SHORT-TERM RENTAL AGREEMENT & HOUSE RULES

IMPORTANT NOTICE
By booking, making payment, completing check-in, or occupying the unit, the Guest agrees to all terms and conditions in this Agreement. This Agreement is governed by Florida law and applicable Miami-Dade County regulations.
- INTRODUCTION & KEY HOUSE RULES (READ FIRST)
Welcome and thank you for choosing our property. Please take care of it — it is very valuable to us.
Core rules (strictly enforced):
Parties or noisy meetings are not allowed under any circumstances.
Please refrain from dyeing your hair while in the condo to avoid accidents and permanent staining.
Don’t forget to take out the trash before you leave.
As for the rest: relax and enjoy your stay!
Violations may result in penalties, eviction, and/or charges to the card on file.
- ARRIVAL & DEPARTURE
Arrival and Departure Times
Check-in: After 3:00 PM
Check-out: By 11:00 AM (local time)
If you need flexibility, Landlord will try to accommodate if communicated in advance (not guaranteed).
- PAYMENT & CREDIT CARD REQUIREMENTS
Payment
The total amount for your stay, including room, taxes, cleaning, deposit, resort fees, and any other charges, is due before arrival. Payment can be made by major credit cards (Visa, MasterCard, Discover, American Express) or ACH.
Any optional hospitality services or property add-ons requested by the guest (including but not limited to Early Check-In, Late Check-Out, pet fees, parking) are managed and processed through our connected professional Property Management Software. By confirming this reservation, the guest explicitly consents to these specialized operational charges, which will be invoiced via our secure external payment gateway and are fully authorized and exempted from standard off-platform restrictions.
Card Presentation / Verification (Operational Requirement)
PLEASE NOTE: the original credit card used to make the reservation should be shown upon arrival. If it is not possible, the full amount will be charged to a new card under the name of the main guest who made the reservation, and prior payments on the original card will be reimbursed as soon as possible.
Clarifying note (added for enforceability): This requirement is for fraud prevention and chargeback mitigation. Where an OTA provides a virtual card or prohibits card presentation requirements, the booking platform’s payment rules control.
- CANCELLATIONS
Reservations may be cancelled up to 30 days before arrival (or as indicated on the booking website), subject to a 3.5% administrative fee. After that date, the total of this contract will be charged.
There shall be no refunds for shortened stays due to weather conditions, medical/family emergencies, travel delays, or other commitments. The same applies to monthly renters who make a change resulting in a shortened stay—except where required by law or platform policy.
- BUILDING REGULATIONS (ICON OPERATIONS — DO NOT SKIP)
At check-in you will be required to sign the building rules and take a picture of you. These rules are established to ensure enjoyment and safety of all residents and are strictly enforced.
It is not uncommon that the Grievance Committee sanctions condo owners with fines of $100 or higher, in which case guests would be responsible for payment, which would be deducted from any deposits.
Building Rules Summary (as provided)
TRASH: Trash rooms are located next to units ending in 01. Garbage bags should be tossed into the trash chute and no bags should be left on the floor. Boxes must be taken to the ground level.
NOISE: No noise should be heard between 11:00 PM and 7:00 AM. Noise must not cause a nuisance at any time.
DRESS CODE: Shirts and/or cover-ups required in all common areas. Footwear required in common areas.
ODORS: Please refrain from smoking indoors.
BALCONY: Under no circumstance should any item be thrown off the balcony. No items should be hung on balcony railings.
Enforcement:
Should a guest/party be forced to abandon the unit by security, no compensation/refund can be claimed. Proper behavior is required at all times.
- MAXIMUM OCCUPANCY & MINIMUM AGE
Maximum occupancy:
Studio: 3 persons
One-bedroom: 4 persons
Two-bedroom: 5 persons
No additional guests are allowed at any time.
Minimum age requirement: 23 years to reserve.
7) DAMAGE POLICY (SECURITY DEPOSIT OR DAMAGE WAIVER)
Guests must select one (1) damage coverage option prior to check-in. Access will not be granted until a selection is confirmed.
Option 1: Refundable Security Deposit
A $1,000 refundable security deposit will be authorized on the Guest’s credit card prior to check-in.
The deposit will be released after check-out, provided there is no damage beyond normal wear and tear, missing items, policy violations, or excessive cleaning.
Management is authorized to deduct documented damages.
Option 2: Damage Waiver Fee
A non-refundable damage waiver fee is payable prior to check-in.
Covers accidental damages up to $500.
Exclusions:
The waiver does not cover damages exceeding $500, negligence, misuse, intentional acts, unauthorized parties, smoking violations, appliance misuse, or loss/damage to non-covered items such as key fobs, access cards, parking passes, or amenity cards.
8) FOBS, KEYS, AMENITIES CARDS, PARKING MAGNETIC CARD (ICON SPECIFIC)
In the case of damage or loss:
$100 fee for each GUEST or PARKING MAGNETIC CARD
For coded keys plus FOB, $250 fee
Note: FOBS are required for elevators and for access to the pool and other areas.
For amenities cards: please be aware they are not room keys and there is a cost to replace them. Only clients renting a parking space from us get a parking magnetic card.
9) PET POLICY (NOTE: YOUR TEXT CONTAINS TWO PET RULES)
A) Pet Policy for Our Vacation Rental Property (as provided)
At our vacation rental, we understand that pets are an important part of your family. To ensure a comfortable and enjoyable stay for all guests, we have established the following rules for hosting pets:
Pet Types: Well-behaved dogs and cats. Other types may be considered upon prior approval.
Size Limit: Dogs ≤ 75 pounds; cats must be domesticated.
Number of Pets: Max one pet per unit.
Pet Fees: Non-refundable $150 per pet.
Behavioral Requirements: Trained, quiet, non-disruptive, non-aggressive.
Supervision: Not unattended unless crated; owner responsible for damages.
Cleanliness: Clean up inside unit and common areas.
Allergies: Guests acknowledge pets have been present.
Outdoor Areas: Leashed; dispose of waste properly.
Compliance: Follow local laws.
By agreeing to these conditions, guests with pets can enjoy a relaxing stay while ensuring a pleasant experience for all visitors.
B) Building/Lease Rule on Pets (as provided)
PETS – Are not permitted, not even emotional support dogs. Rules for vacation rentals differ from long-term ones.
How this is handled (important):
Because both clauses exist, the controlling rule is: Pets are NOT permitted at ICON for vacation rentals (including emotional support animals), unless M.V.R. provides written approval AND the building/association permits it for short-term stays. Service animals will be handled in compliance with applicable law and OTA policies.
10) SUBLETTING / FALSE RESERVATIONS / RATE CHANGES
Falsified Reservations
Reservations obtained under false pretenses (e.g., number of guests or pets) will result in complete forfeiture of all payments/deposits and the party will not be permitted to check in. Excess occupancy or undeclared persons/pets voids this agreement with no refunds.
Subletting
Subletting or leasing to another person is illegal and sublessees/tenants can be evicted at any time. Sublessors will be reported to booking websites. Exceptions must be communicated and accepted in writing.
Rate Changes
Rates subject to change without notice, but not after full payment has been made.
11) PARKING (ICON OPERATIONS — KEEP AS IS, STRUCTURED)
A) Over than a month ($250 per month)
Fill in the form and send it.
The master office will then provide the guest with an amenity card.
Valet parking will then register the car by using the license plate.
Parking costs $250 per month (Starting every 1st of the month). E.g. If parking is from 15th June to 15th July, guests will have to pay $500.
Guest must go in person to the building office and:
Pay $250 in cashier’s check or money order
Show rental agreement or car title (both under guest name)
Show driver license
Guests should be aware the building office closes at 4:00 PM Friday and opens 10:00 AM Monday on regular weeks.
B) Under 30 Days (Two Alternatives)
For stays shorter than 30 days:
Pay directly to Regular Valet Parking at the lobby entrance.
Pay upon arrival to M.V.R. for a self-parking spot less than 200 yards away at a lower cost. Spaces are limited and reservations are encouraged. M.V.R. does not guarantee availability or rates.
C) Required Waiver for Self-Parking with M.V.R. (as provided)
If you opt for self-parking with M.V.R., you agree to the following:
“I acknowledge that I will park my own, or rented, vehicle at the designated lot, and agree to release, waive, discharge, and covenant not to sue M.V.R. on account of injury to my property, whether caused by negligence or otherwise, and I agree to indemnify and save and hold harmless Park Offerors (the parking owner or manager) from any loss, liability, theft, damage or cost that I may incur due to parking my vehicle on the premises. I realize that the lot is not locked, secured or guarded and will be monitored only sporadically, and I expressly agree that this clause is intended to be as broad and inclusive as Florida law allows and that, if any portion is held invalid, the balance shall continue in full legal force and effect”.
12) INCLUDED FEES & STARTER SUPPLIES
Inclusive Fees
Rates include a one-time linen & towel setup. Extra sets of linen/towels are available per request.
Toiletries and Other Amenities
The landlord will make best efforts to provide an initial supply of body wash, shampoo, conditioner, hand soap, coffee, sugar, cream, dishwasher tablets, liquid dishwasher, washer tablets, kitchen towels, toilet paper, water bottles, garbage bags. These items are not guaranteed and are intended only for the first 24–48 hours.
13) EMERGENCIES & OFFICE HOURS
Office hours are 8:00 AM to 11:00 PM. For emergencies after hours, we will make the best effort to solve the issue but it may not always be possible. Non-urgent issues will be handled during office hours.
14) HOUSEKEEPING, LOCK-OUTS, CLEANING, TRASH
No Daily Housekeeping
Daily maid service is not included, but is available per request.
Lock-Out
If guests are locked out due to no fault of the Landlord, we will try to solve as soon as possible.
Cleaning
Guests are expected to leave the apartment in decent condition. Trash must be disposed of by guests (trash chute on every floor next to apartment xx01). Trash must be placed in plastic bags.
If returned extremely unclean, an extra cleaning fee of $150 to $500 will be charged.
Toilet / Plumbing
Toilets clog if improper materials are flushed. If caused by misuse, damages up to $150 may be charged.
15) SMOKING & PARTIES (STRICT)
Smoking in the unit is prohibited. Parties are prohibited. If smoking or parties occur, a $500 penalty will be applied, plus additional costs if remediation is required.
16) A/C, TV, WI-FI, APPLIANCES (AS-IS)
Functioning is not guaranteed. Repairs will be made as soon as possible, but no refund shall be given for malfunctioning, lack of signal/content, internet disruption, lack of A/C, or appliance issues.
17) SPA & SWIMMING POOL (ICON OPERATIONS — ACCESS / TOWELS / CARD RETURN)
Please note the Association will only give access to registered guests.
By presenting your AMENITIES CARD, you will obtain one or two pool towels or one spa towel. Your AMENITIES CARD will be returned to you upon returning the towels.
IMPORTANT: please verify that the right card is returned to you, or the $100 lost card fee will be charged.
Tenants agree not to take towels or linens from the unit. Hot tubs have health risks. The landlord is not responsible if the Condominium cannot provide a towel, or if the pool/amenities are closed for maintenance, renovation, or other purposes.
The tenant understands the pool/hot tub is strictly an amenity and not guaranteed. Any interruption, non-availability, or special regulations enacted by the Master Association will not violate any terms of the agreement.
18) PARCELS DELIVERED DURING STAY
Guests can receive parcels or envelopes during their stay. Please advise Landlord if you intend to do so.
Guest exonerates Landlord from loss/damage to parcels/envelopes. Any package not claimed after departure will be returned to the sender.
19) WRITTEN EXCEPTIONS / WAIVERS
Any exceptions to policies must be approved in writing in advance. M.V.R. does not waive any rights under this Agreement or applicable law unless expressly set forth in writing.
20) DAMAGES / LIABILITY / INDEMNIFICATION
Tenants and Tenants’ guests indemnify and hold harmless Landlord and M.V.R. against all claims of personal injury, property damage, loss, theft, or vandalism arising from use of the premises regardless of the nature of accident/injury/loss.
Tenant recognizes that any insurance the Landlord maintains does not cover Tenants’ personal property and Tenants should purchase their own insurance if desired.
M.V.R. reserves the right to prosecute authors of damages or losses to the condo or building.
21) ENTIRE AGREEMENT
This Agreement constitutes the entire agreement and supersedes all prior oral or written agreements. If any term is deemed unenforceable, such term shall be stricken and shall not invalidate the remainder.
22) FORUM / CHOICE OF LAW (MIAMI-DADE)
Florida law governs. Any suit must be brought in a court of record in Miami-Dade County, Florida. Tenant consents to jurisdiction and waives objections to venue.
23) SERVICE OF PROCESS
Tenant designates the Florida Secretary of State as agent for service of process in civil actions arising from enforcement of this Agreement. Tenant retains right to contest jurisdiction except objections based on defect in summons or service. Tenant agrees this agreement provides M.V.R. limited power of attorney to execute a waiver of service of process form on Tenant’s behalf.
24) ATTORNEYS’ FEES & COSTS
If Landlord or M.V.R. is the prevailing party in any dispute (including chargebacks), Landlord/M.V.R. shall be entitled to recover reasonable attorneys’ fees and costs incurred before suit, during suit, and on appeal, including fees for determining entitlement and quantifying fees/costs. Guest waives rights under Section 57.105(7), Florida Statutes, to prevailing party attorney’s fees.
25) CREDIT CARD CHARGEBACK FEES
If it is determined guest wrongfully files a chargeback, guest agrees to pay all expenses and costs incurred by M.V.R. to recover funds and additional liquidated damages of $2,500.00 due to harm caused.
26) RECOVERABLE COSTS
Recoverable costs include taxable and non-taxable costs including:
(a) investigation; (b) travel; (c) information technology support; (d) consultant/expert witness fees; (e) court reporter/transcripts; (f) mediator fees; and (g) other reasonable costs incurred by prevailing party.
ACCEPTANCE
The guest accepts that payment of reservation implies acceptance of all terms and conditions in this contract.
