We want you to enjoy your stay and be happy with your choice. Please review the following rules to ensure that the property is a good fit:

The primary renter must be present. Registered guests only are allowed on the premise. Up to two small (30 lbs and less) dogs are welcome with a $200 nonrefundable fee for the first dog and $100 for the second. Pets must kept in crate if left alone in the house. Please keep pets off of furniture. No smoking / no parties or events Firearms Are Not Allowed Quiet hours: 10:00 pm-7:00 am. A signed rental agreement (see below) is a requirement of renting the house (see below) Please reach out if you have any questions concerning these rules. We are happy to help!

1. Rental Party/Maximum Occupancy: The rental party shall be limited to the number listed on the rental reservation. The maximum number of guests is limited to 8 persons. At all times during said rental period, Guest agrees to have no more than the allowed number of guests for occupancy (including children). If more than the stated number of guests are found to be occupying the unit, without prior written permission, Owner has the right to terminate this Agreement and Guest will forfeit all monies paid, including rent, cleaning, and deposits. 2. Term of the Lease: The rental period begins at 4 p.m. on the dates in the reservation and will end at 10 a.m., on the check-out date. Check in time is 4 p.m. and check out time is 10 a.m. 3. Rental Rules: Guest agrees to abide by the Rental Rules attached to his Agreement as Addendum A, and to abide by the House Rules in Airbnb listing, at all times while at the Property and shall cause all members of the rental party and anyone else Guest permits on the Property to abide by such rules at all times while at the Property. Should Guest violate these rules, Owner reserves the right to cancel this rental immediately with no refund due to Guest. 4. Noise: Guest understands and agrees that Guest, and all members of Guest’s rental party will be respectful to our neighbors, including, driving slowly on the road to the Property, not creating any noise (including music) which the neighbors can hear, especially in the evening and during the night. Any violation of this Agreement and Guest will be required to leave immediately, with no refund for any unused rental time 5. Access: Guest shall allow Owner access to the Property for purposes of repair and inspection, upon the occurrence of an emergency or for any other reasonable purpose. 6. Rental Rate and Fees: The rental rate shall be as stated on the Airbnb listing. (a) Balance: If not already paid in full, any balance of the rental and all taxes, insurance fees, security deposit and cleaning fees must be paid in prior to the Check-In Date as outlined in Airbnb payment schedule. See the booking confirmation for the financial details. (b) Condition of Property: Guest shall return the Property in the same condition as received. Guest will pay a cleaning fee which includes normal “turn” cleaning. Guest agrees Guest will be responsible for excessive additional cleaning if needed, and hereby agrees to have excessive cleaning deducted from their security deposit, at Owner’s sole discretion. Guest also agrees to leave the Property in the same condition with all furniture, fixtures and other items of personal property in the same place as where they found them upon move in. 8. Cancellation Policy: Guests are advised that the cancellation policy is per Airbnb guidelines as stated at the time of booking. 9. Travel and Vacation Rental Insurance: Life is unpredictable; therefore, we encourage all guests to purchase travel insurance. If purchased by you, this insurance may reimburse you for prepaid non-refundable expenses due to certain unforeseeable circumstances that may jeopardize your vacation investment and force you to incur unplanned expenses. This can include but is not limited to sudden illness, death in the family, or Property unavailability due to force majeure. It is strongly recommended that Guest purchase this valuable protection; however Guest has the option to decline to purchase travel insurance. You can purchase travel insurance from many providers. Owner is not responsible for the relocation of Guest should the Property become non-habitable due to acts of God, such as wildfire, floods, hurricanes, earthquakes and natural disasters, and Owner is not liable for the costs of finding an alternative accommodation or for damages because alternative accommodation cannot be found. We recommend the purchase of trip insurance that would protect Guest from monetary loss from such an event. 10. No Assignment or Subletting: This Agreement shall not be assigned, nor the Property sublet without the prior written consent of the Owner. Guest acknowledges that Guest will personally occupy the Property for the entire lease or rental period and will not sublet any portion of the Property. Violation of these terms shall give Owner the right to immediately evict Guest and terminate this Agreement, and Guest will forfeit any right of return of any monies paid to date including any security deposit. 11. Indemnification: Guest shall indemnify Owner and Owner’s agents, and their respective members, managers, shareholders, directors, officers, employees and contractors (collectively, the “Indemnified Parties”) and hold harmless the Indemnified Parties from and against any and all claims, actions, damages, liabilities and expenses, including reasonable attorney’s fees, incurred by any Indemnified Party and arising out or of resulting from the loss of life, personal injury and/or damage to the Property or other property in connection with any occurrence in, upon, or about the Property, whether occasioned by an act or omission by an Indemnified Party, Guest or other occupants of the Property. Owner and the other indemnified parties shall have no liability for damages or injury to Guest or any of Guest’s invitees or licensees in any way arising from or related to the occupancy or use of the Property. It is expressly understood and agreed that Owner and the other Indemnified Parties will not be liable for any damages or injury to Guest or other occupants of the Property and their personal property from whatever cause, both inside and outside of the house on the Property, whether on the Property or elsewhere. THE SUPERVISION AND SAFETY OF ALL CHILDREN ARE THE DIRECT RESPONSIBILITY OF GUEST OR PARENTS, OR CARETAKERS OF ANY CHILDREN ON THE PREMISES, including but not limited to decks, ocean and any and all other activities on the Property. Guest specifically accepts ALL liability for use of bunk beds, decks, bicycles, any water accessories including but not limited to kayaks, paddle boards, boogie boards and paddle boat and body of waters including but not limited to Little lagoon and the Gulf of Mexico on or near the Property and understands that Owner and Owner’s agents shall have no liability from any accidents, injuries, or death that may result from the proper or improper use of said items. Guest accepts said liability by voluntary use of said bunk beds, decks, bicycles, any water accessories including but not limited to kayaks, paddle boards, boogie boards and paddle boat and body of waters including but not limited to Little lagoon and the Gulf of Mexico on or near the Property. Guest understands that Owner and Owner’s agents shall have no liability from any accidents, injuries, or death that may result from the proper or improper use of any ladder, deck, dock, or from any accident, injury or death that results from use or attempted use of any part of the property. 12. Entire Agreement: This document and any attached addenda constitute the entire agreement between the parties regarding the subject matter hereof. No oral statements shall be binding. This Agreement may only be amended by a written document duly executed by all parties. If any term or other provision of this Agreement is invalid, illegal or incapable of being enforced by reason of any rule of law or public policy, all other conditions and provisions of this Agreement shall nevertheless remain in full force and effect. Upon such determination that any term or other provision of this Agreement is invalid, illegal or incapable of being enforced, such term or provision shall be deemed automatically amended to the extent necessary to make it no longer invalid, illegal or unenforceable. 13. Disputes and Jurisdictions: This agreement shall be interpreted under the laws of the State of Alabama. Any dispute under this Agreement shall be resolved in the County of Baldwin, State of Alabama. If either party brings an Action to enforce its rights under this agreement, the prevailing party may recover its expenses (including reasonable attorneys' fees) incurred in connection with the action and any appeal from the losing party. 14. GUEST ACKNOWLEDGES THAT GUEST HAS REVIEWED AND UNDERSTANDS THE TERMS OF THIS AGREEMENT and the Rules and Regulations attached and agree to be bound by them. 15. Guest and Owner acknowledge that electronic acceptance of this Agreement is legally binding acceptance of all terms and conditions, the same as if Guest had actually executed the Agreement in person. ACKNOWLEDGEMENT of AGREEMENT On this day, the parties agree to the terms of this Short-Term Rental Agreement, as evidenced by their electronic acceptance of this Agreement.

ADDENDUM A: RENTAL RULES 1. By making a reservation at Heron's Hideaway, Guest agrees that Guest and Guest’s party will abide by these Rules and Regulations, as well as any other rules and regulations posted in the Guidebook, AirBNB house rules or on the Property. 2. Guest is renting a house with decks, and private pool which by its inherent nature, poses risk of injury, accident or death. Guest warrants that: All children will be attended when in the house and on the grounds, but specifically on the decks or near the water. 3. No one will jump off of the deck. 4. No one will dive into the pool. 5. The Guest understands and agrees that the Owner and/or Owner’s agents of Heron's Hideaway are not responsible for any accidents, injuries or illness that occurs while on the Property or its facilities. Guest specifically indemnifies and holds the Owner and Owner’s agents harmless from any such liability. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the Property or others whom they invite to use the Property. If all guests on this reservation do not personally sign this waiver of liability, then the primary renter accepts liability for all guests and hereby waives any Owner or Owner Agent liability on their behalf. 6. Owner and/or Owner’s agents are not responsible for the loss of personal belongings or valuables of the Guest. 7. Access to the Property will be available at 4 p.m. on the starting day of your rental days. Guest will be given a code for the key pad on the door, for private access to the house. The code will be provided to you via email or via your booking platform. 8. People other than those in the Guest party set forth in this Agreement may not stay overnight in the Property. The Property shall not be used for gatherings of any kind for anyone other than registered guests (i.e. dinner parties, weddings, etc.). 9. Guest promises to keep the Property and all furnishings in good order and to leave the Property in the same (or better) condition than when it was rented. Guest promises to only use appliances and amenities of the vacation rental for their intended uses. 10. Children: Heron's Hideaway is family friendly and welcomes everyone. Parents hereby agree to supervise their children both indoors and outdoors, especially in and around the water, in the bunk bed and deck areas. 11. Housekeeping: Linens and bath towels are included in the rental rate. A washer/dryer are provided for Guest’s use. 12. Pool and water equipment: Guest acknowledges that the property includes a private swimming pool for their enjoyment. By choosing to use the pool, Guest assumes full responsibility and liability for its use.Guest understands that use of the pool carries inherent risks, including but not limited to the risk of injury or drowning. Guest is also aware that consuming alcoholic beverages around the pool can be dangerous and assumes all responsibility for their actions. By using the pool, Guest agrees to do so at their own risk and hereby indemnifies and holds Owner harmless from any and all claims, liabilities, damages, or injuries arising from such use. 13. Pets: Up to two (2) small (<30 lbs) dogs are permitted if registered before arrival and with nonrefundable ($200 for first pet, $100 for second). Pets must be kept off of furniture and crated if left alone in the house. Guest is responsible for any damage caused by pet. 14. Smoking: Smoking is NOT allowed on the Property, either inside OR outside. 15. Alcoholic Beverages & Drugs: Guest agrees that there will be no illegal activities on the Property, including but not limited to: possession, serving or consumption of alcoholic beverages by anyone under the age of 21; or the possession or use of any illegal drugs. Additionally, Guest accepts full responsibility and liability and hereby indemnifies Owner and/or Owner’s agents for anything that happens in reference to Guest and/or Guest’s party partaking of any alcoholic beverages or drugs on the Property. 16. Fireworks: They are NOT allowed on the property. 17. Grill: A propane grill is provided on the property for guests’ use. Guest agrees to pull the Grill away from the house when using. 18. By making a reservation at the Property, Guest agrees that Guest and all members of Guest’s party will abide by these Rules and Regulations, as well as any other Rules and Regulations posted on AirBNB or on the Property.
