HOUSE RULES (Exhibit A)

We kindly ask that you leave the house in the same condition you found it. Thank you!

1. Occupancy: Up to 16 people. No additional guests are allowed.
2. Quiet Hours: Quiet hours are from 10:00 p.m. – 8:00 a.m. Please be mindful of noise levels to avoid disturbing neighbors.
3. No Smoking: Smoking is strictly prohibited inside the house (eSig’s included). Ashtrays are provided on the deck. A $500 cleaning fee will be charged if we detect smoking indoors.
4. No Pets: Pets and animals of any kind are not allowed. You will be charged $500 per pet and per night if this rule is violated.
5. Property Care: Please do not remove any items from the house. You will be charged the full replacement value of any missing items. You are required to leave the Property in the same general condition as it was in when you arrived, and to clean all food and drink spills immediately. You acknowledge that food and drink spills on carpet and furnishings constitute damage to the Property (and not normal wear and tear).
6. Ski/Snowboard Equipment: Kindly store all ski and snowboard gear in the provided ski closet located near the main entrance, no equipment is allowed inside the house.
7. Grill Usage: The grill is located on the deck. Please do not move it, and ensure it is turned off and cleaned after use. A $150 fee will be charged for inadequate cleaning. No open fires or charcoal grills are allowed.
8. Hot Tub and Bunk Beds: Use of the hot tub and bunk beds is at your own risk. Hot tub is drained, sanitized, and refilled before your arrival but may not be warm until later in the evening. Please unlock and re-lock the cover when not in use, especially during windy conditions. Use the provided soft broom to clear snow from the cover—shovels can cause damage, and a $1200 replacement fee will be charged if damaged. Set the desired temperature an hour before use for optimal comfort (102–104°F is recommended). You are required to shower before entering the hot tub and replace the hot tub cover upon exiting. Further, you may not consume food or beverages inside or around the hot tub. You acknowledge that hot tubs are not suitable for pregnant women, children under 12 years of age, intoxicated persons, or persons with certain heart or other health conditions. If you have any health-related questions about the use of a hot tub, consult your physician or other medical advisor. Do not turn off the heat for the house or hot tub, as frozen pipes could result in damage.
9. Fireplace (Unit 2): The gas fireplace is controlled via the thermostat located on the same wall as the fireplace and TV. Set it to your desired temperature and enjoy! Remember to turn off the fireplace when you’re finished using it. Please no burning of candles and such.
10. Check-Out Procedures: • Check-out time is before 11 a.m. • Please start the dishwasher with all dirty dishes before you leave. • Use the collapsible mesh hampers (under bathroom sinks) for used towels. • Ensure all windows and doors are closed, lights are off, and doors are locked (press the “Schlage” button, then turn the knob). • Make sure the hot tub cover is securely locked. • Dispose of all trash in the designated bins outside; there is a $25 fee for each garbage bag left inside the house. • Please report any damages. We understand accidents happen and will work with you on a reasonable solution. • Leave the bedding in place for our cleaning service to handle. • The house should be left in the same condition as when you arrived; additional cleaning may result in extra fees. Failure to follow check-out procedures that results in theft or damage may result in liability charges. Early check-in or late check-out may be available, as determined by the owner; however, additional charges may apply.
11. Important: Successful completion of both host and guest verification is a requirement for our insurance. Before you arrive you will be asked to complete guest verification through third-party provider Superhog. This is done to ensure we are keeping up-to-date with short-term rental regulations as well as providing both our guests and our properties with extra protection. Superhog will contact you via email and/or text to complete the verification. Please do so prior to arriving at the property to enable a quick and easy check-in process.

SHORT TERM RENTAL AGREEMENT

1. Property. The property is located at 308 Killington Rd., Killington, Vermont 05751
2. Maximum Occupancy: The maximum number of guests (including children) is limited to 16 persons. You will be charged $500 per person and per night if this rule is violated. Guest agrees that no more than 16 persons (10 people on top floor and 6 people on the first floor) shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon Guest under this Agreement.
3. Rental Term: Check-in is any time after 5:00 p.m. on the “Check-in Date” and ends at 11:00 a.m. on the “Checkout Date”. Any delay in checkout, without prior consent of Owner shall result in Guest being charged additional monies.
4. Use: Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, ordinance, nor commit waste or nuisance on or about the Property. Guest agrees to abide by the House Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the House Rules at all times while at the property. Failure to adhere to these rules will be considered sufficient cause for immediate termination of Guest’s stay and all monies paid will be forfeited.
5. Access: Guest shall allow Owner access to the property for purposes of repair and inspection. Owner shall exercise this right of access in a reasonable manner.
6. Security Deposit and Fees: If the premises appear dirty, damaged, or if anything is not working upon Check-in, Guest shall inform Owner immediately.
7. Cancellation and Refund Policy: Rental payments are refundable based on our cancellation policy. No full or partial refunds will be granted for no-shows or if you arrive after the first night of your reservation, or depart before the last night of your reservation. The Property is provided in “as is” condition. Owner cannot guarantee against mechanical failure of heating, air conditioning, Hot Tub, TVs, Internet, or other appliances. Please report any inoperative equipment to us immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. No refunds or rent reductions will be made due to failure of appliances or equipment. If you do not book direct, and instead book through a third party, additional fees and refund and deposit policies may apply (but all other terms and conditions of this Agreement remain the same). Please review the policies of any third-party booking sites prior to confirming your booking.
8. Acts of God: Owner shall not be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, strikes, war, or inclement weather. NO REBATE OR REFUND will be offered in these circumstances. No refunds will be given due to weather or road conditions. You are encouraged to obtain appropriate travel insurance.
9. Age Requirements: Guests under the age of 21 unaccompanied by a parent or legal guardian will not be permitted to rent the property and will lose all funds paid to Owner. Any reservations made under false pretenses will result in loss of advance payments and possible removal of Guest from rental unit. The Owner reserves the right to refuse service to anyone.
10. Criminal and Other Activity Prohibited: Use of the Property for any criminal activity or any activity that results in harm or nuisance to others is prohibited and may result in fines, penalties or prosecution. This prohibition extends to use of the Property’s Internet service, if any, for any such activity, including unlawful downloads of copyrighted or other protected material (including movies, music, software, or other material), or accessing or engaging in any unlawful material or activity.
11. Indemnification and Hold Harmless: Guest(s) agree to indemnify and hold harmless the Owner for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
12. Hot Tub, Bunk Beds and Other Activities: Use of the hot tub and bunk beds is at your own risk. YOU AND YOUR GUESTS ASSUME ALL RISKS RESULTING FROM OR RELATED TO ACCESS TO AND USE OF THE EQUIPMENT OR ENGAGING IN THE ACTIVITIES, INCLUDING THE RISK OF DEATH, PHYSICAL INJURY AND DAMAGE TO PROPERTY. As a condition to using the Property and gaining access to the Equipment and Activities, you unconditionally release and forever discharge the owner(s) of the Property (the “Owner”) from any claims, demands, actions, suits, causes of action, obligations, damages, penalties, and liabilities of any kind (including negligence), that arise, result from or relate to your stay at the Property, including your or your guests’ access to or use of Property or the Equipment, or your or their engagement in any of the Activities.
13. Assignment or Sublease: Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the Guest and included within the number of and as permitted occupants under this Agreement. Regardless of the duration of your stay at the Property, you acknowledge and understand that this Agreement memorializes a short-term nightly rental arrangement and does not constitute a lease (of any duration).
14. Violation of Agreement: If Guest(s) violates any of the conditions and obligations of this Agreement, Owner may terminate this Agreement and enter premises. Upon notice of termination of this Agreement, Guest(s) shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. Guest(s) shall vacate the Premises immediately and forfeit all monies and security deposits.
15. You acknowledge you are responsible and liable for all costs, fees, taxes, expenses and other charges incurred in connection with your short-term rental of the Property, including those items chargeable to your credit card as described above. You acknowledge you are also responsible and liable for other amounts described in this Agreement. You acknowledge that you remain responsible and liable for all such amounts not paid by your credit card company, and that the owner shall have all rights available at law and in equity to collect such amounts if you fail to pay. You agree to pay all such amounts owing immediately on demand, without setoff of any kind. Any amounts owing that remain unpaid after 30 days following demand will accrue interest at the rate of 1.5% per month or the maximum amount permitted under law, whichever is less. You also agree to pay all attorneys’ fees, costs, expenses and other charges incurred by owner, including costs of appeal, together with interest on any judgment or award, in collecting any amounts owed by you under this Agreement. You are the responsible renter of the Property and you agree to be an occupant of the Property for the entire duration of the rental. All other occupants are required to be family members, other responsible adults over 21, or persons 21 or under accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and omissions, and the actions and omissions of such other persons and any other guests or invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the terms of this Agreement. You acknowledge that you are solely responsible and liable for the safety and security of you and each other Occupant during your stay.
16. This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications hereof shall be void unless the same are in writing and signed by both the Guest and the Owner. This Agreement shall be governed by the laws of the State of Vermont. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together constitute one in the same instrument. Execution of a digital signature shall be deemed a valid signature. By accepting this Agreement electronically (for example, by clicking “I accept” or “I agree”), or booking or otherwise occupying, accessing or using the Property, you acknowledge that you have read and understood, and agree to be bound by, all terms, conditions, and policies in this Agreement.
