LUXURY GETAWAYS GUEST RENTAL AGREEMENT & HOUSE RULES

THIS IS A VACATION RENTAL AGREEMENT. THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS RELATED TO TRANSIENT LODGING AND EXPEDITED REMOVAL OF GUESTS. YOUR BOOKING, PAYMENT, TAKING POSSESSION OF THE PROPERTY, OR USE OF THE PROPERTY AFTER RECEIPT OF THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF ITS TERMS AND YOUR INTENT TO USE THIS PROPERTY AS A VACATION RENTAL.

This Guest Rental Agreement and House Rules document is entered into by and between you and Luxury Getaways LLC (“Luxury Getaways,” “we,” “our,” or “us”) and details the obligations and responsibilities of you and any of your guests or visitors collectively, “Guest,” “you,” or “your” at any property offered for rent by Luxury Getaways, the “Property” or “Accommodation.”

By booking, making payment, taking possession, or entering the Property, you agree to all terms and conditions in this Agreement, Airbnb’s terms and policies, and any property-specific house rules provided at or before check-in.

You understand and agree that this Agreement incorporates our general House Rules, which apply across all Properties, together with any property-specific house rules provided in the Airbnb listing, arrival instructions, or check-in materials. You are responsible for ensuring all members of your party comply with this Agreement.

CHECK-IN & CHECK-OUT PROCEDURES

Our properties offer direct check-in. Acceptance of these House Rules and payment in full through Airbnb are required prior to arrival. Access codes are generated and transmitted at or near check-in time. Please plan your arrival accordingly.

Check-In — After 4:00 PM Pacific Time: Unless you have arranged and paid for an early check-in in advance through Airbnb, the Property will not be available before 4:00 PM Pacific Time. Early entry will not be permitted by housekeeping or inspection staff for any reason.

Check-Out — Before 10:00 AM Pacific Time: Unless you have arranged and paid for a late check-out through Airbnb, all persons and personal belongings must vacate the Property by 10:00 AM Pacific Time. Housekeeping will enter and begin cleaning promptly at 10:00 AM.

A fee of $100 per hour, one-hour minimum, may be charged if you or your belongings remain in the Property after 10:00 AM Pacific Time without prior approval. Any late check-out fee or related charge will be requested through Airbnb.

CANCELLATION & REFUND POLICY

For reservations made through Airbnb, the cancellation policy stated on Airbnb at the time of booking applies and supersedes any direct-booking cancellation policy.

Luxury Getaways LLC does not issue separate refunds outside of Airbnb due to acts of nature, including but not limited to weather, road conditions, snow conditions, power outages, or forest and wildfire events.

If your reservation was made through Airbnb or another third-party booking platform, the cancellation policy stated on that platform at the time of booking supersedes this policy.

We strongly recommend obtaining travel insurance.

PAYMENTS

For Airbnb reservations, all payments, deposits, fees, taxes, and approved charges must be processed through Airbnb unless otherwise permitted by Airbnb.

A valid payment method must be maintained through Airbnb for each reservation. Guest is responsible for any costs, fees, fines, violations, or damages arising under this Agreement beyond normal wear and tear. Any such charges will be submitted through Airbnb, including the Airbnb Resolution Center where applicable.

Failure to complete required payment through Airbnb may result in cancellation of the reservation.

USER REQUIREMENTS; AGE; IDENTITY VERIFICATION; BACKGROUND SCREENING

To book a Property, you must be 25 years of age or older. An exception may be made for young married couples under 25 at the sole discretion of Luxury Getaways. Luxury Getaways reserves the right to raise the minimum age requirement for specific properties.

You must provide accurate, current, and complete information for yourself and your reservation party at the time of booking. As permitted by Airbnb, applicable law, and platform policy, Luxury Getaways may request identification or other verifying information when necessary to confirm compliance with these House Rules, property-specific requirements, HOA rules, or legal requirements.

By accepting this Agreement, you represent that:

1. You are 25 years of age or older, or qualify under an approved exception.
2. You are fully able and competent to enter into this Agreement.
3. You have not previously been removed from any Luxury Getaways property.
4. Your use of the Property will comply with all applicable laws, rules, regulations, Airbnb policies, HOA rules, and property-specific rules.

MAXIMUM OCCUPANCY & GUEST ROSTER

The Property may only be occupied by registered guests included on the Airbnb reservation. The number of occupants shall not exceed the maximum capacity listed on your reservation confirmation or Airbnb listing.

Any party exceeding maximum occupancy, inside or outside, is subject to immediate removal without refund to the extent permitted by Airbnb policy. Guests not staying overnight are included in occupancy limits. Children under 12 years of age must not be left on the Property without a supervising adult. Mobile units such as campers, RVs, or tents may not be used on the Property. Children under 18 months of age are excluded from the occupancy count unless otherwise stated in the listing.

SMOKING

Smoking of any kind, including cigarettes, cigars, e-cigarettes, vaping devices, and cannabis, is strictly prohibited in or on all Luxury Getaways properties unless specifically stated otherwise in the Airbnb listing.

Violators are subject to immediate removal, forfeiture of all amounts paid to the extent permitted by Airbnb policy, and a mandatory cleaning surcharge of no less than $500.00, which may be substantially higher depending on remediation required. Any smoking-related charges will be requested through Airbnb.

PETS

Pets are not permitted at any Property except those specifically designated as dog-friendly in the Airbnb listing. No pets other than dogs are permitted at any Luxury Getaways property unless required by Airbnb policy or applicable law.

Where dogs are permitted, the following rules apply:

1. A pet fee must be paid through Airbnb prior to check-in.
2. A maximum of one or two dogs are allowed depending on the property reserved.
3. Pets are not permitted on furniture or beds. No exceptions.
4. Guests must clean up all pet waste promptly, both indoors and in outdoor areas. Failure to do so will result in additional cleaning charges.
5. Pets must not produce excessive noise, including continuous or disruptive barking, at a level that disturbs neighbors or violates community noise standards.
6. Any HOA or local authority fines resulting from pet noise disturbances are the sole responsibility of the Guest.
7. Any damage caused by pets will be charged to the Guest for full repair or replacement through Airbnb.
8. At HOA-governed properties, Guests agree to comply with all community rules regarding pets, leash laws, and sanitation. Any HOA fines or violations arising from pet-related conduct will be charged to the Guest through Airbnb.

Violation of the no-pet policy at non-pet-friendly properties will result in immediate removal without refund to the extent permitted by Airbnb policy and a cleaning surcharge of no less than $500.00. Additional charges may apply depending on cleaning, odor removal, damage, or remediation required.

PARKING

Please refer to your arrival instructions for property-specific parking guidelines. Off-street parking in neighbors’ driveways, swales, lawns, roadways, or undesignated areas is not permitted. Luxury Getaways is not responsible for any parking tickets, towing charges, or fines incurred by guests.

HOA Communities, including Snowline, Mt. Baker Rim, Snowater, and similar communities: Parking on roads within HOA communities is strictly prohibited unless specifically allowed in the property instructions. Carpooling may be required. Any fines assessed by a homeowners association arising from Guest parking violations are the sole responsibility of the Guest and may be charged through Airbnb.

INTERNET, ELECTRONICS & APPLIANCES

The Property includes Wi-Fi internet access and cable or streaming services for Guest use during the stay when available. Luxury Getaways and the property owner are not responsible for any interruption, loss, or degradation of internet, cable, streaming, appliance, utility, or electronic service during your stay.

No refund or reduction in rent will be issued for direct or indirect losses arising from such interruptions. Luxury Getaways will make every reasonable effort to remedy reported issues as promptly as possible.

NOISE & CONDUCT

Guest is responsible for the conduct of all members of their party while on the Property. Noise must be kept at a level that does not disturb neighbors or the general public.

Luxury Getaways properties may be equipped with noise-level monitoring devices to ensure compliance with community standards. These devices monitor decibel levels only and do not record conversations or audio.

Any fines assessed by an HOA or local authority for noise violations are the sole responsibility of the Guest and may be charged through Airbnb.

AUTHORIZED ACCESS

Persons authorized by Luxury Getaways, including maintenance staff, inspectors, lawn care providers, snow removal providers, pool technicians, spa technicians, and other service providers, retain the right to access the Property during your rental to perform repairs, inspections, routine maintenance, emergency service, or required property care.

Guests may not refuse entry to authorized service personnel.

DAMAGE WAIVER PROGRAM

Each reservation may include participation in the Luxury Getaways Damage Waiver Program, which covers up to $500.00 of unintentional damage to the Property occurring during your stay, unless otherwise stated in the Airbnb listing or reservation details.

To ensure you are not held responsible for pre-existing damage, please report any damage or issues present upon arrival to Luxury Getaways through Airbnb messaging by 8:00 AM Pacific Time on the day following your arrival.

Guest is responsible for all damage, theft, loss, excessive cleaning, or rule violations in excess of the $500.00 waiver. Any eligible charges will be submitted through Airbnb.

CREDIT CARD AUTHORIZATION

For Airbnb reservations, payment authorization and payment processing are handled through Airbnb. Guest remains responsible for all deposits, fees, reservation costs, damages, fines, excessive cleaning, missing items, and any additional charges arising under this Agreement.

Any such charges will be requested through Airbnb, including the Airbnb Resolution Center where applicable. A reversal, disputed charge, or failure to pay valid amounts owed under this Agreement may constitute a breach of this Agreement.

CAUSE FOR EVICTION & FORFEITURE

Luxury Getaways rents to family groups only. The primary Guest must be at least 25 years of age unless an exception has been approved.

The following conduct constitutes grounds for immediate removal and forfeiture of all amounts paid, without refund, to the extent permitted by Airbnb policy:

Subletting or assigning this Agreement to any other party Activity constituting a nuisance that is offensive or disruptive to neighbors or the community Bringing pets onto a non-pet-friendly Property, or violation of pet rules at a pet-friendly Property Exceeding the maximum occupancy limit Destruction of or damage to the Property Illegal use of the Property or any illegal activity conducted on the Property Smoking in or on the Property Disabling, tampering with, or removing any safety device Unauthorized parties, events, or gatherings Violation of HOA rules, community rules, or local laws

SAFETY, SURVEILLANCE & SECURITY

Safety: The Property may contain safety features including smoke detectors, carbon monoxide detectors, fire alarms, pool gates, pool alarms, exterior cameras, and sound-level monitoring units as required or permitted by law and Airbnb policy.

You consent to the use of these features and agree not to interfere with or tamper with them. You must immediately report any safety concern, maintenance need, or inoperative safety device to Luxury Getaways through Airbnb messaging.

Disabling or removing any installed safety feature is a material breach of this Agreement and grounds for immediate removal from the Property.

Surveillance: Each Property may be monitored by exterior video surveillance for guest safety and to ensure compliance with community rules and local law. You acknowledge that the Property may be under exterior surveillance and security monitoring, subject to applicable privacy laws and Airbnb policy.

Exterior cameras may monitor exterior areas only, such as driveways, parking areas, entrances, exterior walkways, and other outdoor areas. No interior cameras or recording devices are permitted in private indoor living spaces.

Properties may also include noise-level monitoring devices. Noise monitors measure decibel levels only and do not record conversations or audio.

Security: Luxury Getaways reserves the right to commence, expand, reduce, or discontinue any security measures at any time without notice, subject to Airbnb policy and applicable law.

TRANSIENT OCCUPANCY; NO TENANCY

Guest and all registered guests are renting the Accommodation as transient lodgers for the duration of the reservation. This Agreement is not a lease and shall not be construed to create any tenancy, leasehold interest, or exclusive possessory property right.

Luxury Getaways retains full legal, possessory, property, and access rights at all times.

LATE CHARGES

If any amount due from Guest is not received by the applicable due date, Luxury Getaways may assess charges to the extent permitted by Airbnb policy and applicable law. Luxury Getaways may, at its option, terminate the reservation and/or retain amounts paid to the extent permitted by Airbnb policy.

PERSONAL PROPERTY & INJURY

The personal property of guests, including vehicles, is not insured by Luxury Getaways against loss or damage due to fire, theft, vandalism, water, weather, wildlife, or any other cause.

Luxury Getaways does not insure against personal injury to guests except for conditions arising from the gross negligence or intentional misconduct of Luxury Getaways and its employees.

Guest acknowledges responsibility for the safety of all members of their party, including with respect to any pool, hot tub, dock, creek, river, pond, play equipment, stairs, decks, fireplace, fire pit, grill, or other Property amenity. Children must be closely supervised at all times.

Luxury Getaways recommends that all guests carry personal property, travel, and liability insurance.

EXTENUATING CIRCUMSTANCES

For Airbnb reservations, Airbnb’s applicable cancellation, refund, and major disruptive events policies apply.

Guests impacted by an event covered by Airbnb policy may be eligible for a refund, travel credit, or other consideration as determined by Airbnb.

Covered events may include events that occur after booking, are unforeseeable at the time of booking, and prevent or legally prohibit completion of the reservation, such as declared emergencies, qualifying government travel restrictions, military actions, hostilities, or qualifying natural disasters.

Conditions that are common or foreseeable for the area, including snowstorms, wildfire season, smoke, road conditions, power outages, or seasonal weather, may not qualify for refund consideration unless covered by Airbnb policy.

Cancellation by Luxury Getaways: If the reserved Accommodation becomes unavailable for any reason, including safety issues, maintenance, accidental double-booking, or guest overstays, Luxury Getaways may work through Airbnb to substitute a comparable unit where possible or provide a refund as required by Airbnb policy.

INTERNATIONAL TRAVEL

If your travel involves international travel, you are solely responsible for ensuring you possess all required travel documents, including passports and visas, meet all foreign entry requirements, and have obtained any required medical guidance, vaccinations, or medications.

Luxury Getaways bears no liability for guests denied boarding or entry into any country for any reason. Guests who are not U.S. citizens should review travel advisories issued by their own government prior to booking.

GOVERNING LAW & DISPUTES

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Washington, except where superseded by Airbnb’s Terms of Service or applicable Airbnb policies.

Any dispute or legal action arising from or relating to this Agreement that is not required to be handled through Airbnb shall be instituted and prosecuted in the courts of Whatcom County, Washington. Guest, by acceptance of this Agreement, specifically consents to such jurisdiction and venue.

INDEMNIFICATION, WAIVER & RELEASE

Guest shall indemnify, defend, and hold harmless Luxury Getaways LLC and its members, employees, contractors, vendors, property owners, and agents, the “Released Parties,” from any and all liability for costs, expenses, claims, disputes, litigation, judgments, and attorney fees resulting from loss, damage, or injury to the Property or to any person arising from Guest’s or Guest’s invitees’ occupancy or use of the Property.

If there is more than one Guest, all Guests are jointly and severally liable under this Agreement.

Any personal injury or illness of any nature occurring to Guest or Guest’s invitees while at the Property is not the responsibility of Luxury Getaways except where prohibited by law.

This waiver and release is intended to be a full and complete release of the Released Parties from any and all present or future claims arising from use of the Property to the fullest extent permitted by law.

ADDITIONAL TERMS; OTA BOOKINGS

Luxury Getaways may require separate agreements, waivers, HOA documents, or property-specific rules for specific properties when permitted by Airbnb policy and applicable law.

If a conflict exists between this Agreement and a property-specific agreement, waiver, or rule, the terms of the property-specific document will control unless superseded by Airbnb policy.

If you reserved through Airbnb or another third-party booking platform, that platform’s terms and conditions apply and, where in conflict, supersede this Agreement.

ELECTRONIC ACCEPTANCE

Your booking, payment of any amount toward this reservation, taking possession of the Property, entering the Property, or allowing your guests or visitors to enter the Property constitutes your acceptance of and agreement to all terms herein.

No physical signature is required for this Agreement to be binding.

By booking, submitting payment, or taking possession of the Property, Guest certifies that they have read, understood, and agree to all terms of this Agreement.
