AOAO KONA REEF HOUSE RULES Amended and Adopted March 12, 2025

1. No more than four (4) people are permitted overnight in one-bedroom units, and no more than six (6) people are permitted in two-bedroom units. a. FINE: $100 per night

2. Quiet hours are from 10:00 pm. until 8:00 am. Please be aware of the acoustics and be as quiet as possible when entering and exiting your unit. When windows are open please keep the volume down. a. FINE: $100 per night

3. No excessive noise which may disturb other owners or occupants. This includes but is not limited to events, musical instruments, TV, and musical devices. a. FINE: $250 when police response required

4. The corridors, walkways, stairways, elevators, parking ramps, garage and other common areas for use in getting to and from apartment units shall not be obstructed or used for temporary storage or any other purposes other than for ingress to egress from units. This includes but is not limited to cleaning supplies, vendor materials and owner property. a. FINE: $50 per day

5. No owner or occupant shall put their names in any entryway, corridor, walkway or stairway of the building, except upon the mailbox provided for use of such unit.

6. No rugs, towels, or other items shall be shaken, thrown or emptied over the lanai rails, or out of windows or doors, in stairways, halls, corridors, or outdoor common areas, and no dust, rubbish, or litter shall be swept from the unit to any of the corridors or entryways. No towels, articles of clothing or bedding or any other item shall be placed on the lanai rails of non-ground units, the rock walls in front of the ground floor units, or outside of windows or windowsills. Lanais are a structural element and should not be subjected to unnecessary resting water, please sweep or vacuum lanai’s

7. No one is permitted to play or loiter on the stairways, in the corridors, elevators, parking areas or other common areas.

8. Any damage to the property of others, including the common elements, resulting from misuse of such facilities, or by moving and/or carrying of articles by owner of a unit or his family, tenants, housekeepers, or invitees shall be paid for by such owner. a. FINE: $100 plus cost of repairs/cleanup

9. Dogs, cats and other domestic pets are not permitted in any apartment or common areas at any time. Exceptions are made for registered service, assistance and emotional support animals only when proper registration forms and approval occurs prior to arrival. a. FINE: $100 per day/pet

10. No feeding of birds, chickens or other wild animals.

11. Water shall not be left running for any unreasonable or unnecessary length of time in any apartment unit or shower or other washing facility. Lanais are a structural element and should not be subjected to unnecessary resting water. Please sweep or vacuum lanais.

12. No bicycles, motorcycles, motor scooters, or mopeds are to be ridden on the ocean

front lawn or any other lawn area. No roller skates, roller blades or skateboards are to be used in any of the common areas, including the pool area, courtyard, and sidewalk and parking area. 13. All posted signs must be obeyed.

14. No shades, awnings or window guards shall be used outside a unit except as shall first be approved in writing by the Board of Directors and no signs of any kind shall be placed in windows or on doors or other exterior surfaces or common areas without prior written approval of the Board of Directors.

15. No radio or aerial or connection shall be installed by any owner or occupant outside of his apartment unit.

16. No owner or occupant shall install or operate on the property any machinery, refrigeration or heating device, washing machine or washer-dryer or air-conditioning apparatus or use any illumination other than electric light or use or permit to be brought onto the property any flammable oils or fluids or other explosives (including fireworks) or articles deemed hazardous to persons or property (including firearms and weapons). These restrictions shall not apply to normal household appliances, air conditioning, washing machines or washer-dryers located in apartment units. a. FINE: $50 for fireworks; $500 and police report for firearms/weapons

17. With respect to the Swimming Pool, Jacuzzi and Cabana area:

a. Pool and Jacuzzi hours are from 8:00 am. until 10:00 pm. Please turn off the Jacuzzi if you are the last person out. b. Each apartment is limited to two (2) visitors at the pool on any one day. Only owners, guests and their visitors are permitted in the pool, the Jacuzzi or in the Cabana. The occupant or owner must remain with the guest at the pool. c. Furniture other than that provided by the Association shall not be used in said area and furniture provided by the Association must not be removed from the pool area. d. No breakable containers are permitted in the pool area. When you leave the pool area, please take with you all the articles brought by you, including empty drink cans, suntan lotion containers, towels, books, etc. i. FINE: $25 for glass in pool area; $475 for breakage requiring pool drainage e. No one, whether guest or owner, is allowed to climb over the fences. You should always have your pool key with you. f. No running, pushing or scuffling shall be permitted around the pool. g. There shall be no splashing of water other than that accompanying normal swimming. h. No loud noises, yelling or amplified music shall be permitted in the cabana or pool area. Headphones only. i. No bodyboards, surfboards, inflated floating devices or other such objects shall be permitted in the pool. j. Sand, dirt, etc, shall be washed off before entering the pool or Jacuzzi. i. FINE: $275 when spa draining is required

k. Any person having any skin disease, open sore, inflamed eyes, nasal or ear discharges or any communicable disease shall not use the pool or Jacuzzi. i. FINE: $275 when spa draining is required

18. The Site/Resident Manager shall retain a passkey, or key-less entry code for each unit. No owner shall alter any lock or install a new lock on any door leading into the unit without advising management. If a change is made, the owner must provide management with a key for management use. a. FINE: $100 per incident of need

19. The Site/Resident Manager is responsible for property emergencies. All other unit issues are the sole responsibility of the unit’s On Island Contact or Rental Agent, including lost keys/codes, appliance problems, hot water issues, cable/WiFi access, and parking permits.

20. If any Owner rents or leases the unit, regardless of who is the On Island Contact or Rental Agent, the Site/Resident Manager may post inside the unit entry door a summary of these House Rules.

21. All owners or occupants, their families, visitors, guests and or invitees shall obey the parking regulations posted at the parking areas and ramp and any other traffic regulations promulgated for the safety, comfort and convenience of owners and guests.

22. No owner or occupant shall cause or permit the blowing of any horn from any vehicle which his guest, family, or tenants, when approaching or upon any of the driveways or parking areas serving the Property, except as may be necessary for safety purposes.

23. All vehicles in the parking areas must display either a permanent sticker or temporary parking permit. All guests must register with the unit’s Rental Agent or Owner and obtain a parking permit. Parking passes should reflect “numeric association’ to each unit only. (For example: B32 = 232, D17 = 417). This policy is intended for management to identify the unit for each vehicle onsite and protect the safety and security of our guests when their vehicle is offsite. a. FINE: $50 per day

24. Parking passes are for occupants of Kona Reef units only. No visitor or guest parking passes are allowed. See the approved parking policy for details.

25. If a unit is occupied at any time by anyone other than the owner, whether such occupancy be gratuitous or by rental, such non-owner occupant must be registered with the On Island Contact or Managing Agent and receive a copy of applicable information for occupants and a parking permit.

26. Smoking/vaping is prohibited in all common areas, per state statute Act 295. No smoking/vaping within 20 feet of any common or public area. This includes lanai spaces. It is recommended that owners place “NO SMOKING/VAPING” notice in their units. Designated smoking areas have been provided. The approved smoking/vaping area is on the east side of the main floor parking lot just off Alii Drive, under the large tree. Receptacles for refuse are provided. a. FINE: $100 per incident

27. Only the Site/Resident Manager and their designee may adjust, repair, or alter in any way Kona Reef lighting, cameras and fire systems. a. FINE: $100

28. Under no circumstances are firearms or weapons of any type intended for the harm of individuals or animals allowed to be used on Kona Reef property. a. FINE: $500 and police report

29. The Association of Owners has the right to make other rules and regulations from time to time as may be deemed necessary for the safety, care and cleanliness of the Property and for securing the comfort and convenience of all owners and occupants
