Eagle’s Landing Lodge 354 Oak Lake Drive Sevierville, TN 37876 Check in time: 4pm

This vacation rental agreement is between the owner, Melinda Johnson and renters who agree to rent Eagles Landing Lodge, 354 Oak Lake Drive, Sevierville, TN, a six bedroom, six bathroom lodge. If you rent the cabin, you agree to this document. Here are our common sense rules:

1. We are sharing our family’s home. Please treat it gently, like you are a guest in a friend’s home. If you use it, clean it. Put things back where you found them. Lock the door when you leave the cabin. Be neighborly. 2.The person who makes the reservation is responsible for all guests that come in the cabin, their behavior and any damage to the property, and agrees to pay the rent, cleaning fees, pet fee and taxes as stated at the time the reservation was created. 3.Guests should not create excessive noise at a level that disturbs neighbors. Quiet time is 11pm-7am. In case of excessive, unchecked noise, disturbance or property damage, authorities will be called and you will be evicted from the property. 4.The owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
2. Smoking is NOT allowed in the house. Please only smoke outside with the doors and windows closed. Use the ashtrays to dispose of cigarettes. PREVENT FIRES! DO NOT THROW CIGARETTE BUTTS INTO THE GRASS. Evidence of smoking in the house will result in forfeiture of damage deposit.
3. Pet policy: We love fur babies of responsible owners! $84.56 per pet per booking. If you bring more than one pet, you must pay the additional pet fee or it will be taken from your damage deposit. Each pet that stays must pay a $84.56 additional pet fee. Our front door video is able to see how many pets come into the cabin, so be sure you pay the fee appropriate to the number of pets you bring with you. PETS ARE NOT TO BE LEFT ALONE IN THE CABIN OR IN BEDROOMS ALONE. Use the provided crate or bring your own. Pets left alone tend to scratch the doors. This will result in loss of your damage deposit. Have your pet's vaccinations up to date and treat for fleas. Be aware that Tennessee has a lot of ticks, so check yourselves and your pets after going outside. We ask that you crate your pet when you leave it alone in the cabin and bring a blanket to put down on the furniture if your pet sits on it, though we prefer you bring the pet's own bed for it to rest on. All pets must be leashed at all times while outside. Guest is responsible for cleaning up any/all pet refuse. Pet must not cause damage to premises or furnishings. If damages are caused, the cost of the damage may be deducted from the security deposit. Guest should prevent pets from producing excessive noise at a level that disturbs neighbors. Homeowner assumes no responsibility for illness or injury that may incur to pets or humans while on the premises. The Guest shall be solely responsible for the pet while on the property.
4. Housekeeping: The cleaning fee covers the cleaning after you follow check out procedures to prepare for the next guests. All linens and towels are to stay within the cabin.
5. Garbage: Any garbage must be stowed in the proper bear proof garbage boxes located at the side of the house. Animal precautions are in effect in this area, meaning that trash should never be left outside of the trash container and the lid should be kept closed. If you have a longer stay and need trash pick up before your stay is complete, let me know and someone will pick it up as soon as available for a $35 charge.
6. Hot Tub/jacuzzi jetted tubs: Please supervise children at all times while in the hot tub/jetted tubs. Don’t allow them to stand on the sides or jump in. Please be sure the water is several inches above the jets before you turn them on. When using the hot tub, remember there is a certain health risk associated with its use. Use at your own risk. Hot tub water temperatures should never exceed 104 degrees Fahrenheit. A temperature of 100 degrees is considered safe for a healthy adult. Special caution is suggested for young children. Excessive drinking during hot tub use can cause drowsiness which could lead to unconsciousness and subsequently result in drowning. Pregnant women beware! Soaking in water above 102 degrees Fahrenheit can cause fetal damage during the first three months of pregnancy. Pregnant women should stick to the 100 ­degree maximum rule. Before entering the hot tub, users should check the water temperature with an accurate thermometer; hot tub thermostats may err in in regulating water temperatures by as much as four degrees. Persons with medical history of heart disease, circulatory problems, diabetes or blood pressure problems should obtain their physician's advice before using hot tubs. Persons taking medications which induce drowsiness, such as tranquilizers, anti­histamines or anti­coagulants, should not use hot tubs. Our housekeepers drain, sanitize, refill and replenish chemicals in all tubs prior to your arrival; therefore, it may not be warm until later that evening. [DO NOT STAND ON THE HOT TUB COVERS. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and you may be charged for replacement. Remember when not using the hot tub, leave cover on so hot tub will stay warm. If there is a tiedown provided, please use it in areas where wind can blow the cover off. Cover damage will result in a charge to the damage deposit.
7. Fireplace: The fireplace is a propane gas fireplace. Please do not throw any paper or other combustible materials in the fireplace. Burning stuff in the gas fireplace will result in a forfeiture of your damage deposit. The fireplace will heat the room very quickly. Because it will heat the room, it is only available seasonally, Oct 1 -May 1.
8. Check out time is 11AM, Eastern Time. If the cleaning company arrives and you have not yet checked out, they will charge me a $50 fee, which I will take out of your damage deposit. Check in time is 4pm Eastern time. You may call to ask about availability of earlier check in, but if the cleaning company is still working, you’ll need to wait till they are finished to go in.
9. Deck: please supervise young children on the deck. Do not throw things from the deck. Do not allow children to draw or carve on the deck wood or cabin wood. No charcoal grills are allowed ever on the deck.
10. Electronics/game room: please put remotes back with the TVs. Please tell all of your guests- young and old that the equipment is to be used properly, but not removed, unplugged or changed in any way.
11. Clean the grill after you use it. This will be checked after your stay and if left dirty, will cost an extra cleaning fee of $20, to be taken out of the damage deposit. CHARCOAL GRILLS ARE NOT ALLOWED ON THE DECK because of fire risk.
12. If you see something that needs attention, please let me know so that I can take care of it. I will do my best to address issues ASAP.
13. A note about bugs: the cabin is thoroughly cleaned and receives regular professional checks and pest control treatments; however, this is Tennessee. We have invasive species of ladybugs and Japanese beetles we call stink bugs. They are difficult to get rid of and you may find a few dead ones. The mattresses all have bed bug proof covers on them and we have Dog Inspectors that check regularly for bed bugs and provide reports with each check.
14. Refunds will not be given in case of bad weather, road maintenance issues, power outages, equipment malfunction or other things beyond our control such as acts of God. If there is a maintenance issue, let me know and I will get someone to fix it as soon as possible. Understand that even though I check and maintain the cabin regularly, maintenance issues may arise during your stay. I will get them attended to as soon as possible, after you let me know of the need. Extreme winter weather is rare in the area and the roads are well maintained. Use your best judgment during travel to ensure safety.
15. Cancellations made 60 days before your stay will receive a 100% refund, minus a $75 booking fee. Cancellations made 30 days before your stay will receive a 50% refund. I strongly suggest purchasing trip insurance which will protect you against unforeseen circumstances that could affect your trip plans. This can be purchased on the internet.
16. Security deposit is $500 and will be returned within 21 days after checkout if check-out list was followed and no damage is found. Damage that is found will result in appropriate deductions from the security deposit. Renters that do not abide by these guidelines or who do not vacate at the end of the rental period are subject to eviction.
17. Firearms brought onto the property are subject to Tennessee law. If you bring a firearm to the property, take it home with you. I cannot ship firearms. In this case, the police will be called to retrieve the firearm and it will be in their custody, for obvious safety reasons.
18. Owner and managers reserve the right to use video surveillance on the outside areas only for security reasons.
19. Guest is solely responsible for their own property brought to the cabin. If you leave something behind and want it shipped to you, there will be a $35 trip fee as well as the cost of shipping. Shipped items that are left behind may take up to 30 days to arrive.
20. Power and internet outages: We will report outages as soon as we are aware of them. Refunds are not given for power or internet outages as they are beyond our control.
21. Guest agrees to let us know as soon as any issues arise so that we can help in a timely manner. We ask that non emergency calls and texts take place between 8am and 8pm.

"This agreement shall be governed by the laws of the state of Tennessee. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in Tennessee, as applicable, for any matter arising out of or relating to this agreement."
