✅ This property has special local compliance requirements which include a signed rental agreement, ID verification, and a security hold of $1500 (which is not a traditional security deposit, just a pending transaction). As an optional alternative to the security hold, you may opt in to purchase a non-refundable damage waiver provided by a third-party insurance company. The optional damage waiver is $59 for stays up to 9 nights, with an additional $3 per day for stays longer than 9 nights. Damage waiver purchases are optional.
To make this process easy for you, we use a secure and very simple, app-free platform called Happy Guest. It is not an app, and you do not have to sign up for an account - it’s a safe and secure website. It also gives you a guest portal with all the info about the home and all of my favorite local spots.
A copy of the rental agreement can be found below:
-
LIMITED OCCUPANCY:
Occupancy is limited to a maximum of 5 individuals. If the Owner determines this policy has been violated, the Owner reserves the right to expel the entire party without refund.
-
TRANSIENT OCCUPANCY — NO TENANCY CREATED:
This property is a transient vacation rental. It is not the Guest’s residence, domicile, or dwelling.
No landlord-tenant relationship. The Guest is a transient occupant and licensee only. Nothing in this Agreement creates a tenancy, lease, leasehold interest, or landlord-tenant relationship between the Guest and the Owner, and the Guest acquires no rights, remedies, or protections afforded to residential tenants under the Texas Property Code or any other landlord-tenant statute. The Guest is granted a limited, revocable license to occupy the property solely for the reserved dates.
Extended stays. Reservations of 30 or more consecutive nights may be accepted at the Owner’s sole discretion, including for work crews and corporate bookings. Occupancy remains transient regardless of the length of the stay, and no reservation of any duration converts the Guest’s limited license into a tenancy, lease, or leasehold interest. For any stay of 30 or more consecutive nights, the Guest agrees to execute the Owner’s Extended Stay Addendum prior to arrival, reaffirms that the property is not and will not become their residence or domicile, agrees that all amounts are due in advance of each rental period, and agrees that the right to occupy ends immediately upon non-payment or upon the departure date stated in the reservation, whichever occurs first.
Guest representation. The Guest represents and warrants that the property is not, and will not become, the Guest’s primary residence, permanent address, or legal domicile. The Guest shall not use the property’s address for mail or package delivery, voter registration, a driver’s license or state ID, vehicle registration, employment or income verification, school enrollment, public benefits, or any other legal, governmental, or official purpose.
No possession. The Owner retains full legal possession and control of the property at all times and reserves the right to enter for inspection, maintenance, safety, or to verify compliance with this Agreement. Access codes and keys convey a license to enter, not possession.
Holdover. The Guest’s right to occupy terminates automatically at the check-out time on the departure date. Any Guest or occupant who remains on the property after that time without the Owner’s prior written consent is an unauthorized occupant and trespasser, and the Owner may pursue immediate removal by all lawful means, including contacting law enforcement. A holdover Guest agrees to pay liquidated damages of $1,000.00 per day, or the property’s prevailing nightly rate, whichever is greater, plus all costs of removal, including attorney’s fees, court costs, locksmith charges, and compensation for any bookings the Owner is forced to cancel or relocate.
- NON-DISTURBANCE CLAUSE:
Renter and their guests shall not disturb, annoy, endanger, or create inconvenience for neighbors, nor shall they use the premises for any unlawful purposes.
Fireworks are strictly prohibited on the property and surrounding grounds at all times, regardless of local ordinance. If you or your guests are using fireworks, you will be evicted from the property with no refund, and the authorities will be called.
- CARE OF PREMISES/DAMAGES:
PET FRIENDLY — DOGS ONLY, 2 MAXIMUM
🐶 We welcome up to 2 dogs, 50 lbs or less each. A non-refundable pet fee of $115.00 per pet, per stay applies and must be disclosed at the time of booking.
Please clean up after your dog. Animals may not be left inside the unit alone unless crated (crate not supplied), and are not permitted on the furniture. The Renter is responsible for all damage and for the full cost of any additional cleaning caused by an animal.
Undisclosed animals, dogs over 50 lbs, a third animal, or any animal other than a dog will result in a non-refundable fee assessed to your reservation of $1,500.00, and/or your stay will be forfeited, and no refunds will be given. Service animals are permitted as required by federal law; ESA’s are not considered service animals under federal law.
NO SMOKING OR VAPING PERMITTED IN THE HOUSE.
Any violation will result in automatic eviction and forfeiture of both the deposit and rent.
The Renter agrees to compensate the Owner for any damages to the property, furnishings, appliances, or household items that occur during their stay.
The Renter further agrees to reimburse the Owner for the full cost of any cleaning required beyond standard turnover cleaning as a result of the Renter’s occupancy. This includes, but is not limited to, excessive trash, stains, spills, odors, smoke or vape residue, animal hair or waste, and the removal of the Renter’s belongings left behind.
-
OWNER’S RIGHTS:
If the conditions and limitations of this agreement are not met, the Owner reserves the right to cancel the agreement and may enter the property by statutory proceedings or force to inspect the property and ensure the Renter has vacated. All payments made by the Renter shall be forfeited as liquidated damages.
-
INDEMNITY CLAUSE:
The Renter agrees to indemnify and hold the Owner harmless from all claims, including those from third parties, arising from or related to Renter’s use of the property or any personal property provided. The Renter assumes all risks of injury or loss related to any recreational activities on or about the premises, and will hold the Owner harmless.
-
NO SUBLETTING:
The Renter may not sublet or assign this lease, in whole or part, without the prior written consent of the Owner.
-
REPAIRS AND MAINTENANCE:
The property is rented with the Owner’s furniture and furnishings. The Owner is not responsible for providing additional furnishings or equipment. The Renter must report any maintenance issues immediately. The Owner will make reasonable efforts to repair or replace faulty equipment but cannot guarantee all equipment will function properly at all times. No rate adjustments or refunds will be made for equipment or appliance failures.
-

PEST CONTROL & WILDLIFE DISCLOSURE:
Due to the subtropical climate of Texas, guests may occasionally encounter common pests such as American cockroaches (commonly known as “tree roaches”), insects, mosquitoes, or other wildlife typical to the region. This is a normal occurrence in Texas properties and is not indicative of poor housekeeping or property conditions.
The property is regularly serviced by a licensed pest control provider. As such, no refunds, credits, or relocations will be issued due to the presence of common pests.
If a guest believes an infestation exists, the guest must submit a written request for a third-party licensed pest control inspection. Should the inspection confirm no infestation is present, the guest will be solely responsible for the cost of the inspection and any associated service fees. If an infestation is confirmed, management will take appropriate remediation steps.
- HURRICANES, TROPICAL STORMS & INCLEMENT WEATHER:
This property is located in a coastal area of Texas where hurricanes, tropical storms, flooding, heavy rain, high tides, Red Tide and other severe weather events may occur. Weather conditions are unpredictable and are outside of the Host’s control.
No refunds, credits, date changes, or cancellations will be provided due to hurricanes, tropical storms, tropical depressions, mandatory or voluntary evacuations, road conditions, power outages, flooding, inclement weather, or any other weather-related event unless otherwise required by applicable law.
Guests are strongly encouraged to purchase travel insurance that includes coverage for trip cancellations, interruptions, weather events, and other unforeseen circumstances. Travel insurance may be purchased HERE.
- UTILITIES:
Power, internet, water, cable, and other utility services are provided by third-party utility companies and service providers. While every effort is made to maintain these services, the Host has no control over outages, interruptions, equipment failures, weather-related disruptions, or utility company repairs.
No refunds, credits, discounts, or cancellations will be provided for interruptions to electrical service, internet, cable, water, or other utilities that are outside of the Host’s control. This includes temporary loss of air conditioning, heating, appliances, or other amenities that rely on utility services.
The Host will make reasonable efforts to report outages and coordinate repairs as quickly as possible, but restoration times are determined solely by the applicable utility or service provider.
-
PARKING:
You may park up to 2 vehicles in the driveway, and there is additional parking on the street. Do not block the driveways of neighboring homes at any time.
