• No smoking is allowed inside of the accommodation whatsoever. Any GUEST or their guests not adhering to the No Smoking policy will result in the termination of GUEST occupancy with no refund of any kind.
• Additional guests staying at the cabin will result in you being asked to leave and no refund given.

POOL / HOT TUB:

• Guest acknowledges and accepts all responsibility for the safety of all individuals, approved or unapproved, including children, while using hot tub and pool.
• Children must be supervised by an adult at all times.
• Guests understand there is no lifeguard on duty and supervision is their responsibility.
• Guest agrees to release all liability of Agent and Owner.
• No glass in or around the hot tub and pool.
• Guest agrees to report all cleanliness issues regarding the hot tub and pool upon arrival.
• Guest agrees to pay a cleaning fee if said cleanliness issues are reported more than 24 hours post arrival. Hot tubs may take up to 8 hours to reheat completely after cleanings. Please leave lid on unit when not in use to allow the water temperature to heat appropriately.
• Guest also should not put any soaps, detergents, or bubble bath into hot tub or pool.
• The hot tub is for guests 21 and over only. You are not allowed to use the hot tub if you have consumed alcohol or you are pregnant. Use the hot tub AT YOUR OWN RISK! -*** DO NOT GIVE POOL ROOM CODE TO ANYONE UNDER 18 AND PLEASE SUPERVISE CHILDREN WHILE SWIMMING***

The property has video cameras on the exterior.

We do not offer late check out or early check in. Send me a message with the word mango so I know you read the house rules. If you arrive early or depart late there will be a $500 charge per.

We do not offer refunds for weather or natural disasters as well as power outages.

If you sneak a pet of any kind without specifying it in the reservation, you will be charged an additional $500 and you will be asked to leave.

If any of these rules are broken, you will be asked to leave by law enforcement and no refund will be given. Additional charges will apply.

RENTAL AGREEMENT: This AGREEMENT applies to all members of the GUEST'S party no matter the age or affiliation. GUEST acknowledges that GUEST is responsible for sharing the renter agreement, and its requirements, with all members of the GUEST'S party and anyone else permitted onto the RENTAL PROPERTY by the GUEST.

Please read this Renter Agreement thoroughly. Any monies received by HOST for occupancy of short-term rental accommodation hereinafter referred to as “ACCOMMODATION” indicates the acceptance of the terms and conditions of this AGREEMENT. It is the responsibility of the GUEST(S) to be familiar with all policies within this agreement. This occupancy will be in the form of a Short-Term Lease only and does not constitute a permanent or primary residence or other tenancy.

This Agreement is in addition to any rental agreement entered into by Guest on the website by which Guest located the Accommodations (the “Booking Site”). In the event of any conflict between the terms of this Agreement and the terms of any such rental agreement, the terms of such rental agreement shall govern. By booking the Accommodations, or by clicking to accept or agree to when that option is made available to you, you accept and agree to be bound and abide by this Agreement. If you do not want to agree to the terms of this Agreement, you must not book the Accommodations.

In consideration of the rent received and the mutual promises contained herein, HOST of the RENTAL PROPERTY does hereby lease and rent to GUEST(S) such RENTAL PROPERTY under the following terms and conditions:

1. GUEST agrees to abide by all rules and regulations contained herein or posted on the premises related to the RENTAL PROPERTY. GUESTS obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that GUEST uses. GUESTS agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. GUEST'S breach of any duty contained in this paragraph shall be considered material and shall result in the termination of GUEST occupancy with no refund of any kind.
2. In no event shall the RENTAL PROPERTY be occupied by more persons than the capacity of the property as stated on the web site or the confirmation letter, without prior approval by HOST. No fraternities, school, civic, or other non-family groups are allowed unless HOST grants prior approval. In no event shall GUESTS assign or sublet the RENTAL PROPERTY in whole or in part. Violations of these rules are grounds for expedited eviction with no refund of any kind. GUESTS hereby acknowledge and grant specific permission to HOST to enter premises at any time for inspection purposes should HOST reasonably believe that GUESTS are causing or have caused any damage to RENTAL PROPERTY. GUEST further agrees to grant HOST access to RENTAL PROPERTY for purposes of maintenance and repair. If listed "For Sale", GUESTS agree to grant access by scheduled appointment upon notification.
3. GUESTS must obtain permission from the HOST to have pets on the RENTAL PROPERTY. If the pet is a service animal, the GUEST must provide documentation that the pet is actually a service animal. If permission is not given by the HOST, any pet(s) found in or about the RENTAL PROPERTY will be grounds for expedited eviction and forfeiture of all monies paid.
4. GUESTS must inform the HOST of their intention to bring children and the specific number. A child is defined as any person under the age of 18.
5. No refunds will be provided due to inoperable appliances, pools, hot tubs, elevators, etc. The HOST will make every reasonable effort to assure that such appliances will be and remain in good working order. No refunds will be given due to power blackouts, water shortage, flooding, snow, construction at adjacent properties, or mandatory evacuations of the area by county officials due to hurricanes or other potentially dangerous situations arising from acts of god or nature.
6. It is expected that major systems in and around the home will break down from time to time such as air conditioning, washer, dryer, refrigerator, etc. HOST will attempt to repair the problem as soon as possible upon notice by the GUEST. HOST assumes no liability to GUEST if such should occur as all products have a useful life and break down occasionally.
7. GUEST is responsible for all shipping costs for any Lost and Found items that HOST is requested to return to GUEST. Items found and not claimed within 30 days will be disposed of at the discretion of HOST.
8. A hot tub and pool are provided at the RENTAL PROPERTY, it will be prepared and tested for proper and safe chemicals prior to or on the day of occupancy. Misuse of a hot tub or pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, oils, glass or metal will result in a Service Call Charge at the sole discretion of HOST. Under no circumstances are pets allowed in pools or hot tubs. Violation of this provision shall be grounds for expedited eviction and forfeiture of all monies paid.
9. If linens or towels are rented from HOST or supplied with RENTAL PROPERTY, GUEST is responsible for lost or damaged items at the cost of two (2) times the published standard rental price for such damaged or lost linens or towels.
10. In the event HOST is unable to make RENTAL PROPERTY available for any reason other than described above or a reasonable substitute as determined by HOST, GUEST agrees that HOST'S sole liability as a result of this unavailability is to provide a full refund of all monies paid under this AGREEMENT and GUEST expressly acknowledges that in no event shall HOST be held liable for any special or consequential damages which result from this unavailability. GUEST also agrees to indemnify HOST from and against liability for injury to GUEST or any other person occupying RENTAL PROPERTY resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the phone, spa, hot tub, sauna, whirlpool tub, pool, exercise equipment, elevator, etc. except only such a personal injury caused by the gross negligence or intentional acts of the HOST.
11. HOST may terminate this AGREEMENT upon the breach of any of the terms hereof by GUEST. GUEST shall not be entitled to the return of any rental monies paid under the terms of this AGREEMENT and shall vacate the Property immediately.
12. AGREEMENT shall be enforced under the laws of the state within which the RENTAL PROPERTY is located, including any applicable rental acts of that state, and represents the entire AGREEMENT. Any amendments must be in writing and signed by both parties. In the event of a dispute, legal action may only be instituted in the county within which the RENTAL PROPERTY is located. If any part of this AGREEMENT shall be deemed unenforceable by law, that part shall be omitted from this AGREEMENT without affecting the remaining AGREEMENT.
13. The RENTAL PROPERTY may offer access to recreational and water activities, including but not limited to canoes, bicycles, and swimming. GUEST fully understands and acknowledges that outdoor recreational and water activities have inherent risks, dangers and hazards. Participation in such activities and/or use of equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. GUEST agrees to fully indemnify and hold harmless the HOST and any and all agents, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the HOSTS, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. GUEST hereby assume all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the HOSTS or by any other person. GUEST hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify HOST and any and all agents, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of RENTAL PROPERTY facilities, equipment, or activities. GUEST further assumes full responsibility for the actions of any and all persons whom he may allow to enter the property during the rental period and indemnifies HOST from any and all claims arising from such other persons.
14. This is a NON SMOKING property. No smoking is allowed inside of the accommodation whatsoever. Any GUEST or their guests not adhering to the No Smoking policy will result in the termination of GUEST occupancy with no refund of any kind.
15. The maximum number of overnight GUESTS for this property is limited to 7 persons. Maximum occupancy for this property shall not exceed 7 persons at any time. If GUEST exceeds the maximum occupancy, GUESTS and any and all of their guests are subject to immediate removal and will result in the termination of GUEST occupancy with no refund of any kind.
16. The GUEST must supervise their guest(s) while on the premises. Noise in the accommodation must be kept a reasonable level as not to cause a disturbance to the neighbors or general public. In no event may the Maximum Occupancy (as listed on this AGREEMENT) be exceeded without written consent.
17. Electricity, water, and/or gas utilities are included. In addition, wireless internet are included. GUEST will be charged additional fees for the following:

• Cable or streaming service charges for any programming ordered during the rental period.
• Excess linens left.
• Any damage to the RENTAL PROPERTY or its contents.

18. Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check-in.
19. Under no circumstances shall any illegal drugs be allowed on the property. GUEST understands that possession and use of any such substance is grounds for immediate eviction and forfeiture of payment. GUEST further waives any and all rights to recourse against the HOST for enforcing this clause.
20. All occupants are required to perform "Normal" household duties that include, but are not limited to:

• Notification to HOST of any damages or problems with the property.
• Locking of all doors when GUEST(S) leave the home for any period of time.

21. There shall be no subletting of the premises. The GUEST shall occupy and use the premises as a vacation rental only and not use the premises for any business, professional, unlawful or hazardous purpose.
22. The HOST must be notified immediately if you discover any item that needs attention.
23. At the end of the term, the GUEST shall leave the premises in good condition and remove all GUEST property.
24. HOST of RENTAL PROPERTY shall not be liable for any damages and/or injury to GUEST and/or their guest(s), or their personal property due to GUEST’S acts, actions or neglect. GUEST agrees to hold HOST harmless against any claim for damage and/or injury due to GUEST’S act or neglect or their guests act or neglect.
25. FIREARMS, WEAPONS, FIREWORKS - No Firearms are allowed. Any shooting endangers neighbors. GUESTS are not permitted to bring any weapons of any kind - Fireworks: Although fireworks may be legal in Tennessee, they are not permitted at our cabin at any time.
26. GUEST and their guests agree not to violate quiet enjoyment and privacy of the surrounding neighbors. HOST is not responsible for the actions of any neighboring property.
27. HOST is not responsible for any weather conditions or acts of god or nature that happen during GUEST’S stay on premises and no refunds will be made.
28. HOST is not responsible for bugs, insects or other creatures in the RENTAL PROPERTY. Although HOST has recurring pest control service to minimize and prevent pest activity, pests may still enter RENTAL PROPERTY. Keep the doors shut to prevent them from entering the house. Recurring pest control service is quarterly and will be exterior and may include interior service if needed. HOST will make coordinate with the GUEST to schedule time for service. Exterior service does not require GUEST to be present. Interior service does require GUEST to be present.
29. If any unforeseen conditions or problems with the RENTAL PROPERTY arise prior to or during GUEST’S stay, HOST reserves the right to either refund GUEST’S payment pro-rate or place GUEST in a comparable house with the same amenities, bedroom, etc. Such unforeseen conditions could be the following but are not limited to, hurricanes, storms, vandalism, flood, etc. HOST assumes no responsibility for such unforeseen conditions. Message HOST the word "mango" to show that GUEST is reading this rental agreement.
30. GUEST agrees to allow access to the RENTAL PROPERTY to HOST and his agents upon 24 hours’ notice by telephone or in person. Agents include but are not limited to, cleaners, handymen, plumbers, electricians, rental companies, pest inspection, etc. HOST reserves the right to inspect the premises and condo interior upon 24 hours’ notice to GUEST. GUEST agrees not to deny access. If GUEST refuses to allow access to HOST or any agent designated by HOST, the HOST reserves the right to terminate the GUESTS short-term lease and GUEST will immediately vacate the premises upon demand by HOST and will forfeit the short-term payment. HOST reserves the right to enter without notice in the case of emergency or report of illegal activity.
31. GUEST acknowledges and agrees that they are responsible for the safety of themselves, their GUESTS and their children with respect to the pool, the deck areas, and any other hazard either natural or manmade on the property. GUEST acknowledges and agrees to hold HOST harmless from any injuries to them or their GUESTS. It is understood that there is no lifeguard and that supervision is their responsibility.
32. GUEST acknowledges to not modify or tamper with remote devices such as video doorbell camera, exterior cameras and thermostat. GUEST agrees to maintain current WiFi settings/configuration. HOST needs to be able to access remote devices in the case of emergencies or other instances. GUEST'S breach of this paragraph shall be considered material and shall result in the termination of GUEST occupancy with no refund of any kind.
33. GUEST agrees to not modify the layout of furniture and furnishings throughout the RENTAL PROPERTY. Any charges incurred by the HOST to remedy any modification or damages to furniture and furnishings will be passed onto the GUEST via Airbnb.
34. GUEST may be responsible and liable to HOST for damages or loss caused by GUEST or their guests. All rights and remedies in law and in equity are reserved by the HOST.
35. Host is not responsible for any vehicles, belongings, and other personal property that Guest or Guest’s licensees and invitees choose to bring into or use in or around the Accommodations and does not provide insurance for any such items. Guest is responsible for insurance of Guest’s personal property. Guest is responsible for all damage to the Accommodations and its contents during Guest’s stay.
36. To the maximum extent permitted by law, Guest agrees to indemnify, defend, and hold Host harmless from any damage caused by Guest or Guest’s invitees, visitors, or guests to the Accommodations, the contents of the Accommodations, the Building or any of its common areas, and any personal injury or death suffered by Guest or Guest’s invitees, visitors, or guests to the extent such personal injury or death is determined by an appropriate authority not to have been a result of negligence or misconduct by Host, its shareholders, directors, officers, employees, agents, or representatives. Host shall not be responsible for any loss or damage suffered by Guest or Guest’s invitees, visitors, or guests due to interruption of utility services, essential services, fire, or other occurrence of a similar nature, provided, that, in the event any such interruption results in the Accommodations being rendered unusable through no fault of Guest or Guest’s invitees, visitors, or guests, Host shall refund to Guest the amount prepaid by Guest and not applicable to the period prior to the Accommodations becoming unusable.
37. To the maximum extent permitted by applicable law, Guest assumes all risk arising out of Guest’s access to the Accommodations. This shall mean it is Guest’s responsibility to investigate the Accommodations prior to use to confirm that it suits Guest’s needs and Guest willfully assumes any risk of illness, bodily injury, disability or death that may be associated with its use of the Accommodations.
38. Guest’s use of any pool, pool floats, hot tubs, spas, saunas, bikes, sleds, canoes, slides or any other equipment or amenity that may be within the Accommodations or available within the Building shall be at Guest’s sole risk and Guest hereby indemnifies Host and agrees to hold Host harmless from all claims, actions, costs and expenses, including reasonable attorneys’ fees, arising from any personal injury to the Guest or Guest’s invitees, visitors or guests, and Guest shall be solely responsible for any damage caused by Guest or Guest’s invitees, visitors or guests.
39. Dispute-Resolution & Waiver of Jury Trial. The Parties desire prompt, inexpensive, and efficient dispute resolution procedures and therefore agree to attempt to resolve through direct discussions all controversies, claims (and any related settlements), and matters in question arising out of or relating to (a) this Agreement, (b) any breach of or questions as to the interpretation of this Agreement, (c) any acts or omissions by either Party (and their officers, directors, employees, agents, subcontractors, or affiliated persons or entities, if any), and/or (d) any actual or purported express or implied representations or warranties relating to the Company or this Agreement (collectively, a “Dispute”). If the Parties desire to Mediate, the mediation must be conducted under the commercial mediation rules of the American Arbitration Association (the “AAA”). All Disputes not resolved by direct discussions and/or mediation must be submitted to a court of competent jurisdiction in the county and state in which the Accommodations are located for a bench trial. The Parties knowingly, intelligently, and voluntarily agree to waive their respective rights to a jury trial and agree that this provision constitutes prima facie evidence of the Party’s written consent to submit all Disputes to a bench trial. Guest waives all rights Guest may have to join in or participate in any class action arising out of or in any way related to this Agreement.
40. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, such provision shall be severable and the remainder of this Agreement shall not be affected and each remaining provision will be valid and enforceable to the fullest extent of the law.
41. In the event of any dispute arising out of or relating to this Agreement, whether or not litigation or another form of dispute resolution is commenced, Host shall be entitled to recover from the Guest its reasonable attorneys’ fees and costs incurred in resolving such dispute.
42. Entire Agreement. This Agreement, along with the other agreements to which the Guest assented on the Booking Site in connection with booking the Accommodations, contains the entire agreement and understanding between Host and Guest with respect to the Accommodations and may not be superseded or changed by evidence of any prior, contemporaneous, or later oral agreement. This Agreement may not be amended except in a writing executed by Host and Guest. The Agreement may be executed in two or more identical counterparts, each of which shall be deemed an original instrument enforceable against the party who executed it and all of which shall, when taken together, constitute one and the same instrument. Electronic signatures and reproductions of “wet-ink” signatures sent by email, fax, or other electronic means shall be deemed originals. The persons executing this instrument each represent and warrant that they are duly authorized to execute and deliver this Agreement on behalf of the persons and entities they purport to represent.
43. Notices. All notices must be in writing and delivered to Host, Guest or their respective attorneys by email, commercial carrier, or Regular US Mail, Return-Receipt Requested, or personal delivery. Each party may change its address for notice purposes by not less than ten days’ prior notice to the other parties.
44. Any exceptions to the above mentioned policies must be approved in writing in advance by HOST. We encourage all renters to purchase travelers insurance.
45. Upon departure, all items indicated on the Checkout Instructions message must be completed. The Checkout Instructions will be sent out after dinner the night before checkout.
46. Failure to comply with any of the foregoing clauses and overall rules established by HOST will subject you to immediate removal from the RENTAL PROPERTY and forfeiture of all rental payments and security deposits. If GUEST fails to vacate the premises at the end of the rental period prescribed in this AGREEMENT, GUEST shall be charged and liable to HOST for $1000 per day for every day past the date and time specified in this AGREEMENT.
