*Short term (7-30 nights) and Long term rentals for this condo **This unit requires an application to be completed post booking to stay in the community. Please give the condo association at least 21 days prior to your stay for approval. Delays may occur. ***This unit also requires a background check for the primary guests.
TERMS & CONDITIONS
CLEANING FEE: We pay a living wage to our cleaning crews. A departure cleaning is required and is charged between $200-$375 dependent on the property. Just as we promise you a professionally cleaned unit, we must honor that same promise to guests that may be following you. There is a management fee assessed on all reservations and is included in the nightly rate. The fee is $25 per day to cover administrative and included utilities.
CANCELLATIONS AND REFUNDS: Airbnb Guests will follow Airbnb strict Cancellation Process. Strict: 50% refund up until 1 week prior to arrival, except fees • Cleaning fees are always refunded if the guest did not check in. • The Airbnb service fee is non-refundable. • Cancellation policies may be superseded by the Guest Refund Policy, extenuating circumstances, or cancellations by Airbnb for any other reason permitted under the Terms of Service. Please review these exceptions. • Applicable taxes will be retained and remitted by Airbnb. For a 50% refund of accommodation fees, cancellation must be made seven full days prior to listing’s local check in time (or 3:00 PM if not specified) on the day of check-in, otherwise no refund. For example, if check-in is on Friday, cancel by Friday of the previous week before check-in time.
RENTAL AGREEMENT TRANSACTION DIFFERENCES: The rental agreement you will receive from Roelens Vacations will vary from the amounts you are presented by Airbnb. Airbnb will collect the required 11.5% taxes and also a service fee. We do not see these amounts and therefore our rental agreement will only reflect the amounts we have netted from the transaction brokered by Airbnb.
HOME ACCESS: Guest can go directly to the unit. Guest will find the key in a lockbox or an electronic keypad at the front door (code to access unit will be provided with final payment confirmation). A Meet and Greet meeting with our Property Manager within the first 24 hours of arrival will be required.
OCCUPANCY: The Primary Guest is at least 25 years old or an active member of the military and will be an occupant of rented property and shall ensure compliance with the occupancy terms.
MAXIMUM OCCUPANCY: Your unit can be occupied by no more than the maximum number of persons indicated in this agreement and reservation letter. Occupancy is defined as an overnight stay. In the event occupancy is exceeded, Guest agrees to authorize the Owner to remove Guest(s) from the unit.
PROMOTIONAL INFORMATION: Every effort is made to assure that the information on the website and in Agent’s promotional materials is accurate. The agent cannot be held responsible for changes made by Owners such as decor or bedding, unintentional misrepresentations or printing errors. The information provided by Agent is believed to be accurate and timely, but no warranty as such is expressed or implied.
SECURITY DEPOSIT PRE-AUTHORIZED BY AIRBNB: *Guests booking through Flipkey or Airbnb will be refunded for security deposits held or pre-authorized via the marketplace in which they booked. ELECTRICITY CHARGE. Electricity is charged separately for this home at a rate of $15.00- $20.00 per day (dependent upon size of home) or $8 per day for Condo Units. This non-refundable daily fee is collected at the time of final payment and is considered prepaid utility use. This prepayment has been included in your quote and is part of the total reservation cost. An exception exists for Airbnb or TripAdvisor reservations which require a non-refundable prepaid amount ($25 per day Management Fee for Airbnb or $125 Flat Rate for TripAdvisor). Additional amounts or gross overage beyond the prepayments are collected via respective resolution centers when necessary. Actual usage or post-paid utility use may be offered at booking as an alternative method and will be billed at .185 kW for actual daily usage plus 11.5% tax. This post-payment if elected by the guest, will be charged to the credit card on file.
CHECK-IN & CHECK-OUT PROCEDURE: Upon arrival, Guest may directly go to the home and enter with the provided lock box code (provided with full payment). Inside the house, Guest will find a welcome letter or will receive a Pre Stay Information Letter via email. Check-in is 4:00 pm and check-out is 11:00 am EST. No unauthorized late check-outs or early check-ins will be allowed. A walk through with the property manager or representative can be arranged by contacting our office.
PROPERTY CONDITION/PROTOCOL: Upon arrival, Guest will need to inspect the property for cleanliness and damage. Guest shall promptly notify the Owner of any problems or damage. Guest agrees to leave the property in good condition, including no physical damage to the interior or exterior of the property, property, and yard to be neat and tidy, dishes washed, spills cleaned, and trash in trash bins. An additional cleaning charge may be incurred if extra cleaning is required.
STUDENT GROUPS ARE NOT PERMITTED. Students unaccompanied by a parent will not be permitted to register. Any reservations obtained under false pretense will be subject to forfeiture of all monies prepaid and the party will not be permitted to occupy any unit belonging to Owner.
BBQ GRILLS AND PROPANE GAS: Upon arrival, Guest shall inspect BBQ grill for cleanliness, and shall promptly contact the Owner if the BBQ grill is not clean upon Guest’s arrival. Please contact this office if tanks are empty upon arrival.
OWNER CONTENTS/CLOSETS: Guest agrees not to disturb any locked “Owners Closets/Content Storage areas within the home if one exists. Some homes may restrict the parking space used inside the garage if the garage is being utilized for Owner’s vehicle or if the Owner has designated the garage space for a game space.
UNIT FURNISHINGS: All homes and condominium units are individually owned and decorated and vary according to the Owner’s taste. Accommodations are complete with a fully equipped kitchen towels and linens. Beach towels are not provided. Toilet paper, soap, dish detergent, laundry soap, shampoos and other consumables are to be purchased by the Guest.
MAINTENANCE DURING YOUR STAY: In the event of equipment malfunction within the unit, Owner will expedite repairs as quickly as possible. From time to time, it may be necessary to close swimming pools and other amenities for maintenance purposes. Any maintenance items should be reported to Owner as soon as possible. No rent adjustments can be made for circumstances beyond Owner’s control or for malfunction or loss of use of equipment or amenities. The owner shall provide lawn mowing service.
TELEPHONE USAGE: Most properties are equipped with a telephone. There is no charge for incoming calls (not including collect calls) or outgoing local calls. Outgoing long-distance calls must be charged to a credit card or calling card, billed to Guest’s home telephone number, or collect. Guest is not permitted to make calls to or from the property if these telephone calls generate charges. A minimum-handling fee of $10.00 or actual charges will be imposed on the Guest for long distance/ and other chargeable calls made to or from the property home telephone, whichever is greater. If the phone line is open for long distance calls Owner will charge Guest any long-distance calls/chargeable calls to Guest’s credit card on file or against Guest’s security deposit if no credit card is on file. Emergency medical and police service can be called by dialing 911.
INTERNET SERVICE: Internet service is provided by the Owner. The agent is not an Internet Service Provider and, as such, does not warrant that the available wireless or wired internet service will perform at a particular speed, bandwidth, or data throughput rate, or will be uninterrupted, error-free, secure or free of viruses, worms, objectionable content or the like. Please note that refunds will NOT be given for internet service outages. Guest expressly assumes all responsibility for use of any internet service provided.
PEST CONTROL: Units are treated for pest control by contracted pest control companies. Owner will use its best efforts to address pest control concerns but is not responsible for rebates due to the presence of pests, or in the event of untimely service by pest control companies.
SMOKING: Smoking is not permitted inside the premises. The full security deposit will be claimed if smoking is discovered during or after your stay.
PETS: Pets are not permitted on the property unless authorized by the Property Manager. If unauthorized pets are found on premises Guest will be charged a non-refundable pet fee and is subject to possible eviction. Pets must be always under owner control. Cleaning and disposing of pet excrement is Guest’s responsibility.
PROPER CONDUCT. Guest shall behave in a civilized manner and shall respect the rights of the surrounding neighbors. The Guest shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. The Guest shall see to their own security while in the property by locking doors, windows, garage doors, etc. when it is prudent to do so. No firearms shall be allowed on the property. Guest agrees that fireworks and other hazardous materials shall not be used in or around the property. Pets must not disturb neighbors with barking.
ENTRY OF PREMISES: Any authorized employee or repairperson may enter the premises during customary business hours for any purpose related to the repair, improvement, care, and management of the premises.
UNITS FOR SALE: In the event that, the property is listed for sale, Owner may need to coordinate the showing of the property during Guest’s stay. Owner will make every attempt to schedule the showing at a convenient time to lessen any disturbance to Guest.
UNIT ASSIGNMENTS: Roelens Vacations reserved the right to change rental assignment for reason of a sale of the property or if the property becomes unavailable. Substitutions of comparable properties, within the Roelens Vacations portfolio, may be made without notice or liability should your reserved property become unavailable for rent. You may choose a comparable available property at the published rate or receive a refund of monies paid. Exclusion: including, but not limited to, mandatory evacuation or other storm-related occurrences.
PARKING RESTRICTIONS: Parking areas at individual sites are for automobiles only. Motorhomes, boat trailers, etc. are not permitted without permit from city.
POOLS. (when applicable). The owner is not responsible for pool and spa closures at community pools, and no credit and/or discount can be granted for circumstances beyond Owner’s control. For all single-family homes, the pool service technicians must have access to the pool area through the pool cage screen doors. Please leave these doors unlocked for the pool to be serviced weekly. It is the Guest’s responsibility to learn about safety precautions and procedures concerning swimming in or being around the pool and/or hot tub. Guest agrees to have a responsible adult supervising minors while they swim in the pool and/or hot tub. The pool and spa are dangerous and Guest accepts the risks involved and neither Owner nor his / her agents will be liable for injuries or death as a result of the use of the pool and spa unless caused by negligence by the owner or his / her agents. Do not run, dive, allow children in the pool area without supervision/ to swim alone, regardless of age. Be sure to use safety netting, pool alarms, keep doors closed & locked, and report any safety concerns immediately to Roelens. In the uncommon event temperatures fall below 55 degrees, pool heat may not heat to your satisfaction but there are no refunds.
POOL AND HOT TUB HEAT (when applicable). Pools will heat to approximately 10 degrees above the colder outside temperatures within 48 hours. Pool blankets at select homes can preserve heat when placed on the pool at night and must be removed from prior to use and cannot be stored outside the screened pool area or in the spa and must be neatly rolled or folded. In the uncommon event temperatures fall below 55 degrees, pool heat may not heat to your satisfaction but there are no refunds.
STAND-ALONE HOT TUB RULES and APPLICABLE FEES. (when applicable). If your home has a stand-alone hot tub it is important that you use good methods for keeping the water from becoming cloudy and contaminated. PLEASE RINSE off before entering the hot tub. Do not use any body oils, soaps or lotions before going in the hot tub. NEVER sit on the cover of the hot tub (if applicable) - the fee to replace a damaged cover is $500. DO NOT leave children unattended. Observe all precautions regarding use of medicines and alcoholic beverages while using the hot tub. Hot water can be unsafe for pregnant women. If there is damage to the amenity or extreme cleaning resulting in labor charges we will charge the credit card on file or submit a request through the Airbnb resolution center. Excessive cleaning and labor costs can result from contaminated water due to excessive oils or sun lotion which will require the draining of the hot tub to fully clean out the contaminates. All efforts are made to ensure hot tubs are in good working order at all times. It is possible from time to time the amenity made be closed for service or repair. No rebates of rental rates will be given for any hot tub that is out of service during your stay. In the uncommon event temperatures fall below 55 degrees, pool heat may not heat to your satisfaction but there are no refunds.
MISCELLANEOUS CHARGES: A charge of $25.00 per key and a charge of $75.00 per garage door opener will be withheld from Guest’s deposit, if not returned to Owner upon Guest’s departure.
RENTAL LAW: The Guest agrees that all persons on The Property have transient status as defined by and for the purposes of § 82.045 Fla. Stat. (2015). The sole remedy for failure to provide reserved accommodations is, at most, a prorated refund. The Guest waives any claim to a refund unless The Guest provides written proof that the grounds of the claim were reported promptly to Roelens following the earlier of discovery or the time at which a reasonable person would have discovered such grounds. Roelens warrants the quality of the accommodations only to the extent that its satisfy all legal requirements.
SUBLET: The condominium or house may not be sublet, and this Agreement may not be assigned without the Owner’s prior written consent.
IMMEDIATE RESPONSE NEEDED: Guest shall promptly notify Owner of any cleaning, maintenance or site problems.
LOCKOUT CHARGE: A charge of $40.00 will be accessed for key delivery in the event of a lockout.
LOST ITEMS: Owner is not responsible for any items left in or around the property. If items are found by inspectors and/or cleaners, returns will be held at Owner’s office for 14 days or returned at cost plus a handling fee, not to exceed $40.00.
INDEMNITY. Guest and Guest’s guests shall hereby indemnify and hold harmless the Owner and its agents against any and all claims of personal injury or property damage or loss arising from the use of the premises. Guest expressly recognizes that any insurance for property damage or loss which the Owner may maintain on the property does not cover Guest’s personal property.
SEVERABILITY. The invalidity or unenforceability of any provision hereof shall in no way affect the validity or enforceability of any other provision.
GOVERNING LAW AND FORUM. This Agreement shall be construed and governed in accordance with the laws of the State of Florida. The parties consent to personal jurisdiction in the State of Florida, and any action or proceeding seeking to enforce any provision of, or based upon any right arising out of, this Agreement will be brought against either of the parties in the courts of Lee County, Florida
