Rental agreement Terms:
PROPERTY & TERM:
The rental property (“Property”) is the cabin identified in the reservation confirmation. The rental term begins at the scheduled check-in time on the arrival date and ends at the scheduled check-out time on the departure date, as stated in the reservation confirmation (or the posted house rules). Any early arrival, early entry, late checkout, or continued presence on the Property before check-in or after check-out is strictly prohibited unless specifically approved in writing by the Owner, and if it occurs, it does not create a tenancy or extend any rights of occupancy. If the Owner permits an early check-in or late checkout, this Agreement remains in full force and effect for the entire time the Renter or any guest is on the Property, including any approved early/late access. This Agreement is a short-term vacation rental only and does not create a tenancy under Tennessee law.
SHORT-TERM RENTAL STATUS (NO TENANCY)
This rental qualifies as a short-term vacation rental under T.C.A. § 67-6-205 and is not a lease, residential tenancy, or time-share. No tenant rights, renewal rights, or possessory interests are created.
PAYMENTS, AUTHORIZATION, AND CHARGES
Airbnb processes the reservation payment according to Airbnb’s checkout terms and schedule. The Renter agrees to pay all rent, taxes, and fees as presented on Airbnb at the time of booking.
Reimbursement requests. If the Renter causes damage, missing items, excessive cleaning, rule violations, unauthorized pets/guests, smoking violations, late checkout, or any other costs described in this Agreement, the Renter agrees the Owner may seek reimbursement through Airbnb’s Resolution Center or other Airbnb-approved process, consistent with Airbnb policies.
SECURITY DEPOSITS AND DAMAGE PROTECTION
Airbnb generally does not allow hosts to charge a traditional security deposit for most listings, and damage issues are typically handled through Airbnb’s processes (including AirCover for Hosts and the Resolution Center).
If the Renter purchased any optional damage protection product (if offered), it may provide limited coverage under its own terms; however, it does not eliminate the Renter’s responsibility for damages, missing items, excessive cleaning, unauthorized pets/guests, smoking violations, occupancy violations, or fines/penalties. The Renter remains responsible for all costs and agrees reimbursement may be pursued through Airbnb as allowed.
OCCUPANCY AND USE
Maximum occupancy is stated in the reservation and may not be exceeded at any time. Only registered guests may stay overnight.
Parties, events, weddings, or gatherings are not permitted without prior written approval. Sub-letting or assignment of the reservation is strictly prohibited.
The Renter warrants that the Property will be used solely for personal vacation lodging purposes and not for any commercial use, professional photography or videography, filming, promotional activity, or ticketed event unless expressly approved in writing by the Owner.
Any violation may result in immediate removal from the Property without refund pursuant to Tennessee law.
TERMINATION AND REMOVAL
The Owner may immediately terminate this Agreement and remove the Renter and all guests for any violation, including but not limited to:
✦ Occupancy violations ✦ Unauthorized pets ✦ Smoking inside the Property ✦ Noise disturbances or illegal activity ✦ Falsified or misleading reservation information
Refunds (if any) are handled by Airbnb according to the reservation’s cancellation terms and Airbnb policies. Where permitted by Airbnb policy, the Owner may request reimbursement through Airbnb’s Resolution Center for damages, extra cleaning, rule violations, unauthorized pets/guests, and other costs described in this Agreement. Law enforcement may be contacted if necessary.
ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION
The Renter voluntarily assumes all risks associated with occupancy and use of the Property.
The Renter understands and acknowledges that the Property is not childproof or handicap-accessible and includes inherent risks, including but not limited to:
✦ Hot tubs and water features ✦ Stairs, decks, hillsides, and drop-offs ✦ Wildlife ✦ Weather conditions and mountain roads
The Renter acknowledges that the Property is located in a natural mountain environment where wildlife, including bears, may be present, and agrees to follow all posted safety guidance and local wildlife recommendations.
The Renter shall be fully responsible for and shall indemnify the Owner against any claims, damages, injuries, or losses caused by or arising from the actions of any guest, invitee, or visitor of the Renter, whether registered or unregistered.
The Renter agrees to release, defend, indemnify, and hold harmless the Owner, managers, employees, and agents from any and all claims, injuries, death, loss, or damage arising from the use or occupancy of the Property, including those resulting from acts or omissions of the Renter or guests, use of amenities, acts of God, wildlife, weather, or utility outages. This obligation survives termination of the Agreement.
To the fullest extent permitted by law, the Owner’s total liability for any claim arising out of or related to this Agreement or the Renter’s stay, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Renter for the reservation.
8.) CHILD SAFETY AND SUPERVISION
The Renter acknowledges and agrees that the Property is not childproof or babyproof. While the Property is built and maintained in accordance with applicable safety codes, it is the sole responsibility of the Renter to supervise all children at all times during the stay.
The Renter further acknowledges that the Property includes outdoor areas with inherent risks such as steps, wet surfaces, uneven terrain, water features, and drop-offs, and agrees to supervise all minors at all times and accept full responsibility for their safety.
The Renter understands that the Property may contain features that present potential hazards to unsupervised children, including but not limited to:
✦ Hot tubs and water features ✦ Elevated decks and staircases ✦ Steep hillsides, uneven terrain, and drop-offs
By signing this Agreement, the Renter agrees that children will be properly supervised at all times and will never be left unattended anywhere on the Property.
The Renter accepts full responsibility and liability for the safety and conduct of all children on the Property. The Renter further agrees to defend, indemnify, and hold harmless the Owner, managers, employees, and agents from any and all claims, liabilities, losses, damages, costs, or expenses arising from any injury, death, or property damage involving children during the rental term, whether sustained by the Renter, guests, invitees, or any other persons, to the fullest extent permitted by law.
If the Renter requires child safety equipment during the stay, the Renter acknowledges that such equipment is not provided by the Owner. The Renter may independently arrange for third-party delivery and setup of child safety items such as baby cribs, high chairs, pack-and-plays, baby gates, or similar equipment at the Renter’s sole discretion and expense. Any third-party services are not affiliated with or controlled by the Owner.
HOT TUB AND AMENITY USE
Use of the hot tub and all amenities is entirely at the Renter’s risk. Amenities are provided as a courtesy and are maintained in good faith; however, the Owner does not guarantee uninterrupted availability or functionality. Temporary unavailability of any amenity shall not constitute a breach of this Agreement or grounds for any refund or credit.
Children must be supervised at all times. Alcohol, drugs, soaps, oils, or foreign substances are prohibited. All posted safety instructions must be followed.
The Owner assumes no liability for injury, illness, or death arising from amenity use.
FIRE, GRILLS, AND FIREWORKS
Fireworks are prohibited at all times. Outdoor burning is permitted only in designated fire pits and only when allowed by law. Grills may not be placed on decks or porches. Fireplaces must be used only as instructed.
Violations may result in immediate removal and liability for damages.
CANCELLATION POLICY AND NO-REFUND ACKNOWLEDGMENT
For Airbnb reservations, the cancellation policy that applies is the Firm policy shown on the Airbnb listing and in the guest’s booking details at the time of reservation, along with any Airbnb policies that may apply. This Agreement does not expand refunds beyond what Airbnb allows for the reservation.
All cancellation requests, date changes, and shortening of stay requests must be submitted through Airbnb. Any refund (if any) is processed by Airbnb under the reservation’s cancellation terms and applicable Airbnb policies.
Summary of Airbnb cancellation policy (subject to Airbnb’s rules and any required overrides):
✦ To receive a full refund, guests must cancel at least 30 days before check-in. ✦ If a guest cancels between 7 and 30 days before check-in, they pay 50% for all nights. ✦ If a guest cancels less than 7 days before check-in, they pay 100% for all nights.
In addition, Airbnb’s standard policies include a 24-hour free cancellation period (full refund including taxes) for up to 24 hours after booking confirmation, as long as the reservation was confirmed at least 7 days before check-in (based on the listing’s local time and subject to exceptions).
The Renter acknowledges that purchasing third party travel insurance may cover losses arising from events that are otherwise non-refundable under Airbnb’s cancellation rules. The Renter understands that failure to purchase travel insurance is a personal decision and accepts financial responsibility for any losses not refundable under Airbnb’s policies. The Renter expressly understands and agrees that no exceptions are made to the cancellation policy for any reason, including but not limited to:
✦ Illness, injury, hospitalization, or death of the Renter or any member of the Renter’s party ✦ Severe weather, snow, ice, road conditions, or travel delays ✦ Airline cancellations, vehicle breakdowns, or transportation issues ✦ Work conflicts, family emergencies, or scheduling conflicts ✦ Natural disasters, power outages, or utility interruptions ✦ Decisions to leave early or not arrive at all
Failure to arrive on the scheduled arrival date, failure to occupy the Property for the full reservation period, or early departure for any reason does not entitle the Renter to any refund or credit. Any reschedule offered outside the cancellation window is at the sole discretion of the Owner and does not constitute a refund.
The Renter further understands and agrees that requests to change dates, shorten the stay, or reschedule a reservation are treated the same as a cancellation if made within 30 days of the scheduled arrival date.
For Airbnb reservations, payments and disputes are governed by Airbnb’s terms and payment processes. The Renter agrees to address any issues first through Airbnb’s platform (including the Resolution Center where applicable). The Renter further agrees not to initiate a payment dispute for charges that are properly due under Airbnb’s policies and this Agreement, and acknowledges the Owner may provide this Agreement and supporting documentation to Airbnb in the event of a dispute.
PET POLICY
Pets are prohibited unless pre-approved in writing.
✦Only dogs are considered; cats are never allowed. ✦Unauthorized pets result in immediate removal and forfeiture of all rent. ✦Pet fees apply unless the animal is a legitimate ADA-recognized service animal.
The Renter is responsible for all pet-related damage, which is not covered by any damage waiver.
Fee Type Fee Amount Pet feces or urine discovered inside home $250
Excessive shedding $200

Destruction of furniture Actual cost of repair
Unauthorized pet on premises Termination of stay and loss of all rent
If the Renter lists a dog above but pets were not disclosed/approved on the Airbnb reservation, the Owner may send a request for the required pet fee through Airbnb’s Resolution Center (or other Airbnb-approved process), consistent with Airbnb’s fee rules.
The pet fee is $250 per stay and covers up to two dogs. Each additional dog is an additional $250. Any taxes will be handled as permitted by Airbnb and applicable law.
If dog(s) are brought to the Property and the required pet fee is not paid through Airbnb and/or pets were not approved on the Airbnb reservation, the pet(s) are considered unauthorized, which is a material violation of this Agreement and may result in termination and removal without refund to the fullest extent permitted. Where permitted by Airbnb policy, the Owner may request reimbursement through Airbnb for applicable fees, damages, and additional cleaning.
SMOKING
Smoking is strictly prohibited inside the Property. Violation results in a minimum $500 charge plus any additional cleaning or damage costs.
CLEANING AND CHECKOUT
Late checkout is charged at $200 per hour, billed by the minute.
The Renter understands that standard cleaning is included in the reservation; however, standard cleaning does not include excessive mess, misuse of amenities, or conditions requiring additional labor or specialized cleaning.
The Renter agrees that the Property does not need to be cleaned prior to departure; however, the Property must be left in a reasonable condition and the checkout procedures provided must be followed.
The Renter specifically agrees to the following checkout expectations:
✦ All trash must be fully bagged to prevent leaks. Trash must be placed in the designated trash cage outside or left bagged inside. Double-bagging is required if leakage is possible. ✦ All dishes must be loaded into the dishwasher and the dishwasher started prior to departure. ✦ No soaps, bubbles, oils, or foreign substances may be introduced into the hot tub.
For Airbnb reservations, the Renter agrees the Owner may seek reimbursement for these additional costs through Airbnb’s Resolution Center or other Airbnb-approved process, consistent with Airbnb policies.
✦ Introduction of soap, bubbles, oils, or any substance other than water into the hot tub resulting in additional cleaning will result in a $100 fee. ✦ Dirty dishes left in sinks or throughout the cabin, rather than placed in the dishwasher, will result in a $50 fee. ✦ Trash that is not properly bagged or causes leakage will result in a $100 fee. ✦ If the Property is left excessively messy and requires additional labor beyond standard cleaning, a minimum $200 excessive cleaning fee will be charged. Additional charges may apply if actual cleaning costs exceed this amount.
WEATHER AND FORCE MAJEURE
No refunds are issued for weather conditions, road closures, power outages, illness, or travel disruptions. The Renter is strongly encouraged to purchase travel insurance.
In the event the Property becomes uninhabitable prior to check-in due to circumstances beyond the Owner’s control, the Owner’s sole obligation shall be to issue a full refund of amounts paid, or at the Owner’s sole discretion, offer a substitute property if available.
SURVEILLANCE
Exterior surveillance cameras are used solely for security, safety, and property protection purposes. No recording or surveillance devices are located inside the dwelling. Recorded footage is retained for a limited period and is not shared except as required for security, legal, or insurance purposes.
RIGHT OF ENTRY
The Owner or Owner’s authorized agents may enter the Property at reasonable times and without prior notice in the event of an emergency, to make necessary repairs, to protect the Property, or to investigate a suspected violation of this Agreement. Such entry shall not constitute a breach of quiet enjoyment.

Illegal downloading, streaming, or other unlawful internet activity is prohibited and grounds for removal without refund. Any fines, penalties, or legal costs arising from such activity shall be the responsibility of the Renter.

Guests will be charged a $125 replacement fee for each card that is lost, damaged, or not returned. This fee reflects the replacement cost charged by the HOA.
The resort pools are open seasonally, typically from Memorial Day through Labor Day. Pool availability, hours, and operating dates are determined by the HOA and are not guaranteed.
