MIAMI VACATION RENTALS - SHORT-TERM RENTAL AGREEMENT & HOUSE RULES Important: By booking and/or making payment, the Guest agrees to all terms and conditions in this Agreement. This Agreement must be signed (or otherwise accepted) before check-in in accordance with platform rules and Florida law. The most important rule is to relax and enjoy your stay, but please also take care of the property and respect the neighbors as outlined below.
INTRODUCTION Welcome, and thank you for choosing our property!. Each guideline is based on past experiences, local regulations, and building policies, so they are matters of both courtesy and safety/maintenance. By confirming your reservation, you agree to comply with these rules throughout your stay. We kindly ask for your full cooperation, and in return, we trust you will find your stay pleasant, worry-free, and memorable. Key Points: No parties or loud gatherings are allowed under any circumstances; out of respect for neighbors, noisy events are strictly prohibited. No smoking or vaping of any substance (tobacco, marijuana, etc.) is allowed anywhere in the building or unit. Keep balcony doors closed at all times to prevent humidity damage to walls and ceilings. Do not block curtains or tamper with any safety devices or equipment in the unit. If the unit has a dividing door (for adjoining suites), please leave it open unless you have booked both sides; if closed, a neighbor could accidentally enter the wrong room.
ARRIVAL AND DEPARTURE TIMES Check-in is after 4:00 P.M. and check-out is by 11:00 A.M. (local time). If you require flexibility with these times, please contact us in advance and we will do our best to accommodate (additional fees for early check-in or late check-out may apply as described below). Note that we have a tight cleaning schedule: our housekeeping team arrives promptly at 11:00 A.M. on check-out day to prepare for the next guest, so it is important that you depart on time or have arranged an approved late check-out.. PAYMENT Payment for the full cost of your stay (including nightly rate, taxes, cleaning fee, deposit, resort or association fees if applicable, and any other charges) is due in full before arrival. We accept major credit cards (Visa, MasterCard, Discover, American Express) or ACH transfers. Any optional hospitality services or property add-ons requested by the guest (including but not limited to Early Check-In, Late Check-Out, pet fees, parking) are managed and processed through our connected professional Property Management Software. By confirming this reservation, the guest explicitly consents to these specialized operational charges, which will be invoiced via our secure external payment gateway and are fully authorized and exempted from standard off-platform restrictions. Once confirmed, you can make payment through the SuiteOps guide app. Credit Card Verification: During the SuiteOps check-in process, the original credit card used for the reservation will be verified against the primary booker’s details. This ensures a secure and smooth check-in experience. The verified card will also be used for any additional add-ons or special services requested, once availability is confirmed. DAMAGE POLICY For your convenience and peace of mind, we offer two options to cover potential damages during your stay. You can select the option that best suits you at the beginning of your reservation, prior to check-in. Option 1: Refundable Security Deposit A refundable deposit of $1,000 is required and will be held on your credit card at the start of your reservation, before you enter the unit. This deposit will be refunded in full after check-out, provided there are no damages beyond normal wear and tear. Option 2: Damage Waiver Fee Single Fee: A non-refundable damage waiver fee is payable during the check-in process, before you enter the unit. Coverage: This fee covers accidental damages up to $500, such as minor spills, small furniture dings, or broken glassware. Exclusions: The waiver does not cover damages exceeding $500 or those caused by negligence, misuse, or intentional acts such as unauthorized parties or improper appliance use. Additionally, losses or damages to non-covered items such as parking passes, key fobs, or amenity cards are not included and will incur separate replacement fees if lost or damaged. By choosing your preferred option at the start of your stay, you can select the approach that best fits your needs and enjoy peace of mind. CANCELLATIONS Cancellations are permitted up to 30 days before arrival (or according to the cancellation policy indicated on your booking platform, if different). Approved cancellations are subject to only a 3.5% administration fee to cover credit card processing. After that date (within 30 days of arrival), the reservation is non-refundable, and the total amount of this contract will be charged. There will be no refunds for shortened stays due to late arrival or early departure, weather conditions, medical or family emergencies, or any other reason, except to the extent that an extenuating circumstance policy of the booking platform or applicable law requires a refund. For monthly rentals or longer stays, the same 30-day policy applies. If a long-term guest decides to depart early or change their plans after check-in, the unused portion of the stay is non-refundable. In the rare event that the Host must cancel a booking (e.g. in case of an emergency repair issue or other force majeure situation), we will notify you as soon as possible and provide a full refund (or assist in relocating you to a comparable accommodation if you prefer). We abide by the cancellation terms of the OTA platform used for your booking and any extenuating circumstances policies that may apply. BUILDING REGULATIONS Our property is located in a residential building with its own rules that ensure the safety and enjoyment of all residents and guests. These regulations are strictly enforced by building management and security. Guests must comply with all applicable local laws and building rules, including those for noise, occupancy, parking, waste disposal, and use of common areas. If a Guest or any member of their party fails to follow the house rules or building regulations and is required to leave by the Host or building security, no refund or compensation will be issued. In other words, violation of these rules may result in immediate eviction without a refund. Proper Behavior and Noise: Guests are expected to conduct themselves in a civilized manner at all times and to be mindful of noise levels, especially in hallways and common areas. Quiet hours are from 10:00 P.M. to 8:00 A.M., during which noise should be kept to a minimum both inside the unit and on balconies/patios (this is both a courtesy and a local legal requirement. Loud music, shouting, or any disturbance at any time that could disturb neighbors is prohibited. Parties or any kind of large, loud gatherings are strictly not allowed. Failure to comply may result in intervention by building security or police and eviction for breach of contract. The Guest will be responsible for any fines or penalties imposed by local authorities or the condo association due to noise or misconduct by the Guest or their visitors. No Illegal Activity: All guests must use the property lawfully and safely. Any illegal, unsafe, or disturbing activities are prohibited. This includes (but is not limited to) the use or possession of illegal drugs, underage drinking, solicitation or commercial activities, and the use of firearms or weapons on the premises. No illicit or hazardous materials may be brought onto the property. Any violation will result in immediate eviction and, if appropriate, referral to law enforcement. Compliance with Laws: Both Host and Guest will comply with all applicable local, state, and federal laws, including Miami-Dade County short-term rental regulations and anti-discrimination laws. (This includes, for example, ordinances on trash disposal, noise/nuisance, maximum occupancy limits, pet regulations, fire/safety codes, and laws protecting tenants and neighbors from harassment or discrimination.) Guests confirm that their rental of this property will not violate any law or association rule (for instance, registered sexual offenders or sexual predators are prohibited from transient occupancy by local law; by booking, you confirm that no member of your party is such an offender, in compliance with Miami-Dade County Code. TRASH AND CLEANLINESS and Cleanliness Each Guest is responsible for maintaining basic cleanliness during their stay and for properly disposing of all trash from their unit: Trash Disposal: All routine trash should be tied securely in plastic bags and deposited into the trash chute located on each floor of the building (the trash room is located between apartment lines 06 and 08, close to the elevator zone). Do not leave any garbage bags or loose trash in hallways or outside the unit door at any time. Oversized Items: Large cardboard boxes should be broken down. Do NOT force oversized boxes or large items down the trash chute (this can cause clogs). Instead, such items must be taken to the designated dumpsters in the parking garage (please contact us or the front desk if you need directions). Prohibited Waste: Do not dispose of liquids, flammable materials, or lit cigarettes/cigars in the trash chute. Cigarette butts must be fully extinguished and cooled, and due to building policy, they should not be thrown in the common trash at all (since this is a non-smoking building, there should be no cigarette waste generated). No Littering: Trash, dirty linens, or towels must never be left in common areas, hallways, or on balconies. If the building implements a recycling program, please follow the posted guidelines. Guests should keep the unit in a reasonably tidy condition and avoid attracting pests (e.g. do not leave food out uncovered). Excessive Cleaning: While a standard cleaning is included after checkout, Guests are expected to leave the unit in reasonable condition (dishes reasonably cleaned, trash disposed, spills wiped, etc.). If the unit is left in an excessively dirty or messy condition beyond normal use, an additional deep cleaning fee of $150 up to $500 may be charged to the Guest to cover the extra costs.
DAMAGE CHARGES The Guest agrees and expressly authorizes Miami Vacation Rentals (M.V.R.) to charge their credit card to pay for cancellation penalties, early check-in fees, late check-out fees, replacements, damages, or loss fees as set forth in these terms and conditions, if any. In the infrequent case of damages to the property or stolen goods, the cost will be charged accordingly. For missing goods, the Guest authorizes a charge of 150% of their value. Any damages or issues with the unit must be communicated to the Host upon arrival or no later than noon on the next day. MAXIMUM OCCUPANCY AND MINIMUM AGE The maximum number of guests (occupants) allowed is specified in your booking and was confirmed at the time of reservation. Under no circumstances may occupancy exceed that number. If more guests are found in the unit than the authorized occupancy allows, the extra persons will be required to leave, and the registered Guest may be evicted immediately without a refund for violating this Agreement. In compliance with Miami-Dade County regulations, occupancy is further limited to no more than 2 persons per bedroom plus 2 additional persons for the entire property (excluding children under 3 years old), and never more than 12 persons total. The person making the reservation must be at least 21 years old, and is considered the responsible signing Guest. Visitors: Visitors (people not included in the reservation guest count) are only allowed with prior Host approval and must follow all house rules. No unregistered person may stay overnight. The total number of people at the property at any time (including visitors) should not exceed the maximum occupancy. All visitors must be accompanied by a registered Guest. The amenities (pool, gym, etc.) are for use by Guests and registered visitors only, and some amenities may have their own access rules (see below). If unauthorized people are detected at the property, or if undeclared guests or pets are brought in, it will be considered excessive occupancy/violation and may result in immediate termination of the stay without refund. Minimum Age: Guests who are 21 years old or older may book accommodations. Guests younger than 21 may only book if they are accompanied by someone who is at least 23 years old. Guests younger than 21 who are not accompanied by someone 23 or older are not permitted to book. We do not rent to minors without a parent/guardian present. Any reservations made under false pretenses (e.g. someone under 23 booking using another person’s identity) are considered falsified reservations and are subject to cancellation and eviction without refund. PARKING Parking is available for Guests in the building’s garage, subject to the following rules: Parking Assignments: Guests must park only in the designated areas for short-term rentals. Typically, these are the unassigned yellow spaces on floors 4 and 5 of the garage (do not park in any spot marked with a resident’s name or unit number). Oversized vehicles must not exceed a height of 7 feet, as that is the garage clearance. Garage Access: The building has two garage entrances: one via the hotel’s main entrance on McFarlane Road and another via Grand Avenue. Upon arrival, you may pull into the valet/loading area temporarily while checking in. Parking Violations: Miami Vacation Rentals is not responsible for any towing or tickets if you park incorrectly. Please follow the guidelines to avoid any issues. Do not park in handicap spots without a valid permit, do not block any vehicles or fire lanes, and abide by any posted signage. Vehicle Safety: Lock your car and take usual precautions. The garage is generally secure, but the Host is not responsible for theft or damage to vehicles on the property. We recommend not leaving valuables in plain sight in your vehicle. Guest Registration & Identity Verification Guest Registration and Identity Verification Requirement To comply with building regulations, local laws, and safety requirements, all guests staying at the property are required to complete a mandatory pre check-in registration process prior to arrival. As part of this process, valid government-issued photo identification is required for: The primary booker Accepted forms of identification include, but are not limited to: Passport Driver’s license Government-issued national or state ID
To verify the authenticity of the identification provided, guests may also be required to submit a real-time selfie during the registration process. This selfie is used solely to confirm that the person completing the registration matches the identification submitted and to help prevent fraud, unauthorized access, and identity misuse. All registration steps, including ID upload and selfie verification, are completed securely through our designated check-in system (SuiteOps). The information collected is used exclusively for identity verification, guest registration, building access authorization, fraud prevention, and compliance purposes, and is handled in accordance with applicable privacy, data protection, and consumer protection laws. Failure to complete the required registration process or to provide the requested identification and verification prior to check-in may result in delayed or denied access to the property, and may lead to cancellation of the reservation in accordance with the applicable cancellation policy and booking platform rules. By confirming the reservation, the Guest acknowledges and agrees to comply with this registration and identity verification requirement. PETS Pets are not permitted in this building under the Master Association rules. Only permanent residents are allowed to have small pets. Emotional support animals are not permitted for vacation rentals. If a Guest is found with an unauthorized pet, they may be asked to leave immediately without refund. FALSIFIED RESERVATIONS Reservations obtained under false pretenses, such as falsified information regarding the number of Guests or pets, will result in complete forfeiture of all payments and deposits, and the party will not be permitted to check in. Excessive occupancy or undeclared persons or pets also voids this agreement without refunds. SUBLETTING Subletting or leasing the apartment to another person is strictly prohibited. Violators may be evicted at any time and reported to booking websites. Any exceptions, such as family members, must be communicated in writing and approved in advance by the Host. RATE CHANGES Rates are subject to change without notice but will not change once full payment has been made. INCLUSIVE FEES Rates include a one-time linen and towel setup. Guests may request additional sets of linens or towels for free through the front desk or by contacting customer service via the booking platform. TOILETRIES AND OTHER AMENITIES We provide an initial supply of toiletries and amenities, including body wash, shampoo, conditioner, body lotion, hand soap (refillable bottles), as well as coffee (2 regular and 2 decaf), sugar (8), cream (8), dishwasher tablets (2), liquid dish detergent (1), laundry tablets (2), kitchen paper towels (1), sponge (1), toilet paper (4 per bathroom), bottled water (2 per fridge), and garbage bags (2 extra). These items are intended to last only for the first 24 to 48 hours of the stay. If additional supplies are needed, Guests may contact the Host to purchase more. Extra sets of sheets and towels are also located in the closet. EMERGENCIES Office hours are from 8:00 A.M. to 11:00 P.M. All non-urgent issues will be handled during these hours. In the case of emergencies outside office hours, M.V.R. will make its best effort to resolve the situation but may not always be able to do so. For any life-threatening emergency, Guests must call 911 immediately. In the event of an emergency where a Guest does not respond, the Host may enter the unit to attend to the emergency, always requesting permission first whenever possible. NO DAILY HOUSEKEEPING SERVICE There is no daily maid service included in your stay. Linens and bath towels are provided at check-in, but we do not perform hotel-style daily cleaning. Mid-stay cleaning services can be arranged for an additional fee if desired (subject to availability). Please contact us to schedule and pay for any mid-stay cleanings. Bed linens and towels are provided for the number of guests. There is a washer/dryer in the unit (for one-bedroom and larger units) or a coin-operated laundry room on the 6th floor for other units. Guests may wash towels/linens during the stay as needed. Please do not remove our linens or towels from the unit (if you need beach towels or extra items, ask us and we will try to provide them if available). SMOKING AND PARTIES Smoking/Vaping: This is a 100% smoke-free property. Smoking, vaping, or burning of any substance (including tobacco, marijuana, e-cigarettes, hookahs, incense, candles, etc.) is strictly prohibited inside the unit, on the balcony, and in all common areas of the building. The building is non-smoking, and there are sensitive smoke detectors; tampering with smoke detectors is a serious offense and will result in eviction and fines. If any evidence of smoking is found in the unit (smoke odor, ashes, burns, etc.), or if tampering with detectors is detected, the Guest will incur the $500 penalty as noted and additional fees for smoke remediation if necessary. Parties/Events: Parties, events, or large gatherings are NOT allowed. The reservation is for quiet enjoyment by the confirmed guests only. Any loud or disruptive gathering, or any event where the number of people exceeds the authorized occupancy, is considered an unauthorized party. If such an event is discovered, it will result in immediate eviction of all guests and visitors. The Guest will forfeit all payments and deposits, and will be charged the $500 penalty (at minimum) for violation of this rule. We also reserve the right to charge for any extra cleaning or damages caused by a party. Please note that the property is equipped with measures to detect noise and occupancy, and neighbors will alert management if disturbances occur. Zero tolerance on parties. CLEANING Guests should maintain the unit in a reasonable condition and perform a few basic checkout duties to help our turnover: During Stay: Please treat the space with respect. Use appliances and furniture as intended. Avoid spills on furniture or carpet; if an accident happens, clean it promptly to prevent stains or damage. Do not use towels or linens for cleaning up spills, removing makeup, etc. (extra charges may apply for irreparably stained linens). Only dye-free, powder-free detergents should be used in the washer (if unsure, use what we provided). Before Checkout: We kindly ask guests to (a) wash any used dishes or load and start the dishwasher (if available), (b) collect and dispose of trash in the trash chute as described, (c) place used towels in one pile (you do not need to strip beds; our staff will handle linens), and (d) double-check for personal belongings. The space should be generally tidy. You do not need to make beds or do heavy cleaning – we’ll take care of that – just leave it reasonably picked-up. Excessive Dirtiness: As noted, if the condition of the unit at checkout requires more than normal cleaning (for example, deep stains, foul odors, piles of trash, excessive mess), an additional fee will be charged. This is avoidable by following the above guidelines. Normal use of a home is expected – don’t worry about normal amounts of sand or a few dishes, that’s fine. We only charge if there is abuse of the space or extreme neglect. Damage or Breakage: If something breaks or is damaged during your stay, please inform us as soon as possible (even if you consider it minor). This helps us replace or fix it for you or the next guest. We understand accidents happen; prompt communication is appreciated and minor issues can often be resolved amicably. Significant damage or missing items will be charged as described in the Damage Deposit section.
AIR CONDITIONING, TV, WI-FI, APPLIANCES We strive to provide all amenities in good working order, but occasionally issues can arise. All appliances and utilities (A/C, TV, internet, kitchen appliances, etc.) are provided as-is and no guarantee is made that they will be operational 100% of the time. If something malfunctions, notify us and we will make best efforts to repair or replace it as quickly as possible. However, no refunds or discounts will be given for mechanical failures or service interruptions outside the Host’s control (e.g. HVAC breakdown, TV cable service outage, internet downtime, etc.). This also includes external factors like building maintenance, construction noise, or utility outages. Of course, if any essential service is not functioning (heat/AC, water, electricity), we will work to remedy the situation as fast as possible. Specific notes on amenities: Air Conditioning: South Florida is hot and humid. Please keep the doors and windows closed when the A/C is running to avoid overloading the system and causing condensation. The A/C is set to a comfortable range; do not set the thermostat excessively low (below 70°F) as it can cause the unit to freeze up. If the A/C is not cooling properly, let us know – do not attempt to repair it yourself. Washer/Dryer: Two-bedroom and larger units have an in-unit washer and dryer for your convenience. For studios or one-bedrooms without their own laundry, a coin-operated laundry room is available on the 6th floor. Follow the instructions on machines and do not overload. We are not responsible for any damage to or loss of clothing or personal items using the laundry facilities, so please double-check machines before and after use. Wi-Fi and TV: We provide complimentary Wi-Fi internet access and basic TV service. The network name and password will be provided at check-in. Internet speed and service reliability are subject to the local provider; we cannot guarantee against outages or slowdowns, but the service is generally high-speed. The TVs have Xfinity cable with local channels and smart TV capabilities (or a Roku/Fire Stick). You may log in to your own streaming services (Netflix, etc.), but please remember to log out of your accounts before departure. The Host is not responsible for any charges or privacy issues if you forget to log out. Pay-Per-View / On-Demand Purchases: Any on-demand content purchases (movies, events) made through our TV service during your stay will incur a $100 charge (this covers the cost of the purchase plus an inconvenience fee). We advise against ordering any paid content on the TVs. If you do, you agree that we may charge your card for the fees. Remote Controls: TV and A/C remotes are provided. Typically, TV remotes will be on the dresser under the TV or on a nearby table. Please leave all remotes in the unit upon checkout. Missing remotes will incur a replacement fee. Elevator Keycards/Fobs: Your keycard grants access to the elevator and certain amenities. Do not lose it. Return all keycards at check-out (each missing card is $50 to replace). Maintenance: If any appliance or fixture is not working (plumbing issue, light bulb out, etc.), please contact us. We may need to enter the unit to fix the issue (with notice or arrangement) or arrange building maintenance to address it. By agreeing to this contract, you authorize us and/or building staff to access the unit to perform necessary repairs or maintenance, ideally scheduled at a time convenient for you when possible. SWIMMING POOL The building’s swimming pool and whirlpool (hot tub) are shared amenities operated by the on-site hotel/condo association. Pool hours are generally dawn to dusk (exact hours may be posted as seasonal changes occur). Please adhere to all posted pool rules in addition to the following: Authorized Users: The pool and hot tub may only be used by registered Guests and their registered visitors. To access the pool area, you may need to show your room key or elevator keycard. Towels for pool use are typically provided by the hotel staff at the pool desk – present your room key/elevator card to receive towels. Do not remove hotel pool towels from the pool area; if you bring them to your room, please leave them in the room so staff can retrieve them. Use at Own Risk: There is no lifeguard on duty. All use of the pool and hot tub is at your own risk. The Host/Building is not responsible for accidents or injuries in the pool area. No running, diving, or rough play in the pool area. Guests agree to hold the Host harmless from any liability for use of the pool/hot tub. Children: Children must be supervised at all times in the pool area. Children under 12 must be accompanied by a responsible adult in the pool. Children under 6 are not allowed in the hot tub for health and safety reasons. Small children (under 3) must wear appropriate swim diapers and flotation devices when in the pool. Parents/guardians are fully responsible for their children’s safety and behavior. Conduct: Please keep noise to a minimum to respect other guests. No disruptive or unsafe behavior (e.g. no intoxication, no yelling across the pool). No pets are allowed in the pool area (service animals are permitted only if absolutely necessary for their handler and they should not enter the water). No inflatables, large float toys, surfboards, etc. in the pool. No running, jumping, or diving. No glass containers in or around the pool area. Attire: Proper swimwear is required. When walking to/from the pool through the lobby or elevators, cover-ups and footwear are required (no dripping swimsuits in elevators, please). Topless sunbathing is prohibited. Food & Beverages: Outside food and beverages are generally not allowed in the pool area unless specifically permitted. The building may have a poolside bar or service; only food/drinks served by hotel staff are allowed poolside. (You may have water in plastic bottles, etc., but please no coolers or picnics at the pool.) Hygiene: Shower before entering the pool or hot tub (this is often required by law and definitely appreciated by all). If you have sunscreen or oil on, use a towel on lounge chairs to avoid stains. No spitting or spouting water, and please take frequent bathroom breaks for children. Closures: Occasionally, the pool or hot tub may be closed for maintenance or private events. Use of these amenities is not guaranteed under this Agreement, and such closures will not entitle Guest to any refund or concession. We thank you for understanding that these are shared facilities beyond our direct control. EXERCISE CENTER AND SPA The building features a fitness center/gym and possibly a spa. These facilities are typically open from 6:00 A.M. to 10:00 P.M. daily (hours may vary). Use of these facilities is a privilege and comes with rules: Authorized Users: The gym and spa facilities are for use by Guests and their immediate family only. Registered visitors may only use the facilities when accompanied by the registered Guest who is hosting them. Do not loan your key to anyone not in your group. Age Restrictions: No children under 12 are allowed in the fitness center. Minors 12-15 must be accompanied by a responsible adult. Those 16 and older may use the gym on their own, but please use good judgment. The spa area (if any sauna, etc.) may have 18+ age requirements – follow posted rules. Attire and Equipment Use: Proper workout attire, including shirts and closed-toe athletic shoes, is required in the gym. Wipe down equipment after use with the provided disinfectant or towels (for hygiene). Do not drop weights or misuse equipment. Limit your time on cardio machines to 30 minutes if others are waiting. No Food or Glass: No food is allowed in the gym. Water or sports drinks in a closed container are fine. No glass containers for safety. Personal Trainers: Outside personal trainers or instructors are not allowed unless approved by the building management and any required fees are paid. Generally, only the on-site staff trainers (if any) can train guests. Spa Services: If the building has a spa and you wish to use services (massage, etc.), please coordinate with the hotel/spa front desk. Those services might not be included and may have additional costs and their own policies. No Liability: Use of the gym/spa is at your own risk. The Host and building are not responsible for any injuries or accidents that occur due to use of exercise equipment or facilities. By using the gym, you represent that you are physically fit to do so and assume all risks. Please use equipment properly and consult a doctor if you have any health concerns. Lockers: If lockers are available, you may use them while working out (bring your own lock or borrow from the front desk if possible). Do not leave personal items unattended. The Host and association are not responsible for lost or stolen property in the gym or lockers. POOL DECK / COMMON AREAS In addition to the pool and gym, other common areas such as lounges, business centers, or rooftop decks may be available. When using any common area, be respectful of others, keep noise to a minimum, and clean up after yourself. Follow all posted guidelines for any shared space. Quiet hours also apply in outdoor areas (no loud noise after 10 P.M.). Do not leave personal belongings unattended in common areas; any items left may be removed by staff. PACKAGES Guests may receive packages or mail during their stay. To ensure delivery, address shipments to the building’s address (2889 McFarlane Rd, Coconut Grove, FL 33133) and include the unit number and the name of the main Guest on the label. For example: “Guest Name, Unit 1608, [Building Address].” Please be aware of the following: Reception of Packages: The building front desk or concierge may hold packages for you. You are responsible for tracking and picking up your items. We recommend scheduling deliveries when you will be present or shortly after. No Liability: Miami Vacation Rentals and the building are not responsible for lost, misdelivered, or uncollected packages. We will not sign for or secure your packages unless arranged. Timing: Only send packages to arrive during your stay dates. Packages that arrive before you check-in may be refused or held until your arrival. Any package arriving after your checkout will be returned to the sender unless other arrangements are made. Post-Checkout Forwarding: If a package or piece of mail is delivered for you after you have departed, you may request us to forward it. We will only do so at our discretion. You will need to pre-pay shipping costs plus a $20 handling fee for our staff’s time. We will open any such package to verify contents and safety before forwarding (for security reasons). If you do not arrange forwarding within a week, we reserve the right to return the item to the sender or dispose of it. Deliveries (Food, etc.): For food deliveries (UberEats, etc.), please make sure the driver has your name and unit number. They may need to call you from the lobby. The front desk generally will not send delivery people up unannounced.
Additional Rules and Information Check-Out Inspection: The Host or a staff member will inspect the unit after check-out. If any damage or missing items are noted, or if the unit requires extraordinary cleaning, we will document it with photos and notify you. Charges will be applied as necessary per this Agreement. By accepting this Agreement, you consent to such post-checkout charges if warranted and documented. Host Right of Entry: The Host (and building management/maintenance) reserves the right to enter the unit to address emergencies or perform necessary maintenance. We will always knock and try to notify you beforehand. For non-emergency maintenance, we will schedule with you in advance when possible. In an emergency where there is an immediate threat to life or property and you cannot be reached or are unable to grant access, the Host may enter the unit without prior consent to mitigate the emergency (e.g. water leak, fire, or if a welfare check is needed because you are unresponsive). Entry in such cases will be limited to resolving the issue at hand. Emergency Contact and Procedures: Our office hours are roughly 8:00 A.M. to 11:00 P.M. for routine matters. For any life-threatening or critical emergency, dial 911 immediately. If you have an urgent issue with the property outside of office hours (e.g. plumbing leak, power outage), contact us and we will do our best to assist promptly (we have staff on-call for true emergencies, though response times may vary). For building-wide emergencies (fire alarms, etc.), follow the building’s emergency exit instructions posted on the unit door. The nearest hospital ER is fairly close (Jack son Memorial or Mercy Hospital in Coconut Grove). We provide a fire extinguisher in the unit (usually under the kitchen sink or by the entryway) — familiarize yourself with its location. Smoke detectors are installed for your safety; do not disable them (an alarm will notify security if they are tampered with). If a smoke alarm sounds, evacuate and call 911 if needed. Always prioritize your safety and the safety of your companions. Local Ordinances: Guests must comply with all local ordinances, including those regarding noise, public nuisance, trash, parking, and occupancy limits as mentioned. The property is a licensed short-term rental in Miami-Dade County (Certificate of Use posted inside the unit as required). The Guest agrees not to do anything that would put the Host in violation of these local laws. For example, if the property is in a designated quiet zone or residential area, the Guest will ensure their conduct (and their guests’ conduct) does not trigger complaints. Any fines issued by authorities due to Guest’s actions (noise violations, illegal parking, etc.) will be charged to the Guest. Falsified Reservations: Any reservation obtained under false pretenses will result in loss of payments and immediate eviction. This includes providing a false name, age, number of occupants, or purpose of stay. For instance, if you book stating 2 people are coming but 6 actually show up, or if you book for a “quiet family trip” but actually plan a party, this Agreement will be considered breached. We reserve the right to cancel or refuse check-in if fraud is suspected. If you have any changes in your group or plans after booking (e.g. number of guests changes or you want to have a small gathering), communicate and get written approval in advance. We are reasonable but require honesty and transparency. Subletting and Transfers: The Guest shall not sublet the property or assign this Agreement to any other party. The person making the reservation must be present for the duration of the stay (unless we specifically agree in writing to an exception, such as a reservation made for a family member). You may not rent this unit on someone else’s behalf or list it on another platform. Any attempt to sublease, re-rent, or transfer your stay to another person without consent will result in cancellation with no refund and potential reporting to the booking platform. If you are booking for a third party (e.g. an employer booking for an employee), let us know in advance and ensure all adult guests sign this Agreement. Additional Services: If you request any additional paid services (extra cleaning, equipment rentals, etc.), those charges must be paid upfront and are non-refundable once provided. Property Rules & Manuals: We provide a house manual or digital guidebook with useful information (Wi-Fi info, appliance instructions, local tips, etc.). Please review it upon arrival. It may contain additional rules specific to the property (like how to operate the thermostat or when to put out the trash if applicable). These instructions are considered part of house rules for keeping the property in good condition. Owner’s Closets/Areas: You may find certain cabinets or closets locked for owner use – these are off-limits to guests. Tampering with locked closets or attempting to force them open will result in damage charges and possible eviction. Community Respect: Please be friendly and courteous with neighbors and building staff. Any harassment of other residents or staff, or behavior that creates a hostile environment, is grounds for eviction. Our goal is for everyone to have a peaceful experience. Written Exceptions: Any exception to these policies (waiver of a rule, permission for something normally not allowed) must be approved in writing (text/email is fine) in advance by the Host. Verbal agreements or assurances are not binding. However, no such approval shall waive our right to enforce all other provisions of this Agreement. For example, if we allow a pet as an exception, that doesn’t mean parties are suddenly allowed – all other rules remain in effect. Limitation of Liability and Indemnification Guest’s Responsibility: Guests agree to use the property and its amenities at their own risk. The Guest assumes all liability for any harm, injury, loss, or damage to themselves or their invitees resulting from any activities or use of amenities on the premises, except to the extent caused by the gross negligence or willful misconduct of the Host. All children or minors in the group must be supervised at all times by an adult. Indemnification: Guests agree to indemnify and hold harmless the Host and Miami Vacation Rentals (and their owners, agents, and employees) from any and all claims or liability arising out of or related to the Guest’s (or their invitees’) use of the premises, including but not limited to claims for personal injuries or property damage or loss, theft, or vandalism. This indemnification includes any claim or liability from neighbors or third parties due to the Guest’s actions (for example, damage to a neighboring unit, or fines for noise or ordinance violations as discussed). Guests shall also indemnify the Host for any attorney fees or costs incurred in defense of any such claim, as described further below. Personal Property: The Guest’s personal property (including vehicles) is not insured by the Host. Any personal property of the Guest that is left, stored, or kept on the premises shall be at the Guest’s sole risk. Guests acknowledge that any insurance the Host or property owner may carry is not intended to cover the Guest’s own belongings or personal injuries. Guests are encouraged to obtain their own travel/renters insurance to cover their belongings and any trip interruptions if desired. The Host shall not be responsible for loss or damage to Guest’s valuables, cash, jewelry, electronics, or other items. Safeguard your things by locking doors and windows when out. Amenities and Condition: The Host does not assume liability for the condition of roads, driveways, walkways, stairways, railings, furnishings, or other areas of the property, but will make efforts to maintain them in safe condition. If you notice any condition that could be dangerous (e.g. a broken step, a slippery area), notify us immediately. By proceeding to use an area or item, you are assuming the risk of that use. Use flashlights or phone lights when walking at night if needed; watch your step on uneven surfaces. Acts of God: The Guest shall not hold the Host liable for any temporary defect or stoppage in supply of public utilities (water, electricity, gas, internet) nor for any loss or damage caused by natural conditions (such as flooding, storms, hurricanes, or other natural disasters). If an official evacuation order or a government prohibition on short-term rentals is issued for our area during your stay, we will follow the law regarding any refunds or cancellations (which may supersede our cancellation policy). Otherwise, no refunds will be given for inclement weather. Prosecution for Damage/Theft: Miami Vacation Rentals reserves the right to prosecute or seek restitution from any guest who causes willful damage, theft, or vandalism to the unit or building property. We will pursue civil and/or criminal remedies as appropriate. By agreeing to this contract, you acknowledge that causing significant damage or removing items from the property with intent to steal is a breach of contract and may also be a crime (the unit is equipped with an inventory of items and some security measures to track these issues). General Legal Provisions Entire Agreement: This Agreement constitutes the entire agreement between the Host (Miami Vacation Rentals) and the Guest. It supersedes any prior oral or written agreements or representations. No alteration or amendment to this Agreement will be valid unless in writing and signed by both parties (except for reasonable house rule updates as noted below). If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, it shall be stricken only to the narrowest extent necessary, and the remainder of the Agreement will remain in full force and effect. House Rule Updates: We may update these House Rules from time to time to comply with new laws or platform policies. Guests will be notified of any substantial changes that affect their stay. However, the version in effect at the time of booking (or any updated version accepted by the Guest) will govern the reservation. Governing Law & Venue: This Agreement is governed by Florida law. Any disputes related to this rental shall be resolved exclusively in the courts of Miami-Dade County, Florida. The Guest consents to Florida jurisdiction and venue, including personal jurisdiction for non-Florida residents. Service of Process: If the Guest cannot be personally served in Florida, the Guest appoints the Florida Secretary of State as agent for service of process and grants Miami Vacation Rentals limited authority to accept service on the Guest’s behalf. The Guest may contest claims on their merits but not based on lack of service. Attorney’s Fees & Costs: In any dispute arising from this Agreement, the prevailing party is entitled to recover reasonable attorney’s fees and costs, including those related to enforcement, litigation, appeals, and credit card chargebacks, to the extent permitted by law. Credit Card Chargebacks: Chargebacks are not an appropriate method of pursuing a refund. We will always work with you in good faith to resolve any billing disputes. By agreeing to this contract, the Guest acknowledges that filing a false or meritless credit card chargeback after staying at the property constitutes fraud and breach of contract. In the event of an unfounded or frivolous chargeback by the Guest, the Guest agrees to pay an additional liquidated damages fee of $2,500 to Miami Vacation Rentals. This amount is in addition to reimbursing any chargeback amounts, bank fees, and attorney’s fees/costs as described above. The purpose of this fee is to compensate the Host for the time and administrative burden of addressing wrongful chargebacks. (This clause does not apply to a legitimate bank error or identity theft issue; it is aimed at situations where a Guest stays at the property and then attempts to avoid payment by disputing the charge without valid cause.) Recoverable Costs: In addition to attorney’s fees, if Miami Vacation Rentals or the Host incurs other expenses in enforcing this Agreement or collecting amounts due, those costs will be recoverable as well. Recoverable costs include, but are not limited to: costs of investigation, travel expenses to attend court, fees for expert witnesses or consultants, court filing fees, mediation or arbitration fees, costs of postage and service of process, and any other reasonable expenses related to resolving a dispute or collecting payment. Waiver & Severability: The Host’s failure to enforce any provision does not waive the right to enforce it later. If any part of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in full effect. Acknowledgement & Acceptance: By booking and checking in, the Guest confirms they have read, understood, and agree to comply with this Agreement and House Rules. Violations may result in fees, eviction, and/or legal action. Host’s Remedies: Any breach may result in remedies including retention of the security deposit, charges for damages or fines, eviction, and reporting to the booking platform, which may affect the Guest’s account. Legal Disclosures: Any jurisdiction-required disclosures (including applicable Miami-Dade County or City of Miami regulations) are incorporated herein. By submitting payment and/or occupying the property, the Guest agrees to be bound by all terms and conditions of this Agreement.
