rentals) and GUESTS (short term rentals)

The right of admission to MARBELLA is at all times reserved
INDEMNITY
The Body Corporate of MARBELLA, its Managing Agents (if so appointed), Trustees and Body
Corporate staff shall not be liable for any injury or loss or damage of any description which an
owner or occupier of a section or any member of his family, or his staff, or friend, acquaintance,
visitor or guest may sustain, physically or to his or their property, directly or indirectly, in or about
the common property or in the individual units by reason of any defect in the common property,
its amenities or in the individual units, or for any act done or any neglect on the part of the Body
Corporate or any of the Body Corporate employees, agents or contractors.
The Body Corporate or its agents and staff shall not be liable or responsible in any manner
whatsoever for the receipt or non-receipt, and the delivery or non-delivery of goods, postal
matter, or any other property.
SECURITY
Residents and their visitors are required at all times to adhere to all security procedures and
practices of the Body Corporate as may be instituted and amended from time to time.
The registration book at security office to be signed on arrival. This applies to visitors as well.
No resident shall permit an unidentified person entry onto the premises of the Body Corporate.
Entering and exiting of persons is the resident’s responsibility.
Guests to be issued with security tag together with apartment keys.
CHILDREN
Children are subject to the Conduct Rules in the same manner as adults.
Tenants and Guests must supervise their children, grandchildren and those of their visitors, to
ensure that
An owner/tenant/guest/visitor may not allow his/her children to interfere or tamper with items that
constitute common property. In particular, children may not interfere or tamper with plants, signs,
lights, gates, doors, firehoses or firefighting equipment, swimming pool equipment and it’s
auxiliaries, electric fence, security cameras and electronic gate and ancillary equipment.
Children are not permitted to play in the corridors & stairways, nor the parking areas, including
the parking bays, at any time.
No ball games are permitted on common property.
The use of soapbox cars, skateboard, bicycles, roller blades, wheelies, and the like, is strictly
prohibited on the common property.
Small children to be accompanied by an adult at all times when in the pool area.
Children are not allowed to climb walls, trees or interfere with electrical devices.
Children to only use lifts under adult supervision.
CONDUCT
Fire extinguishers, of whatever nature, may only be used to extinguish fires and it is a criminal
offence to use them in any other manner whatsoever. Fire extinguishers may not be interfered or
tampered with in any circumstances.
Flammable, or other dangerous material or articles, may not be brought onto the common
property or into a section.
Firearms (unless strictly for reasons of security), including pellet guns may not be discharged or
any part of the property.
No stones, or other solid objects, may be thrown on the common property.
No bottles/cans/bottle tops may be thrown from windows and/or balconies
Cigarette ends and other objects may not be thrown from the windows and/or balconies or
anywhere from or onto common property.
Smoking and consumption of alcohol in all common areas, passages and lifts is strictly
Prohibited.
LIABILITY
Should a resident, his family, his tenants, his domestic staff, his guests, or visitors cause any
damages of whatsoever nature to the common property, the owner or resident shall be liable
to reimburse the Body Corporate for the cost of the repairing such damage
EVENTS / CEREMONIES / PARTIES AND FUNCTIONS
The holding of events/ceremonies/parties/functions of any nature within the apartment or on the
common property is not allowed
No fires are allowed on balconies/exclusive use areas with only electric or gas being Permissible
for cooking /braai purposes.
LAUNDRY
Owners/occupants of sections shall not allow any linen, towels, clothing, or mats to be hung on
the outside of any section that will allow for this to be aesthetically displeasing or undesirable
when viewed from the outside of the section. No items may be attached or hung over any
balustrades Carpets and mats shall not be shaken/dusted/beaten over the balconies or through
windows of the units.
LETTING OF UNITS
All tenants/guests of units and other persons granted rights of occupancy by any owner of the
relevant unit are obliged to comply with these conduct rules, notwithstanding any provision to the
contrary contained in any lease of any grant of rights of occupancy. The owner of the unit in
question shall inform the tenants of the existence of the conduct rules for Body Corporate and
shall provide them with a copy of these rules.
Short term Guests/tenants need to register on arrival at the premises and furnish required
information for individual guests as per security requirements and in accordance with Body
Corporate management and conduct rules.
The maximum permitted occupancy per unit is restricted to two persons per bedroom.
With limited parking facilities, Guests/tenants are required to use the owner’s parking bay/garage
and any additional and/or visitors vehicles may be required to park off premises.
An owner shall not store or leave or allow to be stored or left, any article or thing in any part of
the common property.
In the case of all rentals, no pets allowed on the premises.
LITTERING
An owner or occupier of a section shall not deposit, throw, or permit or allow to be deposited or
thrown on the common property or on any other sections any rubbish, including dirt, cigarette
butts, food scraps or any other form of litter whatsoever
MOTOR VEHICLES, USE OF DRIVEWAYS AND PARKING AREAS
The speed limit for all vehicles on the common property roads at Marbella is strictly 5 km per
hour.
Vehicles may not be driven in the parking area in a reckless manner that creates a nuisance or is
considered by the Body Corporate not to be in the interest of safety.
Hooters shall not be sounded within the common property other than in emergencies.
Vehicles may be parked only on such areas of the common property as are specifically indicated
or approved by the Body Corporate for that purpose and in such a way that the flow of traffic and
access and egress from parking bays is not obstructed. Should a vehicle be parked in a manner
that causes obstruction, the resident will be fined at an amount resolved by the Trustees.
Owners and occupiers of sections shall ensure that their vehicles, and the vehicles of their
visitors and guests, do not drip oil or brake/clutch fluid on to the common property or in any other
way deface the common property.
No trucks, caravans, trailers, boats, or other heavy vehicles may be parked on any portion of the
common property.
Any vehicle parked, standing, or abandoned on the common property in contravention of these
rules, be removed off the property by the owner, and at his expense.
Car alarms that are triggered must be attended to immediately. Should the owner of the vehicle
be absent from the complex, and the vehicle alarm causes a disturbance to the residents of the
complex, the Trustees/Management will be entitled to have the alarm switched off in whatever
manner deemed fit at the expense of the owner of the vehicle.
Parking of vehicles upon the common property is subject to the express condition that every
vehicle is parked at the risk and responsibility of the owner of such vehicle and that no liability
shall be attached to the Body Corporate or its agents or any of their employees for any loss or
damage of whatever nature which the owner, or any person claiming to be such, may suffer.
Sleeping will not be allowed in any vehicle on any part of the common property or parking Bays
and the usage of a garage for living space, is strictly prohibited.
Owners/Guests/Tenants are required to use the owner’s parking bay/garage and any additional
and/or visitors vehicles may be required to park off the premises.
The Body Corporate will not accept responsibility for loss or damage by fire, theft, or any other
cause, of any property, vehicles or motorcycles that are on the property at any time.
PETS
Tenants, Guests and visitors - No pets allowed on property
REFUSE REMOVAL
All household refuse shall be placed in plastic refuse bags and put outside the front door of the
unit before 10h00 daily for collection by Body Corporate staff. Any refuse removal after collection
by Body Corporate staff is the responsibility each resident to move his/her refuse to the
designated bin area and place it in the designated waste bins.
No rubbish or refuse may be left on any portion of the common property or in any section where
it would be visible and/or constitute a health hazard.
Cardboard cartons, packing material and newspaper must be stacked neatly and placed in the
designated bin area. These are not placed in the bins as such.
Sanitary items, disposable nappies and liners shall not be flushed through the sewerage
systems. Such items are to be placed in a plastic bag, sealed, and disposed of with your
refuse/rubbish.
SILENCE AND ACTIVITIES
Reasonable quietness must be maintained at all times. All residents are to observe quiet times
between 21h00 and 08h00 daily and between 14h00 and 16h00 on Saturdays, Sundays, and
Public Holidays.
Radios, televisions, musical instruments, records, tapes, CD players and similar equipment must
be used in such manner as not to be heard in adjacent flats, corridors, or common property, or to
cause disturbance or inconvenience to other residents.
No hobbies or any other activities of recurring character, causing undue noise or nuisance to
other residents may be conducted, such as stripping and repairs to motor vehicles.
No auctions or jumble sales may be held on any part of the property.
Building/renovating activities causing a noise are only allowed to take place on Mondays to
Fridays between 08h00 to 16h00.Any of such activities are not allowed to take place on
Saturdays, Sundays, Public Holidays and during School Holidays.
SWIMMING POOL
A shower and two taps are placed just inside the beach gate. Please ensure all sand is washed
off before using the pool.
All owners, guests and visitors are to adhere to the rules of the pool/braai area as displayed .
For safety reasons glass objects and bottles are strictly prohibited in and around the pool area
Only umbrellas allowed – NO Gazebos.
Small children to be under adult supervision at all times
Owners, Guests, and visitors to be considerate towards others and any form misconduct or
misbehaviour is not allowed.
FINES (annexure A)
Marbella Body Corporate Conduct Rules makes provision for a Fining System in instances of
transgressions by owners, tenants, guests and/or their visitors.
Annexure A is in reference to content of the Marbella Body Corporate Conduct Rules relevant to
owner/guest/visitor being in contravention.
Fines of R1,000.00 in respect of contravention of Conduct Rules as per below stated offences.
