The primary renter must be present throughout the stay. Only registered guests are allowed on the premises, and the property is limited to a maximum of twelve (12) guests, including children. Up to two small dogs (30 lbs or less) are allowed with prior approval. A nonrefundable pet fee of $200 applies to the first pet and $100 for the second. Dogs must be crated if left alone in the home and must be kept off of the furniture. Smoking, parties, and events are strictly prohibited. Firearms are not permitted on the property. Quiet hours are observed from 10:00 p.m. to 7:00 a.m. daily. A signed rental agreement is required in order to finalize your reservation. 1. Rental Party / Maximum Occupancy The rental party is limited to those listed in your reservation. Owl’s Nest has a strict maximum occupancy of twelve (12) people, including children. At no time may more than twelve guests occupy the property unless prior written permission has been granted. If this policy is violated, the Owner reserves the right to terminate the rental agreement immediately and all payments, including rent, cleaning fees, and deposits, will be forfeited.
2. Term of Lease The rental period begins at 4:00 p.m. on the check-in date and ends at 10:00 a.m. on the check-out date, as stated in your reservation.
3. Rental Rules The Guest agrees to abide by the rental rules outlined in this agreement and in the Airbnb listing at all times during the rental period. These rules apply to all members of the rental party and any visitors permitted on the property. Violating the rules may result in immediate cancellation of the stay without a refund.
4. Noise Guests agree to maintain respectful noise levels, especially during quiet hours between 10:00 p.m. and 7:00 a.m. This includes driving slowly on the road to the property and avoiding loud music or disruptive behavior. Any significant noise complaints or disturbances may result in eviction without a refund.
5. Access The Guest agrees to allow the Owner or their representatives reasonable access to the property for maintenance, repairs, inspections, or in case of emergency.
6. Rental Rate and Fees All rates, taxes, and fees are as stated on the Airbnb listing. If not paid in full at the time of booking, any outstanding balances, including taxes, insurance, security deposits, and cleaning fees, must be paid according to Airbnb’s schedule. Guests are expected to return the property in the same condition as received. A standard cleaning fee covers general turnover cleaning, but excessive messes or damage may incur additional charges at the Owner’s discretion.
7. Cancellation Policy The cancellation policy is governed by the terms outlined on the Airbnb platform at the time of booking.
8. Travel and Vacation Rental Insurance We highly recommend that Guests purchase travel insurance. This can offer protection for nonrefundable expenses in case of emergencies such as illness, injury, or property unavailability due to unforeseen events. The Owner is not responsible for relocation or alternative accommodations should the property become uninhabitable due to natural disasters or other circumstances beyond our control.
9. No Assignment or Subletting The rental agreement may not be assigned, and the property may not be sublet without the Owner’s prior written consent. The Guest agrees to occupy the property personally for the full rental period and not to transfer this reservation. Any violation of this clause will result in immediate termination of the agreement and forfeiture of all payments made.
10. Indemnification The Guest agrees to indemnify and hold harmless the Owner and their agents from any and all claims, damages, or liabilities arising from the Guest’s use of the property, including personal injury, property damage, or death. The property includes outdoor decks and a private hot tub and is located in a wooded area that may be inhabited by wildlife, including bears and other animals. Guests accept full responsibility for their safety and the safety of their group while on the property. Extra caution should be exercised when using outdoor amenities or walking in the surrounding areas, especially after dark. Children must be supervised at all times, particularly around the decks and hot tub. Guests agree to accept all liability for use of these areas and understand that the Owner shall not be held liable for any accident, injury, or loss that may occur.
11. Entire Agreement This document represents the entire agreement between the parties. No verbal agreements or changes shall be valid unless made in writing and signed by both parties. If any part of this agreement is deemed unenforceable, all remaining provisions shall remain in full effect.
12. Disputes and Jurisdiction This agreement is governed by the laws of the State of Tennessee. Any disputes arising from this agreement shall be resolved in Sevier County, Tennessee. In the event of legal action, the prevailing party shall be entitled to recover reasonable attorney’s fees and related legal costs.
13. Guest Acknowledgment By confirming your booking, you acknowledge that you have read, understand, and agree to all the terms and conditions set forth in this rental agreement. Electronic acceptance of this agreement is legally binding and holds the same weight as a signed, physical document.

Addendum A: House Rules for Owl’s Nest By staying at Owl’s Nest, you agree that you and your guests will follow the house rules listed in this agreement, the Airbnb listing, and the in-home guidebook.

Owl’s Nest is located in a wooded area and includes outdoor decks and a private hot tub. Due to the natural setting, wildlife such as bears and other animals may occasionally be present. Please use caution when outdoors and never leave food or trash unattended. Children must be supervised at all times, especially near decks and in the hot tub.

Jumping from decks or railings is strictly prohibited. The hot tub is to be used responsibly and at your own risk. Children under 12 must be supervised by an adult while using the hot tub. Alcohol or drug use while in or near the hot tub is strongly discouraged due to safety concerns.

Owner and their agents are not responsible for any injury, accident, or illness that occurs on the property. Guests accept full responsibility for their safety and that of their group. The Owner is not liable for any lost or stolen personal items. Guests are provided a private access code to the home’s keypad entry system, which will be shared prior to check-in.

Only those listed in the reservation are permitted to stay overnight. The home is not to be used for parties, weddings, or gatherings beyond the registered group.

Guests are expected to maintain the home in good condition and to use all appliances, furnishings, and amenities for their intended purpose. Linens and towels are provided, and a washer and dryer are available for guest use during the stay.

As noted earlier, up to two small dogs are permitted if registered prior to arrival and with payment of the pet fee. Pets must be kept off furniture and crated when left alone in the house. Any damage caused by pets is the guest’s responsibility.

Smoking is strictly prohibited anywhere on the property, including outdoor areas. Illegal drug use and underage drinking are not permitted. Guests take full responsibility for any consequences related to alcohol or drug use on the property.

Fireworks and firearms are not allowed at any time. A propane grill is provided for guest use; please move the grill away from the cabin before lighting it.
