The Red Dirt Escape Booking Agreement & Liability Waiver

By booking and/or staying at The Red Dirt Escape, the guest (“Guest”) and any of their guests agrees to the following legally binding terms on behalf of themselves and all individuals included in the reservation.

1. Guest Eligibility & Responsibility The primary booking guest must be 25 years of age or older and present for the duration of the stay. The primary guest assumes full responsibility for all individuals on the property, including minors and visitors. No third-party bookings are permitted.

2. Assumption of Risk

Guest acknowledges that use of the property, surrounding land, beach, and provided equipment (including kayaks and paddleboards) involves inherent risks including but not limited to:

Injury, illness, drowning, or death Property damage or loss Environmental hazards (weather, tides, terrain)

Guest voluntarily assumes all known and unknown risks associated with the use of the property and any amenities.

The Red Dirt Escape, its owners, operators, and representatives shall not be held liable for any injuries, damages, losses, or claims arising from use of the property or equipment.

3. Fire Safety & Approved Outdoor Fire Use

To reduce the risk of fire, injury, and property damage, guests must follow all fire safety rules at all times.

Smoking, vaping, candles, incense, and any open flame are strictly prohibited inside the home and near doors, windows, or any combustible materials. The BBQ and designated outdoor fire pit are the only approved flame-producing amenities permitted for guest use.

Guests may use the BBQ and fire pit only in a safe, responsible manner and only for their intended purpose.

Guests must never leave the BBQ or fire pit unattended while in use.

Guests must fully extinguish all flames and embers after use.

The use of fireworks, sparklers, burn barrels, propane heaters, turkey fryers, or any unauthorized flame-producing or combustible devices is strictly prohibited anywhere on the property.

Guests must not use the BBQ or fire pit during unsafe weather conditions, including high winds, fire bans, or other conditions that increase fire risk.

⚠️ Any misuse of the BBQ, fire pit, or any unauthorized flame source, or any violation of these fire safety rules, may result in:

Immediate eviction without refund Full financial responsibility for any resulting damage, loss, or cleanup Charges for structural damage, contents damage, additional cleaning, and loss of rental income Additional recovery pursued through Airbnb or legal action where necessary

4. Equipment Use (Kayaks & Paddleboards)

Guests are responsible for proper and safe use of all equipment.

Life jackets are strongly recommended

Equipment must be returned in original condition.

Guest accepts full responsibility for:

Injury or accidents while using equipment Damage, loss, or misuse of equipment

Full Replacement or repair costs will be charged to the Guest.

5. Safety Guidelines

No use of equipment under the influence of alcohol or drugs

Guests must assess weather, tides, and water conditions before use

Guests must comply with all local laws and safety regulations

6. Property Use, Conduct & Restrictions

Occupancy & Guests Only registered guests are permitted on the property at all times

Exceeding occupancy limits will result in immediate removal

Parties & Events Strictly no parties, events, or gatherings

Violation results in eviction without refund

Smoking Policy Smoking only in designated outdoor areas away from the property

Violation results in a minimum $1,500 cleaning fee

Pets No pets permitted due to severe allergies Unauthorized pets = immediate eviction + $1,500 cleaning fee

Furniture & Property Care

Furniture must not be moved

Guests must maintain the property in respectful condition

7. Monitoring, Security & Compliance

Exterior security cameras and/or noise monitoring devices may be in use for safety and compliance

No devices record inside the home

Tampering with or disabling devices will result in:

Immediate eviction Minimum $500 penalty

8. Damages, Liability & Financial Responsibility

Guest agrees to be fully financially responsible for any damages beyond normal wear and tear, including but not limited to:

Fire or smoke damage Water damage Structural damage Contents and furnishings Excessive cleaning Loss of rental income due to property downtime

Guest authorizes charges through Airbnb resolution center and acknowledges that:

Charges may exceed security deposits Additional recovery may be pursued through legal action if necessary

9. Insurance & Acknowledgment of Risk

Guest acknowledges that:

Platform protections are limited and not guaranteed

The property is privately owned and operated

Guests are strongly encouraged to obtain personal travel insurance to cover:

Liability Personal injury Trip interruption

10. Right to Refuse or Terminate Stay

The Red Dirt Escape reserves the right to:

Refuse bookings that present risk Terminate stays immediately for violations

No refunds will be issued in the event of removal due to rule violations.

11. Governing Law

This agreement shall be governed by the laws of Prince Edward Island, Canada.

12. Acceptance of Terms

By completing this booking, Guest confirms:

They have read, understood, and agreed to all terms They accept full responsibility for compliance and financial liability.
