ADDITIONAL RULES
BY AGREEING TO BOOK, YOU ARE ALSO LEGALLY AGREEING TO THE TERMS AND CONDITIONS BELOW. PLEASE READ CAREFULLY BEFORE BOOKING!
•Responsible party booking this reservation must be at least 25 years old and present for the stay booked.
•This space is set up for 8 adults and 2 children 12 and under per our Palm Springs short term rental permit. Please adjust your guest count accordingly prior to booking.
• This home is not child proofed. Cabinets are not secured, there is a pool and hot tub without child locks, we do have breakable items in the home. We welcome adults who bring well behaved children but we expect them to fully supervise their child at all times and do not advertise or guarantee that the home is in any way child safe /child proofed.
• NO CHECK-IN ON HOLIDAYS. If your reservation start date falls on any holiday listed you will need to rebook your check-in date. Thanksgiving Day, Christmas Day, New Years Day, Easter Day, Memorial Day, 4th of July, & Labor Day.
• 11.5% tax has been charged as a “TOT” per the City of Palm Springs requirements. An additional 1% "Tourism Tax" has also been added for all reservations July 1, 2021, and beyond.
•Bookings over 28 nights are not subject to city tax.
***Heating the pool for your visit is optional, and is an additional $95 per night of your visit. Please let us know at least 48 hours in advance if you would like to choose this option!
•Additional cleaning fees will be added for stays over 10 days. A cleaning rate of $475 per cleaning will be added per week of your stay and requested through the resolutions center. Cleanings will be arranged weekly/biweekly to accommodate guests schedules.
•An outside online contract is required by the city of Palm Springs will need to be read and signed prior to your visit. A link will be sent after your reservation is confirmed. The responsible guest on the reservation will also need to provide a photo of their government issued ID as required for short term rentals in the city of Palm Springs and must be present for the stay.
•All guests will need to read and sign the Good Neighbor Form and be present for a face to face greeting right after check in is required.
•There are noise ordinances here in PS, so please NO OUTDOOR MUSIC of any kind or outdoor noise after 10PM. If someone reports you to the City of Palm Springs Vacation Rental Compliance, or the police, you will be responsible for ALL fines and asked to leave immediately without refund.
-Surveillance or recording devices on property - Ring at front door and drive way to monitor entrance and noise monitoring device inside and on back patio; It does NOT record actual sounds or conversations, it simply monitors the noise level (measured in decibels). We are committed to Rent Responsibly standards. This means we follow best-in-class guidelines to ensure you have a peaceful, safe and memorable stay with us. We use smart home technology to improve your experience. NoiseAware is a smart home device that measures decibel levels throughout the property and allows us to respond to noise nuisances without disrupting your stay. NoiseAware is 100% privacy compliant and is required on this property. If you have any questions, please ask. We are committed to your comfort so please let us know if we can do anything during your stay to make it more enjoyable. Failure of Tenant to adhere to City regulations will be considered a breach of this rental agreement. Tenant hereby authorizes the Manager to make charges to the Tenant's credit card in file for up to $1,500 per incident, should any complaint about the noise level inside/outside the house arise with the local police or the local city authorities. Furthermore, Tenant recognizes the right of the manager to ask Tenant and Tenant's guests to vacate the unit immediately if it becomes necessary without a refund of the rental amount.
HOUSE RULES-
•Check-in is after 3PM
•No parties are allowed- although, having a few guests (up to 4 day guests between 8am-10pm) over for dinner and drinks is encouraged. We want you to enjoy your time without a bunch of rules but please be respectful of the space and of our neighbors.
•There are noise ordinances here in PS, so please NO OUTDOOR MUSIC of any kind or outdoor noise after 10PM. If someone reports you to the City of Palm Springs Vacation Rental Compliance, or the police, you will be responsible for ALL fines and asked to leave immediately without refund.
•This is a NON-smoking home -- NO smoking inside but you may smoke on the patio provided ashtrays are used and sliding doors and windows are closed. If discovered that guests have been smoking indoors, the booking party will be responsible for a minimum $500 cleaning fee.
TOILET DO NOT THROW ANYTHING BUT TOILET PAPER INTO THE TOILETS. All other garbage (i.e. Tampons, baby wipes, paper towels, etc) is to go into the waste basket.
•Please DO NOT bring glasses in or around the pool or spa. There are plastic glasses provided for pool and spa use.
-please bring all trash and recycling to the large bins located on the north side of the house when removing from the home. We have a walk up service that comes on Mondays to empty and set back behind the gate.
•Please DO NOT leave any flammables such as candles, incense unattended.
•Please keep the house reasonably clean and organized.
•Missing and/or stained TOWELS will be charged to the guest at a rate of $25 per item.
ANY BROKEN OR MISSING ITEMS will be charged to the guest accordingly.
•Please keep front door locked and ALWAYS turn A/C to 85 and leave on auto and cool, and lights off when you finish your stay.
•We do allow well behaved pets with an additional fee and approval PRIOR to your visit.
We DO allow service dogs. All pets must be well behaved, cleaned up after. We ask that they stay off furniture if they shed.
FILMING: The filming of any still or motion pictures in any format that requires more than 2 persons and/or any specialized gear, apparatus or crew is strictly prohibited unless prior written authorization is obtained. Failure to obtain written authorization may result in full deposit forfeiture.
TENANT AS SUBJECT OF THE LAW: Tenant acknowledges that during the length of the rental period, Tenant and his/her guests is/are subject to all State and Federal laws, County Ordinances and City regulations valid within the jurisdiction where the home is located. Owner(s) and/or Manager(s) are neither responsible to inform Tenant of what these laws, ordinances and city regulations are, nor could Owner(s) and/or Manager be held liable should Tenant(s) and/or Tenant's guests commit a crime, misdemeanor, felony or infraction (including parking infractions).
You must also acknowledge Security Deposit - if you damage the home, you may be charged up to $2500
TENANT'S LIABILITY: Tenant agrees to accept liability for any damages caused to the property (other than normal wear and tear) by Tenant or Tenants guests, including, but not limited to, landscaping, misuse of appliances, and/or equipment furnished. If damages are in excess of the security deposit being held, Tenant agrees to reimburse owners for costs incurred to repair/replace damaged items.
HOLD HARMLESS: Owner(s) / Manager(s) do not assume any liability for loss, damage or injury to persons or their personal property. Neither do we accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, phone, internet, cable or satellite TV, or electricity services or plumbing. Nor will Owners accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond its control. The foregoing notwithstanding, Owner(s)/Manager(s) will use good faith efforts to remedy any deficient condition following notice.
POOL, SPA and WALKWAYS: The undersigned is fully aware that these can be dangerous, that the walkways and area around the pool and spa can be slippery when wet, and that injury is likely to occur to anyone who is not careful. Tenants should observe and adhere to all rules and policies as posted at the property. With full knowledge of the above facts and warnings, the undersigned accepts and assumes all risks involved in or related to the use of the walkways.
ADDITIONAL TERMS AND CONDITIONS: The undersigned, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Owner free and harmless of any claim or suit arising there from, provided however, that Owner(s)/Manager(s) shall remain liable for such damages to the extent that such damages are determined to be the direct result of Owner(s)/Manager(s) negligence. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.
PERSONAL PROPERTY LEFT BEHIND: If found, any items left behind will be mailed back upon request via USPS. The cost of shipping, shipping container and any packing materials will be deducted from the security deposit along with a handling fee of $25.
SECURITY DEPOSIT: The security deposit is in addition to the rental amount. The amount returned is also conditional upon all terms of this agreement being met (examples include but are not limited to: violations of our non smoking policy, violations of our no party policy). Tenant is liable for all replacements and repairs that are outside what is considered normal wear and tear and will be taken from their deposit.
CLEANING: The property will be inspected and cleaned after your departure. The cleaning fee you have paid will cover this. You are required to leave the property in the same general condition that you received it by making sure, dishes are done and put away, and the home is generally picked up and ready to be vacuumed, dusted and sanitized. If additional cleaning is required, appropriate charges will be deducted from the security deposit and charged through the Resolutions Center at the rate of $50 per hour.
CHECK IN: Unless agreed differently by the Co-host in writing, check-in is any time after 3:00 PM. Co-host will send Tenant the instructions for a self check-in in advance, or keys or and entry-code will be provided at property location upon check-in. Keys will not be issued with a balance owing or without a signed rental agreement in the owners, or owner's representatives, possession. Once Tenant has checked into the unit or he/she has been granted access, Tenant accepts the condition, size and configuration of the Rental Premises in as/is where/is condition and accepts full financial responsibility per this agreement. If for any reason Tenant considers the Unit as not acceptable, Tenant must notify the Manager immediately, so Manager can attempt to remedy the situation to Tenant's satisfaction.
CHECK OUT: By 11:00 am. A later check-out may be exceptionally granted at an extra cost but only if these two conditions are met: 1. there is no new arrival checking into the property on the day of tenant's departure and 2. the request for a late check-out is made within twenty-four hours prior to the check-out date stated on the agreement. Charges for a late check-out not timely requested will be made against your security deposit for a minimum of the total cleaning fee charge stated on your agreement and a maximum of the nightly rental fee. Please leave all keys, garage openers and such at the location. A $50 per item fee will be charged for each lost key and remote control. •
