SHORT-TERM GUEST RENTAL AGREEMENT
Getaway Properties AZ / Rim Lakes Vacation Rentals
This Short-Term Guest Rental Agreement ("Agreement") is made and entered into by and between GPAZ LLC, doing business as Getaway Properties AZ and Rim Lakes Vacation Rentals ("Company," "Host," "we," or "us"), and the guest identified in the reservation and signature record ("Guest" or "you"), as it relates to Guest's use of the accommodations identified in the reservation (the "Property" or "Accommodations"). Company and Guest may be referred to collectively as the "Parties."
- AGREEMENT, BOOKING PLATFORM & ACCEPTANCE
This Agreement is in addition to any terms Guest accepted on the website or platform through which Guest booked the Accommodations (the "Booking Site"). In the event of a conflict, the more protective term in favor of the Company shall govern except where the Booking Site's terms are mandatory. By booking, by clicking to accept where that option is offered, or by taking occupancy, Guest accepts and agrees to be bound by this Agreement. If Guest does not agree, Guest must not book or occupy the Accommodations.
- GUEST IDENTITY & SCREENING
Guest consents to and understands that, prior to or as a condition of occupancy, Company may verify Guest's identity (including government-issued photo ID and a selfie) and may perform a national criminal and sex-offender background screening through an accredited consumer reporting agency. If the result is, in Company's sole judgment, adverse, the reservation may be cancelled and any reservation deposit returned to Guest. Use of a name other than the Guest's true legal name for the reservation is grounds for immediate cancellation.
- PAYMENT
Except where the Booking Site requires otherwise, fifty percent (50%) of the total rental charges is due at the time of booking, and the remaining balance is charged fourteen (14) days prior to the arrival date. If no payment is received within twenty-four (24) hours after booking, or if Company is notified that Guest's payment has failed, Company may cancel the reservation.
- CREDIT CARD AUTHORIZATION
Guest authorizes Company to charge Guest's credit card on file for the rental charges, and for damages, extraordinary cleaning, unauthorized early check-in or late check-out, missing items, and any other amounts set forth in the Fee Schedule below or otherwise owed under this Agreement, as determined in Company's reasonable discretion. Guest agrees that (a) Company may charge the card without obtaining a separately signed credit-card slip; (b) an electronic copy of this Agreement serves as an original charge authorization; and (c) this authorization is irrevocable and remains in effect until ninety (90) days after the end of Guest's occupancy.
- CANCELLATIONS & REFUNDS
Cancellation terms are governed by the Booking Site except as specified in this Agreement. Travel insurance, damage-protection fees, and any processing or administrative fees are non-refundable. No refunds will be given for early departure, inoperable appliances or amenities (hot tub, pool, Wi-Fi, etc.), utility interruptions, weather, road or snow conditions, wildlife, construction at adjacent properties, or mandatory evacuations or other events arising from acts of God or nature. Company will make reasonable efforts to keep amenities in working order.
- OCCUPANCY & GUESTS OF GUEST
Occupancy is limited to the maximum number stated in the reservation. Guest must not exceed this number without Company's prior written approval. No fraternity, school, civic, or other non-family group gatherings are permitted without prior written approval. Guest is responsible for the conduct of every member of Guest's party and any visitor ("Group") and is responsible for sharing this Agreement and its requirements with the entire Group. Guest may not assign or sublet the Accommodations.
- PARTIES, EVENTS & NOISE
No parties, events, or gatherings exceeding the permitted occupancy are allowed. If Company is notified of a noise complaint, Guest will be notified by message, email, or telephone. Upon a second noise complaint, Company may remove the Guest and Group immediately, without a refund. If law enforcement is called to the Property for any reason relating to Guest's activities — disturbance, noise, occupancy, or otherwise — Guest must pay all costs associated with the event, including any resulting damage, and may be subject to eviction. Certain properties carry a separate written event policy (including event fees and deposits), which controls where applicable.
- NO SMOKING
No smoking or vaping of any product or substance is permitted anywhere in the Accommodations or near building entrances. A violation incurs the smoking charge in the Fee Schedule plus all costs to clean and restore the Property, including odor remediation.
- PETS & SERVICE ANIMALS
Pets are not permitted unless approved in advance and in writing by Company; an approved-pet fee may apply. Guest must disclose any assistance animal. Nothing in this Agreement is intended to deny a reasonable accommodation required by law for a service animal; however, Guest remains fully responsible for any and all damage, extraordinary cleaning, or injury caused by any animal, whether a pet or an assistance animal, and agrees that such costs may be charged to the card on file. Undisclosed animals are subject to the unauthorized-pet charge in the Fee Schedule and may be grounds for removal without refund.
- CONDITION, FURNISHINGS & DAMAGE REPORTING
The Accommodations are provided fully furnished, including linens, towels, and a standard equipped kitchen. Towels for hot tubs, spas, or pools are not provided for such use. Furnishings and layout may differ from photographs. Guest must report any pre-existing damage or cleaning issue to Company within three (3) hours of arrival; otherwise the Accommodations are deemed to have been in acceptable, undamaged condition at arrival, and any damage or cleaning issue not so reported is the responsibility of Guest and may be charged under the Fee Schedule. Guest must return the Property in the same condition as received, ordinary wear excepted.
- SECURITY HOLD / DAMAGE WAIVER
A refundable security hold or a non-refundable damage waiver is required, as specified in the reservation. If a security hold is elected and the Property is returned undamaged beyond normal wear and tear, the hold is released in full. In the event of damage, Company will provide an accounting and charge the card on file; if damages exceed the hold or waiver, Guest agrees to pay the balance within five (5) business days of notice. Company is not obligated to use the least expensive means of restoration.
- KEYS
All keys must be returned or left as instructed at check-out. Any key not returned is charged at the rate set in the Fee Schedule.
- USE OF THE PROPERTY
The Accommodations must not be used for any unlawful purpose, or for any commercial, industrial, wholesale, or retail activity. No nails, screws, adhesives, or fasteners may be inserted into or attached to the Accommodations or furnishings. Guest must comply with all Property rules, HOA or building rules, and applicable laws; the more restrictive rule governs.
- PERSONAL PROPERTY & ASSUMPTION OF RISK
Company is not responsible for, and does not insure, any vehicles, belongings, or personal property that Guest or the Group bring to the Accommodations; Guest is responsible for insuring Guest's own property. Guest assumes all risk arising out of access to and use of the Accommodations and is responsible for confirming the Accommodations suit Guest's needs.
- RECREATION, WATER ACTIVITIES & WILDLIFE
The Property and its area may offer lakes, docks, kayaks, canoes, hot tubs, spas, saunas, bicycles, sleds, fire features, and similar equipment or activities, and is located in an area with active wildlife (including bears and elk). Guest acknowledges these carry inherent risks of injury, illness, or death. Use of any such amenity or equipment is at Guest's sole risk. Guest assumes all such risks for Guest and the Group, and releases, holds harmless, and indemnifies Company and its owners, agents, employees, and contractors from any and all claims, losses, injury, or death arising from these activities, wildlife, or the natural elements, except to the extent caused by Company's gross negligence or intentional misconduct.
- INDEMNIFICATION & LIMITATION OF LIABILITY
To the maximum extent permitted by law, Guest agrees to indemnify, defend, and hold harmless Company and its owners, officers, employees, agents, and representatives from any damage or injury caused by Guest or the Group. Company is not liable for loss or damage due to interruption of utilities or essential services, fire, or similar events; provided that if such an interruption renders the Accommodations unusable through no fault of Guest, Company's sole liability is to refund amounts prepaid for the unusable period.
- RIGHT TO RELOCATE
Company reserves the right to move Guest to comparable accommodations should circumstances beyond Company's control arise. If Company is unable to provide the Accommodations or a comparable substitute, Company's sole liability is a refund of amounts prepaid for the affected nights.
- DISPUTE RESOLUTION & WAIVER OF JURY TRIAL
The Parties will attempt to resolve any dispute, claim, or controversy arising out of or relating to this Agreement (a "Dispute") through direct discussion. If the Parties choose to mediate, mediation will follow the commercial mediation rules of the American Arbitration Association. Any Dispute not resolved by discussion or mediation must be brought in a court of competent jurisdiction in the county and state where the Accommodations are located, for a bench trial. The Parties knowingly and voluntarily waive any right to a jury trial.
- GOVERNING LAW, ATTORNEYS' FEES & SEVERABILITY
This Agreement is governed by the laws of the state in which the Accommodations are located. In any Dispute arising out of or relating to this Agreement, whether or not litigation is commenced, the prevailing party is entitled to recover its reasonable attorneys' fees and costs. If any provision is held invalid or unenforceable, it is severable and the remainder of the Agreement remains in full force.
- ENTIRE AGREEMENT, NOTICES & ELECTRONIC SIGNATURE
This Agreement, together with the terms Guest accepted on the Booking Site, is the entire agreement between the Parties regarding the Accommodations and supersedes any prior or contemporaneous understanding. It may be amended only in a writing signed by both Parties, may be executed in counterparts, and electronic and reproduced signatures are deemed originals. All notices must be in writing and delivered to Company, Guest, or their respective representatives by email, commercial carrier, U.S. Mail, or personal delivery.
