We understand that people are not a “one size fits all” category, so please reach out to us with any questions or concerns in this document. COMMUNICATION IS KEY!!!!

Mi casa, tu casa! But you wouldn’t intentionally damage or mess up your home, would you? We ask that you treat our property as if it was your very own as well! Please be aware of the condition of items in the house, and if you happen to notice anything broken when you arrive, please contact us to let us know. We also ask that you please watch noise levels at night. We love our neighbors! They’re nice, we’re nice to them, and we hope you are nice to them too! Noise ordinances for quiet time in the city/neighborhood are at 10pm, so please respect these rules.

Common Concerns By booking this home, you acknowledged that scuff marks on the wall do not constitute as an unclean/unsanitary home or a misleading/altered representation of the images online. We do have our house managers scheduled monthly to come out and retouch the paint, however, in between this timeframe, it is possible for other guests to create new scuff marks in the home. As guests have damaged inventory such as decor, minor appliances, and furniture, we have had to replace items. Keep in mind sometimes the original items pictured had to be replaced with similar items as the original items may no longer be available.

You further acknowledge that the hot tub/pool (if applicable) may have sand minor debris inside. The hot tubs get drained every couple of weeks and as our guests typically enjoy the nearby beaches, sand is a typical occurrence in these areas. Pools are serviced with chemicals and provided a clean weekly, sometimes this can cause blurry water that typical clears in a few hours. The hot tubs get checked for their chemical balance in between each clean and added the proper chemicals accordingly. They get drained and refilled every two weeks.

Communal Living Areas All outdoor areas including the outdoor grill, hammock, chairs, pool area, pool loungers, kayaks, paddleboards, communal bathroom, and picnic table are available on a first come, first serve basis. We expect all tenants to be respectful of the other guests. Should anyone become unruly, they will be given one warning and then if that isn't enough to move the needle, they will be escorted off the premises by law enforcement. The entire communal area will be under surveillance. Nudity is forbidden in the communal area. If you're bringing a pet, please make sure they are leashed at all times in the communal area. If we receive a complaint about pet waste not being collected we will review the cameras to see who did and charge the excessive pet waste fee to them on behalf of our cleaners. As much as we love pets, not everyone else does. Please be respectful of the other guests who might not appreciate loose dogs running up to them. Communal areas hours are subject to change without warning. At this time, it is available until sundown.

Confetti & Other Decor Decorations and confetti are strictly prohibited unless previously discussed and approved. Our cleaners will charge additionally for an excessive clean as it’s incredibly hard to remove. The fees will be passed along to you.

In order for the elevator to function properly, please follow these ELEVATOR INSTRUCTIONS: The accordion door and main doors to the elevator (on all floors) must be closed tightly before and after each use in order for the elevator to recycle. This will allow the elevator to be called from any level. If this is not done properly, it will cause the elevator to need a reset and we can tend to this while our handyman is on site. If the handyman is not on site at the time that this occurs, we will not be able to offer refunds on the matter. Please do not allow young children in the elevator without supervision.

The spa is on a timer and will either stop when the time runs out or if you’d like to speed up the process, you can adjust the timer to have the spa jets stop. If you do press the stop button, it will not only stop the jets but shut down the entire spa, until we need to manually reset it. This means the heating element will also stop causing the heat to go down and making the hot tub less hot and enjoyable! (Not just for you but for others too!)

Lost and Found Oh no! You left something behind? We’ve been there! Valuable items left behind by guests will be held for the guest and every reasonable effort will be made to contact the guest for the return. After 15 days - items not claimed/retrieved, will be considered forfeited. Should you like us to mail your items back, the costs of shipping plus a $25 fee will apply that needs to be paid prior to the shipping.

Mail, Packages, & Delivery If you intend to receive mail, a package, amazon, or any other delivery please notify us prior for our approval. Technically we don’t allow guests to send packages to the property because per Florida law a guest can claim proof of residency by receiving Mail at a location. Also, USPS won’t deliver per city laws to a property listed under the city as a short term rental unit. We can make an exception where if you message us stating “I, (your legal name) will not be residing as a long term tenant in this short term rental property. I will only be staying here as a short term rental vacationer and will only be receiving a package here during my temporary stay.” Just keep in mind USPS still won’t deliver to the address. But you shouldn’t have a problem with Amazon packages.

Maximum Occupancy The maximum number of guests is 8. However, we may be willing to accommodate additional guests for a fee of $40 per night per guest if we have the proper resources available. We cannot make any guarantees that we will be able to honor your request but please reach out to us prior to booking as we view this on a case-by-case basis. All registered guests need to be approved. Any updates are subject to approval and a fee regardless if it's under the maximum guest count.

Minor Differences in Rentals Sometimes we have incidents where guests steal, damage, stain, or break our home’s items. In these instances, we try to replace the item for the same exact item we had previously. Sometimes, this isn’t possible. Should you notice a particular decorative item in an image that is no longer there or is replaced with another decorative item, this is why. If you notice different bed sheets, or pillow cases, this can also be the reason. We’ve had a/c wall units need repair and we have temporarily replaced them with portable a/c units. Even down to patchy grass. We’ve had incidents where guests leave items on our grass and the grass dies. We mention all of this to say that it’s possible to experience slight differences in the listing images in comparison to your in person experience. Should you want to know what the possible differences can be, please ask us prior to your visit and we will inform you. Once you book, you agree that there is a possibility of minor differences in the home.

Monroe County Ordinance & Other Applicable Laws All guests must abide by the City, State, Federal, and all other applicable laws and bylaws.

Moving items Around Please leave all items and furniture in the same place you found them. Our cleaners are not movers and they will charge us additionally for this. The fees will be passed down to you.

We will not be responsible for any parking tickets, parking boots, or towed vehicles.

Pets YES! We have finally decided to allow pets into our home. There will be a $50 upfront fee per pet. There will also be a $45 fee per night per pet thereafter. The 1st nights fee will be waived with the initial flat fee per pet per stay rate of $50. Maximum of 2 pets per stay. Should you bring more than 2 please reach out as depending on the situation we may be able to accommodate you. Please ensure that you are following all local, state, and federal laws pertaining to your pets.

Please ensure that you clean up after your furry family members. We will apply an excessive cleaning fee to unreasonably dirty homes. We do have a designated "Potty Area" for your pets in the backyard patio. However, it is YOUR responsibility to pick up after your pets. We want all of our guests to enjoy our patio without stepping on any unwanted surprises.

Please ensure that your pets are never left unattended inside or outside of the home. This includes leaving pets unattended in enclosed patio areas. Please ensure that your pets are not creating a noise disturbance during your stay. If we receive more than 3 complaints, it may result in the termination of your reservation without a refund.

Pets may NOT be on our beds, towels, bedding, sofas, or carpeted areas. An excessive cleaning fee will be applied if pet hair is found in these areas. Our cleaners charge us for this and so the fees will be passed along to you.

Please make sure all PET FEES are paid PRIOR to your arrival or the entry code will not be given until it has been completed. All pets are to be leashed while outside at all times.

Pool & Spa Our pools get serviced weekly. If you or a previous guest overdoes it on the sun screen, you might start to see a film or foam start to form at the top of the pool. Additionally, there's a lot of wind near the pool area so it may get filled with debris rather quickly. We can always call our pool guy to come out sooner and service the pool, but please keep in mind, it’s not guaranteed.

Our spa is chemically balanced and chemicals are added as needed in between guests. There will be a timer to run the jets. Do not eat or drink in the spa as this can contaminate the spa causing an emergency treatment and incurring an added cleaning fee from our pool and spa technicians. There can be minor debris in the spa.

No running, jumping, or diving in the pool or spa at any time. Swim at your own risk at all times. Parents must be responsible for their children. The pool is closed at sundown. No glass in the pool or spa area. Do not leave trash in this area. No parties or loud noise disturbances. Please be respectful of other guests.

Potential for Noise By renting out this property you further acknowledge and agree that since this home is located in a residential area, there is a possibility for noise that is outside of our control which includes but is not limited to: construction, loud noises from others nearby, and local events on-going. There is a possibility that construction might also occur on or nearby our properties due to a last minute repair that needs to be tended to. No refunds will be provided should this occur.

PRIVATE CELEBRATIONS, EVENTS AND OCCUPANCY POLICY

1. PRIVATE CELEBRATIONS AND EVENT APPROVAL

Guests may celebrate private birthdays, anniversaries, and other personal occasions with their registered and approved guests. A celebration involving additional attendees requires advance written Host approval

Guests requesting a private event must disclose:

• The purpose and nature of the event.

• The number of overnight guests and additional daytime attendees.

• The maximum number of individuals who will be present at the property at any given time.

• The anticipated number of vehicles and proposed parking arrangements.

• The event date, start time, and end time.

• Any additional activities, vendors, equipment, or arrangements associated with the event.

Simply mentioning a celebration does not constitute approval for additional attendees.

The Host must approve the event details and conditions in writing, and the applicable event fee must be agreed upon and paid before property access is provided. Approval applies only to the agreed event date, hours, activities, and maximum attendance.

2. APPROVED PRIVATE EVENT FEES

Event fees are based on the total number of individuals present at the property at any given time, including registered overnight guests and approved daytime attendees:

• 10 to 15 total attendees: $500 event fee.

• 16 to 20 total attendees: $800 event fee.

All additional daytime attendees must depart by the approved event end time, which shall be no later than 12:00 AM (midnight).

Open invite parties, publicly advertised gatherings, and disruptive events are prohibited. Approval of a private event does not exempt guests or attendees from the other House Rules, applicable laws, or Airbnb policies.

3. UNAUTHORIZED ATTENDANCE AND VIOLATION FEES

Only individuals authorized in writing by the Host may be present at the property.

If the total number of individuals present exceeds the approved attendance, the following violation fees apply:

• 10 to 15 total individuals present without the required authorization: $500.

The applicable fee is determined by the maximum documented number of individuals simultaneously present during the violation.

If a violation occurs, the applicable fee is due immediately, regardless of whether the stay is allowed to continue.

All unauthorized individuals must leave immediately upon notification. Payment of a violation fee does not authorize them to remain, and any previously paid event fee does not replace an applicable violation fee.

4. VIOLATIONS, TERMINATION AND ADDITIONAL COSTS

The Host reserves the right to decline any event request that does not satisfy these requirements.

Disruptive behavior, unauthorized gatherings, or violations of the House Rules may result in immediate termination of the event or reservation. The Host may require all guests and visitors to vacate the property and may seek assistance from Airbnb or the appropriate authorities if they refuse to leave. No refunds will be given for unused nights or event fees when a reservation is terminated due to these violations.

Guests may also be responsible for documented property damage, excessive cleaning, and other recoverable costs resulting from their conduct, including applicable third party security expenses or municipal fines, where permitted by applicable policies and law.

If you prefer to have nonessential exterior maintenance postponed or coordinated around your plans, please notify us at least 24 hours in advance whenever possible. We will gladly work with you to accommodate your request, subject to scheduling, safety, and maintenance requirements.

Please note that trash valet services are necessary to ensure timely collection and compliance with local regulations. These services generally cannot be postponed, but alternative arrangements may be discussed upon request.

Our team will coordinate any required access in accordance with Airbnb's policies. Authorized personnel will not enter the home's interior without your permission, except in an emergency or as otherwise permitted by applicable law and Airbnb’s policies.

Sargassum, Seaweed & Natural Marine Conditions

IMPORTANT WATERFRONT PROPERTY DISCLOSURE: This property is located directly on or near the water in the Florida Keys. By booking this property, Guest acknowledges and accepts that sargassum, seaweed, algae, marine vegetation, marine debris, and other naturally occurring environmental conditions may periodically be present or accumulate in the surrounding waters, shoreline, seawall, dock, or nearby outdoor areas.

Sargassum is a naturally occurring marine condition that can affect the Florida Keys and other coastal areas. Its presence, quantity, location, movement, duration, and timing are determined by natural and environmental conditions and are entirely outside of the Host's control. Conditions can develop, disappear, increase, decrease, or otherwise change before or during a reservation without advance notice.

Guests further acknowledge that sargassum and other naturally occurring marine vegetation may produce noticeable or unpleasant odors, particularly when accumulated or decomposing. The Host cannot predict or guarantee the presence or absence of sargassum, seaweed, marine debris, or associated natural odors during any reservation.

Guests with asthma, respiratory conditions, allergies, environmental sensitivities, or other health concerns that could potentially be affected by naturally occurring marine conditions or associated odors should take this possibility into consideration before booking and determine whether a waterfront accommodation is appropriate for their individual circumstances.

By completing a reservation, Guest acknowledges that the possibility of sargassum and other naturally occurring marine conditions is an inherent aspect of staying at a waterfront property in this area and accepts the possibility that these conditions may be present during some or all of the reservation.

The presence, arrival, accumulation, movement, decomposition, appearance, or odor of sargassum, seaweed, algae, marine vegetation, marine debris, or similar naturally occurring environmental conditions is outside of the Host's control and does not constitute a defect or failure of the rental property.

These naturally occurring conditions do not alter the cancellation policy applicable to the reservation and do not independently entitle a Guest to a refund, partial refund, rate adjustment, reimbursement, relocation, or other compensation. If a Guest elects to cancel, leave early, or discontinue a stay because of these naturally occurring conditions, the reservation will remain subject to the cancellation and refund terms agreed to at booking.

Security When you leave the property and at night, please make sure all doors are locked and secured. Even though our home is in a safe neighborhood, we take the safety of our guests very seriously. Our security protocol includes 5 outdoor cameras and 2 sound level detection devices. The cameras are located in the following common areas: the entryway by the front door, the entryway of the garage, inside the garage, the entryway of the side patio door, the side patio walkway, and the backyard pool area. The sound level detection devices are located on each level of the house. One is attached to the ceiling in the kitchen area and another in the ceiling of the second floor hallway near the laundry room. Please note: These devices are not meant to micro-manage our guests. We do not have time to monitor or watch your every move. It is solely there to monitor any suspicious activity that will trip the alarms and cause us concern. In which case, we will check on the safety of our guests immediately.

Security Deposit Refund & Deductions A security deposit may be required prior to check-in. The security deposit is intended to cover damages, excessive cleaning, rule violations, unauthorized occupancy, missing items, fines, fees, or any other costs incurred as a result of the Guest’s actions during the reservation.

The Host shall have up to fourteen (14) days following checkout to inspect the property, review cleaner reports, review security and noise monitoring reports, assess damages, investigate rule violations, and obtain repair estimates, invoices, or other supporting documentation.

The security deposit may be used to cover, including but not limited to, property damage or missing items, excessive cleaning beyond a standard turnover, smoking remediation, unauthorized guests, visitors, parties, or events, noise ordinance violations, HOA, condominium, municipal, or governmental fines, security guard dispatches, law enforcement responses, or related enforcement costs, pet-related damages, odors, stains, or excessive cleaning, excessive trash removal, grill cleaning or misuse, furniture moving or rearrangement requiring labor to restore, lockouts, lost keys, lost remotes, or replacement access devices, plumbing, HVAC, pool, spa, appliance, or other damage caused by Guest misuse, and any violation of this Rental Agreement or House Rules.

The Host may deduct either the actual cost incurred or the stated fee listed elsewhere in this Agreement, whichever is applicable.

Any deductions shall be supported by reasonable evidence, which may include photographs, videos, cleaner reports, maintenance reports, vendor invoices, security reports, noise monitoring reports, witness statements, or other documentation.

Any remaining balance of the security deposit shall be refunded to the Guest within fourteen (14) days following completion of the review process.

If damages, violations, or additional charges exceed the amount of the security deposit, the Guest remains responsible for the full amount owed and authorizes the Host to pursue collection of any unpaid balance through the original payment method or any lawful means available.

Smoking There is to be NO SMOKING inside the property. Smoking is allowed outside on the patio (please utilize ashtrays - do not toss butts in the patio or rocks & PLEASE CLOSE ALL DOORS) or outside of the home. Any burn marks on outdoor furniture or evidence of smoking inside the home (ie smells of smoke, ashes, burns, etc) will cause for an automatic smoke remediation fee of $1000.

Streaming Services Please login to use your own streaming accounts. Pins will not be given to guests to download apps and services. If you need assistance with this, we may be able to help you on a case by case basis.

Trash To ensure the property remains clean and sanitary, all guests must follow our trash and recycling guidelines. All loose items must be bagged and placed inside the provided outdoor waste bins, using the black bin for general trash and the blue bin for recycling. Please ensure all small cans have a bag liner before use (extra bags are under the kitchen sink) and transfer them to the outdoor receptacles once full, taking care not to overfill them. Locations for these bins vary by property, so please reach out if you have any trouble finding yours.

As part of the checkout process, all trash must be bagged and removed from the unit; our standard cleaning fee does not cover the labor required to gather loose debris or haul away overflow. While we provide a professional trash valet twice weekly to maintain capacity, any excessive trash that does not fit inside the bins and requires us to haul it away will result in a $75 removal fee. Furthermore, any excessive waste or scattered mess requiring professional deep cleaning beyond a standard turnover will incur an additional $300 cleaning fee.

Travel Insurance We HIGHLY recommend that you purchase travel insurance. NO REFUNDS will be made under our strict cancellation policy. Florida can have hurricanes and severe weather. Unforeseen events can occur and we will not provide a refund under any circumstances.

Tropical Bugs & Other Wildlife We do our very best to keep any unwanted creepy crawlies from joining your group! This includes a monthly treatment to exterminate any bugs! Yet and still, we are in Florida and you might still see a spider in a corner, June bugs trying to fly in, and the occasional roach that will try to dry off after a rainy day. Please keep in mind, this doesn’t mean there’s an infestation, just a couple unfriendly critters wanting in on your fun! Either way, please let us know if you encounter them and we will try to get to it as soon as possible. Please note iguanas, lizards, and other wildlife can enter in backyards, patio spaces, balconies, and other outdoor spaces.

Unruly Guests We want everyone to have a good time in our home, but we have definitely had an experience with a large group that we gave multiple chances to, that still apologized to us and continued to turn around and be a nuisance to the property and our neighbors. Therefore, we have revised our rules to prevent an incident like that from ever repeating itself again.

Please be advised that at the first mention of any complaint, evidence of rule violation, noise disturbance, or any other unruly behavior will result in your FIRST & FINAL WARNING. If necessary, we will dispatch security (at your expense) to relay any warnings or the hosts will contact you directly. Please note that any costs associated with the dispatch of security will be charged to the guests. Upon the SECOND complaint, noise disturbance, or unruly behavior, your entire group will be asked to vacate the property as you are in direct violation of our house rules. Your group will have 30 minutes to an hour to gather your belongings and exit the premises. In this process, we may invoke the assistance of local law enforcement officers.

Waivers All waivers need to be signed and filled out prior to the use of our paddle boards and kayaks.

WATERCRAFT & DOCKING POLICY No boats, jet skis, or other motorized watercraft may be docked, anchored, or launched from the property. This is strictly prohibited by local city code due to the presence of protected coral reefs and environmental regulations. Guests are responsible for ensuring that any watercraft they bring comply with all city laws. Violating this rule may result in fines, legal action, and immediate termination of your stay without a refund.

Final Address Once again, we appreciate your compliance with these rules. We know this has been a mouthful. We aim to provide our guests with the best experience possible during their stay. In order to do so, we have these rules, and we really appreciate your cooperation in helping us share our beautiful home.

Thanks again and we look forward to hosting you soon!

Best Regards, Jordan & Emily
