Rental Agreement Terms and ConditionsBy making a reservation, you are entering into a rental contract with Best Stay Ever Vacation Rentals LLC, and therefore, agree to and are bound by Best Stay Ever Vacation Rentals LLC’s Terms and Conditions:1. Reservation Acceptance and Payment• All reservations are confirmed when completed through the online reservation system, and the Terms and Conditions are electronically accepted. Payment of the initial sum of $350. 00 USD will further signify the full acceptance of the terms and conditions of this Rental Agreement. • The final payment is due 90 days before the arrival date. We do not auto-collect any rental payments unless other payment arrangements have been made. Best Stay Ever Vacation Rentals LLC will send reminder emails and requests for all reservation payments. It is the Guest’s responsibility to locate and open all correspondence. • The Guest making the reservation must be at least 25 years old, hold a major credit card, and must occupy the rental property for the entire term of the reservation. • If the reservation is made less than 45 days prior to the scheduled arrival, a 20% deposit may be required. See Section 10 for all other requirements. 2. Check-In Documentation• Once the final payment is received and the rental agreement is signed and accepted, guests will receive their door code and arrival details via email. This information will be sent 72 hours and again 24 hours prior to arrival. • All arrival information, door access code, and the digital welcome book are available to the Guest in the Guest Pass Portal account. 3. Check-In and Check-Out• Check-in time is after 4:00 pm EST, and Check-out is before 10:00 am EST. • Early check-in or late check-out may be available for an additional fee. These options are only offered when there are no other guest arrivals or departures scheduled for the same day. Because of this, availability can only be confirmed within 24 hours of arrival. To request early check-in or late check-out, please contact Best Stay Ever Vacation Rentals LLC no earlier than 24 hours before your arrival. It is the guest’s responsibility to confirm availability at that time. • In the event a Guest fails to depart from the property before 10:00 am EST with no late check-out confirmed in writing and results in Best Stay Ever Vacation Rentals LLC being unable to clean and prepare the rental property for the next arriving guest that day, the departing guest agrees to pay damages and costs incurred by Best Stay Ever Vacation Rentals LLC; including but not limited to moving the incoming guest to another rental property. • All properties managed by Best Stay Ever Vacation Rentals LLC are equipped with electronic locks, allowing guests to check in anytime, 24/7, without the need to visit an office. 4. Reservation General Terms and ConditionsVACATION HOMES USE•AIR CONDITIONING: Guests are welcome to adjust the thermostats to their preferred comfort level. However, we recommend not setting the temperature below 72°F (22°C). Lowering the thermostat below this point will not cool the property faster and may cause the system to freeze due to Florida’s high temperatures. If the unit freezes, it must be turned off to defrost, during which time air conditioning will be unavailable. Guests will also be responsible for any technician call-out fees. Condensation on windows is a clear sign that the temperature is set too low and the system is at risk of freezing. •CARS: All guest vehicles are parked at the owner's risk. Best Stay Ever Vacation Rentals LLC is not liable for towing fees, theft, or any damages. Most properties have a limited number of parking spaces, and it is the Guests’ responsibility to ensure there is adequate parking for their group. If additional vehicles exceed the community’s standard allowance, prior written approval must be obtained from the Management Company. As a general guideline, townhomes typically allow 2 vehicles, and houses/villas allow 3. Please refer to the specific parking rules for your rental property. •DOORS AND WINDOWS: Please remember to keep all windows and doors closed whenever possible. This helps prevent bugs from entering and allows the air conditioning system to operate efficiently. The HVAC system is equipped with a “safe mode” feature. If any door or window is left open for more than 5 minutes, the system will automatically shut down to conserve energy. Once all openings are closed, the system will automatically resume normal heating or cooling. •EVENTS/PARTIES: The rental property may not be used for parties, events, or social/group gatherings. Only the individuals listed on the reservation’s guest list are permitted to stay at the property. Any guest found hosting an unauthorized event or exceeding the approved number of occupants will be required to vacate the propertyimmediately, without a refund. Additionally, if it is determined in advance that a guest intends to host a party or gathering, Best Stay Ever Vacation Rentals LLC reserves the right to cancel the reservation at its discretion, with or without compensation. •GUEST LIST: Only individuals listed on the reservation’s guest list are permitted to stay at the property. Best Stay Ever Vacation Rentals LLC reserves the right to immediately cancel the reservation without refund if additional guests are added without prior written approval. •HOA RULES AND REGULATIONS: Guests are required to comply with all rules and regulations set forth by the community and Homeowners Association (HOA) where the property is located. Guests are fully responsible for any violations, including but not limited to parking infractions, improper trash disposal, noise disturbances (such as loud gatherings or parties), and other infractions as defined by the HOA. A copy of the community’s covenants, conditions, restrictions, and easements is available upon request. Please note that fines for violations vary by resort community and can range from $100 to $3,000 per incident. •IMPROPER USE: The use or possession of illegal drugs in or near theproperty is strictly prohibited. Guests may not use the property for any unlawful or inappropriate purposes. Any guest found violating local laws or ordinances will have their stay immediately terminated without refund. •LOCKS: No locks may be adjusted, tampered with, broken, changed, or added to in any way. •NEIGHBORS: Best Stay Ever Vacation Rentals LLC may not manage adjoining properties. If a neighboring property is breaking the quiet hours rules, please contact the neighborhood's security or the non-emergency line at the county sheriff's office. •OCCUPANCY: In accordance with state law, occupancy must not exceed the limit posted for each rental property. This maximum does not include children under the age of three. Guests agree not to exceed the stated occupancy limit at any time. Best Stay Ever Vacation Rentals LLC reserves the right to cancel the reservation immediately, without refund, if the number of occupants exceeds the allowed maximum. •OUTSIDE COOKING EQUIPMENT OR EXTRA APPLIANCES: Personal appliances such as grills, ovens, refrigerators, and freezers are not permitted to be brought into the home. These items may cause damage or create electrical issues, as the property is not designed to support additional equipment beyond what is provided. •OWNERS’ PERSONAL AREAS: The Owner may keep locked areas within the property, such as closets, safes, or garages, for personal belongings. These areas are not for guest use and will remain inaccessible during your stay. •PURPOSE OF HOME: All Best Stay Ever Vacation Rentals LLC properties are intended solely for vacation purposes. Guests may not register or operate any business from the rental homes, whether permanently or temporarily. •QUIET HOURS: Quiet hours are strictly 10:00 PM Eastern Standard Time to8:00 AM Eastern Standard Time. Guests who do not comply and disrupt the peace and quiet will be required to vacate the property without a refund. •RENTAL PERIOD: The rental period starts and ends on the dates specified in the reservation. Failure to adhere to these dates will result in the reservation being voided and all payments forfeited. •RULES AND LAWS: Guests are required to comply with all state, city, county, and community parking regulations. Please observe all posted street signs, especially regarding parking restrictions, as some communities prohibit overnight street parking or mandate parking on specific sides of the street. •RV/CAMPERS/TRAILERS/TENTS: RVs, campers, trailers, and tents are not allowed on or near the property, as set by the rules of the individual community. •SUBLET: This Rental Agreement may not be assigned or the property sublet. •TRANSIENT OCCUPANT: Guests agree that they are transient occupants, not tenants. •VACANT LAND AND PROPERTIES: Guests are not permitted to use vacant lots or neighboring homes for any purpose, including parking. The resort HOA may require immediate removal of any guests found utilizing adjacent properties not owned by the homeowner. •VIDEO RECORDING/FILMING: Amateur or professional video recordings on the property are prohibited without prior written approval from Best Stay Ever Vacation Rentals LLC. POOL / SPA USEPOOL/SPA HEATING OPTION: Pool heating is an optional amenity available for an additional daily fee, unless included in your reservation. The cost varies depending on the property. Pool heat must be purchased for the entire length of your stay. When requested, the pool heater is activated 24 hours before your check-in and operates for approximately eight hours each day during your stay. •POOL AND SPA GENERAL OPERATION: When the system is set to spa mode, it automatically adjusts the valves to prioritize the spa jets. This bypasses the pool, so only the spa heats, reaching temperatures between 100–102°F. If left in spa mode for an extended time, the pool temperature will gradually drop until spa mode is turned off. •POOL PUMPS: The pool and spa pumps are controlled remotely off-site and are programmed to turn on in the morning and off in the evening. This schedule manages the flow of pool heating as well as any decorative water features, including spa spillovers and fountains. •POOL HEATER OPERATION: Pool heaters are remotely controlled from an off-site location and are programmed to operate from early morning until evening. While the pool heater is typically set to maintain temperatures between 86–88°F and the spa between 100–102°F, the actual water temperature cannot be guaranteed. Several factors influence the pool temperature, including ambient weather conditions, rainfall, water added during maintenance, and the number of pool users. During the coldest winter months, maintaining desired temperatures can be especially challenging. Although Florida has a tropical climate, cold fronts can cause overnight lows in the 30s and 40s for several days, significantly cooling the water. When outside temperatures fall below 55°F, electric heat pumps—commonly used for pool heating—become less effective and may be unable to maintain target temperatures. This limitation is due to natural conditions and is beyond the control of Best Stay Ever Vacation Rentals LLC. Cold weatheris not considered a mechanical failure, and no refunds will be issued for temperature fluctuations caused by weather. While we take all necessary steps to maintain the pool heater and ensure its proper function, we cannot guarantee that the system will consistently heat the water to a comfortable swimming temperature due to factors beyond our control. Despite these limitations, the owners and management will make every effort to provide pool heating when requested by the Guest. MACHINE RELIABILITY: Despite our routine maintenance, mechanical issues can occur. If the pool heater fails during your stay, every reasonable effort will be made to repair it promptly. However, neither the Owner nor Best Stay Ever Vacation Rentals LLC can be held responsible if heating cannot be restored quickly due to circumstances beyond their control. If timely repairs are not possible, a refund of the pool heat fee will be issued, prorated for the period the heater was inoperable. This refund will not include interest, additional compensation, or liability for any other loss. IMPORTANT NOTES: When the heater is active, the pool is maintained at a temperature between 86°F and 88°F, which is cooler than the average human body temperature of 98. 6°F. As a result, the water may feel cool upon entry, even when heated. Please note that the pool is not designed to reach bath-like temperatures. However, the spa can be heated to 100°F–102°F upon request. When the heating system is in use, it can heat either the pool or the spa, but not both simultaneously. Activating the spa redirects all heating capacity to the spa, allowing it to reach the higher target temperature. VISITS / HOME ENTRY / ACCESSVISITS TO THE HOME/NOTICE OF ENTRY: Best Stay Ever Vacation Rentals LLC will not enter the home without first notifying the Guest. While we make every effort to avoid entering occupied properties during your stay, entry may be necessary under certain circumstances. The Guest acknowledges and agrees that Best Stay Ever Vacation Rentals LLC and/or its authorized representatives may access the property as reasonably required for purposes such as maintenance, repairs, inspections, protection, emergency situations, or to show the home to prospective buyers. Notice will be provided in advance whenever possible, with the timing and method of notice determined at the sole discretion of Best Stay Ever Vacation Rentals LLC. SMART HOME TECHNOLOGY: To help ensure a safe, comfortable, and seamless experience, the property may be equipped with smart home technology. These proactive systems are designed to prevent issues before they arise and enhance your stay. Devices may include remotely monitored features such as cameras, thermostats, digital door locks, alarm systems, pool heater controls, and other similar technologies. -Alarm Systems: The vacation rental may be equipped with a security alarm system. While its use is optional, guests are encouraged to activate it during their stay for added peace of mind. A code to arm and disarm the system will be provided upon check-in. The alarm system is monitored 24/7 by Best Stay Ever and an off-site security service. -Mobile Device Sensors: The property may be equipped with sensors that detect the total number of mobile devices present at any given time. These sensors help ensure guest safety and compliance with occupancy limits. No personal information or data about individual devices is collected or shared. These devices are privacy-compliant and do not record conversations, voices, or collect any biometric data. For more information, please visit: Cameras: For security purposes, similar to standard hotel practices, exterior surveillance devices, such as security cameras and smart doorbells, may be installed at the rental property. These devices record and are monitored 24/7 by an off-site service. Coverage typically includes the front door, driveway, and occasionally the sides of the home. There are no cameras inside the home or in pool areas, in full respect of guest privacy. Additionally, the community may have its own surveillance cameras in place at entrances, clubhouses, pools, gates, and other common areas for added security. 5. Provided Supplies and Amenities• Each rental property is fully equipped. The kitchen includes a refrigerator, freezer, oven, range, microwave, dishwasher, toaster, coffee maker, blender, cookware, dishes, glassware, and utensils. You’ll also find a full-size washer and dryer, an iron, and an ironing board in the home. All properties are stocked with bed linens and bath towels to ensure a comfortable stay. • While Best Stay Ever Vacation Rentals LLC strives to ensure your stay is comfortable, please note that our properties are self-catering accommodations. A complimentary starter supply of essential items is provided, including hand soap, dish soap, one roll of paper towels, one roll of toilet paper per bathroom, a few laundry and dishwasher pods, and a trash bag for all tall bins. Once these initial supplies are used, it is the Guest's responsibility to restock items as needed for the remainder of the stay. • Best Stay Ever Vacation Rentals LLC is an independent property management company representing privately owned homes within resort communities. As such, we cannot guarantee access to resort amenities such as (but not limited to) swimming pools, golf courses, fitness centers, tennis courts, restaurants, and similar facilities. Guests acknowledge that Best Stay Ever Vacation Rentals LLC is not liable for any restricted or unavailable access to these amenities dueto maintenance, resort policies, or other circumstances beyond our control. 6. Cancellation PolicyAll reservations made with Best Stay Ever Vacation Rentals LLC. are subject to the cancellation terms below:REASONS TO CANCEL: The Guest may cancel the reservation for any reason. CANCEL 60 DAYS OR MORE BEFORE ARRIVAL DATE: A 100% refund of the full rental amount will be issued, less fees incurred by Best Stay Ever Vacation Rentals LLC and/or the Owner. CANCEL 60 DAYS OR LESS BEFORE ARRIVAL DATE: If a Guest cancels and forfeits the full rental amount, they may request to apply the forfeited funds toward a future stay. This credit can be used for any available dates at the same property, subject to availability. Guests acknowledge that nightly rates may differ from the original booking and agree to pay any additional costs associated with the new reservation. Please note:• No specific replacement dates can be guaranteed, as calendars are open and booking up to three (3) years in advance. • The credit option is offered once per original reservation and cannot be extended or reissued. • Credits must be used within three years of the original travel date; unused funds beyond this period will be forfeited. If, during the three-year period, the property is sold or is no longer managed by Best Stay Ever Vacation Rentals LLC, the Guest will be offered an alternative home within our portfolio. The guest will be responsible for any rate differences,and no refunds or credits will be issued if the guest chooses not to rebook. CANCEL AFTER ARRIVAL / MID-STAY CANCELLATION: If the length of stay is reduced for any reason from the original dates after the Guest has checked in, no refund or future travel credits will be provided. CANCEL DUE TO NON-PAYMENT: Failure to pay the remaining balance by the due date will result in cancellation of the reservation and forfeiture of all funds paid to date. CANCEL BY OWNER / MANAGEMENT: In the rare event that the property owners or Best Stay Ever Vacation Rentals LLC must cancel a confirmed reservation, we will make every effort to find a suitable alternative property, subject to mutual agreement. If no alternative can be arranged, all funds paid will be refunded in full. Please note that refunds will be issued without interest, compensation, or liability for any additional losses. Neither the property owners nor Best Stay Ever Vacation Rentals LLC can be held responsible for circumstances requiring such cancellation, and no further compensation will be provided. Best Stay Ever Vacation Rentals LLC reserves the right to cancel any reservation resulting from errors, omissions, or unforeseen circumstances. This includes, but is not limited to, inaccuracies in pricing, availability, or property details, whether communicated verbally, in writing, or displayed on our website. OTHER CANCELLATIONS: In the event that a cancellation or change to the booking becomes necessary due to extraordinary circumstances beyond the reasonable control of the Guest, the Property Owners, or Best Stay Ever Vacation Rentals LLC—such as war or threat of war, civil unrest, terrorist activity, labor disputes, natural disasters, fire, flood, nuclear incidents, global health emergencies (e. g. , COVID-19), government-imposed travel bans, or any similarly significant and unforeseen event, the Guest may cancel the reservation at any time prior to check-in and request a refund. • If such a cancellation occurs within 60 days of arrival and travel is officially restricted or prohibited due to one of the listed events, a full refund will be issued, minus the booking fee, pending written approval from the property owner. GENERAL CANCELLATION INFORMATION:• All cancellations must be received and confirmed in writing. • Neither the property owners nor Best Stay Ever Vacation Rentals LLC can be held responsible for, nor will they provide refunds due to, common travel issues, such as airport closures, flight delays, missed connections, transportation disruptions, schedule changes, or cancellations by carriers, whether commercial or chartered. • Guests are booking a specific property for a specific set of dates. Changes to either the property or the reservation dates are not permitted and will be treated as a cancellation of the original booking. In such cases, the standard cancellation policy will apply. • Guests acknowledge that the “fees” associated with a reservation may include, but are not limited to, costs related to credit card processing, currency exchange, third-party booking commissions, and money transfer services. These transactional fees typically total around 6%, with approximately 3% incurred at the time of payment and 3% for any applicable refunds. • Best Stay Ever Vacation Rentals LLC advertises and manages rental properties both directly and through local partners and third-party booking platforms. This Cancellation Policy applies to any reservation booked through Best Stay Ever Vacation Rentals LLC or where Best Stay Ever Vacation Rentals LLC is listed as the merchant of record (such as on booking websites like VRBO). • Best Stay Ever Vacation Rentals LLC regrets that it cannot waive any of the cancellation fees outlined above, regardless of the circumstances. We strongly recommend purchasing travel insurance to protect your Florida vacation against unexpected cancellations or interruptions. 7. Hurricane Policy• Due to our generous cancellation policy, Best Stay Ever Vacation Rentals LLC does not offer a specific refund for cancellations resulting from hurricane activity. The Guest is also encouraged to review Section 6 of this Agreement for available cancellation options. The peak season for tropical activity is August through October. If Guests are concerned about possible interruptions, cancellations, or delays due to tropical occurrences, they are strongly encouraged to purchase optional trip insurance at the time of booking or within 14 days of booking. (See Section 20 of this agreement, "Optional Travel Insurance")• In the event of a hurricane watch or warning, Best Stay Ever Vacation Rentals LLC may need to prepare the homes, whether occupied or unoccupied, for the safety of both guests and the homes. This includes but is not limited to moving outdoor furniture and décor indoors. Best Stay Ever Vacation Rentals LLC will make every effort to ensure prior communication of such activity and minimize inconvenience to the Guest. 8. Arrival Inspection and Pre-Existing Damage Report• The Management Company inspects the property for damages/issues before Guest arrival, but sometimes things can happen before check-in. In the event of this unlikely occurrence, the Guest agrees to notify Best Stay Ever Vacation Rentals LLC immediately. Also, during the stay, Best Stay Ever wants to ensure everything is perfect, so notify us of any issues that may require attention during your visit. • THE BEST RULE TO FOLLOW: If you would consider calling the management company about something after you check out, or if it would cause you to rate us less than five stars, do not wait! Notify us immediately, as we want your stay to be nothing less than amazing. • The Guest must notify Best Stay Ever Vacation Rentals LLC within three (3) hours of arrival if there is any existing damage or notable conditions. • The Guest is responsible for the cost of any damages sustained to the property, décor, or its contents during the stay, including the moving of items to another property. • In general, a property's nightly rate reflects its age, condition, and overall condition. Homes with lower rental rates are often older and may feature furnishings and contents that show typical signs of wear and use. Additionally, older properties may be more prone to mechanical issues involving appliances, air conditioning, or pool heating systems due to the age of the equipment. In the event of a mechanical issue, we will make every reasonable effort to repair or replace the affected item as quickly as possible to minimize any inconvenience. 9. Accidental Damage Protection (ADP)• The Accidental Damage Protection fee for each reservation is non-refundable and will cover reported accidental or inadvertent damages. Any damage must be reported immediately by email to Best Stay Ever Vacation Rentals LLC within 24 hours. • Accidental Damage Protection will be void after departure; any unreported damage discovered by Best Stay Ever Vacation Rentals LLC will be the sole responsibility of the guest who caused it. • The value of the damage protection is up to $1,000 for condominiums and townhomes, and $1,500 for homes. • The Accidental Damage Protection (ADP) plan covers damage to furnishings and soft goods only. It does not cover damage caused by animals, intentional acts, theft, gross negligence, structural damage, or damage to fixtures (such as chandeliers, cabinets, or large appliances). Any such damage will result in additional charges to the Guest. This plan is offered and administered by Best Stay Ever Vacation Rentals LLC and is not an insurance policy. 10. Last Minute ReservationsID VERIFICATION AND CHECK-IN POLICYReservations made within 30 days of arrival are subject to an ID verification process. The following nine (9) items are required before access to the home. Failure to complete any of these requirements will result in cancellation of the reservation and applicable penalties. Please note that these precautions may also be requestedfor any reservation, regardless of the booking date. 1. In-Person Check-In: Guests must meet a representative from Best Stay Ever Vacation Rentals LLC for an in-person check-in at the vacation rental property during office hours, unless otherwise arranged and confirmed in writing. 2. Valid Photo ID: A valid driver’s license or passport must be presented. 3. Age Requirement: The guest making the reservation must be at least 25 years of age and must occupy the property for the full duration of the stay. 4. Matching Reservation and Payment Information: The reservation must be made in the same name as the credit or debit card used for payment. 5. Card Presentation: The credit or debit card used for payment must be presented at check-in. 6. No Prepaid Cards: Prepaid credit cards are not accepted. 7. Proof of Address: A current utility bill or similar document showing the billing address associated with the credit card must be presented. 8. Document Consistency: The name on all documents, including the reservation, photo ID, credit/debit card, and billing statement, must match the Lead Guest responsible for the reservation and payment. 9. Email Address Requirement: We do not accept reservations made using email addresses that are less than four (4) months old. 11. Security Deposits• Traditional damage deposits are not required for most reservations. However, for certain reservations, a security deposit may be requested to cover potential loss or damage to the property and its contents. This deposit may be requested after the reservation is confirmed. The Management Company reserves the right to determine if a security deposit is necessary and will contact the guest directly if one is required. • If there is no damage or breakage, any collected security deposit will be fully refunded to your credit card. Guests can expect to receive a refund within two weeks of vacating the home. • Failure to pay the requested security deposit will result in the cancellation of the reservation. 12. Additional Damages• Should the Guest experience any new issues with the rental property during their stay, the Guest must contact Best Stay Ever Vacation Rentals LLC in writing, who will make efforts to rectify the matter. • No action can be taken, or liability accepted for any complaints received after checkout. 13. Departure Cleaning• All Best Stay Ever Vacation Rentals LLC rental properties require a one-time departure cleaning. The cost of this cleaning varies and is paid for by the Guest. The cleaning fee is non-refundable. • During the stay and at departure, the guest must properly bag all garbage and place it in the proper receptacles. The type of receptacles, collection days, and further procedures will be provided during arrival and in the Guest Pass Portal. The Guest understands that any garbage left in the home after departure will be subject to a removal fee. 14. Smoking• All properties are strictly non-smoking. Failure to comply with this will result in the removal of the Guest from the property, without recompense or refund. The Guest understands this will include the loss of the security deposit and/or a charge to the Guest's credit card to cover the cleaning costs. The minimum fine for smoking is $500. Smoking is permitted outside of the property while all doors and windows are closed. • Smoke detectors should never be tampered with or removed. The units do report back to our offices and must remain operational at all times. If the smoke detectors are tampered with, it will result in the immediate removal of the Guest from the property, without recompense or refund. 15. Service Animals and Emotional Support Animals• Certified and properly registered service animals are always welcome. It is not required, but it is helpful if Best Stay Ever Vacation Rentals LLC is notified of a service animal in advance of check-in. • Emotional support animals are not classified as trained service animals in Florida and are welcome; however, they may be subject to an “animal reconditioning fee” that is charged at booking. Permission must be granted in writing from Best Stay Ever Vacation Rentals LLC to bring an emotional support animal. • Guests with service animals or emotional support animals are responsible for any damages caused by the animal during their stay. The ADP Fee does not cover any damages caused by such animals. (See Section 8)16. Pets• Pets are not permitted on the property. Violation of this policy will result in immediate removal from the property without refund or compensation. Additionally, the guest will forfeit the security deposit or be charged a minimum fee of $500 to cover deep cleaning costs. If no security deposit is on file, the charge will be applied to the guest’s credit card. 17. General Safety• Best Stay Ever Vacation Rentals LLC assumes no responsibility for the personal safety of guests during their stay. Guests are advised to exercise caution for their own safety and that of their companions. Use of the home’s pool/spa, game rooms, VR studios, and all community amenities, including, but not limited to, pools, waterparks, basketball courts, tennis courts, recreation areas, and fitness centers, is at the guest’s own risk. Children must be closely supervised at all times, especially in and around pool areas. • Pools and spas are used at the Guests' own risk. • Guests under 18 years of age must be accompanied by an adult at all times when using the pools. • For the safety of children, doors providing direct access to the pool may be equipped with alarms. Tampering with or disabling these devices is a criminal offense. In accordance with Chapter 515. 33 of the Residential Swimming Pool Safety Act, tampering with or disconnecting pool alarms constitutes a second-degree misdemeanor, punishable by a fine of up to $5,000 or up to one (1) year in jail. Do not tamper with pool alarms. A minimum charge of $250 per alarm will apply for repair or replacement if tampering occurs. Some properties may not have these alarms and instead feature a pool safety fence around the pool area. • The pool safety fence must be used at all times. This fence must always remain in place and unaltered during the guest’s stay. DANGER: If the safety fence is removed, the guest assumes full responsibility for all use of the pool and spa. • The Guest further agrees that an adult will be responsible for closing pool fences and gates after entering the pool area, and will never leave this responsibility to children. • Spa/Hot Tub Rules - Maximum use of 20 minutes. Pregnant women, small children, people with health problems, and people using alcohol, narcotics, or other drugs that cause drowsiness should not use the spa without first consulting a doctor. • Games, toys, and baby furniture/equipment are used at the Guest's own risk. Children must be supervised at all times. • Children under 18 years old should not be allowed to use features intended for adults, such as gyms, saunas, spas, etc. , where they could potentially injure themselves. Children should also not be allowed to use items intended for adults, such as the billiard table or other items that could potentially cause damage or harm. It is the Guest's responsibility to always supervise children. • If the Owner has provided a complimentary barbecue grill free of charge, or a barbecue grill has been rented from any party, be aware that it is being used at the Guest's own risk. Guests will be held responsible for any damage caused by the use or misuse of the grill. Only use the grill in open, outdoor areas. The grill must not be used in any enclosed, screened, or covered areas. Best Stay Ever Vacation Rentals LLC and/or the Owner do not accept liability for equipment failure. It is the Guest's responsibility to clean and maintain the grill and replenish propane as required. There will be a minimum cleaning charge of $50 if the complimentary grill provided needs professional cleaning to enable use by the next guest. • If the Guest ever feels they may be in a life-threatening situation for any reason, they are urged to call 9-1-1 immediately before calling Best Stay Ever Vacation Rentals LLC. 18. Allergens• Best Stay Ever Vacation Rentals LLC cannot guarantee an allergen-free property. • Peanut Allergy Warning: Because it is nearly impossible for persons who have an allergy to peanut dust to avoid triggering a reaction if peanut dust is in the air, Best Stay Ever Vacation Rentals LLC cannot prevent previous guests from bringing peanuts or products containing peanuts into properties. In addition, Best Stay Ever Vacation Rentals LLC cannot give assurances that remnants of peanuts and/or peanut dust/oil will not remain anywhere in the property. • Best Stay Ever Vacation Rentals LLC cannot guarantee that a property will be free of other allergens, such as perfumes, lotions, cleaning solutions, etc. • Guests are not permitted to bring pesticides, bleach, sanitizers, candles, or air fresheners onto the property. 19. Insects and Wildlife• Guests are reminded that Florida has a tropical climate and is, therefore, home to many insects and other wildlife. Homes are professionally treated regularly to repel such unwanted visitors, but inevitably, they will occasionally find their way into the property. The problem can be greatly reduced if doors and windows are not left open, and if food and crumbs are not left on countertops, tables, floors, or in the pool area, and if spills are cleaned up immediately. Guests are always welcome to request pest control services during their stay should a situation arise. • Best Stay Ever Vacation Rentals LLC’s preventative efforts cannot guarantee that guests will not encounter wildlife, bugs, insects, or pests of all types. Guests agree that Best Stay Ever Vacation Rentals LLC shall not be held accountable or liable for any issues arising from the above, whether occurring within or outside the rental home. • Every property is inspected to ensure that it is free from pests. If pests are ever suspected, the Guest should immediately contact Best Stay Ever Vacation Rentals LLC, who will contact a third-party pest control company for further inspection and treatment if deemed necessary. • Florida wildlife may pose a danger. Approach all outdoor areas with caution. • Never feed or approach wildlife. All pictures must be taken from a safe distance. Common Central Florida wildlife includes, but is not limited to, alligators, snakes, raccoons, foxes, sandhill cranes, etc. It is very dangerous to allow these animals, and many others, to become accustomed to receiving food from humans, as it may result in future attacks. - Feeding alligators in Florida is illegal. Florida Statute 372. 667- Feeding raccoon, fox, and Sandhill Crane is illegal. Florida Statute 68A-4. 00120. Personal Items Left Behind• If a Guest leaves a personal item behind in the rental property, Best Stay Ever Vacation Rentals LLC will do its best to locate it; however, the Owner and the Management Company are not responsible for any losses. If the item is found, the Guest will be responsible for arranging collection, shipment, delivery, and any other costs incurred. Any unclaimed items may be donated to charity or disposed of after 30 days. 21. Optional Travel Insurance• Travel Insurance is offered through a third-party provider. The cost and coverage of the travel insurance are subject to the terms and conditions of the third-party company. • Best Stay Ever Vacation Rentals LLC highly recommends that guests purchase trip insurance at the time of booking or within 14 days of booking, if they are concerned about possible interruption or cancellation of the trip. Force Majeure• In rare cases beyond the control of Best Stay Ever Vacation Rentals LLC, the reserved property may become unavailable. Such circumstances may include, but are not limited to, property damage, sale of the property, utility failures, fire, or any other condition that renders the home uninhabitable or potentially unsafe. • In the event of a Force Majeure, Best Stay Ever Vacation Rentals LLC will make every effort to offer alternative accommodations of comparable quality. If a suitable alternative cannot be found, or if the guest does not accept the offered replacement, all money paid will be refunded, minus the cost of any nights already stayed. If the guest accepts the alternative accommodation, they agree to return to the original property once it is deemed available by Best Stay Ever Vacation Rentals LLC. This constitutes the full extent of the company’s liability, and no additional compensation or costs will be covered. 23. Errors and Omissions / Marketing / Website• All descriptions on the websites and booking channels are made in good faith, and Best Stay Ever Vacation Rental LLC accepts no liability whatsoever for errors or omissions. 24. Limitation of Liability• Best Stay Ever Vacation Rentals LLC and/or the owner do not accept liability for equipment failure and/or services in the rental property. In the event of equipment failure, the guest must notify Best Stay Ever Vacation RentalsLLC within one working day so that Best Stay Ever Vacation Rentals LLC may elect to rectify the failure. • Best Stay Ever Vacation Rentals LLC. and the Owner do not accept liability for lost or stolen personal property of the Guest from the rental property during the rental period. If the guest's property is lost or stolen, they should first notify the appropriate authority and then contact Best Stay Ever Vacation Rentals LLC to report the loss or theft. • Best Stay Ever Vacation Rentals LLC. and the Owner do not accept liability for personal loss or injury to the Guest during the rental period. • Best Stay Ever Vacation Rentals LLC and the Owner do not accept liability for restricted or no access to resort amenities during the rental period. • The guests understand that there is NO lifeguard on duty, and it is a major condition of this reservation that the use of the rental property and pool is entirely at the Guests’ risk. Diving, horseplay, or running around the pool area is prohibited; no child in the party or adult non-swimmer will use the pool without adequate adult supervision by a strong swimmer. The guest must immediately report any problems with the pool alarms or pool safety fencing. • All Guests understand and agree that neither the Owner nor the Property Manager nor the management company representatives can accept any responsibility whatsoever in the event of an accident or illness while on the property. • Best Stay Ever Vacation Rentals LLC does not accept liability for acts of violence, natural disasters, fire, flood, war, civil disobedience, riots, or other force majeure events that may have a deleterious effect on the Guest. • Best Stay Ever Vacation Rentals LLC. cannot accept any liability for the failure of public supplies such as water, electricity, or gas supplies. Nor for the consequences of the actions or omissions of persons who may supply or control main services, or any action taken in the vicinity of the property reserved by any authority or persons over which Best Stay Ever Vacation Rentals LLC has no control. Best Stay Ever Vacation Rentals LLC. cannot accept any liability for the air conditioning system, telephone, cable, internet, pool heater, or any household appliance breaking down. Urgent steps will be taken to hire a local repair service to rectify any problem. • Best Stay Ever Vacation Rentals LLC accepts no responsibility or liability for any loss, damage, or alteration in the terms of a reservation caused by events beyond Best Stay Ever Vacation Rentals LLC, control, including, but not restricted to war, terrorist activity, civil commotion, flight delays, or cancellations airport closure, adverse weather conditions, fire, flood or industrial dispute. No credit will be given for shortened stays resulting from late arrival or early departure for any reason, nor will credit be given for cancellations due to weather conditions. • Any disputes arising from this agreement shall be resolved exclusively through binding arbitration, conducted in accordance with the rules of the American Arbitration Association for commercial disputes. Arbitration will take place in Osceola County, Florida, and will be governed by the laws of the State of Florida. Each party is responsible for its own attorney’s fees and legal costs. The State of Florida shall retain exclusive personal and in rem jurisdiction over any such disputes. • Jury and Class Action Lawsuits. The parties waive their rights to jury trials and class action suits. • By renting a vacation home, you voluntarily assume all risks related to exposure to allergens and viruses. 25. Legal Terms• Arbitration. Any controversy or claim directly or indirectly connected to this contract, including, but not limited to, credit card dispute process and civil litigation, shall be settled by arbitration and shall be administered by the American Arbitration Association with one Arbitrator in Osceola County, FL. Judgment on the award rendered by the arbitrator may be entered in any court with jurisdiction. Parties agree this clause provides a reasonable alternative to civil litigation and credit card disputes because it is mutually agreed to and administered by a neutral party. • Assignment. Any attempted assignment, delegation, or sublease of this Agreement is invalid. • Chargebacks. Guest waives any right to dispute a credit or debit charge, request or demand a chargeback, or dispute that a detailed item description was provided, contact information was clearly and prominently displayed, and grievance policy instructions were provided. • Conflict of Terms. In the event of any material conflict between the terms of this Agreement and any other agreement, the terms of this Agreement shall control. • Data Usage. Guest consents to the use by Management Company of its data, as subject to governing law. • Discretion. The Management Company has sole discretion in determining whether a breach has occurred or what remedy to apply, subject to good faith and adherence to usual and customary practices in the vacation home market. • Entirety. This agreement constitutes the entire understanding between the parties and supersedes all prior negotiations, agreements, and any implied terms under the Uniform Commercial Code (UCC). • Headings. Headings are provided solely for convenience and do not constitute part of the agreement, nor do they affect its interpretation. • Hold Harmless and Defend. The Guest agrees to hold harmless and defend the Management Company and its agents against any third-party complaints. • Indemnity. Guest agrees to indemnify Mgt. Co. for the reasonable cost to defend and any payments made to settle any third-party claims, including those made by members of the Guest’s party and invitees and licensees of the Guest on the Property. • Interpretation. This agreement shall not be construed in favor of the non-drafting party. • Liquidated Damages. The parties agree that the liquidated damages in this agreement constitute non-punitive and difficult-to-forecast damages. • Litigation Terms. For litigation between the parties not subject to the arbitration clause, the Ninth Judicial Circuit of Florida shall be the exclusive forum for any claims related to this agreement, unless there exists exclusive Federal jurisdiction, in which case it shall be the U. S. District Court for the Southern District of Florida. Claims shall be governed by the laws of Florida to the exclusion of all other laws, conflict of law principles, and legal theories. The parties waive their rights to a jury trial. The prevailing party shall be entitled to reasonable attorneys’ fees and costs from the non-prevailing party for defending chargeback demands, public, social media, Better Business Bureau, administrative, or other complaints and litigation arising out of this agreement or otherwise. • Modification. Only Best Stay Ever Vacation Rentals LLC has the authority to modify this Agreement, which must be in writing. • Performance. Management Company is excused from performance when made impracticable by the occurrence of a contingency, the non-occurrence of which was a basic assumption on which the contract was made. • Reliance. Guest acknowledges that he/she/it has not relied upon any current or prior representations or understandings and waives any related rights or claims. • Remedies. The exclusive remedy for breach of this contract is limited to actual financial losses, as governed in this agreement, and includes reasonable attorneys’ fees and costs, which are agreed to be an adequate remedy. Regardless of the failure of the exclusive remedy, the Management Company will not be liable for consequential damages. • Severability. If any provision of this Agreement is invalid or unenforceable under governing law, it shall, to the extent possible, be construed or applied in such a manner as will permit enforcement; otherwise, this Agreement shall be construed as if that provision had never existed. • Third-Party Beneficiaries. No party has third-party beneficiary rights under this agreement, as any benefits received are merely incidental. • Waiver. No breach of this Agreement will be waived without the express written consent of the Party not in breach. • Warranties. No warranties exist unless expressly stated herein. By making a reservation, you are entering into a rental contract with Best Stay Ever Vacation Rentals LLC. , and therefore, agree to and are bound by Best Stay Ever Vacation Rentals LLC Terms and Conditions above.
