This property has special local compliance requirements which include a signed rental agreement, ID verification, and a security hold of $1,500 (which is not a traditional security deposit, just a pending transaction). As an optional alternative to the security hold, you may opt in to purchase a non-refundable damage waiver provided by a third-party insurance company. The optional damage waiver is $89 for stays up to 10 nights, with an additional $2 per day for stays longer than 10 nights. Damage waiver purchases are optional.

SHORT TERM RENTAL USAGE AGREEMENT
Upon booking, this Short Term Rental Agreement (the "Agreement") is made by and between Misfit Homes ("The Host") and the Guest as of the date of booking. For good and valuable consideration, the sufficiency of which is acknowledged, the parties agree as follows:

Rental Unit. The rental unit (the "Rental Unit" or the "Property") is privately owned by an independent third-party (the "Owner"), for which The Host acts as agent.

Rental Party. The rental party consists of the Guest and all occupants staying in the Property. All members of the Rental Party are the sole responsibility of the Guest.

Maximum Occupancy. The maximum number of guests allowed is the number listed on the reservation confirmation. Additional approved guests beyond this limit may incur per-person, per-night charges.

Visitors. Visitors not included in the Rental Party must be approved by The Host. Unauthorized overnight visitors will result in additional charges.

Term of Agreement. The rental period begins and ends at the times and dates stated in the reservation confirmation. Check-in constitutes binding acceptance of all terms.

Late Checkout Fee. Unauthorized late checkout is billed at $100 per hour.

Minimum Stay. A minimum of 2 nights is required unless otherwise stated.

Rental Rules. Guest, the Rental Party, and any Visitors shall follow the Rental Rules attached as Exhibit A.

Access. Guest shall allow The Host access to the Property for repair or inspection when reasonably necessary.

Entry. The Property uses a keyless entry smart lock. Codes will be sent prior to arrival.

Bedding & Sheets. Missing, stained, or damaged bedding may incur replacement charges.

Refrigerator. Guests must empty the refrigerator before departure unless leaving unopened or non-expired items as “pay it forward.”

Garbage. All trash must be bagged, tied, and placed in designated bins prior to departure.

Cleaning. The cleaning fee covers standard turnover only. Guest agrees to maintain the Property in clean, good condition.

Decorations. No glitter or confetti. No tape on walls except blue painters tape. Damage from decorations will result in additional charges.

Smoking. No smoking inside the Property or near open doors or windows. A minimum $500 fine applies for violations.

Noise. Quiet hours are 10pm–8am on weekdays and 12am–8am on weekends.

Pets.
If the listing indicates that pets are not allowed: No pets of any kind are permitted. Any undisclosed or unauthorized pet will result in eviction, forfeiture of all rent, and a $150 penalty per pet.
If the listing indicates pets are allowed: Pets must be disclosed and approved in advance. A $150 pet fee applies per approved pet.

Damage Waiver (Optional). Guests may choose an optional, non-refundable Damage Waiver for $89 per reservation, which provides up to $1,500 of coverage for accidental damage during the stay. Coverage applies to accidental damage only and does not include intentional damage, negligence, missing items, excessive cleaning, fines, or violations of this Agreement. Damage must be reported prior to checkout for coverage to apply.

Security Deposit (Refundable). If the Guest does not purchase the optional Damage Waiver, a refundable $1,500 security deposit will be required. The deposit is refunded within 7 days after checkout if no deductions are necessary. Deductions may be made for damage, excessive cleaning, missing items, rule violations, or any cost incurred by The Host. Guest is responsible for all damage not covered by the Damage Waiver and for any amounts exceeding $1,500.

Damage. Guest is responsible for intentional damage, unreported damage, and accidental damage, including any costs not covered by the Damage Waiver.

Rental Rate and Fees. Payment is due at booking.

Cancellation Policy. Unless otherwise specified through the booking channel, the standard 30-day cancellation policy applies.

Use of Common Areas. Use of fitness centers, pools, or other shared areas is not included unless expressly approved.

Use and Maintenance. Guest shall use the Property safely and lawfully, maintain cleanliness, and comply with all applicable laws. No business activities may be conducted from the Property.

Furnishings. Property furnishings may not be removed. Loss or damage beyond covered amounts will be charged.

Mechanical Failures. No refunds will be issued for outages or mechanical failures. The Host will make reasonable efforts to resolve issues promptly.

Lighting Features. Guests may not touch, lean on, move, or apply weight to lighting fixtures, including neon, LED, or specialty lighting.

Insurance. Guest's personal property is not covered by any insurance maintained on the Property.

Indemnification and Assumption of Risk. Guest accepts all risks associated with occupying the Property and agrees to indemnify The Host, the Owner, and their affiliates from related claims.

Limitation of Liability. The Host is not liable for accidents, injuries, illness, or theft. Guest assumes all risks associated with using the Property.

Violation of Agreement. Any violation of this Agreement may result in eviction without refund.

Governing Law. This Agreement is governed by the laws of the city and state in which the Property is located.

Payment. Payment must be processed through the booking channel or directly with The Host.

Acceptance. By signing or checking in, Guest acknowledges full acceptance of this Agreement.
Exhibit A: Rental Rules
Throughout the rental period, the Guest shall ensure that the Rental Party and any Visitors:

Maintain the Property in good and tidy condition.

Do not use glitter or confetti.
-
Do not use tape on walls except blue painters tape.
-
Do not hang decorations on walls without approved materials.
-
Do not smoke inside the Property.
-
Do not disturb neighbors.
-
Do not bring pets unless the listing indicates pets are allowed and approval has been granted.

Do not move or rearrange furniture or appliances.
-
Comply with all applicable laws.
-
Leave the Property in the same condition in which it was found.
HOT TUB / POOL USE AGREEMENT AND LIABILITY WAIVER
(This section applies only if the listing indicates that the Property includes a hot tub and/or pool.)
This Hot Tub/Pool Use Agreement and Liability Waiver forms an integral part of the Short Term Rental Agreement.
Acknowledgment of Risks:
Guest understands that hot tubs and pools carry inherent risks including drowning, slips, falls, and chemical reactions.
Health & Safety:

Shower before and after use.

Do not use under the influence of substances that cause drowsiness.

People with medical conditions should avoid use unless cleared by a doctor.

Minors must be supervised by an adult 23 or older at all times.
Operational Guidelines:

Follow all posted or provided instructions.

Temperature may not be at peak level upon arrival.

No soaps, lotions, oils, glitter, bubbles, or jewelry allowed.
Liability & Responsibility:

Guest accepts full responsibility for injury or damage arising from use by Guest or their party.

Guest will indemnify and hold harmless Misfit Homes and affiliates.

Guest covers any repair or replacement costs due to misuse or negligence.
Maintenance & Reporting:

Inspect water clarity before use. Do not enter if water is cloudy, dirty, or has unusual odor.

Keep the cover closed and locked when not in use.
Noise:
- Follow quiet hours of the Property.
Availability Not Guaranteed:
- Hot tub or pool use is not guaranteed, and malfunctions do not entitle Guest to refunds.
Emergency Procedures:
- Call 911 in an emergency.
Acceptance:
By signing or checking in, Guest agrees to all terms of this SHORT TERM RENTAL USAGE AGREEMENT and, if applicable, the Hot Tub/Pool Waiver.
