You will be sent a link after booking to sign the renter agreement (shown below), upload government identification and provide a credit card for security deposit which ranges from $200-500 depending on property size. The security deposit is a hold on your credit card, the funds never leave your account. These three items are a REQUIREMENT to book this property.
This Renter Agreement ("Agreement") is made and effective on the date signed below between "Owner and/or Manager" (Mountain Bliss Holdings LLC and/or its representative) and “Guest” (also referred to as “Renter”) regarding the property ("Rental Property" or “Property”)
This Agreement applies to the Guest's stay at Rental Property during dates indicated on your reservation, but also applies to any other dates which may be included if the reservation is changed. This Agreement applies to all members of the Guest's party no matter the age or affiliation. Guest acknowledges that Guest is responsible for sharing the renter agreement, and its requirements, with all members of the Guest's party and anyone else permitted onto the Rental Property by the Guest. In consideration of the rent received and the mutual promises contained herein, Owner of the Rental Property does hereby lease and rent to Guest(s) such Rental Property under the following terms and conditions:
Important things to note:

Smoking and drugs of any kind shall NOT be permitted. If ANY SMOKE SMELL is detected inside the cabin after your stay, or if cigarette butts are laying around outside, ADDITIONAL CLEANING FEES of $300 minimum will apply. Smoking outside the property is allowed with proper disposal of cigarette butts.

People other than those in the Guest count in your reservation may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. Guests are not allowed to exceed the occupancy limit agreed to in their initial booking. Owner reserves right to terminate, without refund, any reservation that exceeds the guest count. If allowed to stay, any guests over the max occupancy limit will be an additional $100 per night per guest.

Guests should not create excessive noise at a level that disturbs neighbors; HOA code-enforced neighborhood quiet hours are from 9:00 PM – 8:00 AM. Parties are not allowed at our cabin. It is also our home and must be treated with respect.

This property is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The homeowners are not responsible for the loss of personal belongings or valuables of the guest. Guest understands their use and occupancy of the property is at their own risk. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise, and agree to hold property manager and owners harmless form any occurrences.

Keep the property and all furnishings in good order; removing any items from the cabin, including living and kitchen furnishings is not permitted. Please do not rearrange our furniture.

Only use appliances for their intended uses

Pets are not allowed at this property. You will be charged $500 and be evicted without refund if a pet is brought onto the premises.

Parking:
• Parking is limited to the amount of vehicles the driveway can fit (stated in the property listing). Vehicles are to be parked in designated parking area only. Owner is not responsible for ticketed/towed vehicles that result from not parking in designated areas or an excess amount of vehicles.
• Parking on the road is not permitted. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.

Housekeeping:
• There is no daily housekeeping service. While linens and bath towels are included in the cabin, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the units. Check-out is 10:00 AM EST and checkin is 4PM EST.

Please lock all doors and windows upon departure.

Garbage:
• Any garbage must be stowed in the proper bear-proof garbage receptacle. GARBAGE IS NEVER TO BE LEFT OUTSIDE OF THE PROPERTY UNLESS IN BEAR PROOF RECEPTACLES.
Garbage is only picked up after your checkout – mid stay garbage pickup is not offered.

Hot Tub:
• Use at your own risk. Renter agrees to hold owner harmless for any injuries.
• Guest(s) are responsible for any damage to equipment, spa cover or spa surfaces.
• Our housekeepers drain, sanitize, refill and replenish chemicals in all tubs prior to your arrival; therefore, it may not be warm until later that evening.
• Minimum age for unsupervised use of the hot tub is 18 years old.
• Minimum age for supervised used of the hot tub is 5 years old.
• Maximum safe spa temperature is 104° or less.
• Replace spa cover after use.
• No eating, no smoking and only drink water from plastic cups only.
• Do not use spa if pregnant or hypertensive (high blood pressure).
• Do not use spa if under the influence of drugs or alcohol.
• Do not use spa if water looks poor, smells bad, or without pump running.
• Notify owner of any equipment failure or water problems.
• DO NOT STAND ON THE HOT TUB COVERS. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and you may be charged for replacement.
• Remember to replace the cover on the hot tub when not in use so it will remain warm.
**Please only adjust the temperature and jets on/off. If a setting is changed that hinders the operation of the hot tub and a service call is required, guest will be responsible for all charges associated.

Fireplace
In properties with wood burning fireplaces, wood and lighters are not supplied. Fireplace use only permitted From October to April. Do not run while A/C is on. Most of our properties now have electric fireplaces which can be used any time of the year as long as A/C is off.

Inclement Weather
• No refund will be given for storms or other weather occurrences outside of the owner’s direct control.
• Mountain roads can be curvy and steep. We highly recommend a four-wheel drive vehicle during the snow months. We do not refund due to road conditions.

Any damage to any items in the cabin including couches, chairs, tables, TVs, table, hot tub, beds, sheets, towels, pillows, etc., are the responsibility of the booking guest. Every item will be looked at before arrival and after departure. If you cause damage, notify the owner immediately. It is our home, please treat it as if it were your own.

Pool
Most of our properties have a community pool. If so, the listing will state it. The community swimming pool is controlled by the local HOA. Generally, it is open from Memorial Day to Labor Day. However, owner is not responsible if the pool is closed for any reason and guest understands owner has no control over pool closures.
GUEST MUST BRING THEIR OWN TOWELS FOR USE AT THE POOL – BATH TOWELS FROM OUR CABIN ARE NOT PERMITTED TO BE BROUGHT TO THE POOL

Septic System
The cabin utilizes a Septic waste system. NOTHING OTHER THAN HUMAN WASTE AND TOILET PAPER MAY BE PUT DOWN THE DRAINS. All other items/food/waste including feminine products must be put into trash cans. GUEST WILL BE RESPONSIBLE FOR ANY DAMAGES OR PLUMBING STOPPAGES THAT RESULT FROM NOT FOLLOWING THESE INSTRUCTIONS.

Camera
Our properties have exterior cameras that monitor entrances to the property. There are no interior cameras. Guest consents to these cameras recording their activity while on the property. Guests are not to touch the camera and tampering with cameras will result in eviction without refund & loss of security deposit.

Supplies
The cabin is stocked with start up supplies (i.e. paper towels, toilet paper, trash bags, etc.). However, you will likely need to supplement with your own during your stay. Food items, oil, spices, salt/pepper, ziplocks, foil, plastic wrap, coffee, coffee filters, etc are NOT provided.

Elevation, Decks. Please note many of our properties have decks or balconies that are at a high elevation. The railings are never to be pushed or leaned on. They are not intended to be weight bearing. Leaning, pushing on, or playing with the railing could result in failure which can cause injury or death. Owner claims no liability for such occurrences & renter accepts the risk of injury or death.

FIRES – If the property does not have a designated fire pit outside, no fires are allowed. Do not start fires in the fireplace unless it’s a wood burning fireplace (if it has something there, it’s electric or gas and can’t be used for another purpose). Candles, and other fires are not allowed. If a property doesn’t have a grill , it’s because our HOA/city doesn’t allow grilling therefore no fires/grilling are allowed on the property.

CHANGES/REFUNDS/ CHARGEBACKS. The full amount of rent paid is earned in full upon the guest checking in and staying the first night. Renter waives the right to any credit card chargebacks after checkin. If renter booked on a platform such as VRBO or Airbnb, the cancellation policy agreed to on there will preside. If booked directly with owner, the cancellation policy is: initial deposit (50-60% of the booking amount) is non refundable 59 days or less before checkin. 29 or less days before checkin, no refunds are allowed. A request to change dates is equal to a cancellation and the cancellation policy still applies. TRAVEL INSURANCE IS HIGHLY RECOMMENDED TO ALL GUESTS as we cannot make exceptions to the cancellation policies. Sickness or Covid-19 is not a valid reason for a cancellation policy exception.

Severability. If any term or provision of this Agreement is held illegal, invalid or unenforceable, such illegality, invalidity or unenforceability shall not affect the legality, validity or enforceability of the remainder of this Agreement.

Headings. Section and other headings contained in this Agreement are for reference purposes only and are in no way intended to define, interpret, describe or limit the scope, extent or intent of this Agreement or any provision hereof.

Waiver of Jury Trial. BY ENTERING INTO THIS AGREEMENT, THE PARTIES KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A JURY TRIAL AS TO ANY CLAIMS A PARTY MAY CLAIM TO HAVE AGAINST THE OTHER WHICH ARISES OUT OF THIS AGREEMENT OR THE COURSE OF DEALINGS BETWEEN THE PARTIES.

By signing and or submitting payment for this rental, Guests and any Occupants agree to indemnify, defend, and hold harmless the Owner, Landlord and Rental Property Manager for any liabilities, theft, damage, or expense whatsoever arising from any claim or litigation which may arise out of or in connection with Guests or Occupants use of rental property. This includes any claim or liability for personal injury, illness, damage or theft of property, incurred or sustained by Guests or Occupants. If for some reason the reserved property becomes unavailable and a refund is due to renter, the property manager and owner will not be responsible for any other direct or indirect costs or fees.

WIFI RULES. Wi-Fi is offered as an amenity to our guests. Please read the following: By accepting this agreement and accessing the wireless network, you acknowledge that you are of legal age, you have read and understood, and agree to be bound by this agreement. The wireless network service is provided by the property owners and is completely at their discretion. Your access to the network may be blocked, suspended, or terminated at any time for any reason. You agree not to use the wireless network for any purpose that is unlawful or otherwise prohibited and you are fully responsible for your use. The wireless network is provided "as is" without warranties of any kind, either expressed or implied.
Failure to comply with the above rules will result in non-return of security deposit and possible additional charges.
Guest hereby agrees to the following:
I understand the rules and rental conditions upon which I am agreeing to rent accommodations, equipment, and use of the property. I acknowledge and accept that the sole responsibility for safety lies with the participant. In agreeing to this, I acknowledge that outdoor activities and exposure to the natural elements and animals can be dangerous and sometimes result in injury and even death. Steps and decks can be slippery, animals and insects can threaten and infect or injure, exposure to the elements can cause hypothermia, sunburn, among other risks inherent in participating in camping, outdoor and water activities. I know that alcohol and/or drugs do not mix safely with any outdoor activity. I am over the age of 25 and assume responsibility for those in my charge under the age of 25. I hereby assume all legal responsibility for bodily injury to me or to any person on the property as a result of my visit and use, operation or possession of equipment hired or loaned to me. I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not.
Acknowledging this, I accept complete responsibility for the minor children and myself in my charge and visit the property and equipment and engage in activities or events at my own risk.
I will abide by the rules and accept these rental conditions:
• The property I rent will be returned in the same condition in which it was rented and I will be responsible for all damage and/or loss that occurs during my rental period.
• I agree to hold harmless and to indemnify the Owner of the Rental Property against all loss, damage, expense and penalty on account of personal injury or property damage to the rental dwellers, the undersigned or to any minor child or children in the charge of the undersigned, howsoever rising, whether by act or acts or failure to act of the employees, owners or animals of the said company or property owners or not.
• I acknowledge receipt of the property in good order and condition (if found otherwise per my arrival I will contact Owner immediately) and further agree that the Owner of the Rental Property shall not be liable for consequential damages of any kind or nature from whatever cause arising, whether property or equipment is loaned or rented.
• I enter into agreement freely with the Owner of the Rental Property at my own risk, acknowledging the risks inherent in indoor and outdoor activities and assume any and all responsibility for the minor children and myself in my charge.
• All parties agree to and will comply with Federal, State and County pollution laws and any other applicable laws and regulations.
I, the guest, understand that payment of rent for this property and my subsequent occupation of the property implies consent to all conditions laid forth here. Furthermore, I attach my digital signature here demonstrating that I have read and agree to the terms. As the signer and renter, I accept responsibility for ensuring all members of my party also know and agree to these terms & conditions.
