HOUSE RULES AND RENTAL AGREEMENT
These rules are part of a rental contract between the guest (“you”) and the property owner, or the property owner’s designee (“we” or “us”), and may be referred to as the “agreement.” By completing a booking, you agree to follow these rules and policies, in addition to any rules, policies, and/or terms of service as defined by Airbnb.
GENERAL RULES OF CONDUCT
— You are responsible for the members of your party and you agree to share the terms and requirements of this agreement with them and anyone else you permit onto the property.
— No smoking on the property.
— All overnight guests must be included in the guest count on the reservation.
— Daytime visitors are allowed, but may not exceed one visitor per registered overnight guest without our written permission.
— Maintain the property in a generally clean and safe condition and return it to us in the same condition in which you received it; do not move furniture, make alterations, disable cameras or smoke detectors, litter, or allow excessive trash to accumulate indoors.
— Keep noise to a respectful level and do not disturb our neighbors.
— Do not put anything down the drains that may cause clogging of the drains, including “flushable” wipes (they really are not flushable), baby wipes, or hygiene products.
— Do not use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation.
— Some properties require trash and recycling bins to be moved out to the street for pickup. If this is the case, we will send a message the day before the pickup day; you agree to move the trash and/or recycling bins out to the street for pickup and bring back the empty bins following the pickup.
— We will provide about one week of consumable supplies (coffee, paper products, etc.). When these supplies run out, you are expected to purchase your own, or contact us for housekeeping of the property (for an additional fee).
BOOKING REQUIREMENTS
— Some of our properties require guests to complete additional steps after making a booking through Airbnb; this may apply to bookings of 30 nights or more, bookings for larger groups, short notice bookings, or bookings from guests with few prior Airbnb reviews. The additional requirements may include one or more of the following:
—---- Paying a refundable security deposit (between $300-500), which may require you to re-enter your credit card into our separate property management system. Airbnb does not actually charge a security deposit to your payment method; this confirms that the funds are available and places a hold on those funds.
—---- Purchasing supplemental damage protection insurance.
—---- Signing (e-signing) a supplemental rental agreement and uploading a driver’s license or ID into our separate property management system.
— We may, at our discretion, within 48 hours of a new reservation being made, cancel and refund your reservation or inquiry, for any of the following reasons:
—---- You have failed to complete payment for the reservation and/or security deposit
—---- You live in the local area of the rental property and have not provided sufficient reason for making the booking
—---- You have made a booking within 72 hours of the arrival date and have not provided sufficient reason for making the booking
—---- Your provided identification does not match the name on the payment method
—---- If we have reason to believe that you have violated or will violate any of the other terms of this agreement
RIGHT OF ENTRY
— You grant us permission to enter the premises for the following reasons:
—---- For any emergency inspections or repairs that impact safety or access (such as replacing the batteries in a keypad lock), or for any repairs and/or alterations that you have requested; in this case we will provide written notice and may enter during reasonable daytime hours.
—---- If we believe that you are in violation of any of the terms of this agreement, or have caused damage to the property; in this case we will provide written notice that we will be entering to inspect the property.
—---- If your stay is 7 nights or longer, we will provide at least 24 hours notice and may access the property during reasonable daytime hours for the purpose of showing the property to potential future renters; this will be limited to 2 showings per week.
—---- If the property is for sale, and this was displayed to you at the time of the booking, you grant access to potential buyers and/or inspectors associated with the sale of the property during reasonable daytime hours; you will be given written notice of appointments.
CANCELLATIONS, ALTERATIONS, DISCOUNTS
— If both parties agree in writing to change the dates of the reservation, the terms of this agreement will apply to the new dates.
— Our cancellation policy also applies to requests to change dates or shorten stays; you may not be eligible for a refund if you need to change dates or shorten your booking.
— For alterations where our policy does not allow for a full refund, we will make reasonable efforts to re-rent any dates that you cancel. If we are able to re-rent any of the unused nights, we will issue a refund of 30% of the nightly rent rate that you paid for those nights.
— Dates that are added to existing stays will be charged at our published nightly rate at the time of the alteration request. This may be higher or lower than the previously booked rate. Stay extensions will not make the entire booking eligible for weekly/monthly or any other length-of-stay discount.
— Stays that are booked and then later shortened may no longer be eligible for length-of-stay discounts; resulting in an increase to the average nightly rate.
— For stays of 30+ nights, if you would like an option to extend, please contact us and we may hold future dates for you for possible extensions. If extensions are not accepted by both parties in writing (email or text) at least 15 days in advance, we will release those dates.
PETS AND ANIMALS
— If pets are allowed, this will be indicated in the listing details. You agree to enter your pets correctly into the guest count of the booking and to pay any additional fees associated with bringing your pets, which will be displayed on the booking platform at the time of booking. For registered service animals, pet fees will be waived, but we ask that you provide documentation from a medical professional or health care provider showing that the animal is certified to perform a specific work or task. Emotional support animals are not eligible for a waiver of pet fees. No animals may be left alone at the property unless they are in a secure crate or enclosure.
ISSUE RESOLUTION & REFUNDS
— In the event of an issue at the property related to maintenance, safety, cleanliness, or the unavailability of advertised amenities, you agree to notify us in writing (via Airbnb message, text message, or email), and we agree to make reasonable efforts to resolve those issues. If we are unable to address an issue that you have reported to us within 24 hours, you may:
—---- Choose to stay in the property and request a partial refund, in which case, we will issue a refund, at our discretion depending on the severity of the issue, of up to 30% of the accommodation value of the nights of your stay that were impacted, or:
—---- Choose to relocate, in which case, we will issue a full refund of the accommodation value of all remaining nights of the reservation (and the cleaning fee, if the issue is reported on the day of arrival and you vacate that day), provided that you officially cancel or change the dates of your reservation with the booking platform to reflect that you have vacated.
— No refunds will be given for issues that we are able to reasonably resolve within 24 hours, or for utility outages (electric, gas, water, internet) lasting less than 24 hours, or for weather conditions, noise, traffic, or any other issue in the neighborhood beyond our control, or for mandatory evacuations of the area.
BREACH OF CONTRACT / CHARGES
— We may terminate this agreement immediately upon the breach of any of the terms herein; in which case you will not be entitled to the return of any rental monies paid under the terms of this agreement and you must vacate the property immediately. In the event of property damages or violations of this agreement, you agree to pay and/or have the following withheld from your security deposit:
— Unauthorized guests or visitors: $20/person/night for the entire duration of the stay
— Smoking and/or pet waste: $250. This charge may be applied if any evidence of smoking or pet is found anywhere on the property (i.e. litter from cigarette butts).
— Holdover / unapproved late checkouts: $40/hr, after a 15-minute grace period.
— Any costs that we incur from excessive cleaning or trash removal, replacement of any damaged or missing items, repairs to the building or grounds from damage caused by your party or visitors, and/or service call fees related to damage caused by your party or visitors.
— Any costs that we incur from relocating or refunding our upcoming guests in the event that the property cannot be made available in time as a result of your violation of any of the terms in this agreement.
— Cost of shipping plus a $10 handling/packing fee for any lost and found items that you request to have shipped back to you.
OTHER TERMS
— In the event of the destruction or partial destruction of the premises, you acknowledge that the owner’s insurance does not cover personal property damage caused by fire, theft, rain, war, acts of God, acts of others, and/or any other causes; nor does it cover relocation, temporary housing, or moving expenses. You are advised to consider purchasing travel insurance for these purposes.
— You hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify the Owner and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of your own use, your party’s use, or your invited guests’ use of the property.
— In the event that we are unable to make the property available for any reason, you agree that our sole liability as a result of this unavailability is to provide a full refund of all monies paid under this agreement; you acknowledge that in no event shall we be held liable for any special or consequential damages which result from this unavailability.
— This agreement shall be enforced under the laws of the state within which the property is located, including any applicable rental acts of that state, and represents the entire agreement. — Any amendments must be in writing (email or text) and agreed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the property is located.
— If any part of this agreement shall be deemed unenforceable by law, that part shall be omitted from this agreement without affecting the remaining agreement.
— If any legal action or proceedings are brought by either party of this agreement, the prevailing party shall be reimbursed for all reasonable attorney's fees and costs in addition to other damages awarded.
