The person making the reservation must be 25 or older, and, must be present for the duration of the stay. No transfers of reservation are accepted under any circumstances.
PARTIES OR EVENTS: All parties or events must be approved by property managers prior to taking place. Quiet hours are from 10:00 PM to 9:00 AM. If you violate this policy, you will be escorted off the premises and no refund will be issued. No music is allowed outside after 10:00 PM. If you are hanging out outside after 10:00 PM, please keep noise to a minimum. If there is a noise complaint or security is called due to noise outside, you WILL BE CHARGED $1000.
If you will bring a pet without permission you will be charged a $500 fee.
If adverse weather conditions (snow or ice) are present, it is required to have chains or 4/all wheel drive.
There is a 24-hour security camera installed with a view of the parking area. Guests acknowledge and agree to the presence of the camera. Our team checks cameras upon each check-in/check-out.
Alteration requests. We will not accept alteration requests 90 days or less before your check-in day if you want to shorten your stay and/or choose different days. You can always add days if it's available.

Credit card processing fee (if applicable) is not refundable at any time after booking is completed.
BUGS: Welcome to the Smoky Mountains, where no amount of “pest control” will ever control all the “pests” making their way into our cabin. We have monthly pest control, but, there are some critters that manage to make their way inside. This is especially true during the beetle season (they are small like ladybugs). They will come inside in droves, through any nook and cranny they can find. They are harmless, but, we can vacuum thoroughly one day, and by the next morning, there may be hundreds inside. They tend to congregate near windows. Also, Tennessee does have small scorpions (don’t worry, they aren’t venomous). They tend to gather near water sources/drains. And of course, there are occasionally stink bugs that make their way inside. Refund Policy: Please note that due to the nature of the environment, we do not offer refunds for any issues related to these bugs.
VACATION RENTAL SHORT-TERM LEASE AGREEMENT

Maximum Occupancy. The maximum number of persons allowed to stay in the Property is limited to 16 unless the Owner gives its prior written consent. If more than 16 stays, you will be asked to leave immediately with NO REFUND. The person named on the reservation must be present during the reserved dates. The minimum age of a person making a reservation is 25 years. No substitutions or transfer the reservation to another family member or friend.

Keys & Access Codes. The owner will provide the Guest with a code, which will unlock the front door to the Property. Any attempt to access a locked area just causes for immediate termination of this Agreement, forfeiture of all rent paid, and Guest will be liable for any missing items or damage.

Acts of God. If there is a storm or severe weather and a mandatory evacuation order is issued by state or local authorities, the Guest shall be entitled to a prorated refund for each night Guest is unable to occupy the Property. The owner will not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of God. We cannot refund monies for severe or inclement weather that may interfere with your travel to/from the cabin. Accordingly, we do strongly encourage you to consider purchasing travel insurance.

Cleaning. Daily housekeeping services are not included in the rental rate. Throughout the rental period, Guests will be responsible for keeping the Property clean and in good condition. Any unsafe or dangerous condition must be reported to the Owner immediately. Guest acknowledges that on the Arrival Date, the Property is in good condition, except for any defect Guest may report to Owner by the end of the first day following the Arrival Date. The Property should be left in the same condition as it was found by the Guest on the Arrival Date. Guest promises to leave the Property in good repair.

Mechanical Failures. The owner attempts to properly maintain the Property. While all electrical and mechanical equipment within the Property are in good working order, the Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air conditioning, audiovisual equipment, internet access, cable service, hot tubs, or appliances. Guest agrees to report any inoperative equipment or other maintenance problem to the Owner immediately. The owner will make every reasonable effort to have repairs done quickly and efficiently. Guest will allow the Owner or a person permitted by the Owner access to the property for purposes of repair and inspection. The owner is not responsible for any inconvenience that may occur. Much like all appliances and equipment within your own homes, malfunctions can be unpredictable and have lengthy solutions at
times. We have knowledgeable maintenance staff and a wealth of options for specialists in all areas. Specialists, however, have schedules of their own as well as waiting periods for certain parts if needed. Please be understanding in these circumstances.

Limitation on Liability. The owner is not responsible for any accidents, injuries, or illness that occur to any member of the Rental Party or Guest’s visitors while in the Property or on the Property. The owner is not responsible for the loss of personal belongings or valuables belonging to any member of the Rental Party or any of the Guest’s visitors. Guest agrees to assume the risk of any harm arising from the use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER BE LIABLE TO GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY. IN NO EVENT WILL THE OWNER BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THIS AGREEMENT, EVEN IF THE OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Violation of Agreement. If Guest or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors, and rental rules and restrictions, Owner may evict Guest and the Rental Party from the Property and Guest will forfeit all rent and security deposit paid.

CANCELLATION/REFUND POLICY: Our policy is STRICT. Please note: general travel insurance does not cover all situations, including Covid-19. You can find “CFAR” policies (cancel for any reason), which can be added to almost any travel insurance policy. There are several options and you can almost surely find one that fits your needs and budget. Simply search google for “CFAR travel insurance” and you will find several websites available to assist you. We do not offer any refunds for No Shows, regardless of the situation. NO REFUNDS can be issued for early departure, malfunctions of equipment (i.e. Hot Tubs, Televisions, Wi-Fi, Fireplaces, HVAC Units, etc.), or weather conditions. NO REFUNDS ISSUED FOR NATIONAL PARK CLOSURES, CLOSURE OF ATTRACTIONS/
RESTAURANTS, ETC.

Pool Deck/Patio: Dogs are not permitted on the pool deck or pool patio area due to safety concerns related to potential drowning risks.

Swimming Pool: Dogs are not allowed in the swimming pool. Allowing dogs in the pool can damage the pool liner and/or dogs shed hair and dander, which can accumulate in the pool and filtration system. This can clog filters and require more frequent maintenance., which may result in replacement costs of up to $8000.
Pet Addendum

Tenant agrees to the following terms:
a. Tenant shall be responsible for Tenant’s Pet at all times.
b. Tenant will take all reasonable action to not allow Tenant’s Pet from creating a nuisance, annoyance, and disturbance to the other tenants and neighbors.
c. Tenant’s Pet will be kept in appropriate areas within the Premises and will not be left unattended for an undue amount of time.
d. Tenant’s Pet will be under the full control of Tenant at all times and is allowed outside the Premises only if contained in a fenced-in area or restrained on a leash or in a pet carrier.
e. Tenant will clean up and properly dispose of all pet waste inside and outside the Premises including any and all common areas.
f. Tenant will comply with all applicable community association rules, statutes, local ordinances, rules, and regulations.

Tenant shall be liable for any damage, loss, or injury caused by Tenant’s Pet. Tenant will pay all costs to repair, clean, or replace any damage to the Premises including but not limited to carpets, floors, tiles, walls, doors, screens, windows, blinds, drapes, cabinets, landscaping, and fences.

Tenant will pay a pet fee.

Tenant shall indemnify, hold harmless and defend Landlord against any and all liabilities, judgments, actions, suits, costs, expenses, losses, or claims by third parties for injury to a person or damage to property caused by Tenant’s Pet.
