Elysian Destination Properties Guest Terms & Conditions

Welcome! Thank you for choosing Elysian Destination Properties for your vacation rental. By booking with us, you agree to the following terms and conditions:

1. Payments and Cancellations Payment and cancellation terms are subject to the specific cancellation policy in effect at the time of booking. Unless otherwise stated, all payments are non-refundable. Under certain circumstances, at Elysian's sole discretion, a future travel credit may be issued. Travel credits are non-transferable, expire one year from issuance, and are subject to additional restrictions. Review the specific cancellation policy for your chosen property before booking.

2. Liability and Assumption of Risk You release Elysian and the property owner from liability for any injuries, damages, or losses during your stay, except for gross negligence or intentional misconduct. You assume all risks associated with your stay, including those related to COVID-19, the property's amenities, and any activities you participate in. Travel insurance is highly recommended.

3. Dispute Resolution Any disputes arising from this agreement will be resolved through binding arbitration in Colorado. You waive your right to a jury trial and class action lawsuit.

4. Occupancy and Conduct The maximum occupancy stated in the listing must be adhered to. Parties and large gatherings are strictly prohibited. You are responsible for the conduct of all guests and agree to follow all applicable laws and regulations.

5. Property Condition, Access, and Damage Report any property issues or concerns to your Guest Contact immediately. Allow reasonable access to the property for maintenance or emergencies. You are responsible for any and all damage caused to the property or its contents during your stay, beyond normal wear and tear. This includes but is not limited to damage caused by negligence, misuse, or intentional acts. You authorize Elysian to charge the credit card on file for the full cost of repairs or replacement, including any associated fees.

6. Cancellations and Unforeseen Circumstances Elysian or the property owner may cancel your booking under certain circumstances. No refunds are given for cancellations due to unforeseen events like natural disasters or pandemics. Elysian may offer a rental credit at its discretion in such situations.

7. Other Important Terms You agree to indemnify and hold harmless Elysian and the property owner from any claims or liabilities arising from your stay. Elysian's liability is limited to the amount paid for your booking.

This agreement is governed by Colorado law. By completing your booking, you acknowledge and agree to these Terms & Conditions.
