Short-Term Rental Agreement

THE PARTIES. This Short-Term Rental Agreement (“Agreement”) made on (reservation_date) between the following: Guest: (guest_name) (“Guest”), and Host: Premium SmartStay Home Rental L.L.C (“Host”).

THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host: Address: (address) Hereinafter known as the “Premises.”

LEASE TERM. The Guest shall be allowed to occupy the Premises starting (checkin_date) from 4:00 PM and ending (checkout_date) at 11:00 AM (“Lease Term”).

OCCUPANTS. The total number of individuals staying on the Premises during the Lease Term shall not exceed a total of the number of guests listed in the booking. Individuals shall only be authorised to enter the Premises if a copy of their passport and their email address has been received via the website provided by the Host. If unauthorised guests are found on the Premises, a fee of 250 per guest per day shall apply, and this Agreement will be subject to termination by the Host.

QUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until 8:00 AM. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents. If violated, a fee of AED 1000 will be charged to the responsible guest.

PEACEFUL ENJOYMENT. Guests are expected to maintain a peaceful environment for the enjoyment of all residents in the building. This includes limiting noise levels to under 80 decibels. Parties, events, and unregistered guests are strictly forbidden. If a violation is detected, for instance, due to complaints from other residents, the guest will initially receive a warning message. If the violation continues beyond this warning, a fee of AED 500 will be levied for every subsequent 10-minute interval of the continuing violation or for every new instance of such a disturbance. During designated quiet hours, all forms of music are strictly prohibited. Non-adherence to these rules may lead to immediate termination of this Agreement.

KEYS. Guest shall be given the appropriate (3) access cards to access the apartment, building or its facilities. Guest have an optional keyless access via the Keyless app. Guest shall leave all access cards on the dinner table before check-out and send the Host a picture for confirmation. If lost by the Guest, an AED 500 recovery fee per access card will be applied.

EARLY CHECK-IN. The standard check-in time is at 4 PM. Early check-in requests should be made at least 24 hours in advance and are subject to availability. An additional fee of AED 100 + 5% VAT per hour will be charged for this convenience.

LATE CHECK-OUT. Late check-out requests should be made at least 24 hours in advance and are subject to availability. An additional fee of AED 100 + 5% VAT per hour will be applied. The standard check-out time is 11 AM, with a grace period of 20 minutes. After the grace period, if no late check-out has been agreed upon, a fee of AED 50 for every additional 10 minutes will be charged.

ADDITIONAL SERVICE. Additional service requests such as cleaning during your stay, linen change, and towel change are optional. Requests should be made at least 24 hours in advance and are subject to availability. An additional fee of AED 200 + 5% VAT for cleaning, AED 150 + 5% VAT for linen change, and AED 90 + 5% VAT for towel change will be charged for these services.

SMOKING POLICY. Any and all forms of smoking shall not be permitted on the Premises on the balcony or in the hallways of the building. This includes vapes, weed or other illegal substances. There is an AED 3500 fee if any cigarette, smoke residue, smoke odour, or other traces are found.

PARKING. 1 parking space is allocated per apartment. Parking spaces are assigned by the building management to each individual unit. The Host does not have control over the parking allocations and is unable to modify, reassign, or provide alternative parking spaces. Unauthorized parking may result in a fine of AED 1000, imposed by building management. Any such fine, towing, or penalty incurred as result of parking violation shall be the sole responsibility of the Guest.

GUEST RESPONSIBILITY. The signing Guest assumes full responsibility for the actions and behaviour of all individuals present at the property during the Lease Term. This extends to any damages, violations, or disturbances caused by any of these individuals. The Guest will bear any costs associated with these incidents.

EXTERNAL CONTRACTORS & CLEANING SERVICES. The Guest acknowledges and agrees that only service providers approved and authorised by Host are permitted to access and service the Premises. The use of any external or third-party cleaners, housekeeping services, contractors, or service providers arranged by the Guest is strictly prohibited unless prior written approval is obtained from Host. This prohibition includes, without limitation, independent cleaners, freelance housekeeping services, or any individual not contracted and authorised by the Host. If unauthorised cleaning services or contractors are used without approval, the Guest shall be deemed in breach of this Agreement, a penalty of AED 1,000 shall apply, and any building fines, damages, or additional operational costs arising from such breach shall be fully chargeable to the Guest. The Host reserves the right to document the incident, notify building management, and take any further action deemed necessary. No refunds, waivers, or exceptions shall be granted in the event of a breach. Guests requiring cleaning or servicing during their stay must arrange such services exclusively through the Host authorised housekeeping team. This clause applies at all times, regardless of the length of stay, guest status, or booking platform.

BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process, due in full before check-in. Payment must be made in full to ensure availability.

PAYMENT VERIFICATION & THIRD-PARTY CARD USE. For security, fraud prevention, and compliance with applicable laws in the United Arab Emirates and international payment regulations, additional verification may be required where the reservation has been paid using a credit or debit card issued under a name different from the booking Guest’s name, excluding reservations made through Airbnb. In such cases, the Guest shall provide the cardholder’s full legal name, a copy of the cardholder’s valid passport or government-issued identification, a photo of the payment card showing only the last four (4) digits with all other details concealed, a photo of the back of the card with the CVV concealed, and a duly completed and signed Credit Card Authorization Form authorizing the use of the card for the reservation. All information collected shall be used solely for payment verification and fraud-prevention purposes and handled in accordance with applicable UAE laws, payment processor requirements, and international card network standards. Failure to provide the required verification may result in delayed check-in, cancellation of the reservation without refund, or inability to proceed with the stay, in accordance with platform and payment processing rules.

SECURITY DEPOSIT. The Guest shall pay a refundable security deposit in the amount of AED 1,000 or 5% of the total booking value, whichever is higher (“Security Deposit”) upon execution of this Agreement. In addition, a 4% processing fee will be applied on top of the final Security Deposit amount, which is non-refundable. Check-in will not be permitted unless the Security Deposit has been collected in full. The Security Deposit is held to ensure the Guest’s full and faithful compliance with the terms of this Agreement and may be applied toward any damages, losses, or breaches incurred during the stay. It shall not be applied toward Rent unless expressly authorized in writing by the Host. Any remaining balance of the Security Deposit will be refunded within a reasonable period, typically within 5–14 days following check-out, subject to inspection and verification.

TERMINATION. The Host has the right to enter the Premises for housekeeping, maintenance and inspection purposes. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with local law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.

MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready-to-rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest, bearing in mind that Host will provide a regular cleaning. The Guest shall pay for direct and indirect damages (like maintenance, replacement of damaged or missing items, excessive cleaning and repairs) should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct the costs of said services from any Security Deposit prior to a refund or deduct from the registered credit card if the Guest causes damage to the Premises or its furnishings.

REPORTING DAMAGES AND ISSUES: The Guest is required to immediately report any damages, stains, or any other issues noticed upon check-in or at any point during their stay. Prompt reporting enables us to make arrangements for replacement or repair, ensuring a seamless experience for the next guest. Please note that by reporting these concerns, you are authorising us to enter the premises to rectify the issue.

TRASH. Upon checkout, Guest shall place trash neatly in the bins. If there is any excess, the Guest shall dispose of it in the refuse of the building. A building fine of AED 1000 will be imposed for the improper disposal of trash.

USE OF PREMISES. Guest expressly acknowledges and agrees that this Agreement is for transient occupancy of the Premises and that Guest shall not make the Premises a residence or household nor use the Premises for commercial use. The guest is not a tenant and waives any potential tenant rights. The Guest is not authorised to sell products or services on the Premises or conduct any commercial activity.

SUBLETTING. The Guest does not have the right to sublet the Premises.

SECURITY: Security cameras are installed in the public spaces of the building, and a decibel- and smoke sensor is installed on the Premises. These are for the safety and security of all occupants. Any alteration, tampering, or removal of these devices will result in immediate termination of this Agreement with no refund of rent or deposits.

SHORTENED STAY AND CONDITIONS. There shall be no refunds of rent due to shortened stays, cancelled stays or unmet expectations because of weather conditions or other similar situations out of the host's control. Please note that the building management may need to carry out maintenance work on any amenity without prior notice. This is part of the necessary upkeep and cannot be used as grounds for a refund.

HAZARDOUS MATERIALS. The Parties agree that fireworks, candles, open fires and other hazardous materials may not be used in or around the Property.

ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behaviour shall cause immediate termination of this Agreement with no refund of rent or deposits.

HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises, regardless of the nature of the accident, injury or loss. The Guest expressly recognises that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of the Guest and that the Guest should purchase their own insurance for themselves or their guests if such coverage is desired.

POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. If claims are not made within one week, they shall become the property of the Host. The Host shall not be held liable for the condition of said items left by the Guest(s).

ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.

GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of the Premise’s location.

SEVERABILITY. In the event any provision or part of this Agreement is found to be invalid or unenforceable, only that particular provision or part so found, and not the entire Agreement, will be inoperative.

ENTIRE AGREEMENT. This Agreement, together with any attached addendums or disclosures, shall supersede any and all other prior understandings and agreements, either oral or in writing, between the parties with respect to the subject matter hereof and shall constitute the sole and only agreements between the parties with respect to the said Property. All prior negotiations and agreements between the parties with respect to the Property hereof are merged into this Agreement. Each party to this Agreement acknowledges that no representations, inducements, promises, or agreements, orally or otherwise, have been made by any party or by anyone acting on behalf of any party, which are not embodied in this Agreement and that any agreement, statement or promise that is not contained in this Agreement shall not be valid or binding or of any force or effect.
