Noise & Events: Strict no-tolerance policy for excessive noise, parties, or disturbing neighbors. No bachelor or bachelorette parties, events, gatherings, or parties unless pre-approved. Any verified noise complaint or violation of the 9 PM outdoor quiet hours may result in immediate eviction without refund.
Property Availability: If a booked unit becomes unavailable due to unforeseen circumstances (e.g., structural failure), we will offer a comparable unit if possible. If no alternative is approved, a full refund will be issued. No further claims will be entertained.
Unforeseen Occurrences: Management is not liable for disruptions beyond our control, including weather, natural disasters, construction, road closures, or service interruptions. No refunds will be issued for such circumstances.
Cleaning: The property is professionally cleaned before arrival. A mandatory cleaning fee applies. Excess cleaning or additional trash removal will result in extra charges.
Amenities: A starter supply of essentials (soap, paper towels, etc.) is provided. Guests must purchase additional supplies as needed.
Pets: No pets allowed unless pre-approved. Only non-shedding dogs under 25 lbs are considered, with a $300 non-refundable fee. Unauthorized pets result in a $1000 charge, extra cleaning fees, and possible eviction.
Service Animals: We accommodate service animals in compliance with ADA and California law. Requests must be made at booking, stating the service provided. Guests are responsible for any damages.
No Smoking: Smoking is strictly prohibited. Violations result in a $2500 fine plus damages. Eviction may occur for smoking on the premises.
Condition of Premises: Report any issues immediately upon check-in. Unreported damages may be charged to the guest.
Construction: Nearby construction noise is beyond our control. No refunds will be given.
Lost & Left Items: Guests are responsible for personal belongings. Unclaimed items after 7 days may be discarded. Shipping requests incur a $50 handling fee plus shipping costs.
Shipping: We are not responsible for lost, damaged, or delayed deliveries.
Occupancy Limits: Only registered guests may stay. Unauthorized guests incur a $500 per person per night fee and may result in eviction.
Illegal Substances: No illegal substances or underage alcohol consumption allowed. Violations result in eviction and forfeiture of rental fees.
TV/Internet Services: Provided as a convenience, not guaranteed. No refunds for service interruptions.
HVAC: If available, A/C must be set no lower than 72°F, and heat no higher than 80°F. No refunds for malfunctioning systems.
Pool/Spa: Guests use pools/spas at their own risk. Any sand in pools or spas results in a $250 cleaning fee.
Recreational Equipment & Amenities, Use at Your Own Risk- Certain properties may include or provide access to recreational equipment and amenities, which may include but are not limited to bicycles, boogie boards, surfboards, or similar items (“Recreational Equipment”). Recreational Equipment is provided solely as a convenience and is not represented or warranted as safe, inspected, maintained, or suitable for any particular use. To the fullest extent permitted by law, Owner and Management shall have no liability for any injury, loss, or damage arising out of or related to the use of Recreational Equipment. Guest is solely responsible for ensuring proper use, appropriate supervision of minors, and compliance with all applicable laws and safety guidelines.
Any loss, damage, injury, or claim arising from the use of Recreational Equipment shall be governed by and subject to the Insurance and Indemnification provisions of this Agreement.
System Failures: We strive to resolve issues quickly but cannot guarantee immediate repairs. No refunds for system failures.
Rules & Regulations: Guests must follow all HOA/community rules. Violations may result in eviction and forfeiture of payments.
Maintenance & Reporting: Guests must report damages promptly. Failure to report may result in charges.
Entry: Management may enter for maintenance, emergencies, or inspections with reasonable notice.
Parking: Guests must adhere to local parking rules. Tickets/towing are the guest's responsibility.
Checkout: Guests must return all keys, vacate on time, and leave the premises in good condition.
Disputes: Any disputes will first be mediated, then resolved via binding arbitration in San Diego, CA.
Governing Law: This agreement is governed by California law.
Liability & Insurance: Management is not responsible for guest belongings. Guests should obtain renters' insurance. Guests release Management from liability for injuries, damages, or losses.
Joint Responsibility: If multiple guests are on the booking, all are responsible for adhering to the agreement.
