RENTAL AGREEMENT AND BOOKING TERMS
Agreement and Acceptance These Rental Agreement and Booking Terms (Agreement) apply to each booking of the Property. By making a Booking, paying any amount towards a Booking, or otherwise confirming acceptance of the Booking, the Guest acknowledges that they have read, understood and agreed to be bound by: (a) this Agreement; (b) the Booking details; (c) the cancellation, amendment and payment policy disclosed or otherwise applicable to the Booking at the time the Booking is made; (d) any property-specific House Rules disclosed or made available to the Guest; and (e) where the Booking is made through a third-party online travel agency or booking platform (OTA), the applicable terms, policies and conditions of that OTA. Together, these documents and policies constitute the terms applicable to the Booking. This Agreement becomes binding when the Booking is confirmed. The cancellation, amendment, refund and payment conditions applicable to a Booking may vary according to the booking channel, rate, Property, dates or other conditions selected when the Booking is made. The conditions applicable to the particular Booking are those disclosed or otherwise incorporated into the Booking at the time it is made and may be administered and enforced by APM accordingly. Nothing in this Agreement permits APM or the Host to retrospectively impose a materially less favourable cancellation or amendment policy upon an existing Booking unless agreed by the Guest or otherwise permitted by law. Nothing in this Agreement excludes, restricts or modifies any right, guarantee or remedy which cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
Parties and Role of Property Manager The Booking records the relevant details of the reservation, including the Property, Guest details, Rental Period, number of occupants, price, fees and other applicable information. Bookings may be made: (a) directly with APM through its website, telephone, email or another approved booking method; or (b) through an OTA. Each Booking is subject to the cancellation, amendment, payment, refund and other booking conditions applicable to the particular rate and booking channel selected by the Guest at the time of booking. For a direct Booking, the applicable policies may be displayed during the booking process, included in the Booking confirmation, incorporated into this Agreement or otherwise provided to the Guest before the Booking is confirmed. For a Booking made through an OTA, the applicable OTA policies and conditions may apply in addition to this Agreement. Where an OTA policy governs the processing of a cancellation, alteration, refund, payment or other Booking matter, APM may administer the Booking in accordance with that policy. The Guest acknowledges that cancellation and amendment conditions may differ between booking channels and between different rates offered for the same Property. APM is authorised by the Host to administer the Booking and to exercise the Host's rights in relation to the Booking in accordance with this Agreement and the policies applicable to the Booking.
Booking The Booking records the relevant details of the reservation, including the Property, Guest details, Rental Period, number of occupants, price, fees and any other applicable information. Bookings may be made directly with APM through its website or other approved means, or through an OTA. The Guest must provide complete and accurate information when making the Booking and must promptly notify APM if any information changes. A Booking is not transferable without the prior written approval of APM. The person making the Booking must be at least 18 years of age and must have legal capacity to enter into this Agreement.
Rental Party The Rental Party comprises the Guest and all other persons recorded as occupants in the Booking. The Guest is responsible for: (a) ensuring all occupants are accurately recorded; (b) ensuring the number of occupants does not exceed the maximum occupancy of the Property; (c) ensuring all members of the Rental Party and visitors comply with this Agreement, the House Rules and applicable laws; and (d) the conduct of all members of the Rental Party and visitors to the Property. Persons not recorded in the Booking must not stay overnight at the Property without prior approval from APM. The Guest must not permit the Property to be used by any person other than the Rental Party and permitted visitors.
Property The Property is the accommodation identified in the Booking. References to the Property include the accommodation itself together with its fixtures, furnishings, appliances and any areas or facilities made available to the Rental Party as part of the Booking. Photographs, floor plans, descriptions and other marketing materials are provided to reasonably describe the Property. Minor differences in furniture, decoration, landscaping, views, condition or other non-material characteristics may occur from time to time.
Rental Period, Check-in and Check-out The Rental Period commences at 4:00 pm on the check-in date and ends at 10:00 am on the check-out date unless otherwise agreed in writing. Early check-in and late check-out are not guaranteed and must be approved by APM. The Rental Party must vacate the Property by the applicable check-out time. Unauthorised late departure may result in additional charges reasonably incurred as a consequence, including additional cleaning, staffing or accommodation costs. The Guest acquires only a temporary right to occupy the Property for the Rental Period. Nothing in this Agreement creates a residential tenancy or gives the Guest any proprietary interest in the Property.
Rates, Fees and Payment The accommodation price, cleaning charges, fees, taxes and other amounts payable are those specified in the Booking.
The Guest must pay all amounts by the dates specified in the Booking or applicable payment schedule. Rates may be offered subject to different payment, cancellation and amendment conditions. For example, a discounted or non-refundable rate may have more restrictive cancellation conditions than another rate offered for the same Property. By selecting and confirming a particular rate, the Guest accepts the conditions applicable to that rate. APM may process payments, refunds, credits, cancellations, amendments and other Booking transactions in accordance with: (a) the Booking; (b) the cancellation, amendment and payment policy applicable when the Booking was made; (c) this Agreement; and (d) where applicable, the rules and policies of the OTA through which the Booking was made. Failure to make payment when required may result in cancellation of the Booking where permitted by the applicable Booking conditions. The Guest authorises APM and any payment processor used by APM to process amounts properly payable under the Booking and this Agreement using the payment method supplied by the Guest, to the extent permitted by law.
Security Deposit and Payment Authorisation Unless otherwise specified in the Booking, a security deposit or credit card pre-authorisation of $500 may be required. The pre-authorisation is ordinarily processed on or around the day of arrival and reserves available funds on the nominated payment method without constituting a charge at that time. The Guest must ensure that a valid payment method with sufficient available funds is provided. Failure to provide a required security deposit or valid pre-authorisation may result in access to the Property being withheld or the Booking being cancelled. Release of a pre-authorisation does not release the Guest from liability for damage, loss, additional cleaning, missing property or other amounts properly payable under this Agreement that are discovered after release of the pre-authorisation. To the extent permitted by law, the Guest authorises APM, on behalf of the Host, to charge the payment method supplied for the Booking for amounts properly payable under this Agreement, including: (a) damage caused by the Rental Party or their visitors; (b) missing items; (c) additional cleaning reasonably required beyond an ordinary departure clean; (d) replacement of lost keys, remotes or access devices; (e) costs resulting from unauthorised occupants, pets or smoking; (f) costs reasonably incurred as a direct consequence of a breach of this Agreement; and (g) any other amount expressly authorised by this Agreement. Where reasonably practicable, APM will provide the Guest with details supporting any material additional charge.
Guest Cancellation A cancellation initiated or requested by the Guest will be processed in accordance with the cancellation policy applicable to the Booking at the time the Booking was made. The applicable cancellation policy may be: (a) a cancellation policy established by APM and disclosed as part of a direct Booking; (b) a rate-specific cancellation policy selected by the Guest; (c) the cancellation policy of the applicable OTA; (d) a cancellation policy expressly contained in this Agreement; or (e) a combination of the above, to the extent each applies to the Booking. APM is authorised to determine and process any refund, cancellation charge, retained amount, credit or other consequence of cancellation in accordance with the applicable cancellation policy and this Agreement. Where the applicable cancellation policy provides that some or all amounts paid are non-refundable following cancellation, those conditions will apply subject to the Australian Consumer Law and any other applicable law. Where an OTA controls or processes a cancellation or refund, APM may process, approve, decline or otherwise administer the request through that OTA in accordance with its applicable rules and policies. A Guest is not entitled to a refund merely because they elect not to use all or part of the Rental Period, except where a refund is provided by the applicable cancellation policy or required by law. Guests are strongly encouraged to obtain appropriate travel insurance covering cancellation, illness, injury, weather disruption, transport interruption and other unforeseen circumstances.
Cancellation by the Host or APM In addition to any cancellation right available under this Agreement, the Host or APM may cancel a Booking where cancellation is permitted under the cancellation terms, booking conditions or OTA policies applicable to the Booking. The Host may also cancel a Booking where the Host reasonably determines that the Property cannot or should not be made available for the Rental Period because of circumstances including: (a) sale, proposed sale or transfer of the Property; (b) withdrawal of the Property from short-term rental accommodation; (c) the Host requiring the Property for their own occupation or the occupation of their family; (d) termination, expiry or material alteration of the Host's property management arrangements; (e) damage, defect, breakdown or deterioration affecting the Property; (f) maintenance, repairs, renovations or building works; (g) safety, security, health or compliance concerns; (h) restrictions imposed by an owners corporation, community association, government authority, insurer or other competent authority; (i) the Property ceasing to satisfy legal, regulatory, insurance or registration requirements; (j) natural disaster, severe weather, fire, flood, interruption to essential services or another event outside the reasonable control of the Host or APM; (k) an administrative, system, pricing, availability or booking error which materially affects the Booking; (l) circumstances creating a material risk that the Host or APM cannot reasonably provide the accommodation as booked; or (m) another circumstance of comparable significance which reasonably prevents or materially affects provision of the Property. APM is expressly authorised by the Host to give notice of cancellation, process the cancellation, arrange or process any applicable refund, communicate with the Guest or OTA and undertake other administrative actions reasonably necessary to give effect to a cancellation authorised under this Agreement or the policies applicable to the Booking. The Host or APM will notify the Guest as soon as reasonably practicable after becoming aware that cancellation is necessary. Where a Booking is cancelled under this clause before commencement of the Rental Period, any refund, credit or other remedy will be determined in accordance with the terms applicable to the Booking and applicable law. Where reasonably practicable, APM may offer alternative accommodation or alternative dates. The Guest is not required to accept an alternative where applicable law entitles the Guest to another remedy. Nothing in this clause excludes or limits any right or remedy which cannot lawfully be excluded or limited under the Australian Consumer Law or other applicable law.
Booking Alterations Any request by the Guest to alter the Booking, including a change to dates, Property, occupancy, Rental Period or other material Booking details, is subject to: (a) availability; (b) the amendment and cancellation conditions applicable to the Booking; (c) approval by APM or the Host where required; and (d) any applicable OTA rules or procedures. APM is not required to approve a requested alteration merely because the requested dates or Property are available. Where an alteration is permitted, APM may: (a) recalculate the accommodation rate and applicable fees; (b) apply any amendment fee disclosed as part of the applicable Booking conditions; (c) require payment of any increase in price; (d) process any refund or credit arising from the alteration; (e) treat a material alteration as cancellation of the existing Booking and creation of a new Booking where this is provided by the applicable Booking conditions or OTA procedures; and (f) process the alteration through the applicable OTA where required. Any cancellation consequences arising from an alteration will be determined under the cancellation policy applicable to the Booking. An alteration is not effective until confirmed by APM or, where applicable, the relevant OTA. APM may also make a reasonable administrative alteration to a Booking where necessary to correct an obvious error, give effect to an agreed change or administer the Booking, provided the alteration does not materially reduce the accommodation service purchased by the Guest without their agreement or otherwise infringe a right which cannot lawfully be excluded.
Guest Breach and Termination The Host or APM may terminate the Rental Party's occupancy where the Guest, a member of the Rental Party or a visitor materially breaches this Agreement, the House Rules, the NSW Code of Conduct for the Short-term Rental Accommodation Industry or applicable law. Circumstances which may justify immediate termination include: (a) exceeding maximum occupancy; (b) unauthorised parties or events; (c) serious or repeated noise or nuisance; (d) violent, threatening, abusive or dangerous conduct; (e) illegal activity; (f) deliberate or reckless damage; (g) unauthorised animals; (h) smoking or vaping where prohibited; (i) interference with smoke alarms, safety equipment or security systems; (j) refusal to comply with a lawful and reasonable direction intended to address safety, property damage, nuisance or a material breach; or (k) conduct creating a material risk to persons, property or neighbouring occupants. Where reasonably appropriate having regard to the seriousness of the breach, the Guest may first be given an opportunity to remedy the breach. Where occupancy is lawfully terminated because of the Rental Party's material breach, the Rental Party must leave the Property promptly and refunds will be determined in accordance with applicable law and the terms governing the Booking.
Use and Care of the Property The Rental Party must use the Property carefully, responsibly and only for lawful residential holiday accommodation purposes. The Guest must not: (a) use the Property for commercial activities without approval; (b) conduct a party, function or event without written approval; (c) sublet, licence or otherwise provide the Property to another person; (d) move furniture outside or materially rearrange the Property; (e) interfere with locks, security devices, utilities or building systems; (f) engage in conduct reasonably likely to damage the Property; or (g) use the Property for any illegal or prohibited purpose.
Damage, Loss and Additional Cleaning The Guest must notify APM as soon as reasonably practicable of damage, breakage, loss or any condition requiring urgent attention. The Guest is responsible, to the extent permitted by law, for reasonable costs arising from loss or damage caused by the Rental Party or their visitors, excluding fair wear and tear. The Guest may also be responsible for additional cleaning costs where the Property is left in a condition requiring cleaning materially beyond an ordinary departure clean. Recoverable costs may include reasonable repair, replacement, cleaning, contractor attendance and associated costs directly resulting from the relevant damage or breach. APM may provide photographs, invoices, quotations, inspection records or other reasonable evidence in support of a claim.
Keys, Locks and Access Keys, access cards, remotes, codes and other access devices must be used only for the Rental Party's access to the Property and must not be copied, transferred or disclosed to unauthorised persons. Lost or unreturned access devices may result in the Guest being charged the reasonable cost of replacement and, where reasonably necessary for security, re-keying or replacement of locks. Access codes may be changed at any time for security purposes.
Property Access During the Stay The Host, APM and their authorised contractors may enter the Property during the Rental Period where reasonably necessary for: (a) emergencies; (b) urgent repairs or maintenance; (c) safety or security concerns; (d) investigation of a suspected material breach; (e) prevention of damage; (f) compliance with legal or regulatory obligations; or (g) other reasonable property management purposes. Except in an emergency or where circumstances make notice impracticable, reasonable efforts will be made to notify the Guest before entry.
Noise, Neighbours and Conduct The Rental Party must respect neighbouring residents, guests and common property. Noise must be kept to a reasonable level at all times. Quiet hours are between 9:00 pm and 8:00 am unless stricter requirements apply under applicable law, strata or community rules or the House Rules. The Rental Party must not engage in conduct that unreasonably interferes with the peace, comfort or privacy of neighbouring occupants.
Parties and Events Parties, functions, events and gatherings exceeding the approved Rental Party are prohibited unless expressly approved in writing by APM. A serious breach of this clause may result in termination of occupancy.
Smoking and Vaping Smoking and vaping are prohibited inside the Property. Where smoking is permitted outside, all waste must be disposed of safely and appropriately. The Guest is responsible for reasonable additional cleaning, deodorising or remediation costs caused by a breach of this clause.
Animals Animals must not be brought onto or kept at the Property unless expressly permitted in the Booking or approved in writing. Nothing in this clause limits rights relating to assistance animals under applicable law.
Parking and Vehicles Vehicles must only be parked in designated or permitted areas. The Guest must comply with applicable parking restrictions, strata or community rules and reasonable instructions relating to vehicle access. The Host and APM are not responsible for fines, towing or other consequences resulting from unlawful or unauthorised parking, except to the extent caused by the Host's or APM's own wrongful conduct.
Rubbish and Waste The Rental Party must dispose of rubbish and recycling in accordance with instructions provided for the Property. Excessive rubbish or waste requiring additional removal may result in a reasonable additional charge.
Fire, Heating and Safety Equipment The Rental Party must not interfere with, disable, cover or remove smoke alarms, fire extinguishers, fire blankets, carbon monoxide alarms or other safety equipment. Any activation, fault or low-battery warning affecting safety equipment must be reported promptly to APM. Fireplaces, heaters, barbecues and other appliances must be used in accordance with supplied instructions and reasonable safety precautions. Children must be appropriately supervised around fireplaces, heaters, balconies, stairs, water, roads and other potential hazards.
Utilities, Internet and Third-Party Services Utilities and services may include electricity, water, gas, heating, internet, television, telecommunications and other services supplied by third parties. Service availability, speed, reliability and content may be affected by matters outside the reasonable control of the Host or APM. The Host and APM do not guarantee uninterrupted availability of third-party services. Where a service failure materially affects the accommodation, any remedy will be determined having regard to the nature and duration of the failure and applicable law.
Common and Shared Facilities Where the Property provides access to common or shared facilities, including pools, gyms, spas, saunas, tennis courts, roads, parking areas or other amenities, those facilities may be operated or controlled by third parties. Availability may be affected by maintenance, safety requirements, operating hours, owners corporation or community association decisions or other circumstances outside the reasonable control of the Host or APM. The Rental Party must comply with all rules applicable to those facilities.
Personal Property Guests are responsible for their own belongings during the Rental Period. To the extent permitted by law, the Host and APM are not responsible for loss, theft or damage to personal belongings unless caused by their own negligence or other conduct for which liability cannot lawfully be excluded. Guests should ensure that vehicles and the Property are appropriately secured.
Items Left Behind APM will make reasonable efforts to identify and, where practicable, facilitate return of items left at the Property. The Guest is responsible for reasonable postage, courier, handling or other costs associated with returning belongings. Items not claimed within a reasonable period may be disposed of, donated or otherwise dealt with in accordance with applicable law. APM does not guarantee recovery of items left at the Property.
Property Condition and Reporting Issues The Guest must notify APM promptly after discovering a material problem with the Property. The Guest must provide APM with a reasonable opportunity to investigate and, where appropriate, remedy the problem. Failure to report a readily identifiable issue during the stay may affect APM's ability to investigate or remedy the issue, but does not exclude any right the Guest has under applicable law.
Maintenance and Repairs APM may arrange reasonable repairs, maintenance or contractor access during the Rental Period where required. Reasonable efforts will be made to minimise disruption. The existence of minor maintenance issues that do not materially affect use of the Property does not automatically entitle the Guest to terminate the Booking or receive a refund. Any entitlement to a remedy will depend on the nature and effect of the issue and applicable law.
Weather and External Conditions The Host and APM do not control weather, snow conditions, road conditions, bushfire conditions, transport services, ski lift operations, resort facilities or other external circumstances. Unless otherwise required by law or the applicable cancellation policy, changes in weather, snow conditions, travel plans, transport availability or external activities do not of themselves entitle the Guest to cancel or obtain a refund. Guests are responsible for assessing travel conditions and obtaining appropriate travel insurance.
Risk and Responsibility The Rental Party uses the Property and any facilities made available with it at their own risk to the extent permitted by law. The Guest is responsible for exercising reasonable care and supervising children and other persons requiring supervision. Nothing in this Agreement excludes or limits liability for death, personal injury, loss or damage where such liability cannot lawfully be excluded or limited.
Liability of APM To the extent permitted by law, APM is not liable for an act or omission of the Host, an OTA, owners corporation, community association, utility provider, telecommunications provider, contractor or other independent third party where the act or omission is outside APM's reasonable control. APM does not warrant that a privately owned Property will remain available indefinitely and is not responsible for decisions independently made by the Host concerning ownership, sale or future use of the Property, except to the extent APM has a liability which cannot lawfully be excluded. To the extent permitted by law, APM's liability for loss arising from services supplied by APM is limited to loss directly caused by APM's breach, negligence or other conduct for which APM is legally responsible. Nothing in this Agreement excludes, restricts or modifies any consumer guarantee or other statutory right which cannot lawfully be excluded, restricted or modified.
Indemnity To the extent permitted by law, the Guest indemnifies the Host and APM against reasonable loss, damage, liability, cost or expense arising from: (a) damage caused by the Rental Party or their visitors; (b) unlawful conduct of the Rental Party or their visitors; (c) a material breach of this Agreement by the Guest or Rental Party; or (d) injury or loss caused by the negligent or wrongful act of the Guest, Rental Party or their visitors, except to the extent the relevant loss was caused or contributed to by the negligence, breach of contract, unlawful conduct or other wrongful act or omission of the Host or APM.
Recovery Costs Where the Guest owes an amount properly payable under this Agreement and fails to pay it when reasonably requested, the Host or APM may recover reasonable costs necessarily incurred in recovering that amount, to the extent permitted by law. Nothing in this clause entitles the Host or APM to recover an amount that constitutes an unlawful penalty or unfair contract term.
NSW Short-Term Rental Accommodation Code of Conduct Where applicable, the Booking is subject to the NSW Government's Code of Conduct for the Short-term Rental Accommodation Industry. The Guest and Rental Party must comply with their obligations under the Code, including requirements to: (a) act lawfully; (b) treat neighbours and other occupants with respect; (c) avoid unreasonable noise and disturbance; (d) not engage in violent, threatening or intimidating behaviour; (e) take reasonable care of the Property and common property; (f) ensure visitors comply with applicable obligations; and (g) comply with applicable House Rules. The Guest acknowledges that serious or repeated breaches may have consequences under the Code in addition to consequences under this Agreement.
House Rules Property-specific House Rules, access instructions and reasonable operational instructions supplied in connection with the Booking form part of the conditions applying to occupation of the Property. Where a House Rule conflicts with this Agreement, this Agreement prevails unless the House Rule is required by law, an owners corporation, community association or other authority.
Complaints and Dispute Resolution A Guest who experiences a problem should notify APM as soon as reasonably practicable so that APM has an opportunity to investigate and, where appropriate, resolve the issue. The parties should first make reasonable efforts to resolve any dispute directly and in good faith. Nothing in this clause prevents a party from exercising rights available under the Australian Consumer Law, contacting NSW Fair Trading or commencing proceedings where legally entitled to do so.
Communications and Notices The Guest consents to receiving communications relating to the Booking electronically, including by email, SMS, booking platform messaging or other contact details supplied with the Booking. The Guest is responsible for ensuring their contact information remains accurate and for monitoring communications concerning the Booking. A notice sent to the contact details supplied by the Guest will be treated as having been sent to the Guest, subject to applicable law.
Privacy Personal information collected in connection with a Booking may be used for purposes reasonably associated with administering the Booking, providing accommodation services, processing payments, security, compliance, dispute resolution and property management. Personal information will be handled in accordance with applicable privacy laws and any applicable APM privacy policy. Information may be disclosed where reasonably necessary to the Host, OTAs, payment processors, contractors, authorities or other service providers involved in administering the Booking or where required by law.
Governing Law This Agreement is governed by the laws of New South Wales, Australia. The parties submit to the jurisdiction of the courts and tribunals of New South Wales, subject to any rights they may have under applicable consumer law.
Severability If any provision of this Agreement is invalid, unenforceable or unlawful, that provision is to be read down to the extent necessary to make it valid and enforceable where possible. If it cannot be read down, it is severed and the remaining provisions continue to operate.
No Waiver A failure or delay by the Host or APM to exercise a right under this Agreement does not constitute a waiver of that right. A waiver in one instance does not constitute a waiver of the same or another right on another occasion.
Entire Agreement This Agreement, the Booking, applicable cancellation policy and any property-specific House Rules constitute the agreement governing occupation of the Property, together with any applicable OTA terms. The Guest must not rely on a representation inconsistent with these documents unless expressly confirmed in writing by APM or the Host. Nothing in this clause excludes liability for misleading or deceptive conduct or any other liability that cannot lawfully be excluded.
Interpretation In this Agreement: APM means Alpine Property Management Pty Ltd. Booking means the confirmed reservation for the Property. Guest means the person who makes the Booking. Host means the owner or other person lawfully entitled to make the Property available for short-term accommodation. OTA means an online travel agency, booking platform or other third-party booking intermediary. Property means the accommodation identified in the Booking. Property Manager means Alpine Property Management Pty Ltd. Rental Party means the Guest and all approved occupants identified in the Booking. Rental Period means the period between the applicable check-in and check-out times for the Booking. References to legislation, regulations, codes or other legal requirements include amendments and replacements made from time to time.
