Short-Term Vacation Rental Agreement

We're excited to host you for an unforgettable stay. This Agreement outlines a few simple rules to ensure a smooth experience for everyone. We're here to help—our contact information is included in your reservation details.

This Short-Term Rental Agreement ("Agreement") is made on the day the Reservation was made on the online rental platform between the following:

THE PARTIES.
GUEST: Your name as it appears on the online rental platform reservation ("Guest"), and HOST: Miami Vacation Stays ("Host"). THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:

Mailing Address: Address as it appears on the online rental platform reservation. Hereinafter, the "Premises."

By making a reservation on the rental platform, you agree to the following:

LEASE TERM. The Guest shall be allowed to occupy the Premises starting on the arrival date specified on the online rental platform, from the check-in time specified, and ending on the departure date specified on the online rental platform, at the checkout time specified, as it appears on the Reservation made on the online rental platform. ("Lease Term").

QUIET HOURS. Quiet hours begin at 10:00 pm each night and continue until sunrise. During these hours, no music is permitted, and all audio is kept to a minimum to respect surrounding residents.

PARTIES. Parties are not permitted, and we have technologies, people, and systems in place to nip these in the bud, with noise detectors and neighbors who call us when they observe a party starting. Additionally, we live nearby, so we'd notice. We do not allow DJs or Bands on the property.

3RD PARTY SERVICES. All 3rd-party services, including Airbnb Services (e.g., in-home chefs or massages booked through Airbnb), are strictly prohibited at any time and in any location on our Premises. We offer services. We've curated and vetted providers, and you are welcome to book these through our guest portal.

OCCUPANTS. The total number of individuals on the Premises during the Lease Term shall be the number of guests, as it appears on the online rental platform reservation. If more guests than the authorized number listed above are found on the Premises, this Agreement will be terminated by the Host.

BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process. If you have not prepaid for your Reservation on the booking platform, a 100% payment is due within 24 hours.

POOL SAFETY. Running, diving, and using glassware are prohibited. Children of any age are not allowed in the pool area without adult supervision. All doors must be kept closed and locked. Any safety concerns, including equipment or locks not working correctly, must be reported immediately to the Host. Do not disconnect or tamper with the pool alarm.

POOL RULES. You can swim at your own risk—no diving, horseplay, or running around the pool. We don't want you to get hurt, so glass containers are not allowed within 50 feet of the pool deck. Please use the provided plastic glasses. Please shower before entering the pool. DO NOT DISCONNECT, PLAY WITH, OR STEP ON THE POOL CLEANER. It needs to run to keep the pool crystal clear.

SAFE USE. Guests must comply with all laws and rules. Fireworks, gas grills, and candles are prohibited. Guests must report chirping alarms to the Host immediately. Furniture may not be moved. Alarms and smoke detectors must not be tampered with. Do not turn on the gas unless you immediately light the grill. Shut the gas off as soon as you're finished using the grill.

UTILITIES. The Host shall be responsible for all utilities and services to the Premises.

ID VERIFICATION: The Guest agrees to complete guest verification through the third-party provider, Truvi, within 24 hours of making the Reservation. We verify our main guests to help combat human trafficking, stay up to date on short-term rental regulations, and provide additional protection for our guests and properties. Truvi will contact you via email and/or text to complete the verification.

CLEANING: We have a local company service our home before your visit. If anything is not up to standard, please let us know by phone or via the booking platform app within 4 hours of arrival. This way, we can address the issue and align it with our standards. Like most people, our crews thrive on positive feedback. Please send us any compliments and/or add them to your review!

According to the Department of Business and Professional Regulation's Division of Hotels and Restaurants, we are providing this notice of an exception to sanitation requirements for our guests: Dishware, glassware, kitchenware, and/or utensils have been provided in this room for guests' convenience. These items have been cleaned within this room or unit using ordinary household dishwashing facilities and agents. They have not been sanitized in accordance with Federal and State standards for public food service establishments.

PEST CONTROL: Our home receives regular pest control to keep the yard and home as pest-free as possible...BUT ALAS, this is Florida. Bugs and critters thrive here. Please understand that you may see them in or around the home, as they like to sneak in and get into all sorts of things. Refunds are not issued for occasional bug sightings, and reports should be made immediately so we can determine whether an emergency call to the pest company is needed. You can also help us by leaving doors closed whenever possible to prevent them from sneaking in.

SAME DAY BOOKING SECURITY DEPOSIT: If you make your reservation for the same day you arrive at the Miami Pool Oasis, we will place a $1,500 hold on your credit card as a security deposit via the guest portal. This deposit will be returned to your card one day after departure. Any damages, missing items, fees, unauthorized guests, or pets will be deducted from that fee.

SECURITY DEPOSIT: We collect a security deposit on some channels like VRBO, Booking and others. We will place a $1,000 for the Miami Pool Oasis ($500 for the Miami Pool Cottage) hold on your credit card as a security deposit. This deposit will be returned to your card one day after departure. Any damages, missing items, fees, unauthorized guests, or pets will be deducted from that fee.

PET POLICY & RULES We love dogs and are thrilled to welcome your four-legged family member to our home! Because we care deeply about the safety and well-being of your dog, we have established specific policies to ensure a safe, comfortable stay for everyone.

Pre-Approval Required Please contact us prior to booking if you plan to bring your dog. All dogs must be pre-approved before your reservation can be confirmed. Please note: Our insurance policy strictly prohibits certain dog breeds on the premises.

No pets other than dogs are permitted. Important: Arriving with an unauthorized pet or failing to comply with our pet rules will result in the immediate cancellation of your stay without a refund, forfeiture of your Pet Deposit, and immediate removal from the property.

Fees & Deposit Pet Fee: $35 per dog, per night (maximum of two well-behaved, healthy dogs). Pet Damage Deposit: A $500 refundable security hold will be placed on your credit card under the merchant name Miami Vacation Stays.

PET RULES & SAFETY GUIDELINES

1. Constant Supervision Required (No Unattended Dogs) Just as with small children around a swimming pool, the best defense against accidents is an alert owner. We are a vacation rental, not a doggy daycare or boarding facility, and our property is not customized to be "pet-proof." Dogs must never be left unattended anywhere on the property—inside or outside. Crating and leaving your dog behind while you go out is strictly prohibited. Your dog must accompany you whenever you leave the premises. Your dog must remain on a leash or under immediate, effective verbal/sight control at all times while outdoors.

2. Outdoor & Property Hazards For your dog’s safety, please keep a close eye on them while enjoying the yard and outdoor amenities:

Natural Hazards: Fallen tropical fruits (such as avocados, mango seeds, and pit toxins) can pose severe choking hazards or toxicity to dogs.

Treatments & Pest Control: Like most tropical homes, we regularly use lawn fertilizers and pest control treatments inside and outside the property that are unsafe for ingestion.

Local Wildlife: Native wildlife (including raccoons, iguanas, and other native species) frequent the area and can pose a danger or threat to your dog if confronted.

Protecting the Grounds: Please keep dogs away from young landscaping, garden beds, outdoor furniture, and property amenities. Dogs can easily damage delicate young plants, irrigation, or outdoor furnishings.

3. General Etiquette & Cleanliness Walks & Waste: Please walk your dog off-property for bathroom needs. Indoor piddle pads are strictly prohibited. Always pick up after your pet immediately, bag the waste securely, and dispose of it in the outdoor trash bin on the side of the house.

Furniture & Kitchenware: Dogs are strictly prohibited on furniture (sofas, chairs, beds) and counters. Please do not use kitchen bowls, plates, or utensils for your pet—kindly bring your own pet feeding dishes.

Behavior: We reserve the right to ask you to remove your dog from the property if the animal is out of control, not housebroken, or causing a disturbance to neighbors.

SERVICE ANIMAL RULES & SAFETY While Service Animals are exempt from pet fees and deposit holds, they are subject to the same strict safety, health, and behavioral standards as all other animals on the property.

1. Constant Supervision Required (No Unattended Animals) By definition under the ADA, a Service Animal performs work or tasks for the benefit of an individual with a disability.

A Service Animal may NEVER be left unattended inside or outside the property at any time. Crating and leaving the animal behind in your absence is strictly prohibited. The Service Animal must accompany the handler at all times whenever leaving the premises.

The animal must be on a harness, leash, or tether at all times outdoors, unless your disability prevents using these devices or they interfere with the animal's safe performance of tasks (in which case direct voice or signal control is required).

2. Health, Safety & Outdoor Hazards For your Service Animal’s safety while outdoors:

Outdoor Hazards: Please monitor your animal closely. Our grounds contain natural hazards common to tropical properties, including fallen fruit/seeds (avocado/mango seeds can cause choking or toxicity), garden fertilizers, pest control treatments, and native wildlife (such as raccoons).

Housebreaking: Service Animals must be fully housebroken. Indoor piddle pads are prohibited.

Waste Disposal: Please walk your animal off-property for bathroom needs. Clean up all waste immediately, secure it in a bag, and dispose of it in the outdoor trash bin on the side of the house.

3. Property & Furniture Care Service Animals may not be on furniture (sofas, beds, chairs) or counters unless doing so is directly necessary to perform a specific task for your disability. If furniture access is required for task work, please inform us in advance so we can prepare appropriate protective covers.

Guests remain 100% financially liable for any physical damage or extraordinary cleaning required due to a Service Animal.

4. Removal & Misrepresentation Policy Removal for Cause: We will require the immediate removal of a Service Animal if the animal is out of control and the handler does not take effective action to control it, or if the animal is not housebroken.

Florida Fraud Warning: In Florida, falsely claiming a pet as a Service Animal is a second-degree misdemeanor under § 413.08(9), Fla. Stat. Conviction can result in up to 60 days in jail, a $500 fine, and 30 hours of community service. Fraudulent Service Animal claims will be reported to law enforcement, resulting in immediate eviction without a refund and forfeiture of all booking fees.

SMOKING POLICY. Smoking in the Premises is prohibited. We have technology in place to detect the use of any substances. You may smoke outside. Please ask us for ashtrays.

SMOKE DETECTORS. (Battery-operated only.) Test by pressing the test button. If the alarm does not sound or chirps at any time during your stay, indicating a weak battery, report it immediately.

SUBLETTING. The Guest does not have the right to sublet the Premises.

INSPECTION. The Host has the right to inspect the Premises with prior notice under State law. Should the Guest violate any term of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises upon the expiration of this Agreement.

MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only carefully and lawfully. The Guest shall leave the Premises in a ready-to-rent condition at the expiration of this Agreement, as defined by the Host as immediately habitable for the next Guest. The Guest shall pay for repairs if the Premises are left in a worse condition. The Guest agrees that the Host shall deduct the costs of said services from any Security Deposit before a refund if the Guest causes damage to the Premises or its furnishings.

TRASH. The Guests shall dispose of all waste material generated during the Lease Term under the instruction and direction of the Host.

QUIET ENJOYMENT. The Guests and neighbors shall enjoy each other's company quietly and respectfully to each other's enjoyment. The Guest is expected to behave in a civilized manner and shall be a good neighbor to any immediate area residents. Creating a disturbance in the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.

CANCELLATIONS AND BOOKING TERMINATION. You may cancel your Reservation up to 30 days before check-in. If we collect payments (for reservations made on booking platforms like VRBO, Booking, our website, and others), we will refund your payment minus the credit card processing fee within seven days. All guest cancellations will incur a 6% service fee to cover credit card processing costs.

TRAVEL INSURANCE We strongly encourage guests to purchase travel insurance to help offset costs that arise when they need to cancel their trip due to unforeseen circumstances such as illness, accidents, family emergencies, or third-party cancellations (such as canceled flights, cruises, …), weather-related events … we will not refund a booking fee, based on any of these issues.

Some booking platforms, such as Airbnb, allow you to purchase travel insurance at the time of booking. You can purchase trip insurance through our guest portal after your Reservation is confirmed.

• You understand that we reserve the right to refuse check-in and/or terminate your stay without a refund if: • You did not complete the verification process with Truvi within 24 hours of making your Reservation, • The primary Guest is not present at arrival. • You do not provide the full names of all guests on your booking details - Airbnb has a help article to help if you run into any issues with this ( https://www.airbnb.com/help/article/2672). • You exceed the number of guests listed on your itinerary. • You exceed the maximum occupancy of the property, • You bring a pet without pre-approval.

CANCELLATIONS OF ADD-ONS TO ENHANCE YOUR STAY. We understand that sometimes you may need to cancel add-ons you purchased to enhance your stay.

Here's how we refund those charges: • Cancellations within 24 hours will be refunded 94% of what you've paid for the add-ons. The 6% fee covers the fees our vendors charge us to process the credit card transaction. • We will refund 50% of what you paid for the add-ons within 14 days of the booking. • We will not refund any money you've paid for the add-ons within seven days before the booking.

Depending on your bank, you will see the refund as a credit approximately 5-10 business days after requesting it.

HOST'S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host from any claims for personal injury, property damage, or loss arising from use of the Premises, regardless of the nature of the accident, injury, or loss. The Guest expressly recognizes that any insurance for property damage or loss maintained by the Host on the property does not cover the Guest's personal property, and that the Guest should purchase insurance for their guests if such coverage is desired.

ATTORNEY'S FEES. The Guest agrees to pay all reasonable costs, attorneys' fees, and expenses incurred by the Host in enforcing this Agreement. USE OF PREMISES. The Guest shall use the Premises solely for residential purposes. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.

ILLEGAL ACTIVITY. The Guest shall use the Premises solely for lawful purposes. Any other such use, including, but not limited to, illicit drug use, verbal or physical abuse of any person, or illegal sexual behavior, shall cause immediate termination of this Agreement with no refund of prepaid Rent.

POSSESSIONS. The Host is not responsible for any personal items or possessions left on the Premises. The Host shall make every reasonable effort to return the item to the Guest. The Guest will pay for the return of any items. If claims are not made within the State's required period or within two (2) weeks, whichever is shorter, the Host may retain such items for sale or personal use.

GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of the Premise's location.

• Emergencies For immediate assistance, please call 911. For non-emergencies, kindly reach the Miami-Dade Police at 311. [ We can't wait to welcome you to stay with us!
