Guest Use Agreement & Comprehensive Liability Waiver
Applies to All Guests, All Amenities, and All Property Conditions
Includes Community Pool, Hot Tub, Beach Access & Environmental Risks
By booking this property, you and all members of your party acknowledge and accept the following terms. This agreement is binding upon all guests associated with the reservation.
- COMMUNITY POOL & HOT TUB – USE AT YOUR OWN RISK
The pool and hot tub are community amenities maintained by the property’s homeowners association (HOA). They are unsupervised and used entirely at your own risk.
All guests must comply with posted HOA rules including hours, maximum occupancy, safety policies, and behavior standards. Temporary closures may occur without refund due to weather, maintenance, or public health guidance.
- WATERBORNE ILLNESS & LEGIONNAIRES’ DISEASE NOTICE
Legionella bacteria, which can cause Legionnaires’ disease (a potentially serious form of pneumonia), may exist in water systems, including but not limited to:
Pools or hot tubs
Showers, faucets, sinks
Cooling systems or HVAC units
Sprinklers, decorative fountains, or other plumbing fixtures
While the host and HOA adhere to industry-standard maintenance practices, no system is guaranteed to be free of Legionella or other waterborne pathogens.
By staying at this property and using any water system, you acknowledge and accept:
The inherent risk of exposure to Legionella and other environmental bacteria
That guests who are immunocompromised, elderly, smokers, or have chronic respiratory or kidney conditions may be at higher risk
That you voluntarily assume all risks related to such exposure and waive liability to the maximum extent permitted by Maryland law
- GENERAL SAFETY RULES – POOL, HOT TUB & BEACH
No lifeguard is on duty. Children must be supervised at all times.
No diving, running, or glass containers allowed near the pool or hot tub.
Use of alcohol or drugs while using these amenities is prohibited.
Limit hot tub use to 15 minutes.
Consult a doctor before using the hot tub if pregnant, elderly, or suffering from heart, blood pressure, or respiratory conditions.
- BEACH ACCESS & OCEAN HAZARD NOTICE
The property provides access to a public or semi-private beach. There are no lifeguards. Swim at your own risk.
Ocean hazards include:
Riptides and strong currents (which can be fatal even for strong swimmers)
Sharks, jellyfish, and other marine wildlife
Floating debris, rough surf, and changing weather conditions
Guests are responsible for supervising minors and ensuring safe behavior at the beach. Do not swim alone, and avoid swimming at dawn/dusk or after storms.
- PROPERTY CONDITIONS & ENVIRONMENTAL RISKS
The property may include stairs, walkways, decks, uneven terrain, insects, wildlife, and other natural features.
Guests should use caution outdoors, especially at night or after rainfall.
The host is not responsible for injury or illness related to natural hazards, allergic reactions, slips, or animal encounters.
- RELEASE OF LIABILITY & INDEMNIFICATION
To the maximum extent permitted by Maryland law, you and your guests agree to:
Waive, release, and discharge the host, property owner, manager, and affiliates from any and all liability or claims for:
Injury, illness (including Legionnaires’ disease), or death
Property damage or loss
Emotional distress
Exposure to natural, biological, or environmental hazards
This includes incidents arising from:
Use of the pool, hot tub, or beach
Water or HVAC systems on or near the property
Acts of nature, third parties, or HOA-controlled spaces
This waiver covers ordinary negligence but not gross negligence or intentional misconduct, which cannot be waived under Maryland law.
You further agree to indemnify and hold harmless the host for any damages, legal claims, or expenses arising from your own or your guests’ misuse of the property, failure to follow rules, or violation of community policies.
- ACKNOWLEDGMENT
By booking this property, you confirm that:
You are 18 or older and legally authorized to accept these terms for your entire party.
You have read and understood this agreement in full.
You accept all risks associated with the property, its amenities, and its environment.
You agree to comply with all house rules and posted regulations.
You accept full responsibility for your own safety and the conduct of your guests.
