This short-term occupancy agreement is hereby made between SHUTTERS BY THE BEACH LLC, hereafter known as OWNER, and the person signing this agreement, hereafter known as CLIENT, for the property known as Shutters By The Beach in North Myrtle Beach, SC. Client’s signature shall constitute acceptance of the following booking conditions on behalf of the Client and every guest in Client’s party.

It is understood and expressly agreed Owner is providing a short-term occupancy accommodation and expressly disclaims any responsibility for any acts or omissions by third persons or other legal entities for the provision of any services, goods, or other products which may be provided during the term of this agreement. Owner and its representatives are in no way responsible or otherwise liable for services beyond the normal operation of the property as a short-term occupancy accommodation.

Mechanical Failures. Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, swimming pool equipment, audio visual equipment, computers or internet access, television or appliances. Please report any inoperative equipment to Thomas Beach Vacations immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. No refunds will be made due to failure of such items. 


LIMITATION ON LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE SHALL OWNER BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR YOUR RENTAL. IN NO EVENT WILL OWNER BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE AMOUNTS ACTUALLY PAID BY YOU IN CONNECTION WITH THIS AGREEMENT, EVEN IF OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. 


Owner and Property Manager assume no liability for losses or damages to personal property, personal injury, death accidents, delay or other damages occurring on the property at any time during Client’s trip. Client agrees to be responsible for the safety of the property during occupancy, to lock house windows and doors securely and to observe all precautions. Owner and Property Manager are not liable for Client’s personal safety, the safety of Client’s belongings or for the acts of third parties. In no event shall Owner or Property Manager be liable to Client or any other person for any incidental, consequential or special damages.

Client acknowledges that the Owner provides no lifeguard for the swimming pool and that any guests take full responsibility for their own safety. Anyone using the pool therefore does so at their own risk. The Client acknowledges that the proper supervision of children is the sole responsibility of the Client and/or other adult. Owner will not be held responsible for the injuries sustained by Client, anyone in Client’s group or Client’s visitors when using the swimming pool and pool area, and Client will indemnify Owner for any actions resulting from injuries to Client or anyone in Client’s group. The water in the pool is not deep enough for diving. NO DIVING ALLOWED.

The pool's size is 30 x 14, with a depth from 3 ft to 6 ft. It is not heated and is generally closed from October through March.

Governing Law; Venue. This Agreement and all transactions contemplated by this Agreement shall be governed by, and construed and enforced in accordance with the laws of the State of South Carolina. Any civil action or legal proceeding arising out of or relating to this Agreement shall be brought in the courts of record of the State of South Carolina in Horry County.

CANCELLATIONS & CHANGES: Cancellation policy subject to stated AirBnB terms and conditions posted at time of booking.

In the event of a force majeure such as a fire, earthquake, hurricane, flood or other circumstances outside the control of a party causing damage to the property which prevents Client from obtaining normal use of the property before arrival, all payments received by Owner will be refunded to Client. In the event of an official hurricane warning in force for the Myrtle Beach area within 48 hours of Client’s scheduled arrival, Client may change reservation to a future date (adjusted to rates of new dates). In the event of a force majeure causing a mandatory evacuation to be issued during Client’s stay, the unused portion of the vacation on a pro-rata basis will be refunded to the Client. Because unexpected travel interruptions may occur due to medical emergencies, illness, weather, pandemic, flight delays/cancellations, or any other unforeseen circumstances that are NOT subject to refund, TRIP INSURANCE THAT COVERS YOUR RESERVATION IS HIGHLY RECOMMENDED.

Owner does not extend refunds for Covid-19 or similar pandemic related situations as it is possible that cases may rise, or that the particular state where you live could enforce restrictions which would not qualify for a refund. For those and other unpredictable reasons, we recommend purchasing trip insurance that covers the cost of your vacation.

BED & BATH LINENS: All beds will be made with fresh linens before your arrival. Washcloths and 2 bath towels are included with single bed linens; washcloths and 4 bath towels are included with double, queen and kind bed linens. Beds have pillows, mattress cover and bedspread.

Upon arrival, please inspect the home and let us know if anything is broken, damaged, or inoperable. Please immediately send us an email (and photo if possible) explaining/showing the problem, otherwise you may be charged if damage is found after you vacate. If there are any non-working items and we will have repairs made as soon as possible. Rates are not adjusted for failure of any equipment or appliances, or for inconvenience that may occur due to construction, road repairs, maintenance, etc.

CRIBS, HIGH CHAIRS, BEACH UMBRELLAS, and other items are available from outside vendors. For beach equipment or baby furniture rentals we recommend North Strand Beach Service. Beach umbrellas and chairs are also available for daily and weekly rental from North Myrtle Beach City beach services located conveniently near the life-guard stations.

TENTS AND CABANAS are not permitted on the beach in North Myrtle Beach 5/15-9/15. Similar rules apply in Myrtle Beach, other nearby coastal towns and Horry County.

GROUPS, HOUSE PARTIES, VISITATION & OCCUPANCY LIMITS: The property will not be used for parties, weddings, or other group-like activities without prior WRITTEN consent of Owner. Live bands are not allowed. We generally do not rent to non-family groups unless all members are 25 or older. (Any exception to this rule must have prior WRITTEN permission from the Owner). The number of guests in Client’s group when booking are the only persons allowed occupancy of the house during Client’s stay. No other persons are allowed visitation or occupancy without prior WRITTEN consent of Owner. Clients violating any of this paragraph’s restrictions may be denied occupancy and/or removed immediately WITHOUT REFUND.

PETS of any kind are NOT ALLOWED in or about property unless approved in writing by Owner.

Client acknowledges that NO SMOKING is allowed in the house or on the property. Client is liable and will be billed for damage to the premises or furniture, to include burns and odors caused by smoking.

DEPARTURE CLEANING - Prior to departure, you are required to (1) remove all items from the freezer and refrigerator; (2) run the dishwasher and return items to their original places; (3) carry out all trash; (4) put all soiled linens and towels in grey bin provided; (5) close and lock all windows and doors, leaving the property in a secure and orderly condition. We will take care of the rest.

CHECK-IN is 4 PM. We will be emailing you a door entry code the day of your arrival when the house is cleaned and ready. Once you receive the code, you are welcome to occupy the house. That may be before 4pm, however there may be occasions where check-in is delayed until after 4pm for maintenance, special cleaning, or on turnaround days. We appreciate your patience while we prepare the house for your stay.

CHECK-OUT: All belongings must be removed and the property vacated by 10 AM. There will be a $100/hour charge if you are not checked out by 10am (unless you have approval IN WRITING permitting late check-out).

PARKING OF MOTORCYCLES, watercraft, trailered vehicles, high-rise vans, ATVS, and/or motor homes are not permitted. Parking spaces for 5 – 6 cars and vans are available in front of the property. DO NOT park in back of the property behind the fence. That is a City paid parking zone and you may receive a citation unless you pay the parking fee to the City.
