Rental Agreement required along with Government Issued Photo ID and must be completed within 24 hours of booking. $500 Refundable Damage/Security Deposit required by host.
Damage & Rental Deposit: A Damage & Rental Deposit of $500.00 is due 10 days prior to the arrival date. Access to the condo will not be granted until all payments, including the Damage & Rental Deposit, has been received and cleared. This is not a "hold" the amount is paid to the host in advance. This deposit is paid directly to the owner, and not through the Airbnb platform due to our reservation software integration
The deposit shall be returned within 14 days of the Check-Out Date provided the following provisions are met:
No loss, damage or theft to the property, its furnishings, or neighboring properties during the term of the agreement, and no unauthorized access is made to the locked and alarmed “Owners Closet(s)”
The unit is in the same condition as check-in and properly secured upon check-out with no excessive cleaning required.
No violation of the Rental Agreement and Rental Rules and no fines/fees incurred by the Homeowner resulting from the this stay
No additional costs incurred by Homeowner due to the stay including, but not limited to, excessive utility (ELECTRIC/WATER), cleaning or cable charges incurred during the stay, including disconnection of any television, cable, internet, thermostat tampering, disconnection of other powered devices.
The Rental Party is not removed/evicted by the Homeowner, their representative or local law enforcement.
No breach of contracts, falsified reservation, occupancy (unregistered guests) or pet violations.
The Homeowner has the right to charge fees, deemed appropriate by the Homeowner, in writing, to the Primary Guest, for any items listed above. If the Deposit does not cover the cost of all losses, fees/fines, or damages, the Primary Guest is responsible for additional payment to the Homeowner, via secured funds, within 5 days of written notice of the damages by the Homeowner. The Primary Guest MUST notify the Homeowner immediately if the premises appear unclean or damaged upon check-in and is responsible for any existing damages if he/she fails to do so.
Removal Clause: You agree to comply with the departure time. If the property is not vacated by checkout time, you consent to removal of all occupants and all belongings from the property and disposing of all belongings at your expense and risk of loss. If law enforcement is required for any situation during your stay, this removal clause is automatically triggered. No late check-outs. At the termination of this agreement, all guests shall quietly yield up the Property in good and habitable condition in all respects, as it was when the Guest took possession. There is a $50 fee assessed every 15 minutes late and deducted from your Damage & Rental Deposit.
Homeowner Cancellation Clause: Unforeseen events (i.e. fire, water damage, etc) occur and the Homeowner reserves the right to cancel current and future stays for any reason. Unless covered in another area of this Rental Agreement, the Homeowner’s sole liability is a refund of the unused portion of fees previously paid to the Homeowner only. The Homeowner is not liable for any consequential or secondary damages, including but not limited to, expenses incurred as a result of moving, any damage, destruction, or loss before or after Check-In has occurred and is not responsible for providing any alternate lodging arrangements.
Cleaning and Damage Inspection: A non-refundable cleaning fee applies for cleaning and inspection at the end of your stay. Although housekeeping is provided at the end of your stay, Guests must keep the unit tidy and free of sand throughout their stay. Primary Check-Out Requirements include basic tidying of the condo, cleaning of all dishes, cookware and utensils that were used, emptying the refrigerator and disposing of any trash which may have an odor. The Primary Guest may request a copy of the Check Out Instructions outlining the expectations at the time of booking. Spot cleaning instructions and supplies (except paper products) will be provided. The cleaning fee does not cover excessive cleaning of the unit or linens or removal of body or pet fluids. Any additional cleaning fees incurred as a result of your stay, will be charged to the Primary Guest.
Guest's Property: The Homeowner is not responsible for any property belonging to any guests.
Cancellation, Default & Weather Policy:
Cancellation: Airbnb Firm Policy - To receive a full refund, guest must cancel at least 30 days before check-in. Cancel between 7 and 30 days before check in, and receive a 50% refund for all nights. Cancel less than 7 days before check in and receive no refund. We do not offer reschedules or other date changes. If you wish to change your reservation, you must cancel by following the cancellation policy and then rebook for the new dates. .
Default: If Primary Guest defaults for 24 hours on any payment or gives Homeowner a check, draft or money order which is not immediately collectible, Homeowner may, without suit, court order, or notice to Primary Guest, re-enter and take possession of the premises or terminate agreement if possession has not occurred. Primary Guest shall forfeit all monies paid prior to, and in addition, shall be liable for such other damages as may be collected by law.
Weather/Acts of God: Weather/ Acts of God refer to any natural event, such as, but not limited to flood, storm, hurricane, tornado, earthquake, etc associated with a force of nature over which no person has any control. Consequently, the Homeowner cannot be held accountable for consequences resulting from any Act of God. Therefore no money will be refunded.
General: In addition to Acts of God, Primary Guest is not entitled to any full or partial refund due to delay in Check-In, unfavorable weather, disruption of utility services, including Internet, or community amenities, guest allergies, malfunctioning or missing equipment/appliances/furnishings, surrounding construction, and associated noise, or any other situation not under the Homeowner’s control.
Guests are encouraged to purchase vacation travel insurance of their choice.
Failure of Equipment, Amenities, and Other Concerns: The property is advertised in good faith. It is expected that systems, such as AC/Heat, washer, refrigerator, etc will fail from time to time. The Homeowner will make reasonable efforts to remedy the failure as quickly as possible and assumes no liability to Primary Guest if such should occur, including refund of any rental fees, or alternate lodging. The Primary Guest agrees to work with the Homeowner to help repair contractors gain access to the condo. The Homeowner is not responsible for the unavailability of any community amenities such as pools, tennis courts, etc. The Primary Guest agrees to notify the Homeowner immediately of any concerns during their stay and to allow the Homeowner the opportunity to remedy any such concerns. The Primary Guest waives the right to any consequential damage claims lacking immediate notification and the opportunity for the Homeowner to remedy
Ring Doorbell and Noise Monitoring: This is a self-check-in rental. A Ring Doorbell with video and audio recording is located at the exterior door. The owner will utilize the camera to verify the check-in/out & rental compliance. The Unit is equipped with Noise level monitoring technology. This technology does NOT record audio
Owner & Property Management Access: The Homeowner, their Representative, and Town Center East Condominium Association of Owners Property Management have full rights to access to the property for purposes of repair and inspection or any other reason deemed necessary. All agree to exercise this right of access in a reasonable manner. Notices of planned Property Management Inspections are posted in the exterior hallways. The Homeowner, their Representative and Property Management may also access the condo for emergency situations or Rental Agreement & Rules violations by the Rental Party, without prior notice.
Personal Hygiene Items, Paper Products & Cleaning Products: Paper products such as toilet paper and papers towels, laundry and dish detergent and personal hygiene items such as soap, shampoo, toothpaste, etc are not provided.
Linens: Clean and sanitized Bed, Bath and Kitchen Linens are provided. However, depending on the length and number of people in your group size, you may need to launder them during your stay. There is a full size washer and dryer in the unit. All linens must remain clean and in good condition. Only beach towels and specified beach blanket may be used outside the condo. No bed or bath linens may be used outside the condo, at the pool or beach. Guest is responsible for lost or damaged linens or towels. Note that makeup will damage towels and bed linens. This is not considered "normal wear and tear" and cost of replacement will be deducted from your Damage/Rental Deposit. Black makup wash clothes are provided.
Pets: This is is a dog friendly vacation rental when approved by the Homeowner, HOA and Fee is applied. No other types of pets are permitted. No refunds or other accommodations are given for guests with pet allergies. Guests must maintain the condition of the condo, and ensure there are no complaints from neighbors. Guests are required to keep the condo free of pet hair during your stay. Please vacuum, sweep and mop as needed to ensure everything remains pet hair free.
Pet Rules are as follows:
Dog must be spayed / neutered, at least 1 year of age, and not to exceed 40 lbs, as documented by an accredited veterinarian.
Dog must be up to date on all vaccinations and on flea and tick repellent at least 3 days prior to arrival. Fleas are rampant in sandy soil. The Primary Guest is responsible for any flea infestations and treatment caused by their stay.
Dog must be leashed and lead by an adult only when walking in the community. Children may not lead the dog. This is enforced by the HOA.
Primary Guest is responsible for cleaning up all dogrefuse. There are bags and pet waste cans throughout the community.
Dogs are not permitted on furniture or bedding. Guest should bring sheets to cover furnishings and bedding to prevent pet hair. We DO NOT permit use of our sheets for this purchase. Any evidence of dogs on the furniture or use of our bed linens for pets will result in loss of the entire Damage & Rental Deposit to cover extra cleaning, sanitation, and replacement fees. Our cleaner thoroughly inspects after check-out
Dogs must be crated when unsupervised. Property Mgt must never be greeted by an uncrated dog in the event of an emergency. Dog must not be left unattended for undue length of time. Pets may not be left on the screened porch. The guest is responsible for any damage caused by the pet
Do not allow the dog to produce noise that disturbs the neighbors. Complaints from neighbors or the HOA requires immediate action to remove the pet
Guest assumes full responsibility and liability for the dog, including, but not limited to, injury caused to other pets or humans. Homeowner assumes no responsibility for illness or injury that may occur to pets or humans while on premise
The Rental Rules outlined below are subject to the consequences outlined in your Rental Agreement.
Smoking & Vaping: This is a NON SMOKING unit. Smoking and Vaping is NOT permitted anywhere in or outside of the condo. This includes anywhere on the condo association property. Any evidence of smoking, such as debris or the smell of cigarette/cigar smoke is sufficient basis to charge the renter for smoke clean-up and removal from carpeting, AC ducts & filters and furniture. Violation will result in loss of Full Damage & Rental Deposit as penalty, in addition to any associated cleanup costs. The unit is equipped with FreshAir technology to monitor compliance. It is also monitored by Onsite Property Management and strictly enforced.
Occupancy Limitations: Maximum Occupancy is 4 people regardless of age per county regulations. Only those listed on this Rental Agreement are permitted in the unit. Any guests in the unit, and not listed on this agreement at the time of reservation, will result in immediate termination of stay/ejection, of the entire Rental Party, and forfeiture of any remaining rental fees and full Damage & Rental Deposit. Local and/or State Authorities may be engaged to enforce occupancy limitations, including HOA Regulations and state laws, and termination of your stay.
Noise Control & Security: All Guests are required to be respectful of noise volume at all times and must never disturb neighbors. Community quiet hours are from 10 PM. – 8 AM. Absolutely no “parties” of any kind are permitted in the unit or on the grounds of the unit at any time. A Ring Doorbell with video and audio recording is located at the exterior door. The owner will utilize the camera to verify the check-in/out & rental compliance. The Unit is equipped with Noise monitoring technology. This technology does NOT record audio. Onsite Property Management assist in monitoring the condo and property to ensure compliance.
Care of Unit: Keep the property and all furnishings in good order. End the stay with the property in the same condition as when entering at the start of the stay. Furniture protectors must remain on the living room furniture during your entire stay.
Shoes: Shoes may NOT be worn in carpeted areas or a $300.00 carpet cleaning fee will apply.
Appliances: Only use appliances for their intended uses. Notify the Homeowner immediately if any appliance is not working properly.
Pets: Pets are NOT permitted without prior approval.
Parking: Unassigned parking is available for up to 2 vehicles. Handicapped parking is enforced. No parking of RVs, boats or other trailer as the community will have these towed at the owner’s expense
Housekeeping: Cleaning and damage inspection is provided at the end of your stay. However, guests are required to keep the Unit tidy throughout their stay. Spot cleaning supplies (except paper towels) are provided. This includes cleaning any kitchen supplies/utensils used during the stay. Any spills or sugar substances must be cleaned immediately as ants are extremely common due to the sandy soil.
Sand: All effort must be made to prevent sand from entering the unit. When returning from the beach, ensure all persons, clothing, beach supplies, chairs and umbrella are cleaned off outside, prior to entering. Excessive sand will result in additional cleaning charges.
Linens: Bed, Bath and Kitchen Linens are provided. However, you may need to launder them during your stay. All linens must remain clean and in good condition. Only beach towels and specified beach blanket may be used outside the condo. Absolutely no bed or bath linens may be used outside the condo, at the pool or beach.
Garbage: Garbage cans are provided. Trash must be emptied and as needed. All garbage must be taken to the neighborhood dumpster, and not be stored on the screened porch or outside the unit.
Community Pool, Pool Passes and Keys: All posted rules must be following while using the pool. One pool pass is provided on a lanyard near the entrance door. Pool passes must be returned to this location prior to Check-Out to avoid a $100 replacement charge per pass. If door keys are provided, a lost key fee of $100 will apply for any keys not returned directly to the Homeowner within 4 days of Check-Out
Candles/Open Flames/Incense/Hair Dyes and Sprays: Candles, incense, other open flame items, hair dye and spray tan products are not permitted to be used in the unit or screened porch at any time.
Air Conditioning & Heat: The condo is equipped with AC, heat and ceiling fans. The AC may not be turned below 70 degrees or heat above 74 degrees to prevent excessive strain on the system and excessive utility charges. All doors and windows must remain closed when the Heating & AC System is operating. The Homeowner receives notifications when doors/windows are left open and the Heating & AC System will be disabled until all doors and windows are closed. Any violations or tampering with the thermostat or connectivity will alert the Homeowner, resulting in excessive utility and/or repair charges to the Primary Guest. Notify the Homeowner immediately if the heating and cooling system is not working properly
Cable TV Service/Internet/Other Electronics: Do not purchase any type of “Pay per View” type services. Violation will result in a $100 fee, plus the cost of the service ordered. Do not use the provided Internet to improperly copy or share illegal or copyrighted content, such as, but not limited to, music, movies, video or software. This activity is monitored by Comcast. The Primary Guest will be responsible for any fines or legal actions as a result of this activity. Additionally, your information will be turned over to proper authorities for handling. Do not move or unplug any television wires, Internet modems or other electronic equipment. A minimum $250 fee will be assessed for reconnection.
Supplies & Amenities: Supplies such as trash bags, cleaners, etc are only intended for use while staying in the condo, and should not be removed or taken with you upon check-out. Wasteful use or removal from the condo will result in a replacement fee to the Primary Guest.
Screened Porch: No items may be draped or hung on the screened porch, including towels and swimsuits. No bikes on porch. The HOA will fine for this, and the fine will be passed on to the Primary Guest.
Grills: The use of grills is strictly prohibited in all locations. This includes the screened porch and common grounds outside.
Furniture: Do not move any of the furniture from its original location.
Fire Alarms, Fire Extinguishers & Sprinklers: Notify the landlord immediately if any alarm chirps indicating a low backup battery. There are two fire extinguishers in the unit (kitchen & laundry room).Do not remove or tamper with any of the fire/smoke alarms, fire extinguishers or sprinklers within the unit or condo building. Do not touch or hang anything from the sprinkler heads. Any damage to fire alarms, extinguishers or sprinklers will be accessed in accordance with the Rental Agreement.
Firearms, Illegal Drugs & Fireworks: Firearms, illegal drugs and fireworks are not permitted in the unit, or on the grounds of the Villages of Five Points Community.
Dehumidifier: The Unit is equipped with a dehumidifier which automatically drains. You agree to always operate the dehumidifier with a maximum setting of 50. The Primary Guest agrees to notify the homeowner if the dehumidifier is not operating properly.
Subletting & Business Use: No subletting of the condo for any reasons. The Unit must not be used to conduct any type of business activity including professional photography or videography. Guests who telecommute (work from home) are permitted.
