By making a reservation at the Property, The Responsible Party (also referred to as “Guest”) agrees that Guest and Guest’s party will abide by these Rules, Regulations, and Policies as well as any others communicated by Property Manager:
(A) Smoking is not permitted on the Property, including interior spaces, balconies or near doors;
(B) Pets are not permitted on the Property without prior written written permission from Property Manager;
(C) Quiet hours are from 10:00 PM to 8:00 AM;
(D) Garbage must be consolidated into trash bags and placed in the proper receptacles or dumpster;
(E) Objects other than toilet paper shall not be flushed down the toilets. This includes, but is not limited to, hygiene products, paper towels, or tissue paper;
(F) The Property shall not be used for gatherings of any kind for anyone other than registered Guests (i.e., dinner parties, weddings, etc.) without prior written permission of the Property Manager;
(G) Guest shall ensure to never exceed the maximum occupancy of the Property;
(H) Cleaning services resulting from the acts or omissions of any member of the Rental Party during the Guest’s stay may result in an increased cleaning fee (up to the actual cost of cleaning services);
(I) Commercial photography or filming or other commercial use is not permitted on the property;
(J) Minimum age to rent the property is 25. A parent or legal guardian over the age of 25 must accompany all guests under the minimum age requirement for the duration of the rental;
(K) Guest is liable for any damage to the property and agrees to accept charges deducted from damage deposit (if collected) or paid by accidental damage insurance (if purchased) or run from credit card held on file (if card number is held) or billed to Responsible Party after the stay;
(L) Guest shall make all efforts to prevent theft of or damage to furnishings or Guest’s or others’ personal property, and Guest shall close and lock doors and windows when Guest is not present at the Property and upon check-out. Property manager and/or Owner and/or Agents of either are not responsible for the loss of personal belongings or valuables of the guest;
(M) Guest and Rental Party agree to conduct themselves throughout their stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to the Property Manager or Owner from police, neighbors, or neighborhood or homeowner associations or others;
(N) NO PERMANENT RESIDENCE: Guest agrees that Rental Party’s use of the Property is on a temporary and transient basis only; that Responsible Party and/ or Rental Party may not use the Property as a permanent residence; and that the Responsible Party and/ or Rental Party’s respective permanent residences are and will remain elsewhere than at the Property. The Rental Party’s presence on the Property outside of the dates and times listed above may be considered trespassing and prosecuted as such without notice;
(O) Use of the Property for any criminal, illegal, or tortious activity is prohibited and may result in fines, prosecution, and/or your immediate removal from the Property. This prohibition extends to use of the Property's internet service for criminal or illegal activity, including but not limited to unlawful downloads of copyrighted material, including movies, music, software, or other material. Owner or Manager may cooperate with any investigation of alleged criminal or illegal activity that occurred at the Property during Guest’s stay. Owner or Manager may give Guest’s identity and information to appropriate authorities if illegal activity is suspected;
(P) Late Check-out. If any member of the Rental Party does not vacate the Property by check-out time (or late check-out as agreed to by Manager), Guest authorizes Manager to charge a late departure fee of up to one night's rental and Manager may remove all Occupants and their personal property from the Property;
(Q) BUNK BEDS: The Property may include “bunk beds” or “bunk-like beds”. Use of these beds is at the Rental Party’s own risk and by using them, the Responsible Party confirms they are in good working order and assumes all risk. The Responsible Party hereby explicitly agrees to hold harmless the Property Owner, Property Manager, and their Agents or Assigns for any injury (or death) related to use of bunk beds;
(R) FIREWORKS: Fireworks and sparklers are not permitted at the Property at any time;
(S) ALCOHOLIC BEVERAGES & DRUGS: Guest agrees that there will be no illegal activities on the premises, including but not limited to, possession, serving, consumption of alcoholic beverages by anyone under the age of Twenty-One (21), or the possession or use of any illegal drugs. Additionally, Guest accepts full responsibility and liability and hereby indemnifies Owner and/or Owner’s Agents for anything that happens in reference to Guest and/or Guest’s party partaking of any alcoholic beverages or drugs on the Property;
(T) HOT TUB, POOL, AND WATER FEATURES: Use of any hot tub, pool, or other water feature (such as a lake, river, ocean, etc.) at, or in the vicinity of the Property, is at Rental Party’s own risk. If applicable, Guest shall replace the hot tub cover after every use in order to prevent damages to the Property and/ or injuries to Guest. Further, if applicable, Guest agrees to lock door or gate to the pool space when pool is not in use;
(U) BALCONIES: Rental Party will not hang or attach anything from the balcony railing (front or back). Do not feed birds from the balconies. This poses a health risk to the other guests. Guest acknowledges that the Property may consist of multiple balconies. Guest should use care when utilizing the balconies, rooftops, and stairs. Owner and Owner’s Agent shall have no liability for damages or injury to guest or guests resulting from use of the balconies, rooftops, and stairs. BY ORDINANCE OF THE FIRE DEPARTMENT, OPERATING GAS OR CHARCOAL GRILLS ON THE BALCONIES IS NOT ALLOWED;
(V) HAZARDOUS MATERIALS AND FIREARMS: The guest shall not have any dangerous or flammable items on the Property or anything that might be explosive in nature that might unreasonably increase the danger of fire or explosion on the premises or that might be considered as a hazardous material by an insurance company (including propane). Firearms are not permitted on the premises;
(W) MAINTENANCE. Property Manager prides itself on providing pristine, high-quality properties. However, things happen. As such, Property Manager is not responsible for the interoperability or unavailability of any amenities. Guest also agrees to give Property Manager a reasonable amount of time to respond to maintenance issues and to cooperate with Property Manager's efforts to address the concern or provide a remedy.
(X) IDENTIFICATION. Government issued identification will be required for check-in (in accordance with local laws) and must match the Guest/Responsible party information on the reservation;
(Y) FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in;
(Z) INDEMNIFICATION: The Guest understands and agrees that the Owner, Property Manager, and their Agents are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. Guest specifically indemnifies and holds the Owner, Property Manager, and their Agent harmless from any liability. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. If all guests on this reservation do not personally sign this waiver of liability, then the Responsible Party accepts liability for all guests and hereby waives any Owner, Property Manager, or Owner/Property Manager Agent liability on their behalf;
(AA) CHILDREN: The Property is family friendly and welcomes all families. Parents hereby agree to supervise their children both indoors and outdoors;
(BB) IT IS EXPRESSLY UNDERSTOOD AND AGREED THAT OWNER AND PROPERTY MANAGER WILL NOT BE LIABLE FOR ANY DAMAGES OR INJURY TO GUEST OR OTHER OCCUPANTS AND THEIR PROPERTY FROM WHATEVER CAUSE ARISING FROM THE OCCUPANCY OF SAID PREMISES, BOTH INSIDE AND OUTSIDE OF THE HOUSE, WHETHER ON THE PROPERTY OR ELSEWHERE.
