This Rental Agreement (the “Agreement”) is entered into between {reservations.first_name} {reservations.last_name} (the “Guest,” and where applicable also referred to in this Agreement as “you” and “your”) and Victoria Prime Services Inc. (“Victoria Prime”), in its capacity as the duly appointed representative of the Owner of the rented premises (the “Subject Property”).
A completed Agreement is required to be on file before you will be allowed to check into the Subject Property. Please review and sign this Agreement where indicated.
Acceptance of Terms and Conditions: By signing this Agreement and by maintaining the reservation booked through Airbnb, the Guest accepts the terms and conditions of this Agreement. For Airbnb reservations, all reservation payments, refunds, and payment processing are handled through Airbnb and are subject to Airbnb’s applicable terms and policies. The Guest remains responsible for charges properly payable in connection with the reservation and occupancy of the Subject Property, subject to Airbnb’s applicable terms and policies and applicable law.
You shall also accept that you will be responsible for any damage beyond normal wear and tear during your stay. Where permitted by Airbnb’s applicable terms and policies, Victoria Prime may request reimbursement for such costs through Airbnb’s Resolution Center or any other Airbnb-authorized process. No off-platform payment or deduction shall be required except where expressly permitted by Airbnb and applicable law.
For reservations booked through Airbnb, the Guest acknowledges that the reservation is made and paid through Airbnb. This Agreement supplements the Airbnb reservation and governs the Guest’s occupancy and use of the Subject Property. All clauses in this Agreement are to be read together with Airbnb’s applicable terms and policies. It is the responsibility of all Guests and members of the Guest’s party to be familiar with the terms and conditions of this Agreement.
Address of the Subject Property: The address of the Subject Property is {reservations_unit.unit_address}.
Period of Rental: The Rental Period begins on the reservation Check-in Date ({reservations.startdate}) and ends automatically on the reservation Check-out Date ({reservations.enddate}). Any occupancy after the Check-out Date without Victoria Prime’s prior written authorization is over-holding and is governed by the “Over-Holding by Guest” clause in this Agreement. No right of continued occupancy is created beyond the Check-out Date.
Rental Rates and Charges: For reservations booked through Airbnb, the rental rates, taxes, Airbnb service fees, and other booking charges applicable to the reservation are as shown and processed through Airbnb, subject to Airbnb’s applicable terms and policies.
Payment: All reservation payments, approved refunds, and booking modifications for Airbnb reservations are processed through Airbnb. Victoria Prime does not collect reservation funds directly from the Guest for Airbnb bookings, except where Airbnb expressly authorizes an off-platform charge and applicable law permits it.
Airbnb Bookings: For reservations booked through Airbnb, this Agreement is intended to govern the Guest’s occupancy and use of the Subject Property and to supplement the Airbnb reservation. Any payment processing, refund handling, booking modification, or guest payment dispute shall be handled through Airbnb in accordance with Airbnb’s applicable terms and policies. Any fee, charge, or reimbursement sought from the Guest must be disclosed and requested in a manner permitted by Airbnb and applicable law.
Changes in Rental Rates: Posted rates on Airbnb are subject to change without notice, but rates will not change after a reservation has been made on Airbnb.
Check-In: Guests receive the check-in information 7 days before the check-in date via email and SMS to the contact details provided during reservation. Check-in is typically through Self-Check-in, where Guests retrieve the keys from a designated collection point as outlined in the provided details. While most properties offer Self-Check-in, some may require a Host-led Check-in.
For Self-Check-in, the Check-in time starts at 4:00 PM Pacific Time with no limitation on the end time of the Check-in.
The check-in window for a Host-led Check-in is from 4:00 PM to 8:00 PM Pacific Time. A Host-led check-in must be scheduled in advance. If the Guest is delayed, a waiting-time fee of $35 per hour (pro-rated) may apply, starting 30 minutes after the agreed check-in time. If the check-in takes place after 8:00 PM Pacific Time, an additional after-hours check-in fee of $35 may apply. Any such fee shall be requested only through Airbnb’s authorized payment channels.
Occasionally, requests for early check-in can be accommodated; however, this cannot always be guaranteed. The Check-out is before 11 am Pacific Time.
Online Guest Book: In the Check-in information Email and SMS text message, you will receive a link to the Online Guest Book which will provide you, as the Guest, detailed information on Check-in, WIFI information and house rules of the Subject Property, favourite restaurants, grocery stores, pharmacies, things to do and activities in the area.
Refunds: The Airbnb policy applies for refunds. Trip insurance is recommended.
Damage Reporting and Claims: The Subject Property will be assessed after check-out for any damage other than damage recorded prior to check-in. Any claim arising from the Guest’s stay will be dealt with through Airbnb’s Resolution Center, subject to Airbnb’s applicable terms and policies.
The Guest is liable for all damage to the Subject Property caused by the Guest or the Guest’s invitees, excluding Wear and Tear and General Maintenance. Where permitted by Airbnb’s applicable terms and policies, Victoria Prime may request reimbursement for such damage through Airbnb’s Resolution Center or any other Airbnb-authorized process.
Please report any damage or deficiency within four (4) hours after check-in. If a damage or deficiency is not reported within this time and is later identified at check-out or during inspection, it may be treated as having occurred during your stay and may result in charges. Wear and Tear and items requiring General Maintenance are not considered damage.
Wear and Tear means normal deterioration from ordinary use over time, such as worn towels or linens, chipped dishes, stained carpets, or scuffed flooring.
General Maintenance means routine upkeep and repairs arising from normal use over time, including window and deck cleaning, yard care, general household maintenance, and appliance or electronic repairs.
Damage claims may include, but are not limited to, damage to floors, walls, or furniture, and damage caused by water being left running or gas being permitted to escape in the Subject Property.
Cleaning Fee: Each reservation includes an exit cleaning fee. Daily housekeeping is not provided and it is the responsibility of the Guest to maintain the cleanliness of the home during the Rental Period. You are, however, welcome to contact Victoria Prime to arrange for interim cleans at the Guest’s cost, provided the cost is disclosed in advance and requested through Airbnb’s authorized payment channels where required.
Upon your departure at check-out, you shall properly discard all recyclable, compostable and garbage materials in accordance with the applicable municipal schedules and guidelines, and remove all personal items. While the home will be cleaned after your departure, you are required to leave the home in a comparable condition of cleanliness as it was found. Failure to do so may result in an additional cleaning fee. The cleaning fee paid applies to one standard move-out clean only. Any extra cleaning or excess garbage removal charges incurred as a result of your stay may be requested through Airbnb’s authorized payment channels, subject to Airbnb’s applicable terms and policies.
Hydro Usage Cap: Hydro Usage Caps apply to reservations of thirty (30) nights or longer. Each property includes a monthly hydro allowance (GST included) based on the size of the Subject Property. The allowances provide the expectation that hydro does not exceed $75/month (one bedrooms), $100/month (two bedrooms), $150/month (townhomes) or $250/month (houses). Any amount exceeding the applicable monthly Hydro Usage Cap shall be requested only through Airbnb’s authorized payment channels.
Lock Out Charges: A $100 lock-out fee may apply if a member of the Victoria Prime team must assist the Guest or a member of the Guest’s party due to lost or mismanaged keys or fobs, or for any other reason caused by the Guest that prevents entry or re-entry to the Subject Property without such assistance. This fee shall be requested only through Airbnb’s authorized payment channels.
Travel / Health Insurance: The Guest is responsible for obtaining their own travel and/or health insurance. To the fullest extent permitted by law, Victoria Prime and the Owner are not liable for accidental injury, death, or damage to, or loss of, the Guest’s personal effects arising from the Guest’s stay, except to the extent such liability cannot be excluded or limited under applicable law.
Non-Smoking: All properties are non-smoking. City and/or Strata bylaws may prohibit smoking of any kind inside, outside, on balconies, or within specified distances of the building. If smoking results in extra cleaning, deodorizing, damage, or bylaw fines, Victoria Prime may request reimbursement through Airbnb’s authorized payment channels, subject to Airbnb’s applicable terms and policies. A fixed smoking charge of $250 per instance applies.
No-Shoes Policy: We kindly ask guests to remove their outdoor footwear while inside the accommodation. Thank you for taking care!
Lost or Stolen Property: Victoria Prime will not be held responsible for lost or stolen personal property, money or jewelry from the Subject Property regardless of whether such loss occurs when the Subject Property is locked against entry or not.
When you, as the Guest, find items in the Subject Property that are deemed to be lost property left by previous Guests, it is your responsibility to turn over the lost item(s) to Victoria Prime so that Victoria Prime will be able to find the rightful owner. Failing to hand over the items to Victoria Prime may be subject to legal action.
Victoria Prime will make reasonable efforts to return lost item(s) to the rightful owner (including the Guest, where applicable). If return by mail or courier is requested, the rightful owner agrees to reimburse the applicable shipping costs and a $50 handling fee. Such fee is requested only through Airbnb’s authorized payment channels.
Pets Policy: Victoria Prime has a no-pets policy. Pets are not permitted in any property unless approved in advance at the time of reservation. Any exception may be granted only for mature, hypoallergenic dogs that are over two (2) years old and under twenty-five (25) lbs.
Any approval applies only to the specific pet disclosed to and approved by Victoria Prime. If the Guest brings a pet that does not meet the approved criteria, or a pet different from the one approved, Victoria Prime may require the pet to be removed and/or require the Guest to vacate the Subject Property. If the Guest is required to vacate under this clause, any refund, if any, shall be determined in accordance with Airbnb’s applicable terms and policies and applicable law.
Guests with approved pets must manage them responsibly, including promptly cleaning up waste, keeping the pet leashed in public areas, not allowing the pet on furniture, preventing excessive noise, and avoiding soiling or damage to the Subject Property.
Bicycle Storage: Every building has a different bicycle storage policy and therefore in general there are no guarantees that spots will be available for bicycle parking.
In addition, every building has a strict zero tolerance for bicycles in the lobbies or elevators and fines will be issued for such. Please check with Victoria Prime upon time of booking whether the unit to be booked has a place to store bicycles. Victoria Prime recommends renting bicycles as many of the bicycle rental companies also offer bicycle storage during the Rental Period.
Use of Mail Box: With the Owner’s permission and subject to mailbox availability, the Guest may receive mail at the Subject Property. Mailbox access (and a key, if applicable) will be provided only after the Guest delivers to Victoria Prime a copy of the Guest’s Canada Post Mail Forwarding payment receipt showing an end date fourteen (14) days before the scheduled Check-out Date.
Parking: Parking is limited to one (1) vehicle for each accommodation rented and is included in the reservation price unless specified otherwise in the description of the Subject Property. The townhouses and houses have parking on the property and/or on the street. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.
Garage Height: It is your responsibility to ensure that the dimensions of your vehicle shall meet the garage clearance of the building where the Subject Property is located. Victoria Prime cannot be held responsible in the case that the vehicle cannot be parked in the allocated parking spot of the Subject Property due to its dimensions.
Maximum Occupancy: The maximum number of Guests varies by property and is detailed in the reservation.
Minimum Age: The minimum booking age is 25.
Minimum Night Stays: All reservations are subject to a minimum continuous stay of either three (3), thirty (30) or ninety (90) nights, depending on the Subject Property and applicable regulations.
Noise and Disturbances: Guests are expected to behave in a civilized manner and to be good neighbours, respecting the rights of surrounding property owners and Guests. Activities that disturb, annoy, endanger, or interfere with the peaceful enjoyment of others are strictly prohibited. Parties, events, or large gatherings of any kind are not permitted, and the Subject Property is to be used for quiet accommodation purposes only. Guests may not host celebrations, social events, or increase occupancy beyond the number of registered Guests.
The Guest agrees that excessive noise, disturbances, or any unauthorized gatherings are strictly prohibited. If such conduct occurs and results in complaints from neighbours or intervention by building management, security, or police, Victoria Prime may provide twenty-four (24) hours’ written notice to remedy the breach or vacate. If immediate termination is reasonably required due to safety concerns, illegal activity, or serious disturbance to neighbours or building operations, the Guest may be required to vacate immediately. If the Guest is required to vacate under this clause, any refund, if any, shall be determined in accordance with Airbnb’s applicable terms and policies and applicable law.
The Guest further acknowledges that the Guest may be liable for extra cleaning, damage, security call-out costs, or fines or penalties arising from bylaw or strata rule violations caused by the Guest or the Guest’s invitees. Where permitted by Airbnb’s applicable terms and policies, Victoria Prime may request reimbursement for such amounts through Airbnb’s authorized payment channels.
Quiet hours must be strictly observed between 9:00 PM and 8:00 AM, or as otherwise stipulated in the applicable Strata Bylaws for the Subject Property.
Alterations: Each property is furnished with the owner's unique tastes in mind. You shall not make or permit to be made any alteration or addition to the Subject Property. This includes adjustments and movement of furniture, the addition of your own pieces of furniture as well as hanging items such as paintings on walls.
Strata Bylaws: All Guests are required to abide by the Strata Bylaws of which a copy can be found in the Online Guest Book.
Maintenance: In the event of equipment malfunction during your stay, Victoria Prime will expedite repairs as quickly as possible. You shall give Victoria Prime prompt notice of any accident or other defect to the Subject Property, including water pipes, gas pipes or heating apparatus, telephone, electric light or other wires. This is to ensure the safety and the enjoyable stay at the Subject Property. You are requested to text or call Victoria Prime on the designated guest communication text number as soon as a problem is noticed.
If the problem is just a loss of manageable items such as a toaster, cable outage, issues with dishwasher, washer or dryer, the shutdown of one bathroom while there is still another, garage door failing to open, and similar events, then Victoria Prime will work as quickly as possible to repair / attend to the issue but these issues will not be considered a major loss.
No refunds or rental adjustments will be provided for temporary issues that are resolved within the same day and do not extend overnight. Refunds or rental adjustments may be considered only if the problem extends overnight and results in a prolonged, major loss of an essential service (heat, refrigerator, water, or electricity). Any refund or adjustment will be limited to the affected period and, if any, shall be determined in accordance with Airbnb’s applicable terms and policies and applicable law.
Use of Subject Property: The Guest must not do, or permit to be done, anything on the Subject Property that contravenes any municipal, provincial, or federal law, or that creates a nuisance. The Guest may not assign, sublet, or otherwise transfer possession of the Subject Property, in whole or in part.
Entry of Subject Property: The Guest agrees, after prior consultation by Victoria Prime, to allow Victoria Prime management, representative, vendors, and contractors/subcontractors to access the Subject Property to make inspections, repairs, improvements, clean, care for, or manage the Subject Property. Victoria Prime will however make every effort to avoid/limit interruptions during your stay.
Emergency Access: Notwithstanding any other provision of this Agreement, Victoria Prime or their authorized representatives may enter the Subject Property without prior notice in the event of an emergency, suspected damage, water leakage, fire risk, gas leak, safety concern, or where immediate access is reasonably required to protect the Subject Property, the building, or its occupants. Victoria Prime will make reasonable efforts to notify the Guest as soon as practicable following such entry.
Over-Holding by Guest: If the Guest remains in occupation of the Subject Property after the Check-out Date without Victoria Prime’s prior written authorization, this constitutes over-holding and a material breach of this Agreement. Victoria Prime may, upon twenty-four (24) hours’ written notice, require the Guest to vacate the Subject Property and may take steps to recover possession. The Guest is responsible for any additional charges, losses, and reasonable enforcement costs arising from the over-holding, provided that any monetary amount sought from the Guest shall be requested only in a manner permitted by Airbnb’s applicable terms and policies and applicable law. No acceptance of payment, delay, or other act by Victoria Prime creates any right of continued occupancy beyond the Check-out Date.
Joint and Several: If more than one Guest is listed on the reservation, each Guest is jointly and severally liable for all obligations under this Agreement, including payment of rent, fees, and any charges or damages.
Validity of Insurance Policy: The Guest agrees not to do, or allow anything to be done, that could void or make voidable any insurance policy covering the Subject Property, or that could result in an increase in the insurance premium.
Vacating Early or Arriving Late: The Guest acknowledges that failure to occupy the Subject Property for the full Rental Period does not reduce or eliminate the Guest’s financial obligations under this Agreement.
Accidents Happen: If a spill happens, please blot it up right away with paper towels and contact a Victoria Prime Representative. We’ll let you know the best way to clean it so it doesn’t set.
Quick action usually prevents stains. If you are travelling with a baby or small child, we recommend bringing waterproof pads to protect the bedding. If there is an accident in a bed, please soak the linens in cold water immediately. Please do not wash or dry stained towels or linens. Just let Victoria Prime know right away so we can guide you.
When doing laundry, please keep light and dark colours separate and avoid overfilling the machines. For the protection of the appliances, please do not wash comforters, duvets, pillow shams, or other bulky items. If you are unsure about anything, just reach out and we will help.
We work hard to keep the carpets clean for everyone. Please remove shoes indoors and clean up spills promptly. If there is excessive soiling or significant staining during the stay, Victoria Prime may request reimbursement for carpet cleaning through Airbnb’s authorized payment channels, subject to Airbnb’s applicable terms and policies.
As a courtesy, if something gets broken during the stay, i.e., a glass or plate or anything, you are kindly asked to let the Victoria Prime Representative know at check-out.
Compost/Recycle/Trash: The City of Victoria and other municipalities may have explicit rules regarding how waste is to be processed. Please review and follow the rules and regulations provided in the Online Guest Book. If the city, municipality, strata, or service provider imposes a fine or additional charge due to the Guest’s failure to comply, Victoria Prime may request reimbursement through Airbnb’s authorized payment channels, subject to Airbnb’s applicable terms and policies.
What Is Provided / Amenities: All linens, fully equipped kitchen with pots, pans, utensils, flatware and glassware you will require to prepare and serve a meal. Toasters/toaster ovens, coffee makers, kettles, and blenders are all normal stock items. If you would request a reasonable item not available in the Subject Property, then Victoria Prime will be happy to supply. Cable TV and telephone with free local calls and fast WIFI are provided for most properties including Netflix. Netflix can however be accessed with your own account information only. A few properties do not have landline phones. All properties offer washer/dryers (either in-suite or central facility in the building), microwave and dishwashers. The rental properties are individually owned and each reflects the owner’s personal taste. Furnishings and amenities may be changed either by the owner or Victoria Prime without notification.
A Start Up Basic Supply: For your convenience, Victoria Prime provides a start-up of basic supplies at your arrival, until you have time to go to the market to purchase any additional things you may need. The basic supply includes toilet paper, hand soaps, shampoo, body wash, basic cleaning products, a limited supply of garbage and compost bags. You are responsible for replenishing your own additional products during your stay. Some of the vacation homes acquire seasonings, teas and other items that have been left behind by previous Guests but this is not guaranteed. Guests are asked to bring with any special items they enjoy cooking with.
Falsified Reservations: Any reservation obtained under false pretence, including false identity, false age, false occupancy details, or false number in party, constitutes a material breach of this Agreement and may result in refusal of check-in or a requirement to vacate the Subject Property, subject to Airbnb’s applicable terms and policies. Any refund, if any, shall be determined in accordance with Airbnb’s applicable terms and policies and applicable law.
Termination: A material violation of this Agreement may result in the Guest being required to vacate the Subject Property. For non-payment or other material breaches, Victoria Prime may provide twenty-four (24) hours’ written notice to remedy the breach or vacate, unless immediate termination is reasonably required for safety, security, unlawful activity, serious disturbance, or material damage risk. For Airbnb reservations, any refund, if any, shall be determined in accordance with Airbnb’s applicable terms and policies and applicable law.
Customer Satisfaction: It is the goal of Victoria Prime to provide each of the Guests with a wonderful stay in Victoria. Victoria Prime therefore wants you to feel completely satisfied with the Subject Property. If at any point during your stay, something is needed or you feel that Victoria Prime has not met your needs, then you should feel free to contact Victoria Prime immediately.
Indemnification: The Guest agrees to indemnify and save harmless the Owner of the Subject Property, Victoria Prime and all of its employees, contractors, suppliers and representatives from any and all liabilities and any and all loss or damage whatsoever arising, related to or in connection with the rental of the Subject Property, including but not limited to any loss of income or damage claim from the Guest, and any claim or liability for personal injury or damage or loss of property which is made, incurred or sustained by the Guest or Guests of the Guest. By accepting this reservation, it is agreed that all Guests are expressly assuming the risk of any harm arising from their use of the Subject Property or others whom they invite to use the Subject Property.
Limitation Of Liability: To the fullest extent permitted by law, Victoria Prime’s total liability arising out of or in connection with this Agreement shall not exceed the total amount paid by the Guest for the reservation.
Under no circumstances shall Victoria Prime be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of enjoyment, relocation costs, travel expenses, lost income, inconvenience, or personal damages arising from the Guest’s stay.
Nothing in this clause shall limit liability for gross negligence or willful misconduct where such limitation is prohibited by law.
General Provisions: For Airbnb reservations, this Agreement supplements, and does not replace, the Airbnb reservation and Airbnb’s applicable terms and policies. This Agreement may not be altered or modified except in writing signed or otherwise agreed in writing by Victoria Prime and the Guest. In the event of a direct conflict regarding booking mechanics, payment processing, refunds, or platform dispute procedures for an Airbnb reservation, Airbnb’s applicable terms and policies shall govern to the extent of that conflict.
The Guest may not assign this Agreement or any of the rights granted to the Guest by this Agreement to any other person without the prior written consent of Victoria Prime.
In the event of any dispute arising between the parties, the law of British Columbia shall apply and the Courts of British Columbia shall have exclusive jurisdiction in the event that legal action is taken by either party against the other.
While the reservation is booked and paid through Airbnb, the Guest agrees that any payment issue, refund request, or reservation dispute should first be raised through Airbnb’s platform and applicable procedures. Nothing in this Agreement limits any non-waivable rights the Guest may have under applicable law.
Force Majeure: Victoria Prime shall not be liable for failure to perform or delays caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, government regulations, public health orders, utility failures, labor disputes, or other unforeseen events.
Interpretation: In this Agreement: (a) words in the singular include the plural and vice versa; (b) words importing a gender include all genders; and (c) the words “including” and “includes” mean “including without limitation.”
