policy. It does not provide coverage for liability, injuries to Guest, their family, invitees, guests, or pets, and does not cover vehicles or personal items.
Default: If Guest fails to pay rent when due or otherwise violates any provision of this Agreement, and such failure or violation continues after notice of default is given, Broker and Owner may choose to: (a) continue the Agreement in effect and enforce all rights and remedies, including the right to recover rent as it becomes due, or (b) terminate all of Guest’s rights under this Agreement and recover from Guest any damages incurred as a result of the breach, including the costs of recovering the Property, eviction of Guest, and any other relief available under Delaware law. Any rent paid up to the time of default shall be forfeited and retained by Owner as liquidated damages.
Cancellation: Per Airbnb terms and conditions
Residential Usage: Guest agrees the property shall be used solely for residential purposes by Guest and the family and/or invitees of Guest.
No Assignment or Subletting: Guest shall not assign this Agreement. Guest shall not sublet the Property or any portion thereof.
Misrepresentation: Guest acknowledges that Guest has either personally inspected the Property and accepted it “as is” or has waived the right to inspect the Property. Guest hereby waives the right to withhold rent for any alleged deficiency in the premises or to claim that the Property has been misrepresented to Guest by Broker or Owner. Broker and Owner make no warranties or representations regarding the condition of the Property and no refunds will be given.
Maintenance, Housekeeping, and Property Conditions: Guest agrees to contact Broker immediately using the contact information provided at check-in and in this Agreement upon noticing any maintenance or housekeeping issues. Guest further agrees to allow Broker a reasonable amount of time to respond and to cooperate with Broker's efforts to address the concern or provide a remedy. Broker or its employees, agents, and contractors may enter the Property, with advance notice to Guest, to address any reported problems. Guest agrees to indemnify and hold Broker, Owner, and their agents, employees, and contractors, harmless from any claims for damages, loss, injury, or claims of any kind, no matter how caused, except for injury or damages caused by willful act or gross negligence of Broker, Owner, or their affiliates, during or relating to their stay upon the Property.
Good Neighbor Policy: Guest agrees to abide by any town, building, community, Homeowner’s Association (HOA), or Condo Owner’s Association (COA) rules and regulations. Emotional support animals are not permitted unless authorized by Broker and Owner as provided herein. Guest agrees that a prohibition on animals is not a guarantee that an animal has not been inside the Property or that the Property is free of animal or pet allergens.
Linens: Guest agrees to furnish all linens including bed sheets and bath towels (unless a linen package was ordered), as well as kitchen towels, additional blankets, beach towels, toilet paper, paper towels, bath soaps, and dish and laundry detergent. Most pools are open from Memorial Day to Labor Day, though some may not open until mid-June. No refunds will be given for pool closures. Additionally, some communities may charge an additional fee, to be paid by Guest, for the use of amenities.
