EXCHANGE OF MONEY AUTOMATICALLY CONSTITUTES ACCEPTANCE OF ALL TERMS AND CONDITIONS SET FORTH HEREIN.

QUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until 8:00 AM. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents. No parties or other gatherings of individuals greater in number than the number of individuals legally permitted to occupy the Premises are permitted in the Premises. If The Host is notified of a noise complaint during Renter’s occupancy, Renter will be notified by direct message, e-mail or telephone. If The Host is notified of a second noise complaint during Renter’s occupancy, Renter will be removed immediately from the Premises without refund. If law enforcement is called to the Premises for any reason relating to a disturbance, noise complaints, occupancy issues, or inappropriate behavior involving Renters, Renter shall be responsible for all costs associated with such activity, including repair of any damage done to the Premises, and may be subject to immediate eviction and prosecution.

OCCUPANTS. Renter must accurately disclose occupancy including the number of adults, children and animals that will occupy said rented premises in the booking data provided through the online platform. That determines the maximum occupancy at all times and applies to day visitors and children as well. Unless otherwise approved in writing by Host, occupancy over the indicated capacity may result in immediate eviction and forfeiture of amounts paid. The party who is on the contract must occupy the subject property for the full duration of the rental lease. Any exceptions to this must be in writing by the Host. In the case that this contract is executed, and evidence later shows the minimum age requirement of 25 years old was not met, then the reservation will be considered cancelled by the Renter and the cancellation policy will be in effect.

PETS. Maximum of 2 dogs allowed. All dogs must be disclosed on reservation in advance of stay. Must be older than 2 years of age. Must be leashed outside at all times, and never left home unattended unless securely crated. No other animal species allowed. Violations will result in a $500 fee, in addition to fees to cover any damages.

PARKING. Parking is permitted in the driveway only. Cars may not be parked on the road or in the yard. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

FEES. The Renter agrees to pay the advertised booking fees electronically via the Hospitable property management system (for direct bookings) or according to the online booking platform (for Airbnb, VRBO and Booking. com reservations) which includes all utilities & cleaning.

SMOKING POLICY. Smoking or vaping indoors OR outdoors is explicitly prohibited. Any evidence of smoking, including smoke residue/odor or cigarette butts, will be subject to additional cleaning that is paid for by Renter. Violations of smoking policy will also result in a $1,000 fine.

ACCOMMODATIONS. The accommodations are equipped and supplied as fully furnished, including bedspreads, linens, blankets, pillows, bath towels, spa or pool towels and a standard equipped kitchen. Furnishings and floor plans of Premises may differ from photographs in advertisements. Missing or damaged items provided in the Accommodations shall be charged to Renter.

SUBLETTING. The Renter does not have the right to sublet the Premises. Only approved and registered Renters may step foot on the property.

REHOUSING. Host shall not bear financial liability to rehouse or refund Renter for any amount if unsatisfied or if Renter chooses to vacate early after Host has made best efforts to resolve Renter’s dissatisfaction. Renter will seek assistance from the booking platform or their travel insurance.

INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Renter violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law.

MAINTENANCE AND REPAIRS. The Renter shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Renter shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Renter after a routine cleaning. The Renter shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Renter agrees that the Host shall charge costs of said services to the Renter if Renters causes damage to the Premises or its furnishings.

TRASH. The Renters shall dispose of all waste material generated during the Rental Term. Trash must be bagged and removed from the house by the Renter and discarded in accordance with the house rules outlined in the welcome materials, checkout instructions and/or listing description. Failure to remove all trash from the property will result in a $250 fine.

AMENITIES. The Renter acknowledges that the property may include but is not limited to amenities such as a pool, hot tub, sauna, hammock, swings, golf simulator, play structure and fireplace/pit ("Amenities") and agrees to use them at their own risk, taking full responsibility for their safety and the safety of any guests. The Renter assumes full responsibility for the supervision of any children or minors using the Amenities during their stay. The Renter understands the inherent risks of using the Amenities, including drowning, slipping, and injury, and agrees to release the Host from any liability related to such risks. The Renter agrees to indemnify and hold the Owner, Host, Property Manager and affiliates harmless from any claims, damages, or liabilities arising from the use of the Amenities by the Renter, their guests, or any children or minors under their supervision.
The Renter must comply with all rules set by the Host and ensure others under their supervision do the same, particularly ensuring children or non-swimmers are always supervised by a responsible adult. The Renter agrees to keep the Amenities secured when not in use, refrain from tampering with safety features, and avoid using the Amenities under the influence of alcohol or drugs. The Renter accepts the Amenities in their "as-is" condition and acknowledges that the Host does not guarantee their safety or condition, nor is the Host responsible for any defects or hazards. The Renter is encouraged to obtain personal insurance as the Host’s insurance may not cover any injuries or damages arising from the use of the Amenities.

FIREPLACE / FIREPIT POLICY (if applicable). In the fireplace/firepit, Renter will only use only wood designated as firewood. In a wood-burning fireplace, Renter is responsible for properly opening the flu and not allowing smoke and soot to come into the house, and will keep the protective screen always closed especially when in use. Renter will not leave a fire burning unattended, and clean up and safely dispose of any ashes.

CHILD SAFETY. The Renter acknowledges that the rental property is not childproofed and understands that they are solely responsible for ensuring child safety during their stay. This includes supervising any children present on the premises and taking appropriate precautions. The Renter further acknowledges that any use of child-related items or equipment within the rental property is at their own risk, and they agree to exercise caution accordingly. The Renter agrees to indemnify, defend, and hold harmless the Owner, Host, Property Manager and affiliates, including its agents, representatives, and affiliates, from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees and court costs) arising out of or related to any injuries, accidents, or incidents involving children during the Renter’s occupancy.

SECURITY CAMERAS/TECHNOLOGY. There are no interior cameras of any kind. Exterior cameras, video doorbells, keypads, smart home technology and noise/smoke monitors are installed for the safety and protection of the Premises and its Renters and may not be tampered with or disabled. Renter will be immediately evicted with no return of funds paid upon violation of this policy.

PLUMBING. The Renter is responsible to inform all individuals in their party to use only septic safe toilet paper, and no other items will be flushed in the toilet even if it says "flushable". Any damage caused by Renter to the septic or plumbing system - and result damage thereafter - will be the full responsibility of the Renter. These terms are subject to change at the Host’s discretion.

PINATAS / CONFETTI / GLITTER / FIREWORKS. No confetti, glitter or pinatas are allowed anywhere on the premises or grounds. No tape or anything else that will mark the walls may be used to hang decorations or for any other reason. No fireworks of any kind, even safe and sane, may be brought or used in or on the premises.

INDEMNITY CLAUSE. The Renter and any of their guests agree to hereby indemnify and hold harmless the Owner, Host, Property Manager and affiliates against any and all claims, demands, liabilities, damage, cost or expense whatsoever (including attorney’s fees), including those of third parties, of personal injury or property damage or loss arising from the use of the Premises, regardless of the nature of the accident, injury or loss. This includes but is not limited to any claim or liability for personal injury, property damage, wrongful death, accidents, allergic reactions, illnesses or any other casualties or health problems, which may arise during Rental Term or as a result of said occupancy, as well as loss of personal belongings or theft of property which is made, incurred or sustained by Renter and/or anyone Renter allows on Premises. Renter assumes all risk of injury or other losses, including but not limited to the use of the private swimming pool, hot tub, natural water features, sauna and any other part of the Premises, and will hold Owner, Host, Property Manager and affiliates harmless with respect thereto.

ATTORNEY’S FEES. The Renter agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.

ILLEGAL ACTIVITY & WEAPONS. The Renter shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall cause immediate termination of this Agreement with no refund. Additionally, firearms, ammunition and other weapons are not permited anywhere on the Premises, even if legally owned.

FALSIFIED RESERVATIONS. If reservation was made under any false pretense (including, but not limited to, a falsified name, age, party size), booked for a third party, or includes undisclosed animals, you will be subject to immediate eviction and forfeiture of all amounts paid.

POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Renter. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.

GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.

DAMAGE INSURANCE. The duration of the Rental Period is covered by Waivo damage protection up to a $1,500 limit. Coverage details are spelled out at waivo .io /client/stay-booked-llc, which you agree to adhere to by signing this contract. The Renter expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Renter and that Renter should purchase their own insurance for their Renters if such coverage is desired. Damage not covered by, or exceeding the coverage limit of, the accidental rental damage insurance, Security Deposit, or booking platform coverage, is your full responsibility. In the case that an insurance claim must be filed with homeowner's insurance, the guest is liable to pay the deductible.

CANCELLATION POLICY. Renter can cancel in accordance with the cancellation policy of Airbnb, VRBO, or Hospitable (for direct bookings) where they completed their reservation.

LEGAL ACTION. By signing this agreement, the Renter waives the right to pursue legal action in court and agrees to resolve disputes through arbitration or mediation. The Renter must first seek any award from the online booking platform, with any additional awards limited to the coverage specified in the Host's insurance policies.
Renter, by booking this property via Airbnb, VRBO, or direct booking, acknowledges that they will comply with the terms of this agreement, and each assumes the responsibility for the obligations set forth herein.
Renter acknowledges that they have reviewed, understood and will comply with the House Rules and Checkout Procedures as outlined in the listing advertisement for the Premises.
Renter acknowledges that they have read, accepted, and agree to the terms set forth.
