THE RULES 1- Agreement RULE: You must sign and return the Agreement within 24 hours of placing your reservation. It will be emailed to you. This is allowed by Airbnb for hosts with a professionally connected software system. Legal photo ID is required upon our request. Your failure to sign and return the Agreement within 24 hours of booking constitutes a cancelation of the booking by the guest.

2- Animal RULE: One friendly housebroken crate trained dog is welcomed with a non-refundable payment of $200. No puppies. No cats. Dog must be crated if left in home without humans. A Service Dog must meet ADA rules to waive the dog fee. A Support Animal or Emotional Support Animal is not a Service dog. A violation of this rule will incur a fee of $500.00. Amount due will be invoiced to you and is due and payable within 5 days.

3- Guest RULE: Only booked guests may be on the property. A violation will cause a demand to depart without refund or recourse, plus a fee of $200.00 per night for each violation person per night. Any amount due will be invoiced to you and is due and payable within 5 days.

3a - Visitor RULE: No visitors are allowed unless we pre-approve them in writing in advance. A violation of this rule will incur a fee of $100.00 for each unapproved visitor each time. Any amount due will be invoiced to you and is due and payable within 5 days.

4- Behavior RULE: Don’t come here to party, puke, and pass out. Unruly or inappropriate behavior is a rule violation. A violation may cause a demand to depart without refund or recourse. Quiet Hours: 11pm to 7am. You will be charged $500.00 for a violation of this rule. Any amount due will be invoiced to you and is due and payable within 5 days.

5- Damage RULE: You are covered by our Damage Protection Policy. You are still responsible for damage, breakage and loss beyond normal wear and tear that is not reimbursed by the Policy. Intentional or negligent damage is not covered. Animal damage is not covered. Any amount due will be invoiced to you and is due and payable within 5 days.

6- Departure Condition RULE: You agree to leave the premises in the same general and good habitable condition as upon arrival. Exceptional, unusual, or excessive cleaning or scrubbing is charged to you at $60 per hour. Any amount due will be invoiced to you and is due and payable within 5 days.

7- Repairs RULE: You agree to allow us, or an agent, to enter for emergency repairs or inspection in a reasonable manner and if necessary, without notice. This rule overrides any Airbnb rule that prohibits our access for emergency situations.

8- Smoking RULE: NO SMOKING inside or outside. Smokers must be 100 ft from the property land boundaries. If there is evidence of smoking you will be charged $300 to deep clean. Any amount due will be invoiced to you and is due and payable within 5 days.

9- Service and maintenance RULE: The property may have pest control, mosquito control, lawn and plant care services while you are here, all without notice and as needed.

10- SECURITY CAMERA NOTIFICATION and RULE: The exterior parameters of the house, the front area, the parking gravel, the driveway, and fenced path are monitored and recorded by security cameras. There are no indoor cameras. Covering or turning off a camera is a rule violation. This violation may cause a demand to depart without refund or recourse.

11- Behavior RULE: A neighborhood disruption, unacceptable noise, unruly behavior, or actions disregarding reasonable quiet hours is a rule violation. Quiet Hours: 11pm to 7am. A violation may cause a demand to depart without refund or recourse.

12- Sublet RULE: You may not sublet this property or transfer this agreement. THE PERSON ON THE BOOKING MUST BE PRESENT each night at the house; we do not accept any 3rd party bookings. A violation may cause a demand to depart without refund or recourse.

13- Maintenance, housekeeping, and mechanical failure RULE: You must notify us immediately of any maintenance, mechanical, or housekeeping issues. Problems will be attended to as swiftly as reasonably possible. No refunds or compensation will be given unless the failure causes the property to be unusable or uninhabitable. We reserve the right to remedy the situation.

14- Removal RULE: You agree to comply with the departure time. If the property is not vacated by checkout time, you consent to removal of all occupants and all belongings from the property and disposing of all belongings at your expense and risk of loss. A fee of $100 per hour may be charged for failure to depart on time. Any amount due will be invoiced to you and is due and payable within 5 days.

15- Owner NOTICE: Owner lives in the main house. Your space is separate and fully independent from the owner’s space.

16- Water RULE: No car or boat washing is allowed. Notify us of any leaks immediately.

17- Liability and Claims RULE. It is understood and agreed that we shall not be held liable for any injuries, accidents, or other harm. You agree to hold harmless and indemnify owners, shareholders, trust holders, and Vacation Rental Charleston, LLC from any loss or damage, including attorney fees, incurred as a result of any and all claims, demands, causes of action, suits, fines, judgments, or penalties arising out of your use or occupancy of the property, the dock, the interior or the exterior, the grounds, and any equipment or toys provided.

18- Cancellation RULES: Guest Initiated Cancellation=Airbnb policy, rules, and terms are followed. Consult with Airbnb regarding your cancel terms. Property Initiated Cancellation=This property reserves the right to cancel this reservation for unforeseen circumstance, act of God or a situation that makes the property unusable. You will then receive a full refund of the money you paid to us. There will be no other money given for damages, consequential losses, or expenses.

20- Refunds RULE: If the property is unusable or inaccessible, or if there is a mandatory government evacuation order affecting the location of the property, a Full refund will be issued. Otherwise, there are no refunds for your unforeseen, unexpected or unfortunate events, including but not limited to cancelled or delayed flights, death, illness, or injury, nor for catastrophic events such as pandemics, covid, evacuations, earthquakes, hurricanes, fires, flood, travel restrictions and bans, border closures, civil unrest, protests, war or terrorism. Travel Coverage and Protection is highly recommended. Consider purchasing a “Cancel for any Reason” policy.

21- Resolutions RULE: You are liable for all court costs, credit card fees, collection fees, arbitration costs, and attorney fees, if it is necessary to enforce payment or collection through the courts. A 12% compounded interest fee is automatically applied to all money due. Fraudulent or False challenges and all credit card chargebacks initiated that are in violation of this agreement will be subjected to a penalty of treble damages.

22- Tenancy RULE: You are not a tenant. You have acquired no leasehold in this property. You agree that you are a licensee only pursuant to SC State Code 45-2-20 et.seq. Any use of the term “rent” is for convenience only. You are subject to innkeeper laws of the State of South Carolina.

23- Governing Law-Severability RULE. This agreement shall be interpreted and enforced according to the laws of the State of South Carolina. All legal actions shall take place in the County of Charleston, State of South Carolina. The invalidity or unenforceability of any one or more provisions of this Agreement shall in no way affect any other provisions. You are liable for all costs, court costs, and reasonable attorney fees incurred in the enforcement our rights under this agreement.
