Vacation Rental Terms and Conditions

A completed “Vacation Rental Terms and Conditions” is required within 24-hours to hold your reservation. The Rental Deposit is due upon receipt. Review and acceptance of the Vacation Rental Terms and Conditions is required before a confirmation will be issued.
This agreement serves as a contract between a Guest renting a vacation property (Guest), and NSB Realty Team, Inc(Manager). Please review the terms and conditions relating to your reservation. By remitting your payment you acknowledge, agree and accept all rental terms and conditions contained herein of NSB Realty Team, Inc.
Check in is at 4pm on your date of arrival and Checkout is at 10am on your date of departure unless other arrangements have been made with the Manager.
Payments shall be made by credit card. We are no longer accepting paper checks. Please reference your booking confirmation email at the above referenced confirmation number for balance details.
The final balance is due 90 days prior to arrival or in accordance with your booking Channel(for example: VRBO/AIRBNB/TRIPADVISOR etc).
If payment is not received by the due date, the Manager has the right to cancel the reservation.
DAMAGE PROTECTION:
A damage protection policy covering $1500 is required to book this property.
Upon check-in, please report any damage to your unit to the Manager.
By signing this Agreement, you hereby authorize the Manager to charge the credit card/bank account on file for the cost of repairs, replacement, services, telephone charges or extra cleaning for all damage, breakage and/or loss incurred during his/her stay. In the event of damage to the Property, including but not limited to: its equipment, furniture, or flooring, you shall be responsible for all damage costs exceeding the damage policy, including any collection costs and attorneys’ fees. Documentation detailing damages and charges will be provided to you. We will only charge additional charges for unreturned keys, loss or damage to the rental property, number of guests exceeds that which is listed on the rental contract, excessive cleaning/laundry or rearranging furniture that has been moved, replacement of missing items from unit (including beach towels), soiling of towels, linens and carpets, costs of cleaning beyond the normal out clean fee, misuse of items belonging to the property and unauthorized extension of lease term.
OTHER FEES:
Some units have cameras in common areas which are here to protect and enforce. If there are gates, please keep all gates shut and locked at all times.
Each unit receives two sets of keys.
Lock out service is not provided after office hours, M-F 9am-5pm. If you lose one of the following items, a lost item charge shall be made as follows:
Property/Unit key: $50
Pool Gate key: $50
CANCELLATION/REFUNDS: All cancellations must be made in writing (email acceptable). The $600 deposit is non-refundable. For cancellations less than 90 days prior to your arrival, total rental rate is forfeited. Travel insurance is available through Rental Guardian at the following website. The Manager unilaterally and at its sole discretion reserves the right to change or cancel your accommodation. In the event this property becomes unavailable for rent, the Manager agrees to use best efforts to secure an equivalent rental property. If this is not possible, the Manager reserves the right to cancel this reservation and return all monies to Guest(s).
MINIMUM AGE: Guests must be 25 years of age to reserve any of our properties and check-in.
TRASH: Guests are responsible for removing trash from the property. A $50 fee will be charged if more than 2 bags of trash remain after departure.
PETS: You must have expressed permission from management to have a pet on premises. There is an additional pet fee determined by the Manager. For units in a complex(non-single family units), you must keep your pet leashed and accompanied while on common property and always pick up after your pet. The Manager reserves the right to terminate the lease without warning if animals are disruptive and/or disturbing to other tenants at the Manager's sole discretion. Animals may not be tied up or "staked" in the yard. Guest is responsible for any/all damages caused by animals they bring to a unit.
EMERGENCIES/MAINTENANCE: For EMERGENCIES dial 911. Please contact NSB Realty Team, Inc should a problem arise with Property.
SMOKING: Smoking is strictly prohibited. No smoking in the unit or anywhere on premises. No smoking is allowed in units, hallways, balconies, patios, poolside, or by the grills. There are absolutely no exceptions. If there is evidence of smoking in the unit, you will be charged a $500 fee and asked to vacate the Property immediately. The Guest will be held financially responsible for any smoke related damage without limit and gives the Manager full authority to charge the credit card on file or bill the guest for all smoke related damages.
LAUNDRY: Please only leave a maximum of 2 loads of laundry for a two-bedroom unit, 3 loads for a 3-bedroom unit, and 4 loads for a 4-bedroom unit. Please wash and put away beach towels, if any. Additional loads of laundry over the maximum will be charged to the Guest at a rate of $20 per load and be charged either to your security deposit or to the credit card on file.
TURTLE SEASON: May 1st through October 31st of each year is turtle season. From Sunset to sunrise no lights are to be visible from the beach. In beachfront locations, please keep blinds closed after dark. Fines can be up to $500 per occurrence. Guests will be responsible for payment of any citations that occur from failure to comply with the restrictions.
PARKING: All parking is at your own risk. If you are at a private home, please park on designated driveways, and not on the grass. Many complexes require parking passes and any car in the lot; otherwise you are subject to be towed. If you are at a condominium complex and the office is closed upon your arrival, please secure a pass the next time they are open. Failure to obey posted parking restrictions may result in your vehicle being towed at your sole expense.
MAXIMUM OCCUPANCY: Each property has a maximum occupancy. Take note of the maximum occupancy allowed before making your reservation. This maximum occupancy includes all members in the party regardless of age and includes your registered guests. Maximum occupancy is dictated by our fire code and/or business licenses and is taken seriously. Exceeding maximum occupancy can result in eviction without refund. Use the unit as a place to live; you agree not to host an event, wedding, party or other gathering that exceeds the maximum occupancy displayed on the contract without prior written agreement with the Manager. If you have guests stay overnight with you, you must inform the Manager for approval. If you are going to be away from the unit for a duration of more than 3 nights, you must inform the Manager.
AMENITIES: All vacation rentals are individually owned. While amenities vary by unit, they all provide amenities to a minimum standard. If you would like a copy of the amenities list, the Manager will provide upon request. Basic starter supplies such as toilet paper/paper towels are usually provided, but not guaranteed. Grocery stores are very close if you need to get some immediately. Vacation rental units are fully furnished. Furniture is not to be moved, within or from the unit, nor shall you provide your own furniture. Plants must be in a vase. Potted plants are prohibited on site. Candles are prohibited on site.
POOL:
If you have a pool on property. Check with your check in instructions as to whether you need a gate key and for pool rules. Swimming in the pool(s) is at your own risk.
If you are at a private home, pool maintenance is provided on a weekly basis. Check with the manager’s representative as to the schedule.
Pool rules, if applicable, are incorporated into this Agreement. Guests and all members of your party including any visitors, acknowledge and agree to abide by these rules. Violating these rules may result in considerable fines and/or eviction. Any fine incurred due to the action(s) or inaction(s) of your or any of your party including your visitors, will be your responsibility and will be immediately charged to the credit card on file.
AIR CONDITIONING: It is common to want to welcome a sea breeze; however, the salt air is so corrosive we request that all doors and windows be kept closed while not in the property/unit. Also, please DO NOT turn the thermostat below 74 degrees. With our Florida humidity levels/heat it causes the system to freeze and makes the system unusable.
GRILLS: Please clean the grill after use to prevent grease fire. If the grill is propane and at a private home, gas is the Guest’s responsibility.
LOCAL ANIMALS: Naturally dwelling animals, reptiles and insects are different than might be encountered in an urban setting and some might be considered “pests” by some individuals, i.e., lizards, roaches, spiders, rodents, termites and mosquitoes. You should be prepared to accept such inconveniences or discomfort as a normal and necessary aspect of renting a home in this area.
COMMUNITY RULES AND REGULATIONS: If your rental is in a community with more than one unit, the Condominium’s/Association's/Property's rules are incorporated into this Agreement and are attached to this email. Guests and all members of your party including any visitors, acknowledge and agree to abide by these rules and regulations. Violating these rules and regulations may result in considerable fines and/or eviction. Any fine incurred due to the action(s) or inaction(s) of your or any of your party including your visitors, will be your responsibility and will be immediately charged to the credit card on file.
PROPERTY: Please help keep the landscape beautiful by keeping chairs/toys/towels off the grass and pick up any trash. Please do not leave anything in the hallways or common areas, if applicable. No games played on the grass. Grass is treated with pesticides.
DEPARTURE: Check-out is no later than 10 am on the day of your departure. Should you be planning to leave before 10 am, if you are able, please let us know so we can arrange for cleaning. You must leave unit on the date and time designated, unless prearranged, and any additional rent must be paid in advance.
Guests that stay longer than their pre arranged date and time designated for checkout and that do not arrange for such extended stay and pay in advance will incur costs associated with such extension including payment for lodging and damages to others that may result from the additional stay. Examples include payment for accommodations for others that were prearranged to stay, Agents’ fees for time seeking and acquiring such adequate alternate accommodations at an hourly rate of $35/hour.

UNIT ACCESS: Guest Agrees to allow THE MANAGER and/or assignees the right to enter due to the following:
To make necessary or agreed repairs.
To supply services agreed upon.
If unit is for sale or access is needed for other reasons, we will give you 24 hours advance notice to access the unit at reasonable hours.
In case of an emergency, we reserve the right to enter at any time for the purpose of safekeeping or prevention of further damage.
MANAGER RESPONSIBILITY:
We will give you the right to occupy your unit per your agreement. You have the right to occupy the Property and use all of the amenities in a community or condominium complex subject to the rules and regulations of the community or condominium complex.
We will provide and maintain appliances. We will not be liable for interruption of services that is beyond our control. We will also not be responsible for interruption electricity, water, or gas beyond our control. Please promptly notify NSB REALTY TEAM, INC. of any problems. You may not end this agreement because of these interruptions.
GUEST RESPONSIBILITY:
Guest is responsible for using their best efforts to familiarize themselves with property, its location, and surroundings.
Guest acknowledges this is a binding contract and cannot be released from the contractual obligations upon arrival.
Please obey all house rules posted in unit or otherwise provided.
Obey all local/state/federal laws. We receive the right to terminate the contract and keep all guest monies should Guest or other person on premises due to association with Guest contributes to events that require any police involvement.
MISCELLANEOUS:
Housekeeping services are available by request for additional fees.
This contract is binding.
Changes: The booking agent must be notified in writing of any changes as soon as possible for which there may be a service charge for each accepted change to the reservation.
Abandoned possessions: We will not be responsible for any of your personal effects left in the unit. We will be glad, if found, to mail them to you and charge you for postage
If we cooperate with another agency in securing the rental, THE MANAGER will not be held responsible for their course of actions
Unit may not be sublet or assigned without prior written consent of The Manager and/or Owner of the property
The Manager shall place all advance payments as necessary or required from Guest, including rent, security deposits and any other fees permitted by law, in an escrow account(s) and such advance payments may be placed in an interest-bearing account(s). Guest agrees that any such interest shall belong to the Manager or their agent and that Agent may remove such interest from account(s) at all times and with such frequency as is permitted under the terms of the account(s). This Manager may at times rent 5 or more dwelling units and Guest waives any requirement by Manager to post surety bonds or notify Guest of the manner in which the Manager is holding advance rents or security deposits, and the interest rate, if any. The Guest understands that he/she will not receive any interest on advance rents or security deposits held by the Manager.
In any lawsuit brought to enforce the Lease or under applicable law, the party in whose favor a judgement or decree has been rendered may recover its reasonable court costs, including attorneys’ fees, from the non-prevailing party. Guest shall hold Manager harmless against all expenses including attorney's fees and liabilities arising from a dispute or litigation with third parties involving the agreement, improvements, or occupancy of the premises. The place for filing any suites or other proceedings with respect to the Lease shall be the county in which the Premises is located.
DISCLAIMER: GUESTS FOR THEMSELVES AND THEIR RESPECTIVE HEIRS, PERSONAL REPRESENTATIVES, SUCCESSORS AND ASSIGNS, HEREBY RELEASE THE MANAGER, INC AND THEIR RESPECTIVE DIRECTORS, THE OWNER OF THE PROPERTY, OFFICERS, AGENTS, EMPLOYEES, SURETIES, INSURERS, INDEMNITOR, ATTORNEYS, SUCCESSORS AND ASSIGNS FROM ALL CLAIMS, DEMANDS, OR CAUSE OR THING WHATSOEVER RESULTING FROM OR IN CONNECTION WITH THE PROPERTY OF THIS RENTAL CONTRACT, INCLUDING WITHOUT LIMITATION ANY CLAIM, DEMAND OR CAUSE OF ACTION FOR PERSONAL INJURY OR DEATH AND ANY AND ALL LOSS, LIABILITY, COST AND EXPENSE RESULTING FROM ANY CLAIM, DEMAND, SUIT OR CAUSE OF ACTION WHICH MAY BE ASSERTED.
Guest hereby agrees to of the terms and conditions as stated in this Agreement and acknowledge receipt by making payment on the property.
ACKNOWLEDGEMENT:
I/we, the undersigned, hereby apply for the above listed accommodation and warrant that I/we have read, understand and agree to the terms and conditions of this application, and I/we agree to abide by homeowners/agents/association restrictions on use of said property. I/we further understand and represent that I/we are executing this application on behalf of all parties named staying in the unit.
