Rental Agreement
Fee's Charged by Third Party Booking Sites are NOT Included
This occupancy will be in the form of a Vacation Rental only and does not constitute a permanent or primary residence or other tenancy. Occupancy shall begin on arrival date and end on departure date listed above. This is agreement is made directly with VRBP and has no affiliation with the onsite rental office. The following are the specifics of this agreement:
CHECK-IN/CHECK-OUT: The check-in time is 3:00 pm forcondo's and 4:00 for homes. The check-out time is 10:00 am. GUEST agrees to such time periods so the property may be properly cleaned for the next guest. If you have a vehicle, please register it with the main office if applicable or pick up the parking pass with your keys at Vacation Rentals Beach Properties’ office, located at:
6233 A1A South, St. Augustine, Florida.
Please advise if you expect late arrival after 5 p. m, contact our office at on the day of arrival. Also you will need a valid I. D. and credit card at check-in.
CANCELLATIONS: Cancellations must be made in writing at least thirty (30) days prior to the scheduled arrival date. You will forfeit your reservation deposit and rental rate if you cancel less than (30) days and VRBP is unable to re-rent the property. If re-rented, all funds will be returned within thirty (30) days of the new booking date, minus a $50. 00cancellation fee. A cancellation fee of $50. 00 will be charged to any guests that cancel to cover all administrative fees.
ADDITIONAL CHARGES: All "Normal" utilities are included. Tenant will be charged additional fees for the following: long distance phone charges, fines or summons imposed as a result of your actions or your guest’s actions, any damage to the premises, contents, grounds or dock, excessive utilities, water, electric, to include excessive cleaning, disassembly of any electronic components to include surround sound, televisions, phones or stero systems, etc. Anything requiring service or action by owner or agents as a result of guests actions. The phone will be blocked from long distance and 900 number calls. A calling card or credit card will be required to make long distance calls. Toll free calls are assessable. *SOME UNITS OFFER FREE LONG DISTANCE FOR THE U. S. AND CANADA. PLEASE ASK ABOUT YOUR RENTAL.
Balance Due: The balance of your payment is due no less than 30 days before arrival. 30 days prior to arrival Vacation Rentals Beach Properties will automatically charge the balance to the credit card on file that was used for your reservation deposit. If we do not receive the balance 30 days prior to arrival, your reservation is subject to cancellation and forfieture of your reservation deposit. If you reservation is booked within 30 days of arrival, the full balance will be due upon booking.
PETS: Pets are allowed at some homes and condo's with prior approval and for an additional fee of $100. 00 per pet. The maximum number of pets is 2. Pet owners must pick up droppings, keep pet leashed when outside and keep pets off of furniture and bedding. The pet(s) must also be kenneled if left alone in the home. If we find that you have left a pet alone unkenneled, there will be a $250 fine charged to the credit card on file.

Parties found with pets without prior approval will be asked to leave immediately without refund and will pay the pet fee of $100. 00 per pet and will also be charged a $500. 00 fine which will be charged to the credit card on file.

The Damage Protection does not cover any pet-related damage.
RETURN CHECK FEE: A fee of $150 will be charged for a returned check for insufficient funds.
GUESTS/PARTIES/NOISE: The GUEST must supervise any other guest(s) while on the premises. Noise in the premises must be kept to a reasonable level as not to cause a disturbance to the neighbors or general public. In no event may the maximum occupancy be exceeded without our written consent.
LOCKOUT CHARGES: A lockout consists of when a guest locks themselves out of a property and needs assistance from our staff to re-enter. A minimum charge of $50. 00 will be charged for all lockouts outside of business hours.
NO SMOKING POLICY: No smoking is allowed inside the premises whatsoever. If evidence is found of smoking in unit,Guests will be charged $500. 00 for violating the NO Smoking Policy.
CLEANING: Please start a load of laundry prior to departure. Please discard used food from the cabinets and refrigerator, and all recyclables placed in the container in outdoor bins. Please remove the trash from the premises and put in the appropriate bins. Please load and start the dishwasher upon departure.
MAINTENANCE: Every effort is make to keep each property and its equipment in good working order, but just like with your own home, failures to occur. Please notify Vacation Rentals Beach Properties of any maintenance problems or difficulty you experience during your stay as soon as possible so repairs can be scheduled. If our office is closed you may always reach staff at our emergency phone.
- Please remember NO REFUNDS/REBATES will be given for mechanical failures. However, if there are failures to necessary systems (such as water, hot water, heat, or septic systems) that cannot be resolved in a timely manner, we will make every effort to provide alternative accommondations or compensation. We appreciate your understanding.
MAINTENANCE: It is expected that major systems in the premises will break down from time to time such as air conditioning, refrigerator, etc. VRBP will make every effort to have the issue repaired as quickly possible upon notice by the tenant to VRBP. Owner and VRBP assume no liability to guest if such should occur as all products have a useful life and break down occasionally.
TENANT RESPONSIBILITIES: Please report any issues with the unit immediately to VRBP.
SUBLETTING/ASSIGNING/OCCUPANCY: There shall be no subletting of the premises. The GUEST shall occupy and use the premises as a vacation residence only and not use the premises for any business, professional, unlawful or hazardous purpose.
END OF TERM: At the end of the term, the GUEST shall leave the premises clean and in good condition, remove all GUESTS property, repair unreasonable damages caused during their stay.
HOLD HARMLESS AND INDEMNITY: Guest hereby agrees to indemnify and hold VRBP harmless for injuries or other losses to Guest and other persons and property that may occur in connection with Guest's use of the Premises. Guest further agrees that, as agent for the owner of the Premises, VRBP has no control over the condition of the Premises and, furthermore, that VRBP is not under any obligation to accept for safekeeping any moneys, securities, jewelry or other articles of personal property belonging to Guest, nor is VRBP liable for any loss in connection with any such items, or for providing security for the Premises. VRBP will cooperate in forwarding any complaint or concern of Guest to the owner of the Premises, but shall not be obligated to correct any condition or hazard associated with the Premises. All property information is provided by the individual property owner and is true and accurate to the best of VRBP’s knowledge, however guest agrees to indemnify and hold VRBP harmless for any property information errors due or changes due to maintenance or owner's removal of items from the home or premises. We have made every effort to ensure that all information on VRBP’s website is correct and accurate.
OCCUPANTS: The occupancy of the premises is limited to the number of persons and particular persons described in this agreement. The maximum occupancy is ________ ( ) persons including babies and children. IfGuest exceeds the maximum occupancy,Guests and any/ all guests are subject to immediate removal and forfeiture of their security deposit and rental payment. If tenant exceeds the maximum occupancy without owners consent, tenant will be charged $100. 00 per day, per person that exceeds the maximum rental. In addition, no boats or trailers are allowed to be parked on the property. The guest must seek storage of the trailer(s) offsite at a proper trailer storage facility. A maximum of _____ vehicle(s) are allowed to be parked on the property.
ACCESS: Guest may be asked to allow access to the premises and property upon the request of VRBP and/or owner and his agents. Agents, to include, but are not limited to: plumbers, electricians, rental companies, maintenance, pest inspection, etc.
SAFETY: Guests acknowledge and agree that they are responsible for the safety of themselves, their guests, and their children with respect to the pool and beach. Guest acknowledges and agrees to hold owner harmless from any injuries to them or their guests. It is understood that there is no lifeguard and that supervision is his or her responsibility.
KEYS: Keys can be picked up on day of check-in at VRBP’s office. The keys must be returned upon departure. We do charge for lost keys. There will also a fee for lost beach/gate access card at the rate determined by the premises association. Failure to return keys to rental office will result in a charge of $25. 00 for keys and $100. 00 for each access card.
AGE REQUIREMENT. Guests under the age of 25 unaccompanied by a parent or legal guardian will not be permitted to rent or occupy any vacation rental home from Vacation Rentals Beach Properties. Any reservations made under false pretenses will result in loss of advance payments and removal from the premises.
HOUSE PARTIES/QUIET HOURS: All of our properties are privately owned and our management agreement with our owners prohibits house parties. Any guest abusing this policy will be asked to leave immediately with no refund and an additional $500. 00 will be added to the rental fee. In general, neighbors are not tolerant of noise after 10:00 pm. Please make sure that, after this hour, music and voices are not audible outside of your rental.
LAWS: The Laws of the State of Florida shall apply to all terms under this Agreement. Venue for enforcement shall be in Saint Johns, Florida for any dispute under this agreement. It is expressly agreed and understood that this agreement shall not be recorded in the County Clerk’s office. This agreement is made and shall be governed in the county of Saint Johns, Florida under Chapter 509, Florida Statutes.
LIABILITY: Guest may be responsible and liable to owner for damages in excess of the damage protection for any damage or loss caused by guest or their guests. No refund will be given for weather conditions, or Acts of God or nature. Should the unit be rendered uninhabitable for any reason prior to the arrival date, every effort will be made to move the guest’s reservation to another unit or the rental agreement will be voided and refunded to the tenant.
DAMAGE CHARGES. Your credit card information will be kept on file during the term of your stay in our St. Augustine office for use as a "security/damage deposit" to insure compliance with the terms of the Rental Agreement. If, after inspection, it is determined that the condition of the rental you inhabited is beyond normal wear and tear, or contents are missing from the unit, Guest agrees to accept all liability and understands that these costs will be charged to the Tenant's credit card, to include an applicable administrative fee. Amounts may also be charged to cover unnecessary service calls, unreturned keys, or remotes to our St. Augustine rental units. Please report any problems or damage in your unit the day of check-in. If not reported, we must assume the damages occurred during your occupancy of our rentals. Vacation Rentals Beach Properties determination of damages will be conclusive.
RENTAL DAMAGE PROTECTION. This Vacation Rental Damage Protection covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out. The policy will pay a maximum benefit of $1,500. 00 for homes and $1,000 for condo's. Any damages that exceed $1,500. 00 will be charged to the credit card on file. Certain conditions apply. By signing this document you agree to charge the credit card on file for any damage that is not coverage by the damage protection plan or if the damage exceed the plan's coverage.
RIGHT TO REFUSE OCCUPANCY AND REMOVAL OF GUEST. If Guest violates the terms and conditions of occupancy of the Premises, including without limitation, failure to pay rent as agreed with VRBP, failure to check out of the Premises at the time set forth herein (or if such time is extended at VRBP's sole option, at the time otherwise agreed to by Guest and VRBP in writing), causing damage to the Premises, or engaging in prohibited use of the Premises, and Guest fails to pay for, or vacate the Premises upon written or oral request by VRBP, Guest may be summarily removed with the assistance of a Florida law enforcement officer in compliance with Section 509. 141(4), Florida Statutes. In addition, in the case of a large unpaid bill for rental of the Premises where VRBP reasonably determines that such an unpaid bill may not be paid by Guest, VRBP may elect, in addition to all other remedies available to VRBP, to lock Guest out of the Premises until payment arrangements are made in accordance with Section 509. 401, Florida Statutes. In the event a guest fails to depart from the home on time at 10:00 am, forcing VRBP not to be able to clean and prepare the home for the next arriving guest that day and having to move that guest to another home, the departing guest agrees to pay damages and cost incurred by VRBP. VRBP reserves the right to refuse service to any guest for any reason, provided, however, that such refusal shall not be based on race, creed, color, sex, physical disability or national origin.
Maximum Occupancy. The maximum number of tenants is as permitted on the Short Term Vacation Rental Certificate for the property.
Tenant Registration. Provide the name and ages of all persons who will be occupying the unit and the license tag numbers for all vehicles that the occupant(s) will be parking at the unit, with a total number not to exceed the number of off-street parking spaces at the unit as designated on the Short-Term Vacation Rental Certificate.
TELEPHONES, TELEVISIONS, INTERNET AND OTHER AMENITIES: Many, but not all of our rental properties, have telephones, televisions and other amenities. It is your responsibility to double check the amenities listed for the rental property that you have rented. Every effort is made to ensure that the information on our website is as accurate as possible. We are not responsible for incorrect assumptions regarding cell phone coverage, internet access, TV servcie, etc. We cannot guarantee internet, internet speeds, cable TV, satelitte TV, and their functionality and we will not provide any refunds or rebates in cases of failure. We will make every effort to remedy the situation as soon as possible.
FURNITURE: Please do not rearrange furniture or other items at the rental property. These properties are privately owned. You may not agree with theplacement of items, however, this is the arrangement preferred by the owner. If you do move an item or piece of furniture, please return it to its original location up check-out. Failure to return items or furniture to it's original location could result in a charge.
LOST ITEMS: When departing, please check for personal items. Left items that are found can be returned upon request, with a fee for retrieval, processing, and shipping. Unclaimed items will be disposed of 30 days after the guest's departure date.
CERTIFICATION: I or we, the Guest(s), hereby certify and consent that I/we have read all pages of this agreement and conditions and agree to the terms and will comply with them during the course of this vacation rental.
