Rental Agreement

Check-in time is 5pm EST and check-out is 10am EST. No early check in or late check out.

All Villas are NON smoking units. If guest have been smoking in the villas, you will be asked to leave the premises immediately and will forfeit the entire rent and deposit. Smoky Mountain Villas has a NO tolerance policy with NO exceptions. Please adhere to this policy. If there is a lingering smell of smoke that requires cleaning, removal of carpet, furniture, bedding, or any other means, you will be responsible to pay these damages above and beyond the rental rate. Renters will be responsible for any and all fees and cost associated with collecting these funds.

There are NO PARTIES OR EVENTS allowed on the property under any circumstance. If we receive complaint that your group is being disruptive to other guests, you will be removed from the property with no refund of deposits or any other monies already paid.

Pets are NOT permitted in the rental units, or on the property, under any conditions. Due to the possibility of allergic reactions as well as safety concerns, they are not allowed on the property under any circumstances.

Damage/Reservation Deposit- A damage/reservation deposit of $500 is required. This must be held by credit card prior to the day of check in. The hold is NOT applied toward rent; however, it will be released within 7 business days of check out, provided all of the following provisions have been met.
A. No damage is done to unit or its contents beyond normal wear and tear.
B. No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
C. Flushable wipes are not allowed to be used in the units. No feminine products are to be flushed in any capacity, please dispose of them in the proper trash receptacle. Guests will be responsible for any damage/repair to the plumbing system that results from flushing any such wipes, cloths or feminine products.
D. There is no sign or smell of smoking in the unit.
E. All debris, rubbish and discards are placed in trash bags and left in front of villas, and dirty dishes are placed in dishwasher, guests will need to start the dishwashing cycle, please contact the office if you need detergent for this.
F. Home is left locked, including all exterior doors and windows.
G. All charges accrued during the stay are paid prior to departure.
H. NO linens, accessories or items are lost or damaged.
I. NO early check in or late check out.
J. No damage to Dock or Slip
K. No damage to amenities
L. The renter is not evicted by the owner (or representative of the owner), the local law enforcement, the security company employed by Smoky Mountain Villas.

Payment. An advance payment equal to 50% of the rental rate is required 90 days before arrival. The advance payment will be applied toward the villa rent. Please make payments in the form of traveler’s checks, bank money orders, cashier’s checks or personal checks payable to “Smoky Mountain Villas”. The advance payment is not a damage deposit. The balance of rent is due Thirty (30) days before the arrival date.

Cancellation Policy for daily and weekly rentals. For a full refund of the renter’s deposit, a cancellation notice of at least ninety (90) days prior of the date of arrival is required. Cancellations that are made less than ninety (90) days prior to the arrival date are subject to a 50% Cancellation fee charge of the full rental rate. Cancellations or changes that result in a shortened stay, that are made within sixty (60) days prior of the arrival date, forfeit the full advance payment and damage/reservation deposit. Cancellation, other than stated above, or early departure does not warrant any refund of rent or deposit. Renters can choose to purchase travel insurance separately, or though us during booking.

There are wifi thermostats in all units. Temperatures can be adjusted by tapping the face and then using the (+) and (-) next to the current temperature reading. Guests will need to contact Josh to change the settings between "Heat" & "Cool".

Maximum Occupancy- The maximum number of guest per six bedroom villa is limited to sixteen (16) persons and eighteen (18) for the seven bedroom villas. If it is found that additional guest are staying in the units without consent, there will be a $50 per day per person fee assessed, or guests will possibly be evicted from the property with no refund.

Longer rental stays may be required during holiday periods.

No Daily maid Service- While linens and towels are included in the unit; daily maid service is not included in the rental rate. Guests will need to provide beach/lake towels, as we do not allow towels and linens to be taken out of the units.

Rate Changes- Rates subject to change without notice. However, if you have already confirmed the dates with a deposit, your rental rates will not change from the agreement amount.

Falsified Reservations- Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money and the party will not be permitted to check in.

Written Exception- Any exceptions to the above mentioned policies must be approved in writing in advance.

Travel Insurance- We recommend you purchase travel insurance. If you wish to purchase travel insurance there are plans available through Generali on our booking page.

RV’s are not allowed on the premises.

Outdoor furniture. Any damage to the outdoor furniture caused by guests will be the responsibility of the guest. Guests will be charged for any damage to outdoor furniture while on the property.

Pool/Hot Tub Rules- The pool and hot tub are for the enjoyment of all guests. The pool and hot tub area is open from Memorial Day weekend to September 14th. The rules listed below are for your safety and the safety of the other guests. If you violate the rules of the pool area, we reserve the right to ask you to leave the pool area. The pool and hot tub may be closed at any time for repair and maintenance when needed.
A. The pool and hot tub are for registered and paying guests only. Any persons found in the pool area that are not guests of Smoky Mountain Villas will be prosecuted for trespassing. If you believe there are guests who are not registered please report to the owner/manager.
B. There is NO lifeguard on duty. Swim at your own risk. Please watch and supervise your children. All children and non swimmers must be accompanied by a parent, guardian or responsible adult.
C. There is NO diving under any circumstance.
D. Children who are not toilet trained must wear a swim diaper at all times.
E. NO GLASS in the pool area.
F. Please put all trash in containers made available in pool area.
G. There is no climbing on rocks or landscaping at any time.
H. When using the hot tub please be sure to turn off all jets, and replace cover when you finished. No children under 5 years of age are allowed in the hot tub.
I. Please be respectful of other guest at the pool. No foul language, or loud music is permitted.
J. No Smoking allowed in the pool area.
K. The umbrellas at the pool area are for your enjoyment. Please close and secure the umbrellas after use. Please put down umbrellas at all times when not in use. We have high winds and storms that can be present at any time. You WILL be responsible for the cost of replacement of the umbrella, table, chairs and windows if broken. The cost of the table is $265 and the umbrella is $125 chairs are $325. Please do not forget! We do not like to charge a fee to our guest for something that can easily be avoided.

Dock- Guest may use the docks as much as you would like. Life jackets are required by law when using the paddle boards and kayaks, we have life jackets available for them. Please put back the equipment when finished and tie them up as to keep them from floating or blowing off. NO diving off of dock for your safety. There is a swim ladder located at each end of the dock. Please be careful around the boat dock as the water will shift boats around. Look out for swimmers and boats alike. There is NO lifeguard on duty. Swim at your own risk

Lake Levels- Water levels on Douglas Lake fluctuate frequently, due to the lake being a reservoir. Lake levels fluctuate about 40 feet during the year. Lake levels are controlled by the TVA (Tennessee Valley Authority) to generate power for the surrounding areas, they are also lowered for flood control. During the off seasons (September to May) the water levels are low. At times, it may be necessary for us to adjust the position of the dock to keep it floating. Due to changes in the water levels our dock is not floating year-round. We are on the main channel of Douglas Lake so we always have water in front of the villas. Smoky Mountain Villas is not responsible for water levels upon arrival resulting from inclement weather conditions or TVA usage. During extremely dry seasons the TVA may lower lake levels more than usual. We are not responsible for the lake levels effects on our docks, or amenities such as swimming, boating or fishing.

Check-In & Check Out Policies: Check in time is at 5pm and we do not allow early check in’s under any circumstance. The cleaning staff needs the full allotted time to make sure your Villa is clean and ready for your stay. If you arrive early, you are more than welcome to start enjoying the resort and amenities. Check out time is promptly at 10 am. There will be a $50 charge taken out of your deposit for every 30 minutes past the required check out time of 10am. Please do not make us enforce this policy and understand that we need the Villa back in time to ensure it is ready for the next guest to enjoy.

Smoky Mountain Villas is NOT responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Owners are NOT responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming all risk of any harm arising from their use of the premise or others whom they invite to use the premise.

We are in the Great Smoky Mountains region. Our properties terrain is natural to East Tennessee. The terrain is hilly and uneven. Access to the lake is different from coastal areas. Enjoy walks to the lake, take in all the natural beauty Smoky Mountain Villas has to offer.
I agree that all rental monies are non refundable per cancellation policy above. I have read my rights as to purchase vacation insurance. By signing electronically, I agree to all terms and conditions of this agreement.
