Guest Agreement. Relates to all properties. Please read this Contract Carefully

Rent: A 50% deposit is due to Airbnb at the time of booking. The balance of the full rental payment (including any remaining rental and security deposit balance, cleaning fees, any additional charges and/or booked services and applicable taxes) is due 60 days prior to arrival. Final payment is due at the time of booking if booked less than the required period in advance of guest arrival. Rent does not include long distance phone charges, personal items, cleaning upon departure, or tax.

Refundable Secuirty Deposit: Garden Island Properties LLC reserves the right to charge a Security Deposit. Any interest earned on deposits will be retained by Garden Island Properties LLC. Any long-distance charges, unreturned keys, loss, or damages to the rental property, including but not limited to excessive cleaning, moving of furniture, missing items, soiling of linens, furniture or carpet, and cleaning beyond the normal out clean fee, will be charged to the guest's card on file. The security deposit refund will be processed within 14 days after departure unless additional expenses related to the items described above are required. If expenses exceed the amount of the Security Deposit, or if there is no security deposit being held, the guest shall be required to pay additional fees to restore the property back to its pre-rental condition within five (5) days of guest's receipt of additional billing.

Credit Card Guarantee: We require valid credit card information to be held on file and guest agrees to the Credit Card Guarantee, attached hereto, and incorporated herein by reference, to cover any charges that may exceed the security deposit. Any expenses incurred, including but not limited to damage, loss, telephone toll charges, missing items, moving of furniture and/or excessive cleaning resulting from your stay will be deducted from your security deposit.

Cancellations: All cancellation requests must be done in writing. 50% refund up until 60 days prior to arrival. After that time, no refunds will be given for changed or cancelled reservations, early departure, or late arrival, nor can any portion of your deposit be applied to a future stay; you are responsible for the entire period booked once within the non-cancellation period. Because our properties are individually owned, we reserve the right to relocate you to a comparable unit or property if an unforeseen circumstance arises that makes such relocation advisable in the discretion of Garden Island Properties LLC (such as but not limited to Act of God, sale of the unit, maintenance concern, or owner removing property from rental pool). If relocation is not possible, Garden Island Properties LLC may cancel this reservation and refund any applicable amount of the cancelled reservation.

I/we hereby accept said cancellation policy and waive my right to dispute any charges with my credit card company.

Rental Policies and Conditions

Minimum Age Requirement: I/we hereby acknowledge that the Primary Guest named on this Rental Agreement is 21-years of age or older. Guests must be 21-years of age or older to check-in.

Reservation Fee and Deposit: A non-refundable reservation fee is taken at the time of booking. For any change to bookings after a confirmation has been issued, there will be a $75.00 charge for each revision made.

Check-In: Any time after 3:00 p.m. (unless otherwise noted on your Check-in Instructions). Check-Out: 10:00 a.m. Late checkout and/or early check-in will result in an additional charge equal to the daily rate.

Use of Property: Use of the home for parties, weddings, receptions, or any purposes other than family vacation purposes is strictly prohibited. Guests shall not bring any pets onto the property. Guests shall abide by the House Rules of the Owner and/or the Condominium Association as provided to the guest.

Air Conditioning: Unless stated otherwise in unit description, air conditioning is NOT available. Guests staying in units with AC for 28+ days are advised to monitor use to avoid excess charges. We make every effort to ensure that all appliances within each rental are in working order. In the event of a breakdown, we will strive to repair it as soon as possible after being notified of a problem. We cannot guarantee that the air conditioning will not break down during your stay and therefore no refunds or adjustments will be made for mechanical failure.

Additional Guests: Approval of the rental rate stated is based upon the number of occupants disclosed at the time of booking. Additional guests must be disclosed to and approved by Garden Island Properties and may be subject to additional rent. Non-permitted occupants may subject the undersigned to termination of this contract and eviction from the premises.

Non-Smoking Property: Smoking is prohibited in your rental and on property. For designated smoking area(s) on resort properties, please check with the front desk. Any smoking in the home/condo or on the lanai will result in an additional charge equal to no less than $250. Smoking in the rental is grounds for termination of this agreement and removal from the property. Damages to the unit will be charged accordingly.

Use of Pool and Jacuzzi: If available on your rental property, you shall not permit any use of a pool or Jacuzzi by unsupervised children or other guests and shall keep pool gates closed. Guests and other invitees shall use any pool and/or hot tubs at their own risk and you fully understand and accept the risks of injury and/or death inherent in and associated with such use. Pregnant women and children under fifteen years of age are not advised to use Jacuzzi. Pool heating in private homes is an additional charge.

Risks Associated with the Ocean: There are certain inherent risks to persons and property as occupants of property located adjacent to the ocean, including but not limited to the risks associated with the ocean, such as drowning. Guest acknowledges that the Owner would not rent the property unless the guest fully accepts the risks associated with the property and its location.

Security of Home and Rental Equipment: You assume full responsibility for the premises you rent, including its contents and your own personal property. Always lock the doors and windows when you leave or when retiring for the evening. Lock up your automobiles and put away any rental equipment. Use of rented equipment by guests is strictly at your own risk and could cause liability and/or additional expenses.

Cleaning: There is no daily maid service unless requested and arranged for prior to arrival. Your home will be cleaned prior to your arrival and again upon your departure. A cleaning fee is required for each home. Excessive departure cleaning will be deducted from your security deposit or charged to your credit card. You agree to leave the property in the same condition (exclusive of out-clean) upon departure as at check-in. IF the furniture is rearranged, please return to its original location to avoid additional costs. Mid-stay cleans are required for stays of 20 days or longer at guest's expense.

Keys: Upon departure, units with keys must be returned to the location where it is picked up. There will be a $50.00 fee assessed for each key lost or not returned to the location where they were picked up which includes removing key from lock box. Service call to unlock door due to lost key or removal from lock box will incur a minimum $50 charge; $100 after 4pm, holidays, and weekends or deliveries to south or north shore properties.

Repairs and Entry onto Property: We make every effort to ensure that all appliances within each rental are in working order. In the event of a breakdown, we will strive to repair it as soon as possible after being notified of a problem. We cannot guarantee that appliances, televisions, DVDs, Air Conditioning, etc. will not break down during your stay and therefore no refunds or adjustments will be made for mechanical failure. Except for an Emergency, with 24 hour notice, the Owner or its agents may enter the property at reasonable times to make repairs or show property.

Telephone: Some properties are equipped with telephones for your convenience. Please do not abuse this privilege or jeopardize your security deposit by charging long distance calls to the Owner’s telephone through regular long-distance services, fax machines, personal computers or otherwise. Cost of calls plus $25 per bill collection fee will apply.

No Pets Permitted: No pets are allowed in or on the premises. Violation of this policy will result in an additional charge equal to the cost of fumigation and additional cleaning and shall be grounds for termination of this agreement and removal from the property.

Vacation Rental Travel Insurance: We advise all guests to secure travel insurance for your protection in the event you must cancel this reservation due to injury, illness or death to yourself, traveling partners or family members. If you opt-in, there is an additional charge of 6.95% of your total booking charges.

Acknowledgement I/we hereby apply for the above listed accommodation and warrant that I/we have read, understand, and agree to the terms and conditions of this application and I/we agree to abide by homeowners’ restrictions on use of said property.

Any changes made to this Rental Agreement without prior authorization or knowledge by Management Company will not be honored.

I/we further agree that Garden Island Properties LLC is acting as the marketing agent for Owner and/or property manager. I/we represent that I/we are executing this application on behalf of all members in our group.

Liability and Agreement to Indemnify: Garden Island Properties LLC acts as a marketing and rental agent for homeowners, suppliers, and contractors. Under no circumstances shall Garden Island Properties LLC be responsible for any loss, expense, damages, claims, or injury, direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred whether arising in contract or otherwise in law or equity as a result of any delay(s) substitution(s), rescheduling(s) or change(s) in the provision of services or accommodations by Garden Island Properties LLC or by reason of any agents, employees, subcontractors, or services as substituted or by reason of any act of God or other circumstance or actions beyond the control of Garden Island Properties LLC. Garden Island Properties LLC, in its sole and unfettered discretion, reserves the right to refuse or discontinue service to any person(s) and/or to rescind any contract for accommodation or guest services. You agree to hold Garden Island Properties LLC harmless from any liability or expense arising from your use of the property, including use by all occupants, invitees, and others, and you further agree to indemnify Garden Island Properties LLC for all claims, costs, expenses, including attorney fees, and/or damages incurred by Garden Island Properties LLC, its agents, employees, successors and assigns, directly or indirectly, as a result of your use of the property or your breach of this agreement.
